<section id="H9BA6C3DCBE424E31A3597F63A34D6FD5" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Duty of Transparency Act</short-title></quote>.</text></section> 
<section id="H735E2C1FB27C4F8DAB0BFCA4B8F966C8"><enum>2.</enum><header>Disclosures related to prolonged absence from the Congress</header> 
<subsection id="H4E781C69D97644408D161D8BF956F6B5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An individual who is a Member of Congress and who has a reasonable belief that the individual will not be physically present to participate in the proceedings of the applicable House of Congress of which the individual is a Member for a period of not less than 21 consecutive calendar days shall file a disclosure statement under subsection (b) with the designated attending officer of the House of Congress not later than 5 calendar days after having the reasonable belief.</text></subsection> <subsection id="H2BA9683874F1437EABE33EB357D69988"><enum>(b)</enum><header>Contents of disclosure</header><text>The disclosure statement referred to in subsection (a) shall include the following:</text> 
<paragraph id="HB67820E8D9014680B28C42DD8569809F"><enum>(1)</enum><text>The expected dates during which the Member of Congress will not be physically present to participate.</text></paragraph> <paragraph id="H0DA3D6E824FB48D7B882C8CC2255FCE1"><enum>(2)</enum><text>A statement explaining why the Member of Congress will not be physically present to participate during the dates described in paragraph (1).</text></paragraph> 
<paragraph id="H7F157F607C2D4138B21281D10903231A"><enum>(3)</enum><text>Whether the Member of Congress shall be able to perform official duties or responsibilities notwithstanding not being physically present, including through remote work, and, if so, a description of the duties or responsibilities.</text></paragraph> <paragraph id="H862B5B520BD64FB6906942C697C9794E"><enum>(4)</enum><text>Identification and contact information of an individual employed by the Member under the Members’ Representational Allowance who shall have access to the Member should the need arise with respect to the House of Congress.</text></paragraph></subsection> 
<subsection id="H91241749482A4C15A4C5D0993A906678"><enum>(c)</enum><header>Incapacitation</header><text>A Member of Congress who does not comply with subsection (a) despite being subject to such subsection because the Member was incapacitated or otherwise unable to comply shall file a disclosure statement under subsection (b) with the designated attending officer of the House of Congress not later than 5 calendar days after the end of the incapacitation or inability to comply.</text></subsection> <subsection id="H53C4A38F24674F3AA59E9FF8767C3807"><enum>(d)</enum><header>Privacy</header><text>A Member of Congress required to file a disclosure statement under this section shall not be required to disclose any diagnosis, prognosis, course of treatment, medical record, or other protected health information concerning the Member or another individual, but the disclosure statement may contain such additional information that the Member may choose to disclose beyond the information required under subsection (b).</text></subsection> 
<subsection id="H512DA0CA4BD04CCA89556E89A703A0A9"><enum>(e)</enum><header>Updates</header><text>Every 30 days after the start of a period during which a Member of Congress is not physically present to participate in the proceedings of the applicable House of Congress and through the end of such period, the Member shall file a new disclosure statement that updates the information provided in the prior disclosure statement.</text></subsection> <subsection id="H016A6213320B41C1B8949CEA87AA76EB"><enum>(f)</enum><header>Public availability</header><text>The designated attending officer of each House of Congress shall make available to the general public, in a website under the authority of the officer, each disclosure statement filed with the officer not later than 2 calendar days after the filing.</text></subsection> 
<subsection id="H091EDABBF5E04A8A848F5585FD6E5E4E"><enum>(g)</enum><header>Enforcement</header><text>The failure to comply with this section shall be a matter in the jurisdiction of the applicable ethics committee.</text></subsection> <subsection id="HDD4C138CAAF049B5B9801CE008CE46CF"><enum>(h)</enum><header>Rulemaking authority</header><text>This section is enacted as an exercise in the rulemaking power of the House of Representatives and the Senate, respectively, and as such shall be considered as part of the rules of each House, with full recognition of the constitutional right of either House to change such rules at any time, in the same manner, and to the same extent, as any other rule of that House.</text></subsection> 
<subsection id="HF1FB0785CA8543149E211ADD0B7EB79C"><enum>(i)</enum><header>Effective date</header><text>This section shall apply with respect to any period during which a Member of Congress is not physically present to participate in the proceedings of the applicable House of Congress that begins after the date of the enactment of this section.</text></subsection> <subsection id="H79D850D390564A39A2C714715BCEC299"><enum>(j)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HBE4744FD99714DBAA78F53355D7972BF"><enum>(1)</enum><header>Applicable ethics committee</header><text>The term <quote>applicable ethics committee</quote> means—</text> <subparagraph id="H34EBABFEF83A40169D5902FD183CC3B7"><enum>(A)</enum><text>with respect to the House of Representatives, the Committee on Ethics of the House of Representatives; and</text></subparagraph> 
<subparagraph id="HDA24A92BF7434E9982390472580E438C"><enum>(B)</enum><text>with respect to the Senate, the Select Committee on Ethics of the Senate.</text></subparagraph></paragraph> <paragraph id="HB9BCB08906704907AA40A2CF072D1DCF"><enum>(2)</enum><header>Area of constituency</header><text>The term <quote>area of constituency</quote> means—</text>
<subparagraph id="HFEB601B60B524CFC89DAD0E04861708D"><enum>(A)</enum><text>with respect to a Representative in, or a Delegate or Resident Commissioner to, the Congress, the congressional district of the Representative, Delegate, or Resident Commissioner; and</text></subparagraph> <subparagraph id="H96BBACF848054ED98DB46FA13D3D3B73"><enum>(B)</enum><text>with respect to a Senator in the Congress, the State of the Senator.</text></subparagraph></paragraph>
<paragraph id="H25553698F8F147949390707A2540882B"><enum>(3)</enum><header>Designated attending officer</header><text>The term <quote>designated attending officer</quote> means—</text> <subparagraph id="HE10A0F9D3B67446FAC0C0363356E922A"><enum>(A)</enum><text>with respect to the House of Representatives, the Clerk of the House of Representatives, or an officer or employee of the House of Representatives designated by the Clerk; and</text></subparagraph> 
<subparagraph id="HC804FCBD38D849998D7850CB69C27F71"><enum>(B)</enum><text>with respect to the Senate, the Secretary of the Senate, or an officer or employee of the Senate designated by the Secretary.</text></subparagraph></paragraph> <paragraph id="HBA8BE314F21040D29958AF690CE6B20A"><enum>(4)</enum><header>Member of Congress</header><text>The term <quote>Member of Congress</quote> means a Senator or Representative in, or a Delegate or Resident Commissioner to, the Congress.</text></paragraph> 
<paragraph id="H240F6A6C355747DD9407508D6DD462B5"><enum>(5)</enum><header>Physically present to participate in the proceedings</header><text display-inline="yes-display-inline">The term <quote>physically present to participate in the proceedings</quote> includes, with respect to a House of Congress, entering the Capitol Buildings (as such term is defined in section 5101 of title 40, United States Code), entering the office of a Member of Congress in the Capitol Buildings or in the area of constituency of the Member which is accessible to the general public, entering the applicable Hall or Chamber of such House, casting or making a vote in such House, making a motion or request for unanimous consent on the floor of such House, or engaging in any other activity that requires physical presence in the Capitol Buildings.</text> </paragraph></subsection></section> </legis-body></bill>
