<section id="H40F12A72BFDB44129CE41A0119C56D0C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="H3E6061A6A8A446EC902070AC3CC5981A"><enum>(1)</enum><text>The United States has a compelling national interest in protecting the health, safety, economic security, and environmental well-being of the people of the United States from significant air pollution originating outside the United States.</text></paragraph> 
<paragraph id="HB49280A6650944CAA185D06710365552"><enum>(2)</enum><text>Wildfire smoke may contain fine particulate matter and other pollutants capable of traveling substantial distances and degrading air quality beyond the jurisdiction in which a wildfire originates.</text></paragraph> <paragraph id="HF6CFE9E2C8274FFC9D75CF27E177A831"><enum>(3)</enum><text>During 2026, wildfire smoke originating in the sovereign territory of Canada repeatedly crossed the international border of the United States.</text></paragraph> 
<paragraph id="HD6BB0292DE184409ADF8307641BA6A2F"><enum>(4)</enum><text>Such smoke—</text> <subparagraph id="H419326D428024CE3AAC44D1F5BAF9EE0"><enum>(A)</enum><text>caused or materially contributed to unhealthy air-quality conditions in communities in the United States;</text></subparagraph> 
<subparagraph id="H4C4A1E38E5914DDF87F23E94F46E5982"><enum>(B)</enum><text>impaired visibility;</text></subparagraph> <subparagraph id="H92669D01EE6D4A6D80EAFE29B7376261"><enum>(C)</enum><text>disrupted outdoor work, transportation, recreation, education, tourism, and commercial activity;</text></subparagraph> 
<subparagraph id="HC0532BD056364DDC8BE835A437C4A280"><enum>(D)</enum><text>increased public-health risks, particularly for children, older adults, pregnant individuals, outdoor workers, and individuals with respiratory or cardiovascular conditions; and</text></subparagraph> <subparagraph id="HADAF363989CA43A887A23ED1F81DC67C"><enum>(E)</enum><text>imposed costs on individuals, businesses, State and local governments, Tribal governments, and the Federal Government.</text></subparagraph></paragraph> 
<paragraph id="HAA85EEA5AA8A42518DA69D5FF0A5539F"><enum>(5)</enum><text>The Government of Canada possesses the authority and capacity to take reasonable measures to mitigate wildfire risks, improve forest and land management, suppress dangerous fires when practicable, provide timely information to neighboring jurisdictions, and cooperate with the United States regarding transboundary air pollution.</text></paragraph> <paragraph id="HC2C52DA2A2D34E348D2EFBF2398B2BB1"><enum>(6)</enum><text>The Government of Canada has failed to take sufficient and timely measures to prevent, mitigate, or respond to repeated transboundary wildfire-smoke events affecting the United States.</text></paragraph> 
<paragraph id="H3D80A6A73D2E4EE6BAC389B38382E979"><enum>(7)</enum><text>The diplomatic representations of the United States regarding such smoke have not resulted in adequate remedial action by the Government of Canada.</text></paragraph> <paragraph id="HBFE0E729523545448903D62D5A803278"><enum>(8)</enum><text>The repeated and foreseeable transmission of significant wildfire smoke from Canada into the United States constitutes a serious foreign-policy concern and warrants the imposition of targeted economic and diplomatic consequences.</text></paragraph></section> 
<section id="H917F52EE062949FC8ECF490CFA945AB9"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text> <paragraph id="HD2A10026FA684B7FAC08B7106EDB4F42"><enum>(1)</enum><text>to protect the people of the United States against significant transboundary air pollution;</text></paragraph> 
<paragraph id="H698873C7BAFF49CAA573618F8313D2A4"><enum>(2)</enum><text>to hold foreign government officials and entities accountable when their knowing or reckless failure to address preventable environmental conditions causes substantial harm in the United States;</text></paragraph> <paragraph id="H87BB2714735F46F29498BF1748D0FC48"><enum>(3)</enum><text>to encourage the Government of Canada to—</text> 
<subparagraph id="H762E0C192B0F40E2A7540CCFB84A929C"><enum>(A)</enum><text>adopt and enforce effective wildfire-prevention and forest-management policies;</text></subparagraph> <subparagraph id="H7701DE8FC2D34516B34CE3D19C7131C3"><enum>(B)</enum><text>devote adequate resources to wildfire detection, containment, suppression, and mitigation;</text></subparagraph> 
<subparagraph id="H63C42407CAF446B28E62087708C0C594"><enum>(C)</enum><text>share timely and accurate air-quality and wildfire information with the United States;</text></subparagraph> <subparagraph id="HFD5F0CD6F4AA4D56AD24C75F83FFADED"><enum>(D)</enum><text>cooperate with Federal, State, local, and Tribal authorities in the United States; and</text></subparagraph> 
<subparagraph id="H05CFC71B3CF24FDB9CB2DF0B2E390CA8"><enum>(E)</enum><text>prevent recurring material incursions of wildfire smoke into United States territory;</text></subparagraph></paragraph> <paragraph id="H11F17924451C4EE8A19CA5DC21B3AB33"><enum>(4)</enum><text>to employ targeted sanctions in a manner that minimizes unintended harm to ordinary residents of Canada; and</text></paragraph> 
<paragraph id="HCE9ECD61CB64414D9684ABBBCE810408"><enum>(5)</enum><text>to terminate sanctions imposed under this Act when the Government of Canada has taken verifiable and durable corrective action.</text></paragraph></section> <section id="H19AE8E505F9C4D04A87ABCC508540655"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HC49CBACBD9214CBF82C72D971A2CF30F"><enum>(1)</enum><header>Admitted; alien</header><text>The terms <term>admitted</term> and <term>alien</term> have the meanings given those terms in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>).</text></paragraph> <paragraph id="H1E2F3D8616AC4A6E97CBDB74B3B96F18"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> 
<subparagraph id="H1363A2F848F74E5BAEA4FCC7A32285AE"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, the Committee on Finance, and the Committee on the Judiciary of the Senate; and</text></subparagraph> <subparagraph id="H6BF811366A2D4CCDB4C9005313B66B3F"><enum>(B)</enum><text>the Committee on Financial Services, the Committee on Foreign Affairs, the Committee on Ways and Means, and the Committee on the Judiciary of the House of Representatives.</text></subparagraph></paragraph> 
<paragraph id="HE3DD45053C3445D1973FC5B3E73C1EAA"><enum>(3)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means an individual or entity that is not a United States person.</text></paragraph> <paragraph id="H0E074FBCE49545D8BF905CC4E6954350"><enum>(4)</enum><header>Government of canada</header><text>The term <term>Government of Canada</term> means—</text> 
<subparagraph id="H1F6A5EFCBA8D4263AAED7DB25A4E5985"><enum>(A)</enum><text>the Government of Canada and any political subdivision, agency, instrumentality, ministry, department, regulatory body, or other governmental authority thereof;</text></subparagraph> <subparagraph id="HB1C459D78793482EB268EE544C17A1DB"> <enum>(B)</enum> <text>any person owned or controlled by, or acting for or on behalf of, the Government of Canada; and</text>
        </subparagraph> 
<subparagraph id="H92CA9F5A773B4E21A1AA71633C307C86"><enum>(C)</enum><text>any successor to an entity described in subparagraph (A) or (B).</text></subparagraph></paragraph> <paragraph id="HE2F6E4CA9BF8433EB54556B6C0CF25AC"><enum>(5)</enum><header>Knowingly</header><text>The term <term>knowingly</term>, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, circumstance, or result.</text></paragraph> 
<paragraph id="H74716FD70C4F4F39A7DA970D3360F82E"><enum>(6)</enum><header>Material transboundary smoke event</header><text>The term <term>material transboundary smoke event</term> means the transportation by prevailing winds or other atmospheric conditions of wildfire smoke originating substantially within the territory of Canada into the United States in a concentration, duration, or geographic scope that—</text> <subparagraph id="H7E69B9BA1B62442C97DCA8BC6FC96F5D"><enum>(A)</enum><text>causes or materially contributes to an exceedance of an applicable national ambient air-quality standard established under section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>);</text></subparagraph> 
<subparagraph id="HAC789775DFA548448666A9EF89E58122"><enum>(B)</enum><text>results in an Air Quality Index category of <quote>Unhealthy for Sensitive Groups</quote> or worse, as determined by the Administrator of the Environmental Protection Agency, in any area of the United States;</text></subparagraph> <subparagraph id="H16ED7451E2C74510AA9F2B6627207D84"><enum>(C)</enum><text>causes the issuance of a public-health advisory by a Federal, State, local, or Tribal authority; or</text></subparagraph> 
<subparagraph id="H37BF80A33A5743E7853A8579F8732993"><enum>(D)</enum><text>otherwise causes significant adverse effects on public health, safety, transportation, commerce, agriculture, recreation, or the environment in the United States.</text></subparagraph></paragraph> <paragraph id="H54090037497C4AF084757E8C6ACF1367"><enum>(7)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph> 
<paragraph id="H8EC059B23A8C49248A0BD5526491E95A"><enum>(8)</enum><header>Responsible foreign person</header><text>The term <term>responsible foreign person</term> means a foreign person determined under section 6(a) to be responsible for, complicit in, or to have materially assisted conduct relating to material transboundary smoke events.</text></paragraph> <paragraph id="H519D3208C1C141AEBDFCDD95BEAA4337"><enum>(9)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text> 
<subparagraph id="H2366978BDC404A209CA957B26148E1C6"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></subparagraph> <subparagraph id="H6EC4BB3B197B489F8DEAF7290E482C23"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph> 
<paragraph id="HDF1A769E98E64FE698B16525AC567033"><enum>(10)</enum><header>Wildfire smoke</header><text>The term <term>wildfire smoke</term> means airborne particulate matter, gases, or other pollutants emitted by a wildfire, prescribed fire, peat fire, forest fire, grassland fire, or other uncontrolled or inadequately controlled vegetation fire.</text></paragraph></section> <section id="H1C3FDE16D49A47C6B25FCDC092E86C6E"><enum>5.</enum><header>Determination regarding transboundary smoke emergency</header> <subsection id="H49D2F3D48F5942549B0C928AF2E7EA7C"><enum>(a)</enum><header>Initial determination</header><text>Not later than 30 days after the date of enactment of this Act, the President, acting through the Administrator of the Environmental Protection Agency and in consultation with the Secretary of State, the Secretary of Agriculture, the Secretary of the Interior, the Secretary of Commerce, and the heads of other relevant Federal agencies, shall determine whether—</text> 
<paragraph id="HE918775B7EA04535B6DB663133D5DEF7"><enum>(1)</enum><text>one or more material transboundary smoke events originating substantially in Canada occurred during the 12-month period preceding such determination; and</text></paragraph> <paragraph id="HCD36035EE7274FF2AAF5DF48ABF5E279"><enum>(2)</enum><text>the Government of Canada failed to take reasonable and effective measures to prevent, mitigate, contain, or otherwise respond to the conditions causing such event or events.</text></paragraph></subsection> 
<subsection id="H99ABE37A6E5A4A859C18A1AACF51F44A"><enum>(b)</enum><header>Affirmative determination</header><text>If the President makes affirmative determinations under paragraphs (1) and (2) of subsection (a), the President shall—</text> <paragraph id="HDFA3BD53B1AD419982C12DDB781EE2B4"><enum>(1)</enum><text>publish notice of such determinations in the Federal Register; and</text></paragraph> 
<paragraph id="H7EF164F3405F45C4B16F9FC4F172CC30"><enum>(2)</enum><text>impose the sanctions required below.</text></paragraph></subsection> <subsection id="HCD93DD851A104A648666F838882E8B1E"> <enum>(c)</enum> <header>Failure To make determination</header> <text>If the President does not make the determination required under subsection (a) by the date specified in that subsection, the determinations described in paragraphs (1) and (2) of that subsection shall be deemed to have been made in the affirmative on the day after such date.</text>
      </subsection> 
<subsection id="H2963E0BFB13D4B68A305B6F9EE888979"><enum>(d)</enum><header>Periodic review</header><text>Not less frequently than once every 180 days after an affirmative determination under subsection (a), the President shall review whether the conditions supporting such determination continue to exist.</text></subsection></section> <section id="H89B025923502481C81AAFB9E48389C66"><enum>6.</enum><header>Sanctions with respect to responsible foreign persons</header> <subsection id="H80BA38E5C39B4558AC75937449C47A34"><enum>(a)</enum><header>Identification</header><text>Not later than 60 days after an affirmative determination under section 5(a), and periodically thereafter, the President shall submit to the appropriate congressional committees a list of each foreign person the President determines—</text> 
<paragraph id="H0DBD079D120E4039B78976D0F1D75BB2"><enum>(1)</enum><text>serves as the Prime Minister, as any current or former member of the Cabinet of the Government of Canada, as any deputy minister or head of a department or agency, or as any successor or substantially equivalent official;</text></paragraph> <paragraph id="HE5D331A34F344C21914BBFA851D1B54C"><enum>(2)</enum><text>is or was a senior official of the Government of Canada responsible for—</text> 
<subparagraph id="H65B123AB5AA344F5AFB3AE2B5A230132"><enum>(A)</enum><text>forestry;</text></subparagraph> <subparagraph id="HE1FB654614824944B5C71D4AEC46A4B3"><enum>(B)</enum><text>land management;</text></subparagraph> 
<subparagraph id="HDD0E7CD4644C4188A40AFE31F16C559E"><enum>(C)</enum><text>wildfire prevention or suppression;</text></subparagraph> <subparagraph id="H57E7ED761EE641AAA04EDA53E8BE1B84"><enum>(D)</enum><text>emergency management;</text></subparagraph> 
<subparagraph id="HE80F14EB7FE9416C821356CBB0D04E97"><enum>(E)</enum><text>environmental protection;</text></subparagraph> <subparagraph id="HF5E8B291D82D4C808D632BB0E47BEFB3"><enum>(F)</enum><text>air quality monitoring;</text></subparagraph> 
<subparagraph id="H48FEBCA9084B47A5886B41F5C77AD334"><enum>(G)</enum><text>natural-resource management; or</text></subparagraph> <subparagraph id="HBDEBA197F45D4B6D88ED071F94DA749D"><enum>(H)</enum><text>cooperation with the United States regarding any matter described in subparagraphs (A) through (G).</text></subparagraph></paragraph> 
<paragraph id="H997325F74B40464C8A11B00D36074B3A"><enum>(3)</enum><text>knowingly ordered, directed, authorized, facilitated, or implemented a policy or practice that materially increased the likelihood, severity, or duration of a material transboundary smoke event;</text></paragraph> <paragraph id="HEB8A541BA8F14EFD957B3D535B95B824"><enum>(4)</enum><text>knowingly obstructed or prevented reasonable action to mitigate or suppress a wildfire that caused or materially contributed to a material transboundary smoke event;</text></paragraph> 
<paragraph id="HBD17B2DC28C34CC7B9C84FDDD554828D"><enum>(5)</enum><text>knowingly concealed, falsified, or materially misrepresented information regarding—</text> <subparagraph id="HDA4890207A2F46C68D888B53DA6042B9"><enum>(A)</enum><text>the origin, location, severity, or expected duration of a wildfire;</text></subparagraph> 
<subparagraph id="H13AC08EAE10E4D68ACD6E37547C60F51"><enum>(B)</enum><text>wildfire-smoke emissions;</text></subparagraph> <subparagraph id="H6D473A874C024DF99FC74E8FC41F4759"><enum>(C)</enum><text>air-quality conditions; or</text></subparagraph> 
<subparagraph id="H8BE2827386FE474F9377A8D872A0DA0A"><enum>(D)</enum><text>the expected movement of wildfire smoke toward the United States;</text></subparagraph></paragraph> <paragraph id="H05B25C473FEB4DD1908D463628B73B71"><enum>(6)</enum><text>knowingly failed to provide information or assistance requested by the United States when such failure materially impaired the ability of the United States to prepare for or respond to a material transboundary smoke event;</text></paragraph> 
<paragraph id="H2DBE9C7742C844938AD772FE1686AE81"><enum>(7)</enum><text>materially assisted, sponsored, or provided financial, material, or technological support for an activity described in paragraphs (1) through (6);</text></paragraph> <paragraph id="H20FEB7853F79488CA2F03B43EC46FF05"><enum>(8)</enum><text>is owned or controlled by, or has acted or purported to act for or on behalf of, directly or indirectly, a person described in paragraphs (1) through (6); or</text></paragraph> 
<paragraph id="HC57AE94718984C299CF37364C1D7BAA6"><enum>(9)</enum><text>is an immediate family member of a person described in paragraphs (1) through (8), if the President determines that the family member knowingly received or controlled property or economic benefits derived from conduct described in such paragraphs.</text></paragraph></subsection> <subsection id="H63702E00DA3C473C9C628DB26840BCA8"> <enum>(b)</enum> <header>Blocking of property</header> <text>The President shall exercise all authorities granted under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/170">50 U.S.C. 170 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of a responsible foreign person identified under subsection (a) if such property and interests in property—</text>
        <paragraph id="HF9127F0B3EE347E7A2C2D915D75753DE">
          <enum>(1)</enum>
 <text>are in the United States;</text> </paragraph> <paragraph id="H5C7680A490A74A24824ACFF32F17F0E8"> <enum>(2)</enum> <text>come within the United States; or</text>
        </paragraph>
        <paragraph id="H1CDB5521E50F46FAA936013A839D6653">
          <enum>(3)</enum>
 <text>are or come within the possession or control of a United States person.</text> </paragraph> </subsection> <subsection id="HBB403CE3A6F947D2BD17A03E2BC634F3"><enum>(c)</enum><header>Prohibition on transactions</header><text>Except as provided in section 10, a United States person may not knowingly engage in a transaction with a responsible foreign person whose property and interests in property are blocked under subsection (b).</text></subsection> 
<subsection id="HFC4B16C8627C4F59BC4708CE35F4532A"><enum>(d)</enum><header>Updates</header><text>The President shall update the list required under subsection (a) not less frequently than once every 180 days for so long as an affirmative determination under section 5(a) remains in effect.</text></subsection> <subsection id="H9AC87AA6B9534ECB8AA9B7E42CB1D65F"><enum>(e)</enum><header>Form of list</header><text>The list required under subsection (a) shall be submitted in unclassified form and made available to the public, except that the President may include classified information in a classified annex.</text></subsection></section> 
<section id="H4E4A64A6B6304F37BE28BB9BC03E9EC3"><enum>7.</enum><header>Sanctions with respect to the Government of Canada</header> 
<subsection id="H148461D8FDBA4A67AC1AF00FAAFD3669"><enum>(a)</enum><header>Mandatory sanctions</header><text>Upon an affirmative determination under section 5(a), the President shall impose the sanctions described in paragraphs (1), (2), and (3), and not fewer than 3 of the sanctions described in paragraphs (4) through (9):</text> <paragraph id="HDC5EDCAC069C40DB8A0C3441C98589CF"><enum>(1)</enum><header>United states government procurement</header><text>The head of an executive agency may not enter into or renew a contract for the procurement of goods or services with the Government of Canada or an entity owned or controlled by the Government of Canada.</text></paragraph> 
<paragraph id="H5A33441F8E834FCDACA638C2F7BFD7D7"><enum>(2)</enum><header>Export-import bank assistance</header><text>The Export-Import Bank of the United States may not give approval to the issuance of any guarantee, insurance, extension of credit, or participation in the extension of credit in connection with the export of any goods or services to the Government of Canada or an entity owned or controlled by the Government of Canada.</text></paragraph> <paragraph id="H9589B49AD9004F3CB818598C49ECF874"><enum>(3)</enum><header>International financial institutions</header><text>The Secretary of the Treasury shall instruct the United States executive director at each international financial institution, as defined in section 1701(c)(2) of the International Financial Institutions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/262r">22 U.S.C. 262r(c)(2)</external-xref>), to use the voice and vote of the United States to oppose any loan, grant, strategy, or policy that would benefit the Government of Canada, except assistance intended to meet basic human needs or directly support wildfire prevention, suppression, mitigation, environmental remediation, or public health.</text></paragraph> 
<paragraph id="HB7B9057281E3480DB7FCF5BA3A5A6CCD"><enum>(4)</enum><header>Prohibition on banking transactions</header><text>The President may prohibit any United States financial institution from making loans or providing credits to the Government of Canada, except loans or credits for the provision of humanitarian goods, agricultural commodities, food, medicine, medical devices, or wildfire-management assistance.</text></paragraph> <paragraph id="H710E2FD7D9154745A2A2E908AC5ED83A"><enum>(5)</enum><header>Restrictions on sovereign debt</header><text>The President may prohibit United States persons from purchasing, subscribing to, or otherwise dealing in new debt issued by the Government of Canada or an entity owned or controlled by that government.</text></paragraph> 
<paragraph id="H582A38275CD04CD2B3DB5AC61A7D8F8B"><enum>(6)</enum><header>Restrictions on government equity</header><text>The President may prohibit United States persons from purchasing or dealing in new equity issued by an entity owned or controlled by the Government of Canada.</text></paragraph> <paragraph id="H3AB06788ABBA41F692B4A03EACA6FB2F"><enum>(7)</enum><header>Import restrictions</header><text>The President may prohibit the importation into the United States of goods produced, manufactured, grown, or extracted by an entity owned or controlled by the Government of Canada.</text></paragraph> 
<paragraph id="H84A2FB838DB44DE881457E3C19832DAD"><enum>(8)</enum><header>Restrictions on new investment</header><text>The President may prohibit new investment by a United States person in an entity owned or controlled by the Government of Canada.</text></paragraph> <paragraph id="H954A86825FF54BD1802FF30B4838856D"><enum>(9)</enum><header>Restrictions on state-owned enterprises</header><text>The President may block and prohibit transactions in property and interests in property of any State-owned enterprise of Canada that materially finances or supports a ministry, agency, official, policy, or activity described in section 6(a).</text></paragraph></subsection> 
<subsection id="HBC4F07BD2C3D4C86B91BFBEA29D43842"><enum>(b)</enum><header>Application</header><text>A sanction imposed under subsection (a) shall apply notwithstanding any contract, license, or permit entered into or issued before the date on which the sanction is imposed, except to the extent the President provides a wind-down period not exceeding 60 days.</text></subsection> <subsection id="HC140E1B7EE544582A3523EFE325BA4B0"><enum>(c)</enum><header>Regulatory authority</header><text>The President may prescribe such regulations, licenses, orders, directives, and guidance as are necessary to carry out this section.</text></subsection> 
<subsection id="H4B1D18461A164D089653171550AFF034"><enum>(d)</enum><header>Rule regarding private persons</header><text>Nothing in this section shall be construed to require the imposition of sanctions on a privately owned person in Canada solely because that person is organized or located in Canada.</text></subsection></section> <section id="H969F073D4FDF4F1FA5294319FFBE72B0"><enum>8.</enum><header>Visa restrictions</header> <subsection id="H9649B9F568444B7CA5660D97E802DB8C"><enum>(a)</enum><header>Ineligibility</header><text>A foreign person identified under section 6(a) is—</text> 
<paragraph id="H87EF91C7F7504F0D91AF827260FB6C05"><enum>(1)</enum><text>inadmissible to the United States;</text></paragraph> <paragraph id="H33CF73774F2A4294AE9B9D16A1E6100F"><enum>(2)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></paragraph> 
<paragraph id="H167B89DE004E435285013EA8FE290A57"><enum>(3)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></paragraph></subsection> <subsection id="HB2A4F2E3DD714BDEAC606095BE3A1176"><enum>(b)</enum><header>Current visas revoked</header><text>The Secretary of State shall revoke, in accordance with section 221(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(i)</external-xref>), any visa or other entry documentation issued to a foreign person described in subsection (a).</text></subsection> 
<subsection id="HDAE5FA171FCA4373B3371F903085ACD6"><enum>(c)</enum><header>Effect of revocation</header><text>A revocation under subsection (b) shall—</text> <paragraph id="HAAE3C8FE1C6F4F00B8041F93B85483EF"><enum>(1)</enum><text>take effect immediately; and</text></paragraph> 
<paragraph id="HCD6089EF8AF543DD970E91EF5F944299"><enum>(2)</enum><text>automatically cancel any other valid visa or entry documentation that is in the possession of the foreign person.</text></paragraph></subsection> <subsection id="H74BC131A8CB54E89B00BE5A5A1CC17CA"> <enum>(d)</enum> <header>Exception To comply with international obligations</header> <text>The Secretary of State may waive the application of this section with respect to a foreign person if the Secretary determines that such a waiver is necessary to permit the United States to comply with—</text>
        <paragraph id="H863E3D0770664106A6912A322A128705">
          <enum>(1)</enum>
 <text>the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947; or</text>
        </paragraph>
        <paragraph id="HB8834E55A37048D4AF06ADFBADCB1907">
          <enum>(2)</enum>
 <text>another applicable international obligation of the United States.</text> </paragraph> </subsection> <subsection id="H09DA625AB2584E93B51FA982F21AE2A7"> <enum>(e)</enum> <header>Law-Enforcement exception</header> <text>The Secretary of State or the Secretary of Homeland Security may waive the application of this section with respect to a foreign person if the relevant Secretary determines that admission or parole of the person is important to—</text>
        <paragraph id="H1336122AF082448BAB3FFC4417721081">
          <enum>(1)</enum>
 <text>a criminal investigation or prosecution in the United States;</text> </paragraph> <paragraph id="H7B28C8EFB1C94F51A63F4E1DE2FFD4C0"> <enum>(2)</enum> <text>the fulfillment of a law-enforcement objective; or</text>
        </paragraph>
        <paragraph id="HD62AF72E28284A23A61DD0DDABAD270B">
          <enum>(3)</enum>
 <text>the protection of national security.</text> </paragraph> </subsection></section> <section id="H27A7E8FD54974F869B23AD71346B606C"><enum>9.</enum><header>Sense of Congress regarding certain diplomatic personnel of Canada</header> <subsection id="H3067A3BFCFA443038AA541CC33981FB7"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="H85FCAC438B914F56A6374A19F549E2FD">
          <enum>(1)</enum>
 <text>Article 9 of the Vienna Convention on Diplomatic Relations, done at Vienna April 18, 1961, permits a receiving state, at any time and without having to explain its decision, to notify a sending state that the head of mission or another member of the diplomatic staff is persona non grata;</text>
        </paragraph> 
<paragraph id="HD799866C59A94508A5F94701F64AE121"><enum>(2)</enum><text>upon such notification, the sending state is expected, as appropriate, to recall the person concerned or terminate the person’s functions with the mission; and</text></paragraph> <paragraph id="H09B701D6130D4278B6AA2AFD55BAF5BF"><enum>(3)</enum><text>continued material transboundary smoke events, combined with the failure of the Government of Canada to take adequate corrective action, warrant a substantial diplomatic response.</text></paragraph></subsection> 
<subsection id="H46A7D40CBC2645D5B68AD95E3CCAB7CF" commented="no"><enum>(b)</enum><header>Sense of congress</header><text>It is the sense of Congress that, until the President submits the certification required under section 13, the Secretary of State should consider declaring persona non grata, pursuant to applicable international law and diplomatic practice, the following accredited diplomatic personnel of the Government of Canada, or the equivalent person as determined by the Secretary of State;</text> <paragraph id="H0ADB42CCA9BD4494815025E4E6C7D717" commented="no"><enum>(1)</enum><text>The Ambassador Extraordinary and Plenipotentiary;</text></paragraph>

<paragraph id="HFD29AFB5DE544F4ABF9949079612A318" commented="no"><enum>(14)</enum><text>The First Secretary for Economic Affairs;</text></paragraph> <paragraph id="H29E1A855E4F544B6BD6DF62340FA5570" commented="no"><enum>(15)</enum><text>The Press Counselor or Embassy Spokesperson; or</text></paragraph> 
<paragraph id="H945B5B7EF46B442686918E31AD3DC96E" commented="no"><enum>(16)</enum><text>Any substantially equivalent diplomatic officer, counselor, attaché, secretary, consul, or accredited representative of the Government of Canada, as determined by the Secretary of State, whose official responsibilities include environmental policy, forestry, wildfire management, emergency response, natural resources, economic affairs, public diplomacy, scientific cooperation, or other matters related to the prevention, mitigation, monitoring, or public communication of transboundary wildfire smoke.</text></paragraph></subsection> <subsection id="HC7D711668F744D76AA54DE1D552EB8D1"> <enum>(c)</enum> <header>Presidential certification</header> <text>No replacement ambassador or other diplomatic personnel referenced in subsection (b) may present credentials until the President certifies that the AQI in affected United States communities has remained below 100 for 90 consecutive days due to the cessation of smoke originating in Canada.</text>
      </subsection> 
<subsection id="HAC102CC2A5BF441F984A0CA96E2B6686"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed—</text> <paragraph id="HE06BF73748F849EEA1383D75FA538D39"><enum>(1)</enum><text>to require the President to receive, reject, recognize, or maintain diplomatic relations with any particular diplomatic representative;</text></paragraph> 
<paragraph id="H2D30157618004AC1AB1C73100EAB6C98"><enum>(2)</enum><text>to alter the authority of the President or the Secretary of State with respect to the conduct of diplomatic relations; or</text></paragraph> <paragraph id="H23CFE2DEBD8A4C67910919E464E7B01A"><enum>(3)</enum><text>to modify the privileges and immunities afforded under the Vienna Convention on Diplomatic Relations, the Diplomatic Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/22/254a">22 U.S.C. 254a et seq.</external-xref>), or any other applicable law or international agreement.</text></paragraph></subsection></section> 
<section id="HC4FEB2F1254142D9830F0A36631217AD"><enum>10.</enum><header>Humanitarian, diplomatic, and other exceptions</header> 
<subsection id="HF271A641B54042BB91AA41E3A603A592"><enum>(a)</enum><header>In general</header><text>The authorities and requirements to impose sanctions under this Act shall not include the authority or requirement to impose sanctions on—</text> <paragraph id="HCDBC9956C8AA47AC99B1B4AA09D6497F"><enum>(1)</enum><text>the importation of goods into the United States;</text></paragraph> 
<paragraph id="H1A7A984058AB4F94BFEC56BF35742252"><enum>(2)</enum><text>the exportation of goods from the United States; or</text></paragraph> <paragraph id="HD492CC64196E41158BD80A5A6E434FB3"><enum>(3)</enum><text>any transaction involving the provision of goods or services, if the President determines that the goods, services, or transaction are necessary for—</text> 
<subparagraph id="HADE822E602B64A80BAC5089099C69340"><enum>(A)</enum><text>food, medicine, medical devices, or other articles intended to relieve human suffering;</text></subparagraph> <subparagraph id="H2644EA4EB5454AC08FE1F30A7714B1C4"><enum>(B)</enum><text>wildfire prevention, detection, containment, suppression, or mitigation;</text></subparagraph> 
<subparagraph id="HE330E2BE9E2246EA999BE2BE61238D05"><enum>(C)</enum><text>forest restoration or environmental remediation;</text></subparagraph> <subparagraph id="HA3007D1968E74EB68C53A2C34D612EAA"><enum>(D)</enum><text>air-quality monitoring, public-health protection, or emergency preparedness;</text></subparagraph> 
<subparagraph id="H0353630F734247E0836651082BB8A2F2"><enum>(E)</enum><text>disaster response;</text></subparagraph> <subparagraph id="HCEF35E2E4EBF46CABF48E7C5C3814CE3"><enum>(F)</enum><text>agricultural or food security;</text></subparagraph> 
<subparagraph id="H0B3E1BC5C5A04A6DAC1EAB9E53BFA0D8"><enum>(G)</enum><text>telecommunications services necessary for humanitarian or emergency purposes; or</text></subparagraph> <subparagraph id="H35D272D0A7DF464AB7C92630ED5BC31F"><enum>(H)</enum><text>the protection of human life.</text></subparagraph></paragraph></subsection> 
<subsection id="H677554AEF3BC4A7C90AFF2B847D26F7D">
        <enum>(b)</enum>
        <header>I<enum-in-header>EEPA</enum-in-header> exceptions</header>
 <text>The exceptions provided in section 203(b) of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702(b)</external-xref>) shall apply to the exercise of authorities under this Act to the same extent as such exceptions apply to the exercise of authorities under that Act.</text>
      </subsection> 
<subsection id="H3873BEB46F134DD58A26E93F3B4F5D91"><enum>(c)</enum><header>Diplomatic activities</header><text>Nothing in this Act shall be construed to prohibit—</text> <paragraph id="H0576E59A186540D88C0E499DEF1562EE"><enum>(1)</enum><text>any transaction necessary for the conduct of the official business of the United States Government;</text></paragraph> 
<paragraph id="H02F96F8434EC4B4D8B38FA71861BA3E5"><enum>(2)</enum><text>any transaction necessary for the conduct of the official business of a diplomatic or consular mission of Canada in the United States that is consistent with the international obligations of the United States;</text></paragraph> <paragraph id="H4FEBAF43F7B846E5B3C3AF1F909A1A07"><enum>(3)</enum><text>the payment of reasonable and necessary expenses associated with the departure of a diplomatic agent or family member from the United States; or</text></paragraph> 
<paragraph id="HEF8CDB83C3B04B07943CCA38F777BFB1"><enum>(4)</enum><text>the performance by the United States of any obligation under the Vienna Convention on Diplomatic Relations, the Vienna Convention on Consular Relations, the Diplomatic Relations Act, or the United Nations Headquarters Agreement.</text></paragraph></subsection> <subsection id="H280BA10652E746828FF06CE8569F1F2E"><enum>(d)</enum><header>Intelligence activities</header><text>Nothing in this Act shall be construed to apply to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) or to any authorized intelligence activity of the United States.</text></subsection></section> 
<section id="H573111F5C61C47A58E9CD07FD9C800AD"><enum>11.</enum><header>Implementation; penalties</header> 
<subsection id="H92CDF1B31421436E962A04ABED79A201"><enum>(a)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this Act.</text></subsection> <subsection id="H7696232F1C0444E0A72F02DA374CEAFB"><enum>(b)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this Act or any regulation, license, order, directive, or prohibition issued to carry out this Act shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subsection> 
<subsection id="HE8BE41619EEA461AAAF166A58DBF792C"><enum>(c)</enum><header>Administrative authorities</header><text>The President may—</text> <paragraph id="H5B0C9F8030CC47BE9EB57F02C9524974"><enum>(1)</enum><text>issue such regulations, licenses, orders, and guidance as may be necessary to carry out this Act; and</text></paragraph> 
<paragraph id="H0938940B27EE40C2A98CC3EF257C7D72"><enum>(2)</enum><text>delegate to the head of an appropriate Federal agency any authority necessary to carry out this Act.</text></paragraph></subsection> <subsection id="H7F236C9CD05047CEB94E34753F7F5983"><enum>(d)</enum><header>Regulations</header><text>Not later than 90 days after the date of enactment of this Act, the President shall prescribe regulations to carry out this Act.</text></subsection></section> 
<section id="HB0A36B63D922486CB28E026DF8DA8E28"><enum>12.</enum><header>Waiver</header><text display-inline="no-display-inline">The President may waive the application of a sanction under section 6, 7, or 8 with respect to a person or transaction if the President—</text> <paragraph id="H0AE86679122E40F7917E5AF48EF98616"><enum>(1)</enum><text>determines that the waiver—</text> 
<subparagraph id="HD0263C8504D34DE7AB6C19AFC3B00D25"><enum>(A)</enum><text>is vital to the national security interests of the United States;</text></subparagraph> <subparagraph id="HFA99AC3E0119494AAA5F4E2EE8C275F1"><enum>(B)</enum><text>is necessary to address a humanitarian emergency;</text></subparagraph>
                <subparagraph id="HFF2FA3C8AF944432A43C4B413CAAC795">
                    <enum>(C)</enum>
 <text>will materially advance cooperation by Canada in preventing or mitigating transboundary wildfire smoke; and</text>
                </subparagraph> 
<subparagraph id="HA61D641622A64F8C8C4AD529F470C64C"><enum>(D)</enum><text>is necessary to protect public health or safety in the United States; and</text></subparagraph></paragraph> <paragraph id="H677F71AAD9F648EB918E6F7385CC920D"><enum>(2)</enum><text>submits to the appropriate congressional committees the notice described in subsection (b).</text></paragraph></section> 
<section id="H98B3D0E4A29D45AA945A433F9370FCDE"><enum>13.</enum><header>Presidential certification and termination of sanctions</header> 
<subsection id="H7DB75E2E3DAF419DB4A9AB742438A73F"><enum>(a)</enum><header>Certification</header><text>The President may terminate the sanctions imposed under this Act if the President submits to the appropriate congressional committees a certification that—</text> <paragraph id="HEBB81E9DF9034A0298C83A81EC6DC328"> <enum>(1)</enum> <text>no material transboundary smoke event originating substantially in Canada has occurred during the preceding 90-day period;</text>
        </paragraph> 
<paragraph id="H0F935A0A0B944BA1BA6FA9C8D2905E1C"><enum>(2)</enum><text>the Government of Canada has—</text> <subparagraph id="H146BD5939C6E41DBBF2B5B02368A62FF"><enum>(A)</enum><text>adopted and begun implementing a credible and adequately funded plan to prevent, mitigate, detect, contain, and suppress wildfires that may affect the United States;</text></subparagraph> 
<subparagraph id="H9B911A6C636E4A9784CC08F41EB95278"><enum>(B)</enum><text>established effective procedures for timely notification to the United States regarding wildfires and smoke conditions that may affect the United States;</text></subparagraph> <subparagraph id="HD838132BF42D493DBB2B93832A3A1B0E"><enum>(C)</enum><text>provided the United States with access to sufficient data to verify the origin, severity, emissions, and expected movement of relevant wildfire smoke;</text></subparagraph> 
<subparagraph id="H00B45E778E744F2FABA01C73E4F8EBED"><enum>(D)</enum><text>cooperated in good faith with appropriate Federal, State, local, and Tribal authorities; and</text></subparagraph> <subparagraph id="HAD0F76F78517491DB67FEBA82C53AED8"><enum>(E)</enum><text>taken reasonable measures to remedy the acts or omissions that formed the basis of the affirmative determination under section 5(a);</text></subparagraph></paragraph> 
<paragraph id="H0CD707F782D046E7A9322BF052593521"><enum>(3)</enum><text>the measures described in paragraph (2) are reasonably likely to prevent or substantially reduce future material transboundary smoke events; and</text></paragraph> <paragraph id="HBBCF5003559A4367BA22F9E21F248377"><enum>(4)</enum><text>termination of the sanctions is in the national interest of the United States.</text></paragraph></subsection> 
<subsection id="HDEF3E74215BC465D8D9AEE0BFC8DFC72"><enum>(b)</enum><header>Reimposition</header><text>If, after sanctions are terminated under subsection (a), the President determines that—</text> <paragraph id="H39450FD0438D4282AE946DA6E47AA83A"><enum>(1)</enum><text>another material transboundary smoke event originating substantially in Canada has occurred; and</text></paragraph> 
<paragraph id="HE492AC7B8BB3490291B1E55E7D0A0B9F"><enum>(2)</enum><text>the Government of Canada has failed to take reasonable and effective measures to prevent, mitigate, contain, or respond to that event, the President shall reimpose the sanctions required herein.</text></paragraph></subsection></section> <section id="H583F204267C0477D9C7BED155B6E93DB"><enum>14.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed—</text> 
<paragraph id="H530685F253D8435185AFB2059D86E6A6"><enum>(1)</enum><text>to limit the authority of the President under—</text> <subparagraph id="H620FDAB095C24606AC8E2D971854C838"><enum>(A)</enum><text>the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="HECA2DE179126499E8E91B6C4E2A8ED05"><enum>(B)</enum><text>the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>);</text></subparagraph> <subparagraph id="HB16F9334B543446F80CA4161CBC82490"><enum>(C)</enum><text>the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>); or</text></subparagraph> 
<subparagraph id="H820B6140DCCE4FAF8144F748D4578F40"><enum>(D)</enum><text>any other provision of law;</text></subparagraph></paragraph> <paragraph id="H776E4A9615724D059CC072C5D1773CBC"><enum>(2)</enum><text>to authorize military force against Canada or any other foreign country;</text></paragraph> 
<paragraph id="H49EA5909A8C546038A343E6F3CFAFD6F"><enum>(3)</enum><text>to create a private right of action against the United States, the Government of Canada, or any other person;</text></paragraph> <paragraph id="HFDD5DAE8828847EE85D09223D3F20DF6"><enum>(4)</enum><text>to require the blocking of property used exclusively for diplomatic or consular purposes if such blocking would be inconsistent with the international obligations of the United States; or</text></paragraph> 
<paragraph id="H1BC31D7261AD4B3F97B2B023E9CC0C57"><enum>(5)</enum><text>to prohibit diplomatic negotiations, environmental cooperation, wildfire assistance, humanitarian assistance, or other engagement intended to secure compliance with the objectives of this Act.</text></paragraph></section> </legis-body></bill>
