<section section-type="section-one" id="H63007C39932745ED88B0768A2DC91D24"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice is Beneficial Limitation on Investments and Necessary Disclosure Act of 2026</short-title></quote> or as the <quote><short-title>Justice is BLIND Act of 2026</short-title></quote>.</text></section> <section id="H0E8B0F50DC9643B8B2D228C8F7FA4849"><enum>2.</enum><header>Placement of certain assets of justices, judges, magistrate judges, or bankruptcy judges and their spouses and dependent children in blind trust</header><text display-inline="no-display-inline">Section 455 of title 28, United States Code, is amended—</text> 
<paragraph id="H9331248AC7B04A7C856EF6B26472DABB"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H6CEB65D07CED40F9A6D794ECCD914EB4"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>A</quote> and inserting <quote>(1) A</quote>; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2D95C02E41B541F38929A63C7B6858E7"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H90C98C3B1AA347D587639A7B56C895CA"> <paragraph commented="no" display-inline="no-display-inline" id="H5084EB63B41B41C9B7DC7DB0CE242CC4" indent="up1"><enum>(2)</enum><text>The reasonable effort described in paragraph (1) does not include seeking information about the identity of the financial instruments contained in any qualified blind trust other than the initial assets of the qualified blind trust established by a justice, judge, magistrate judge or bankruptcy judge, or the spouse or dependent child of such justice, judge, magistrate judge, or bankruptcy judge, to comply with subsection (g).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H566FBE5E903645C187941CC72B22E7D9"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H839A7B6FBD02478D9C64CEF21B7D6E38"> <subsection id="H85C61B01A3C3450FBC0D2A48A2B126CC"><enum>(g)</enum><header>Placement of certain assets of justices, judges, magistrate judges, or bankruptcy judges and their spouses and dependent children in qualified blind trust</header> <paragraph id="HA44CF057414B43F39C36C318B9234A8F"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="HB8BBF37F99954721BFD85C4BE0AA229A"><enum>(A)</enum><header>Commodity</header><text display-inline="yes-display-inline">The term <term>commodity</term> has the meaning given the term in section 1a of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a</external-xref>).</text></subparagraph> <subparagraph id="H65BC807B77674713B2B4E5B0A8438638"><enum>(B)</enum><header>Covered financial interest</header><text>The term <term>covered financial interest</term>— </text> 
<clause id="HA263821C26884A99AAE7C4B8103C9B7E"><enum>(i)</enum><text>means a financial interest in a security, a commodity, or a future, or any comparable economic interest acquired through synthetic means such as the use of a derivative; and</text></clause> <clause id="H45BA0E90420A401A86BA1829932F7F00"><enum>(ii)</enum><text>does not include—</text> 
<subclause id="H84F87C34D7B14CC8B078A30844193E16"><enum>(I)</enum><text display-inline="yes-display-inline">a widely held investment fund described in section 13104(f)(8) of title 5 that is diversified and registered as a management company under the Investment Company Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80a-1">15 U.S.C. 80a–1 et seq.</external-xref>);</text></subclause> <subclause id="H5BE954D0FAC247F89B4D489FA7F761D4"><enum>(II)</enum><text>a United States Treasury bill, note, or bond;</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="HE8AB4AC1B6ED4487B5E0D2D90C926F5B"><enum>(III)</enum><text>any compensation received by the spouse or dependent child of a covered official from their employer.</text></subclause></clause></subparagraph> <subparagraph id="H2937B2D2393E4250AB6C2D7399031E91"><enum>(C)</enum><header>Dependent child</header><text display-inline="yes-display-inline">The term <term>dependent child</term> has the meaning given the term in section 13101 of title 5.</text></subparagraph> 
<subparagraph id="HCD11FCA0EC034186A1A7F90396F00870"><enum>(D)</enum><header>Qualified blind trust</header><text display-inline="yes-display-inline">The term <term>qualified blind trust</term> has the meaning given the term in section 13104(f)(3) of title 5.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H47D2E45307A7461C8A94BAA47F3CD922"><enum>(2)</enum><header display-inline="yes-display-inline">Placement</header> <subparagraph id="H77992C05012D48D8A249932A298E0EF9"><enum>(A)</enum><header>Justice, judge, magistrate judge, or bankruptcy judge occupying office on date of enactment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this subsection, a justice, judge, magistrate judge, or bankruptcy judge and any spouse or dependent child of such justice, judge, magistrate judge, or bankruptcy judge shall place any covered financial interest of such justice, judge, magistrate judge, or bankruptcy judge or any spouse or dependent child of such justice, judge, magistrate judge, or bankruptcy judge, into a qualified blind trust.</text></subparagraph> 
<subparagraph id="H91EB2994280F4965AA92718392156161"><enum>(B)</enum><header>Justice, judge, magistrate judge, or bankruptcy judge assuming office after date of enactment</header><text display-inline="yes-display-inline">Not later than 90 days after the date an individual is sworn in as a justice, judge, magistrate judge, or bankruptcy judge, such individual and any spouse or dependent child of such individual shall place any covered financial interest of such individual, spouse, or dependent child into a qualified blind trust.</text></subparagraph> <subparagraph id="H9AC4AB42DC854EECA529F7A2C6D33D50"><enum>(C)</enum><header>Mingling of assets</header><text display-inline="yes-display-inline">A spouse or dependent child of a justice, judge, magistrate judge, or bankruptcy judge may place a covered financial interest in a qualified blind trust established by such justice, judge, magistrate judge, or bankruptcy judge under subparagraph (A) or (B). A justice, judge, magistrate judge, or bankruptcy judge may place a covered financial interest in a qualified blind trust established by the spouse of such justice, judge, magistrate judge, or bankruptcy judge under subparagraph (A) or (B).</text></subparagraph> 
<subparagraph id="HEF7BD76A88FD4189AFC8173B4F616B5C"><enum>(D)</enum><header>Assets upon separation</header><text display-inline="yes-display-inline">A justice, judge, magistrate judge, or bankruptcy judge and any spouse or dependent child of such justice, judge, magistrate judge, or bankruptcy judge may not dissolve any qualified blind trust in which a covered financial interest has been placed pursuant to subparagraph (A) or (B), or otherwise control such a financial interest, until the date that is 180 days after the date such justice, judge, magistrate judge, or bankruptcy judge ceases to be a justice, judge, magistrate judge, or bankruptcy judge.</text></subparagraph></paragraph> <paragraph id="HAF7C09DD062547FFA3A51E0A545748C2"><enum>(3)</enum><header>Accountability</header> <subparagraph id="H99CCEA2B443C435BBB30A7615E9A72AF"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A justice, judge, magistrate judge, or bankruptcy judge shall—</text> 
<clause id="H2CCA41475A8446E3B4F2C55AB4D2C515"><enum>(i)</enum><text display-inline="yes-display-inline">not later than 15 days after the date a qualified blind trust is established under paragraph (2), attest in writing that such trust has been established and that any covered financial interest of such justice, judge, magistrate judge, or bankruptcy judge or a spouse or dependent child of such justice, judge, magistrate judge, or bankruptcy judge has been placed in such trust; or</text></clause> <clause id="HECD21FF6587C4F06AFE826722C45FC72"><enum>(ii)</enum><text display-inline="yes-display-inline">attest in writing that such justice, judge, magistrate judge, or bankruptcy judge and a spouse or dependent child of such justice, judge, magistrate judge, or bankruptcy judge does not have any covered financial interest.</text></clause></subparagraph> 
<subparagraph id="HC40D49E823EC4D25A8240E850C47B2AC"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">The Administrative Office of the United States Courts shall make available on the searchable internet database established under <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /105">section 105(c)</external-xref> of the Ethics in Government Act of 1978 any attestation made under subparagraph (A).</text></subparagraph></paragraph> <paragraph id="H8EC5BC93FCEB4CAC98A576EFA69B5821"><enum>(4)</enum><header>Severability</header><text display-inline="yes-display-inline">If any provision of this subsection or the application of such provision to any person or circumstance is held to be unconstitutional, the remainder of this subsection and the application of the remaining provisions of this subsection to any person or circumstance, shall not be affected.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
