<official-title display="yes">To clarify United States birthright citizenship laws in the territories and combat foreign nationals who are seeking citizenship in the United States territories.</official-title>

<section id="H3C00C0D7443E48D689013F53B721755C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Birthright Citizenship for Territories Act</short-title></quote>.</text></section> <section id="a01"><enum>2</enum><header>Background</header> <paragraph id="a02" indent="subsection"> <enum/> <text>Whereas, under article IV, section 3, clause 2, the Constitution states: <quote>The Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States;</quote>;</text>
            </paragraph>
<paragraph id="a03" indent="subsection">
                <enum/>
 <text>Whereas, Supreme Court of the United States precedents, known collectively as the Insular Cases, stands for the proposition that Congress has the power to legislate with respect to the United States territories, including citizenship status;</text>
            </paragraph>
<paragraph id="a04" indent="subsection">
                <enum/>
 <text>Whereas, Congress has previously granted citizenship by statute to four of the five United States territories but not to the people of American Samoa;</text>
            </paragraph>
<paragraph id="a05" indent="subsection">
                <enum/>
 <text>Whereas, the decision in Trump v. Barbara did not address or call into question any of these Insular Case based statutes; and</text>
            </paragraph>
<paragraph id="a06" indent="subsection">
                <enum/>
 <text>Whereas, Congress has the inherent authority to change statutes relating to citizenship of persons born in the territories.</text>
            </paragraph></section>
<section id="H0D79DC5156F643BC8DB014E099AD23B4"><enum>3.</enum><header>Limitation on citizenship for individuals born in the commonwealth of Puerto Rico</header>
<subsection id="H620F672E382B430882096159AC75809E"><enum>(a)</enum><header>In general</header><text>Title III of the Immigration and Nationality Act section 302 (<external-xref legal-doc="usc" parsable-cite="usc/8/1402">8 U.S.C. 1402</external-xref>) is amended by striking the comma after <quote>after January 13, 1941,</quote> and adding <quote>and before January 1, 2027,</quote>.</text></subsection></section> <section id="H4CDC24EEFBAB4E6787B4CEB143032DEA"><enum>4.</enum><header>Limitation on citizenship for individuals born in the territory of the Virgin Islands</header> <subsection id="H5F4F3D3110ED4AFC897BD00F2EFF7304"> <enum>(a)</enum> <header>In general</header> <text>Title III of the Immigration and Nationality Act section 306 (<external-xref legal-doc="usc" parsable-cite="usc/8/1402">8 U.S.C. 1402</external-xref>) is amended in subparagraph (b) by inserting the <quote>and before January 1, 2027,</quote> after <quote>after February 25, 1927,</quote>.</text>
                        </subsection></section>
<section id="H115E5F6C7029465AAE1BA2FD1F429AF1"><enum>5.</enum><header>Limitation on citizenship for individuals born in the territory of Guam</header>
<subsection id="HCBBEEC70049942E196A347FD7C196725"><enum>(a)</enum><header>In general</header><text>Title III of the Immigration and Nationality Act section 307 (<external-xref legal-doc="usc" parsable-cite="usc/8/1406">8 U.S.C. 1406</external-xref>) is amended—</text> <paragraph id="a08"><enum>(1)</enum><text>in subparagraph (b) by striking the parenthesis before <quote>whether</quote> and after <quote>1950</quote>;</text></paragraph>

                    <enum>(2)</enum>
 <text>by adding a comma before <quote>whether</quote> and after <quote>1950</quote>; and</text>
                </paragraph>
<paragraph id="a10">
                    <enum>(3)</enum>
 <text>by adding after <quote>August 1, 1950</quote> the following: <quote>and before January 1, 2027.</quote>.</text>
                </paragraph></subsection></section>
<section id="HDEDD3558B8174198ADA40311AE100EF7"><enum>6.</enum><header>Limitation on citizenship for individuals born in the commonwealth of the Northern Mariana Islands</header>
<subsection id="H9BDFA1E22FA7498F8C91787AFF8D0436"><enum>(a)</enum><header>In general</header><text>Subchapter I—The Covenant to Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America, as approved under <external-xref legal-doc="public-law" parsable-cite="pl/94/241">Public Law 94–241</external-xref>, section 303 at (<external-xref legal-doc="usc" parsable-cite="usc/48/1801">48 U.S.C. 1801</external-xref>) is amended in subsection 303 by adding after <quote>and</quote> the following: <quote>before January 1, 2027, are</quote> and by striking <quote>at birth</quote> at the end.</text></subsection> <subsection id="HA5B553EABAF842408F2695961144C7D3"><enum>(b)</enum><header>Applicability</header> <paragraph id="H5F8357B9B3E34977AAD108CD542E8FA8"><enum>(1)</enum><text>The amendment made by subsection (a), (b), (c) and (d) shall not be construed to affect the citizenship or nationality status of any person born in the United States before January 1, 2027.</text></paragraph>
<paragraph id="H8705D45B9EFF402DBD463E251D14E181"><enum>(2)</enum><text>The amendment made by subsection (a), (b), (c) and (d) shall not be construed to affect the citizenship or nationality of a person born in the United States territories, who is born as a child of a United States citizen or the child of an alien lawfully admitted for permanent residence in the United States.</text></paragraph></subsection></section> </legis-body> </bill>
