<section id="HACC748C1D4414DABB7CBAA342A3EC4FE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vaccine Injury Compensation Modernization Act of 2026</short-title></quote>.</text></section> 
<section id="HF6A42DB233974C56BB0E9ABC50BD432A"><enum>2.</enum><header>Changes to Vaccine Injury Compensation Program</header> 
<subsection id="H7FEF091516874218A9EF2AAD16F1565E"><enum>(a)</enum><header>Special masters</header> 
<paragraph id="HDC2398EB51FB4F8B8B29096D5522E0AB"><enum>(1)</enum><header>Establish minimum number of special masters</header><text display-inline="yes-display-inline">Section 2112(c)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-12">42 U.S.C. 300aa–12(c)(1)</external-xref>) is amended by striking <quote>not more than 8</quote> and inserting <quote>not less than 10</quote>.</text></paragraph> <paragraph id="H049C7C06208F4AEC96EFDEF03B15DDDA"><enum>(2)</enum><header>Terms</header><text display-inline="yes-display-inline">Section 2112(c)(4) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-12">42 U.S.C. 300aa–12(c)(4)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="HEB936D4399974D4599DDC99578A50B32" display-inline="no-display-inline"> 
<paragraph id="H77AC6FE8012247CD9A82A00880FAFB72"><enum>(4)</enum><text display-inline="yes-display-inline">The appointment of any individual as a special master shall be for an initial term of 4 years, subject to termination under paragraphs (2) and (3). An individual appointed as special master may be reappointed to serve one or more additional terms of up to 8 years each, pursuant to paragraph (1), and subject to termination under paragraphs (2) and (3).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> <paragraph id="H4F31443D9D934FF9B7C42A5B6A5DD533"><enum>(3)</enum><header>Additional reporting requirements</header><text display-inline="yes-display-inline">Section 2112(c)(6)(E) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-12">42 U.S.C. 300aa–12(c)(6)(E)</external-xref>) is amended—</text> 
<subparagraph id="HB60B809543A44BDCBB63783F79E10C8C"><enum>(A)</enum><text>by inserting after <quote>disposition of petitions,</quote> the following: <quote>the number of petitions filed that are pending disposition, the number of hearings scheduled with respect to a pending disposition,</quote>; and</text></subparagraph> <subparagraph id="H02ED673234554C128E5A569E8B5F4C33"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, including recommendations on whether additional special masters are needed to ensure an expeditious and fair resolution of petitions or otherwise improve the Program</quote> after <quote>in the Program</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H3BBC1F9E8CC046A5A16E08C5D159C3A3"><enum>(b)</enum><header>Recommendations from CDC</header><text display-inline="yes-display-inline">Section 2114(e)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-14">42 U.S.C. 300aa–14(e)(2)</external-xref>) is amended—</text> <paragraph id="H1C6E7215292A4C79A01CD0753A0F3AE7"><enum>(1)</enum><text>in the matter preceding subparagraph (A)—</text> 
<subparagraph id="H2998525A9BF640C9B32135EB21EDC1ED">
                        <enum>(A)</enum>
 <text>by striking <quote>routine administration to children</quote> and inserting <quote>administration to children, adults, or pregnant women</quote>; and</text>
                    </subparagraph> 
<subparagraph id="HFCA2143E841F4572A62611B132064345"><enum>(B)</enum><text>by striking <quote>within 2 years of</quote> and inserting <quote>within 6 months of</quote>; and</text></subparagraph></paragraph> <paragraph id="HDAD13FF6789D40788CB38E9B854DBF18"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>routine administration to children</quote> and inserting <quote>administration to children, adults, or pregnant women</quote>.</text></paragraph></subsection> 
<subsection id="H50BEACFFC8AE4BF0A86B295A68C6D704"><enum>(c)</enum><header>Increase in compensation</header> 
<paragraph id="H491CE215724B48E5A4237415AA8F6598"><enum>(1)</enum><header>Compensation for death</header><text display-inline="yes-display-inline">Section 2115(a)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(a)(2)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="HC6E0AFA6756742CE9567DADC26F038E9" display-inline="no-display-inline"> <paragraph id="H237074431DED453BB1E9156BE6B82E4C"><enum>(2)</enum><text display-inline="yes-display-inline">In the event of a vaccine-related death, an award of $600,000.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H807E5B96538E4BDA979AAB5ADCFB6604"><enum>(2)</enum><header>Compensation for pain and suffering</header><text>Section 2115(a)(4) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(a)(4)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="HEF7E2A7CF42A42539D59071759976E75" display-inline="no-display-inline"> <paragraph id="H1252611224AA437BA72859C5B944FE21"><enum>(4)</enum><text display-inline="yes-display-inline">For actual and projected pain and suffering and emotional distress from the vaccine-related injury, an award not to exceed $600,000.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE9CB3D6424EC4F18B900FCFA4BB59BD3"><enum>(d)</enum><header>Increase statute of limitations</header><text display-inline="yes-display-inline">Section 2116(a)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-16">42 U.S.C. 300aa–16(a)(2)</external-xref>) is amended by striking <quote>36 months</quote> and inserting <quote>5 years</quote>.</text></subsection> <subsection id="HDACEAC3DD0EF44E892E4F979057F8A66"><enum>(e)</enum><header>Program integrity</header> <paragraph id="H97DAC9A7BBF6486D916FF7C796D90A28"><enum>(1)</enum><header>Including medical records in petitions</header><text>Section 2111(a)(2)(A) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-11">42 U.S.C. 300aa–11(a)(2)(A)</external-xref>) is amended, in the matter preceding clause (i), by inserting <quote>that includes the medical records and other information required under subsection (c) (including, if applicable, an identification of unavailable records and explanation of unavailability pursuant to subsection (c)(3))</quote> after <quote>unless a petition</quote>.</text></paragraph>

                    <enum>(2)</enum>
                    <header>Decision timing for special masters</header>
 <text>Section 2112(d)(3)(A)(ii) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-12">42 U.S.C. 300aa–12(d)(3)(A)(ii)</external-xref>) is amended by striking <quote>the petition was filed</quote> and inserting <quote>on which the petition and the medical records and other information required to be filed with such petition under section 2111(c) was filed</quote>.</text>
                </paragraph></subsection></section> 
<section id="H982461AFB4D348ED957254A1D029CC09"><enum>3.</enum><header>Treatment of COVID–19 vaccines</header> 
<subsection id="H670B325C33E149B2BB07231AF225BE69"><enum>(a)</enum><header>Vaccine injury table</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of Health and Human Services shall promulgate regulations to add, in accordance with section 2114(c)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-14">42 U.S.C. 300aa–14(c)(3)</external-xref>), COVID–19 vaccines to the Vaccine Injury Table. In promulgating such regulations, the Secretary shall provide for notice and opportunity for a public hearing and at least 30 days of public comment.</text></subsection> <subsection id="H71516EF588D0482AA979B6344461EF5E"><enum>(b)</enum><header>Eligibility for compensation</header><text display-inline="yes-display-inline">Notwithstanding sections 319F–3 and 319F–4 of the Public Health Service Act (42 U.S.C. 247d–6d; <external-xref legal-doc="usc" parsable-cite="usc/42/247d-6e">42 U.S.C. 247d–6e</external-xref>), any individual who received a COVID–19 vaccine, or any other vaccine that is added to the Vaccine Injury Table pursuant to section 2114 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-14">42 U.S.C. 300aa–14</external-xref>), shall be eligible to file a petition for compensation under section 2111 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-11">42 U.S.C. 300aa–11</external-xref>), subject to the requirements of section 2116 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-16">42 U.S.C. 300aa–16</external-xref>).</text></subsection> 
<subsection id="H27995079AE734725929CDAE0774F310B"><enum>(c)</enum><header>Concurrent remedy</header><text display-inline="yes-display-inline">Section 2115(g) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(g)</external-xref>) is amended by striking the period at the end and inserting <quote>, or (3) under the Countermeasures Injury Compensation Program under sections 319F–3 and 319F–4, which shall be considered a concurrent remedy. Sections 319F–3 and 319F–4 shall not otherwise impact the availability of compensation under this Act, with respect to a vaccine-related injury or vaccine-related death</quote>.</text></subsection> <subsection id="H6DEC5D01B55A47E8B0D1BEDC4AAA6689"><enum>(d)</enum><header>Vaccine Liability Rules</header> <paragraph id="H43705C7B69334CCE871F6DB155A08FD2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this section, or any amendment made by this Act, shall be construed to affect or limit the application of section 319F–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6d">42 U.S.C. 247d–6d</external-xref>) (including the liability protections for covered countermeasures provided under such section) and any declaration made under such section 319F–3, or any amendments made to such a declaration.</text></paragraph> 
<paragraph id="H5F12BA91CB1245BCA37C07B4A65DAB5D"><enum>(2)</enum><header>COVID–19 vaccines</header><text>Any civil action (other than a petition for compensation under the National Vaccine Injury Compensation Program pursuant to section 2111 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-11">42 U.S.C. 300aa–11</external-xref>)) that is related to the administration to an individual of a COVID–19 vaccine which was, at the time of administration, a covered countermeasure, will be subject to the procedures specified in section 319F–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6d">42 U.S.C. 247d–6d</external-xref>), regardless of whether the individual involved has filed a petition for compensation pursuant to section 2111 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-11">42 U.S.C. 300aa–11</external-xref>) and elects, pursuant to section 2121 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-21">42 U.S.C. 300aa–21</external-xref>), to withdraw the petition or to file a civil action instead of accepting the compensation or judgment on the petition.</text></paragraph> <paragraph id="HDEEDA664953046B39220C5BC973D1225"><enum>(3)</enum><header>Time-barred and Final Actions</header><text>Nothing in this Act shall be construed to allow any civil action (other than a petition for compensation under the National Vaccine Injury Compensation Program pursuant to section 2111 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-11">42 U.S.C. 300aa–11</external-xref>)) if, on the date of enactment of this Act, such civil action was time-barred under applicable law or that was the subject of a final judgment or order.</text></paragraph></subsection> 
<subsection id="HD6D49A428D27433F800257B3121E1DDD">
                <enum>(e)</enum>
                <header>COVID–19 vaccine defined</header>
 <text>In this section, the term <quote>COVID–19 vaccine</quote> refers to any vaccine that is intended to prevent, mitigate, or limit the harm from COVID–19, or the transmission of SARS–CoV–2 or a virus mutating therefrom, including any vaccine that is licensed under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>) or authorized for emergency use under section 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360bbb-3">21 U.S.C. 360bbb–3</external-xref>), regardless of the platform or technology used to produce such vaccine.</text>
            </subsection> </section> 
<section id="H601F19D5D11E40DCA07508DB66B11F9C"><enum>4.</enum><header>Professional judgment budget</header> 
<subsection id="HAD62E25060F546308553FC4D463E009F" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services—</text> <paragraph id="HE604F0E773834547A997471C36ADDFB6" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in consultation with the Attorney General, shall submit a budget outlining the resource needs for each agency for purposes of carrying out the National Vaccine Injury Compensation Program under subtitle 2 of title XXI of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-10">42 U.S.C. 300aa–10 et seq.</external-xref>) for fiscal years 2027 through 2031; and</text></paragraph> 
<paragraph id="H21B22FE848D343779D8134A45E540B91" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">shall submit a budget outlining resource needs for purposes of carrying out the Countermeasures Injury Compensation Program under section 319F–4 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6e">42 U.S.C. 247d–6e</external-xref>) for fiscal years 2027 through 2031.</text></paragraph></subsection> <subsection id="HC1AC46D9E40E466CA7100FF3FF22DAA2" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The budgets described in paragraphs (1) and (2) of subsection (a) shall include estimates of both—</text> 
<paragraph id="HBD9935BB1C91499085FB2F0BE484D24F"><enum>(1)</enum><text>the resources necessary to process current backlogs under each program referred to in such subsection; and</text></paragraph> <paragraph id="HAA81B714F9904BDDAF29B7F111817132"><enum>(2)</enum><text display-inline="yes-display-inline">each program’s ability to reduce processing times for claims under the programs referred to in such paragraphs.</text></paragraph></subsection></section> 
<section id="H35419BAFC7734D5DB6BB075966D18421" section-type="section-one"><enum>5.</enum><header>Addition of miscellaneous vaccines to list of taxable vaccines</header> 
<subsection id="HC33D805E531F410CA4555C157765245E"><enum>(a)</enum><header>Dengue vaccine</header> 
<paragraph id="HC68CB9973C9F4C8A90C53EC7737C8066"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/4132">Section 4132(a)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="H542FD24E0E844B559E1086D1F8594BE2" display-inline="no-display-inline"> <subparagraph id="HE4677FA7510144BD8B9E1F65FC871ACE"><enum>(Q)</enum><text display-inline="yes-display-inline">Any vaccine against dengue.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H710C272EE6864C74AA278B334D16AF74"><enum>(2)</enum><header>Effective date</header> 
<subparagraph id="H37BD94900BCB4B17B0FAA8B7C100BBE5"><enum>(A)</enum><header>Sales, etc</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to sales and uses on or after the later of—</text> <clause id="HC5AF0B8B5B914567B63437E8D7851719" display-inline="no-display-inline"><enum>(i)</enum><text>the first day of the first month which begins more than 4 weeks after the date of the enactment of this Act, or</text></clause> 
<clause id="HACA0E1C58D4C405F844BB986F0B628CA"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which the Secretary of Health and Human Services lists any vaccine against dengue (other than any vaccine against dengue listed by the Secretary prior to the date of the enactment of this Act) for purposes of compensation for any vaccine-related injury or death through the Vaccine Injury Compensation Trust Fund.</text></clause></subparagraph> <subparagraph id="HF8A6F207C1224418ACC598EA73E9BFA5"><enum>(B)</enum><header>Deliveries</header><text>For purposes of subparagraph (A) and <external-xref legal-doc="usc" parsable-cite="usc/26/4131">section 4131</external-xref> of the Internal Revenue Code of 1986, in the case of sales on or before the effective date described in such subparagraph for which delivery is made after such date, the delivery date shall be considered the sale date.</text></subparagraph></paragraph></subsection> 
<subsection id="HFC18D94CC1034F9D918CFD3D10BFB990"><enum>(b)</enum><header>SARS–CoV–2 vaccine</header> 
<paragraph id="HC9B763A669534A1CA45DB7E377082B6E"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/4132">Section 4132(a)(1)</external-xref> of the Internal Revenue Code of 1986, as amended by subsection (a)(1), is amended by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="H45CFE3EDC62B4157AE958CBE929D44A7" display-inline="no-display-inline"> <subparagraph id="HBA60A95184514950B179164544ADB26E"><enum>(R)</enum><text display-inline="yes-display-inline">Any vaccine against SARS–CoV–2.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H3130A3F87E11404385F9A83FCD400F9E"><enum>(2)</enum><header>Effective date</header> 
<subparagraph id="H6B8CD0A919CF4AECB0F2AB4268651177"><enum>(A)</enum><header>Sales, etc</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to sales and uses on or after the later of—</text> <clause id="H28B38FE3417B414089CAB5E55FD10245" display-inline="no-display-inline"><enum>(i)</enum><text>the first day of the first month which begins more than 4 weeks after the date of the enactment of this Act, or</text></clause> 
<clause id="HBD50BBD7A5284E70B4F34FCBAC8E85DA"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which the Secretary of Health and Human Services lists any vaccine against SARS–CoV–2 (other than any vaccine against SARS–CoV–2 listed by the Secretary prior to the date of the enactment of this Act) for purposes of compensation for any vaccine-related injury or death through the Vaccine Injury Compensation Trust Fund.</text></clause></subparagraph> <subparagraph id="H1FB0260D16FE448E959833DEFBB9D368"><enum>(B)</enum><header>Deliveries</header> <clause id="H3B00FB7A1BA845B891D7B42498E06B5C"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), for purposes of subparagraph (A) and <external-xref legal-doc="usc" parsable-cite="usc/26/4131">section 4131</external-xref> of the Internal Revenue Code of 1986, in the case of sales on or before the effective date described in such subparagraph for which delivery is made after such date, the delivery date shall be considered the sale date.</text></clause> 
<clause id="HB1CA75D9A83643D2852D6C536C4BF1AB"><enum>(ii)</enum><header>Exception</header><text>Clause (i) shall not apply to any sale to the United States Government.</text></clause></subparagraph></paragraph></subsection> <subsection id="H8A0DC295DD1142F9817235F7E2368E7B" display-inline="no-display-inline"><enum>(c)</enum><header>Respiratory syncytial virus vaccine</header> <paragraph id="H1074E544B10A4EF98A4154F36E2DBE40"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/4132">Section 4132(a)(1)</external-xref> of the Internal Revenue Code of 1986, as amended by subsection (b)(1), is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="HDE3E2957D7814B609B8ADC4099B471DF"><enum>(S)</enum><text display-inline="yes-display-inline">Any vaccine against respiratory syncytial virus.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H25C784F6D2D244ED87E68075AC4232EF"><enum>(2)</enum><header>Effective date</header> <subparagraph id="H7D616A08241E46F690BE5A919398139E"><enum>(A)</enum><header>Sales, etc</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to sales and uses on or after the later of—</text> 
<clause id="H7D23152384944A35A1F8D3E7EE295CF7" display-inline="no-display-inline"><enum>(i)</enum><text>the first day of the first month which begins more than 4 weeks after the date of the enactment of this Act, or</text></clause> <clause id="HD3FD00B4AC1B42B0B5A7B7D9FE0BD2A7"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which the Secretary of Health and Human Services lists any vaccine against respiratory syncytial virus (other than any vaccine against respiratory syncytial virus listed by the Secretary prior to the date of the enactment of this Act) for purposes of compensation for any vaccine-related injury or death through the Vaccine Injury Compensation Trust Fund.</text></clause></subparagraph> 
<subparagraph id="H63FC570633944361B5806B1C12C9FB24"><enum>(B)</enum><header>Deliveries</header><text>For purposes of subparagraph (A) and <external-xref legal-doc="usc" parsable-cite="usc/26/4131">section 4131</external-xref> of the Internal Revenue Code of 1986, in the case of sales on or before the effective date described in such subparagraph for which delivery is made after such date, the delivery date shall be considered the sale date.</text></subparagraph></paragraph></subsection> <subsection id="H5E77E4F697C94BD0816208061F69D5E6" display-inline="no-display-inline"><enum>(d)</enum><header>Herpes zoster (shingles) vaccine</header> <paragraph id="HF9C4A270FF1D41209034606D54142017"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/4132">Section 4132(a)(1)</external-xref> of the Internal Revenue Code of 1986, as amended by subsection (c)(1), is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H45AD0A1C119745C790204E0D47C308E9"><enum>(T)</enum><text display-inline="yes-display-inline">Any vaccine against herpes zoster (shingles).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H076C9664114D4DF283CCE867E70C9704"><enum>(2)</enum><header>Effective date</header> <subparagraph id="H2AE0D930933048928424795AADB493A3"><enum>(A)</enum><header>Sales, etc</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to sales and uses on or after the later of—</text> 
<clause id="HFBE4E004E1C946529FF84487B34E3E3E" display-inline="no-display-inline"><enum>(i)</enum><text>the first day of the first month which begins more than 4 weeks after the date of the enactment of this Act, or</text></clause> <clause id="HF63C1A62A7AE4865BBD04D07DDC5FE02"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which the Secretary of Health and Human Services lists any vaccine against herpes zoster (shingles) (other than any vaccine against herpes zoster (shingles) listed by the Secretary prior to the date of the enactment of this Act) for purposes of compensation for any vaccine-related injury or death through the Vaccine Injury Compensation Trust Fund.</text></clause></subparagraph> 
<subparagraph id="HD22E6E12E8434A5DB4CDC9E3E4E35C1D"><enum>(B)</enum><header>Deliveries</header><text>For purposes of subparagraph (A) and <external-xref legal-doc="usc" parsable-cite="usc/26/4131">section 4131</external-xref> of the Internal Revenue Code of 1986, in the case of sales on or before the effective date described in such subparagraph for which delivery is made after such date, the delivery date shall be considered the sale date.</text></subparagraph></paragraph></subsection> <subsection id="H78A37DC6F2884EA6837E616FA18009E7" display-inline="no-display-inline"><enum>(e)</enum><header>Routinely administered vaccines</header> <paragraph id="HA82EEC87FED647A3B841C4F85A7E0BC0"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/4132">Section 4132(a)(1)</external-xref> of the Internal Revenue Code of 1986, as amended by subsection (d)(1), is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H9C244EAE670B4D53BD5647CEAE2E2ABD"><enum>(U)</enum><text>Any vaccine not described in this paragraph—</text> <clause id="H70982EDEE0C248E89CCC92592BCB748F" commented="no"><enum>(i)</enum><text>which either—</text> 
<subclause id="HEB5FCBBF0DA449D59E962B849FB36085" commented="no"><enum>(I)</enum><text>is licensed under section 351 of the Public Health Service Act, or</text></subclause> <subclause id="H740C58D08A8F413FA2CB12364D65621F" commented="no"><enum>(II)</enum><text>is authorized for emergency use under section 564 of the Federal Food, Drug, and Cosmetic Act, and</text></subclause></clause> 
<clause id="H7F3D148AE5B843119733FA6BE7FE41C5" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>which is commercially distributed in the United States.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H02A98334426246BEA8B89E6DFA340377"><enum>(2)</enum><header>Effective date</header> <subparagraph id="H83AEC55190EB43A9B5431A296F42C8F9"><enum>(A)</enum><header>Sales, etc</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to sales and uses of vaccines described in subparagraph (U) of <external-xref legal-doc="usc" parsable-cite="usc/26/4132">section 4132(a)(1)</external-xref> of the Internal Revenue Code of 1986, as amended by paragraph (1), on or after the later of—</text> 
<clause id="HDCE7AAFE7FF64B0486B6102978BE86C8" display-inline="no-display-inline"><enum>(i)</enum><text>the first day of the first month which begins more than 4 weeks after the date of the enactment of this Act, or</text></clause> <clause id="H3AF46BBFBD654B71A7FF8C5CF0D42B16"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which the Secretary of Health and Human Services lists any such vaccine (other than any such vaccine listed by the Secretary prior to the date of the enactment of this Act) for purposes of compensation for any vaccine-related injury or death through the Vaccine Injury Compensation Trust Fund.</text></clause></subparagraph> 
<subparagraph id="H284FDE54C06445E09BB80F829B2F58A9"><enum>(B)</enum><header>Deliveries</header><text>For purposes of subparagraph (A) and <external-xref legal-doc="usc" parsable-cite="usc/26/4131">section 4131</external-xref> of the Internal Revenue Code of 1986, in the case of sales on or before the effective date described in such subparagraph for which delivery is made after such date, the delivery date shall be considered the sale date.</text></subparagraph></paragraph></subsection> <subsection id="H96158996E1F4472E9A9476F28F2B394D" commented="no"><enum>(f)</enum><header>Clarification of definition of vaccine</header> <paragraph id="HF1E4983225ED45D6922E5399436EA86D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/4132">Section 4132(a)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>by stimulating active immunity or by providing passive immunity for long-term protection through long-acting monoclonal antibody products included in recommendations of the Advisory Committee on Immunization Practices that have been adopted by the Director of the Centers for Disease Control and Prevention</quote> before the period.</text></paragraph> 
<paragraph id="HF684E8AD89C7431985FF533BDF2400A1" commented="no"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to sales and uses on or after the date of the enactment of this Act.</text></paragraph></subsection> <subsection id="H86E974911D4040ED8B111FF7B05665ED" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Notification requirement</header> <paragraph id="H1D376DED2C634D34AF54D2FD8A128A9E" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after a vaccine—</text> 
<subparagraph id="HEC4E1103FA9B44CA82F0C7E40B8DAF2B" commented="no"><enum>(A)</enum><text>is either—</text> <clause id="HA53F134B63984615AD59643D8333632E" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">licensed under section 351 of the Public Health Service Act, or</text></clause> 
<clause id="H272840DE27C14DC3BD07ED6D5780301B" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">authorized for emergency use under section 564 of the Federal Food, Drug, and Cosmetic Act, and</text></clause></subparagraph> <subparagraph id="H367C7EA7C5274DC3B5396EE757F501E5" commented="no"><enum>(B)</enum><text>is first commercially distributed in the United States,</text></subparagraph><continuation-text commented="no" continuation-text-level="paragraph">the Secretary of Health and Human Services shall provide notice of such license or authorization to the appropriate recipients.</continuation-text></paragraph> 
<paragraph id="HD57E9158393F4A0F8CEDAB27F9D38BA5" commented="no"><enum>(2)</enum><header>Appropriate recipients</header><text>For purposes of paragraph (1), the term <term>appropriate recipients</term> means—</text> <subparagraph id="H65D39B518650415D824DD07D350E93B9" commented="no"><enum>(A)</enum><text>the Secretary of the Treasury,</text></subparagraph> 
<subparagraph id="HE61AED8BFEE94BB8826F7C03D35DEB00" commented="no"><enum>(B)</enum><text>the Committees on Ways and Means and Energy and Commerce of the House of Representatives, and</text></subparagraph> <subparagraph id="H284812379A1B476B85E02E30E943AABD" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>the Committees on Finance and Health, Education, Labor, and Pensions of the Senate.</text></subparagraph></paragraph></subsection></section> 
<section id="H0132D32B032B4B0C8B2526925B7B908B"><enum>6.</enum><header>Increase in vaccine excise tax</header> 
<subsection id="HA0AB5A1A20994CBDB3E9B63BC6122677"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/4131">Section 4131(b)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>75 cents</quote> and inserting <quote>$2.20</quote>.</text></subsection> <subsection id="H9AD8F77427844A32BB0B48F1BCEE4A96"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply to sales and uses on or after the first day of the first month which begins more than 6 months after the date of the enactment of this Act.</text></subsection></section>
