<section id="HBE4F45C8BECB48848D15F7CC048C151C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Intelligent Arbitration Act of 2026</short-title></quote>.</text></section> 
<section id="H65D45E31DF314B59887D085F633A0E75"><enum>2.</enum><header>Use of artificial intelligence in arbitration</header> 
<subsection id="HACF9DDD92286403699EF1DF06D2068EF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/1">Chapter 1</external-xref> of title 9, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/9/2">section 2</external-xref> the following:</text> <quoted-block style="USC" id="H27F0C64399E1436ABF484859883A10C8" display-inline="no-display-inline"> <section id="HE1BC1B7BE5A14FC7A454C8A3E00B877D"><enum>2a.</enum><header>Artificial intelligence</header> <subsection id="HDF93A4259E1B4498AA61E008CC0E883F"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">Except as provided in subsection (d), a party to an arbitration may use artificial intelligence for—</text> 
<paragraph id="HAACB07060EA8479CA7D1C650C8ADAEDD"><enum>(1)</enum><text>the purpose of—</text> <subparagraph id="HAE83962576A444BDBA63AC70AC25FAE7"><enum>(A)</enum><text>identifying any law that is relevant to the facts giving rise to the arbitration, including any relevant case law;</text></subparagraph> 
<subparagraph id="H7609B4E34CB4411A859BE5D820AE30D7"><enum>(B)</enum><text>making recommendations on the order, form, and relevance of documents;</text></subparagraph> <subparagraph id="HD94851EC54DB4DD390E5083CE0466998"><enum>(C)</enum><text>filing appropriate supporting documents with the appropriate arbitrating body in the case that—</text> 
<clause id="H6B0F16DC2B724594AECC10579AD93B0A"><enum>(i)</enum><text>the facts of the arbitration are not in dispute; and</text></clause> <clause id="HE82DAFE1B304487BB7B73863D4F2BB12"><enum>(ii)</enum><text>there is a genuine question of law; and</text></clause></subparagraph>
<subparagraph id="H939A4CE8C2EB497496415A052380843A"><enum>(D)</enum><text>delivering a final decision to parties in the case; and</text></subparagraph></paragraph> <paragraph id="H3329EABE5C17466D9C964E8274845413"><enum>(2)</enum><text>such other purpose as a party determines necessary.</text></paragraph></subsection> 
<subsection id="H10EA2312DA9B4A7A930C123AA1FE40E6"><enum>(b)</enum><header>Consent and disclosure</header><text>Artificial intelligence may only be used in an arbitration under this title if each party provides written consent for the use of, and uses, such artificial intelligence.</text></subsection> <subsection id="H9074C4AB1E5F41BEAD83FE6F6D5B5B5B"><enum>(c)</enum><header>Assumption of risk</header><text>A party that uses artificial intelligence, or agrees to its use, for any purpose in an arbitration may not move to vacate, modify, or correct an award solely on the basis of an error occurring as the result of such use.</text></subsection> 
<subsection id="H57279258C18A45E185EDBE8276275EC1"><enum>(d)</enum><header>Limitation</header><text>Generative artificial intelligence may not be used in any arbitration under this title.</text></subsection> <subsection id="H322D45E6CD494268854A9BED240A7D61"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to affect the arbitration procedures under this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H645FCF04BE124EB4A8E744BBDBE2BD3A"><enum>(b)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/1">chapter 1</external-xref> of title 9, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/9/2">section 2</external-xref> the following:</text> <quoted-block style="USC" id="H1CA4DF2B42DA43D1B0479F084B8A9231" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">2a. Artificial intelligence.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> </legis-body></bill>
