<section id="H355CE2F8601A48A0AE027A6B7E231346" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Ratepayers Act</short-title></quote>.</text> </section> <section id="H929F2B19E31149AF9E47F7A48C54B17A"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H2A459067101946E99E87F4B40CCA24FE"><enum>(1)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means a private company, or other private entity, that—</text> <subparagraph id="H0CF0B8085B304F08B964BD6345676E03"><enum>(A)</enum><text>owns, operates, or maintains a data center; or</text></subparagraph> 
<subparagraph id="H6D3BD319D5F44E5DB9CAB0FCA56D586D"><enum>(B)</enum><text>has plans to own, operate, or maintain a data center within the next 5 years.</text></subparagraph></paragraph> <paragraph id="HFDA8E243C5F34ACE9F5F57C00952B0D2"><enum>(2)</enum><header>Data center</header><text>The term <term>data center</term> means a data center, as defined in section 453(a) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17112">42 U.S.C. 17112(a)</external-xref>), with a power demand of 5 megawatts or more.</text></paragraph> 
<paragraph id="HEB90DE81FC5542ACBAA9BF961AB0A8A9"><enum>(3)</enum><header>Existing data center</header><text>The term <term>existing data center</term> means a data center that has begun operations as of the date of enactment of this Act.</text></paragraph> <paragraph id="H85A41BFA337646F6B7CA636C573D21B9"><enum>(4)</enum><header>New data center</header><text>The term <term>new data center</term> means a data center or planned data center that is not yet operational as of the date of enactment of this Act.</text></paragraph></section> 
<section id="HE568B08FC58249BBA94A5DE292D1754B"><enum>3.</enum><header>Data center requirement for off-grid power and water supply</header><text display-inline="no-display-inline">Beginning on the date that is 180 days after the date of enactment of this Act, a covered entity may not build, own, operate, or maintain a new data center or existing data center unless the data center derives all—</text> <paragraph id="H80493FA1C6304873900437647936AE6B"><enum>(1)</enum><text>energy, including back-up energy, from a captive power plant, on-site power generation, or some other source or combination of sources separate from, and not deriving power from, the electric grid; and</text></paragraph> 
<paragraph id="HE4FEE079615047CC92EADE783C598EC6"><enum>(2)</enum><text display-inline="yes-display-inline">water, including back-up water, from an on-site water source, or some other water source or combination of sources separate from, and not deriving water from, the public water system.</text></paragraph></section> <section id="H332D0B1744E843229216BD58E05CAEE9"><enum>4.</enum><header>Ratepayer Protection Pledge</header><text display-inline="no-display-inline">Proclamation of the President issued on March 9, 2026, titled <quote>Ratepayer Protection Pledge</quote> (91 Fed. Reg. 11439) shall have the full force and effect of law.</text></section>
