<section commented="no" display-inline="no-display-inline" id="HFD4B4B4F054949CB9DCD1D8790A8A533" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Autocycle Safety Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H830DE0E2D0A44B36A77326F276D0C7DD" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Motor vehicle safety standards</header> <subsection commented="no" display-inline="no-display-inline" id="HF77E6765FFA748D2B3F3BF9C38C85D84"><enum>(a)</enum><header display-inline="yes-display-inline">Defined term</header><text display-inline="yes-display-inline">Section 30102(a) of title 49, United States Code, is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HB0ED38A2DC124E67810C5B97E572B727"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (13) as paragraphs (2) through (14), respectively; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H439E42A5BEC24DB0ACFFBC6C37B42D38"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before paragraph (2), as redesignated, the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="H317E8294D8114DF885A2EF270F5245BB"><enum>(1)</enum><text display-inline="yes-display-inline"><term>autocycle</term> means a motorcycle with 3 wheels in contact with the ground, front-wheel drive, a fully enclosed occupant compartment, and a steering wheel, which is subject to applicable Federal motor vehicle safety standards, as determined necessary by the Secretary of Transportation through regulation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H479D496F3F2D4509A24867810DC535CA"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability of motor vehicle safety standards to autocycles</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">Chapter 301</external-xref> of title 49, United States Code, is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H2867215244084677A96C3645E6CEB132"><enum>(1)</enum><text display-inline="yes-display-inline">in the table of sections, by inserting after the item relating to section 30114 the following:</text> <quoted-block display-inline="no-display-inline" id="H9665B1E6A185495D9043A8518A61AEFB" style="USC"> <toc> <toc-entry bold="off" idref="HAE7573DF9C62437993FBBA9BC1054561" level="section">30114A. Autocycles.</toc-entry></toc><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <continuation-text continuation-text-level="paragraph">and</continuation-text> <paragraph commented="no" display-inline="no-display-inline" id="H13DF49763B5C46439F385B89E94A9163"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 30114 the following:</text>

<section commented="no" display-inline="no-display-inline" id="HAE7573DF9C62437993FBBA9BC1054561" section-type="subsequent-section"><enum>30114A.</enum><header display-inline="yes-display-inline">Autocycles</header>
<subsection commented="no" display-inline="no-display-inline" id="HD11724BECBFE4AE790399D9B657D89FA"><enum>(a)</enum><header display-inline="yes-display-inline">Interim safety standards for autocycles</header><text display-inline="yes-display-inline">During the period beginning on the date of the enactment of the <short-title>Autocycle Safety Act</short-title> and ending on the effective date of the rules issued pursuant to subsection (b), a person satisfies the requirements set forth in section 30112(a) with regard to an autocycle if the autocycle—</text> <paragraph commented="no" display-inline="no-display-inline" id="H63246A4EF13548A68B55858721AFF07A"><enum>(1)</enum><text display-inline="yes-display-inline">complies with the motor vehicle safety standards for passenger cars, as set forth in part 571 of title 49, Code of Federal Regulations, relating to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H3878DB4674E349AB845908830627D1E4"><enum>(A)</enum><text display-inline="yes-display-inline">controls and displays (FMVSS 101);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6E4D5A1BEDA84C44B7FCEA1056B1735E"><enum>(B)</enum><text display-inline="yes-display-inline">lamps, reflective devices, and associated equipment (FMVSS 108), except for center high-mounted stop lamps;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H518D5AA058DB40BF823CCD870A246105"><enum>(C)</enum><text display-inline="yes-display-inline">brake systems (FMVSS 135);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H3DAD790B7F3D49A9A47540A8EB1F4948"><enum>(D)</enum><text display-inline="yes-display-inline">seating systems (FMVSS 207);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA62B8D3297E24DE5A484CFCAC22DB4F1"><enum>(E)</enum><text display-inline="yes-display-inline">belted occupant crash protection (FMVSS 208); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE8CBB552878C4162B16CD2B2D192B870"><enum>(F)</enum><text display-inline="yes-display-inline">seat belt assemblies (FMVSS 209);</text></subparagraph></paragraph>
<paragraph id="H0EA3932728EC415986A34842752A3AD8"><enum>(2)</enum><text display-inline="yes-display-inline">complies with the motor vehicle safety standards for motorcycles, as set forth in part 571 of title 49, Code of Federal Regulations, relating to—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HCE8BEA4EE0DE4685AECC146888DACB5E"><enum>(A)</enum><text display-inline="yes-display-inline">new pneumatic tires (FMVSS 119); and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H22DA1DA1565948719F42634A9D882348"><enum>(B)</enum><text display-inline="yes-display-inline">tire selection and rims (FMVSS 120);</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HEAC1D16706724305838F55FC9002F19D"><enum>(3)</enum><text display-inline="yes-display-inline">complies with the motor vehicle safety standards for motorcycles or passenger cars (at the option of such person), as set forth in part 571 of title 49, Code of Federal Regulations, relating to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H8E54431669954B93954CB6D6A4CAB732"><enum>(A)</enum><text display-inline="yes-display-inline">brake hoses (FMVSS 106);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H86FCDED07CCB4CC99CE8F426F79A0E40"><enum>(B)</enum><text display-inline="yes-display-inline">rearview mirrors (FMVSS 111), except for inside rearview mirrors;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HEA45504FD69F4F398924775E0443E265"><enum>(C)</enum><text display-inline="yes-display-inline">motor vehicle brake fluids (FMVSS 116); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HEED2C9A477934B72B32A9D0176E08711"><enum>(D)</enum><text display-inline="yes-display-inline">glazing materials (FMVSS 205);</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H08C01CCC8BD140139A02829E6FBB6118"><enum>(4)</enum><text display-inline="yes-display-inline">meets the performance criteria relating to upper interior impact set forth in FMVSS 201 to the extent possible to reach the target points; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA781C25E9C9947C0A7B1BBE04C62A15E"><enum>(5)</enum><text display-inline="yes-display-inline">is equipped with a steering wheel air bag, anti-lock brakes, and electronic stability control.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H47AF0564715A4D8CB88B5795927172A7"><enum>(b)</enum><header display-inline="yes-display-inline">Rulemaking</header>
<paragraph commented="no" display-inline="no-display-inline" id="H73C2FEBFE6C046E4820597C5FDA4EC77"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of the <short-title>Autocycle Safety Act</short-title>, the Secretary of Transportation shall issue such final rules, interpretations, and test procedures in accordance with paragraphs (2) and (3) as may be necessary for a person to satisfy the requirements set forth in section 30112(a) with regard to an autocycle.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H7687B3B516224E3085D7C6719AF8F0A0"><enum>(2)</enum><header display-inline="yes-display-inline">Determination</header><text display-inline="yes-display-inline">In determining which motor vehicle safety standards are applicable to autocycles under paragraph (1), the Secretary shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H0B1718159F504C95916A621F2A3FB392"><enum>(A)</enum><text display-inline="yes-display-inline">apply appropriate motorcycle safety standards to those aspects of an autocycle’s performance that are appropriately regulated through the motor vehicle safety standards applicable to motorcycles; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H21C2E8B5F13D41CBBFEAF1475D72DAF7"><enum>(B)</enum><text display-inline="yes-display-inline">apply appropriate passenger car safety standards to those aspects of an autocycle’s performance regulated through motor vehicle safety standards that are not otherwise appropriately regulated through a motorcycle standard.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7BD5612A7A7B48B68F790D182E5BF8D8"><enum>(3)</enum><header display-inline="yes-display-inline">Other requirements</header><text display-inline="yes-display-inline">In issuing rules to preserve autocycle safety pursuant to paragraph (1), the Secretary shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H31B7C4C21482426094006EBBBB5447FB"><enum>(A)</enum><text display-inline="yes-display-inline">provide autocycle manufacturers with appropriate lead time to comply with the safety standards set forth in such rules; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H799B4BD9B5734530A46097B2B8DB72A1"><enum>(B)</enum><text display-inline="yes-display-inline">comply with the requirements and considerations set forth in subsections (a) and (b) of section 30111.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H61BD716D08DC46578F49420F863BC107"><enum>(c)</enum><header>Conforming amendments</header><text>Section 30112(a) of title 49, United States Code, is amended—</text>
<paragraph id="H7DA9CFACBA11426E942D067EB0BE457B"><enum>(1)</enum><text>in paragraph (1), by striking <quote>sections 30113 and 30114</quote> and inserting <quote>sections 30113, 30114, and 30114A</quote>; and</text></paragraph> <paragraph id="HB3E07FDFE6F94AEABE447044238076D5"><enum>(2)</enum><text>in paragraph (3), by striking <quote>section 30114,</quote> and inserting <quote>sections 30114 and 30114A,</quote>.</text></paragraph></subsection></section>
