<section id="HAA9DA5318EA3480C96DE3478AE30A3A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clinics for Law students Investigating and Navigating Claims Assistance Act</short-title></quote> or the <quote><short-title>CLINIC Assistance Act</short-title></quote>. </text></section> <section id="H5C92C6B0E53A4A9AAB57C2F5EC65CF2E"><enum>2.</enum><header>ERISA clinics</header> <text display-inline="no-display-inline">Part 5 of title I of the Employee Retirement Income Security Act of 1974 (29 U.S.C.1131 et seq.) is amended by adding at the end the following:</text>

<section id="H65F12B755D204EFA867AB8F2B5D75A40"><enum>525.</enum><header>ERISA clinics and pro bono programs</header> 
<subsection id="H7B9F2867CCC449F182E74CF885C5C099"><enum>(a)</enum><header>Establishment of grant program</header><text display-inline="yes-display-inline">The Secretary shall provide grants to eligible institutions for the purpose of planning, developing, or operating an attorney-supervised clinical program, externship, or pro bono program for law students to improve access to benefits under employee welfare benefit plans.</text></subsection> <subsection id="H7841A498CB0342C486993848048904C4"><enum>(b)</enum><header>Use of funds</header> <paragraph id="HE612C3903BCF43F7992F2543D9A0EAD4"><enum>(1)</enum><header>In general</header><text>An eligible institution that receives a grant under this section may use such grant to support programs through which participants and beneficiaries of employee welfare benefit plans can receive representation—</text> 
<subparagraph id="HBD57D9D87D8146E3896E7689B8831735"><enum>(A)</enum><text>in appeals of benefit denials, including through the internal claims procedure and external review process of the plan;</text></subparagraph> <subparagraph id="HF765B216ACC64988ADC01A23EEE15D39"><enum>(B)</enum><text>in actions brought under section 502;</text></subparagraph> 
<subparagraph id="H146CA4922A5247BBBC7656BA58187931"><enum>(C)</enum><text display-inline="yes-display-inline">in actions brought against a participant or beneficiary by a health care provider or facility regarding unpaid out-of-pocket costs; and</text></subparagraph> <subparagraph id="HF87BD65D2DA5449183FF4A3D7C4DE6AF"><enum>(D)</enum><text>in any other action relating to—</text> 
<clause id="HE6F53FC196664E99ACD550BCEBAD49AA"><enum>(i)</enum><text>the enforcement of title I of this Act; and</text></clause> <clause id="HEFF911B506704A43BE841146E328D422"><enum>(ii)</enum><text>the receipt of benefits under employee welfare benefit plans, as determined by the Secretary.</text></clause></subparagraph></paragraph> 
<paragraph id="HBA29E8657B1A4EBDB66101A23C2368CD"><enum>(2)</enum><header>Supervisory attorneys</header><text display-inline="yes-display-inline">In addition to the uses specified in paragraph (1), an eligible institution that receives a grant under this section may use a portion of such grant to pay the costs of providing an attorney to supervise a program supported by such grant.</text></paragraph> </subsection> <subsection id="HA4AD7014741B413B8AEECE6CE74FA3D1"> <enum>(c)</enum> <header>Eligible institution</header> <text display-inline="yes-display-inline">In this section, the term <term>eligible institution</term> means an accredited law school that is, or is operated by, an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)).</text>
                    </subsection> 
<subsection id="H2E9CE03EA59E4697962233B14F8F1331"><enum>(d)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an eligible institution shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection> <subsection id="H482365CE1C2044B5840DF3C6AF932115"><enum>(e)</enum><header>Amount</header><text>The Secretary may not award more than $500,000 to an eligible institution for any fiscal year.</text></subsection> 
<subsection id="H3687732EB8564657A1010BA92A7C8148"><enum>(f)</enum><header>EBSA coordination</header> 
<paragraph id="H8DABBBE45CD94B7AAD761FD80E0F9F92"><enum>(1)</enum><header>In general</header><text>The Secretary shall require benefit advisors of the Employee Benefits Security Administration of the Department of Labor to coordinate with eligible institutions operating a program described in subsection (a) to assist participants and beneficiaries in challenging denied benefit claims.</text></paragraph> <paragraph id="H9F83BDE137574FA4BDD626769D4918E0"><enum>(2)</enum><header>Information sharing</header><text>Such benefit advisors may provide participants and beneficiaries with a list of eligible institutions that operate a program described in subsection (a).</text></paragraph></subsection> 
<subsection id="H31DB5266B937472B944C93E1AF1C69AE"><enum>(g)</enum><header>Consumer assistance programs</header><text display-inline="yes-display-inline">A program supported under subsection (b)(1) may coordinate with, and make referrals to, a State office of health insurance consumer assistance, health insurance ombudsman, or other program that carries out the duties described in section 2793(c) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-93">42 U.S.C. 300gg–93(c)</external-xref>).</text></subsection> <subsection id="H438F7F3B2C974F1A96DF5A8F07D3BB7B"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $5,000,000 to carry out this section for each of fiscal years 2026 through 2030.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
