<section id="H856637012FF04C66B22692EF795DA985" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Police Security Enhancement Act</short-title></quote>.</text></section> 
<section id="HC4B0AB010D2A473783FC85F746A4D402"><enum>2.</enum><header>Department of Veterans Affairs Police Security Enhancement</header> 
<subsection id="H9C017A229889418898DEB7651889C5B1"><enum>(a)</enum><header>Department property</header><text display-inline="yes-display-inline">Section 901 of title 38, United States Code, is amended, in subsection (a)(2), by adding at the end the following:</text> <quoted-block style="OLC" id="H20D980BB544C40829574D6D2A778E380" display-inline="yes-display-inline"><text display-inline="yes-display-inline">Such term includes—</text><list level="subparagraph"><list-item>(A) land and buildings that are occupied by or under the custody or control of the Department;</list-item><list-item>(B) land and buildings leased by or on behalf of the Department;</list-item><list-item>(C) land and buildings leased by the Department to another entity, including property subject to an enhanced use lease agreement; and</list-item><list-item>(D) the area immediately surrounding such land or buildings.</list-item></list><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H9A34BD860FE045C08E85506DF018810F"><enum>(b)</enum><header>Memoranda of Understanding</header><text>Such section is further amended by adding at the end the following new subsection:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H474A6CFE3D494161AC4DB905F7F7BCB9"> <subsection id="H1BA8A48F3B044D4D8386325288C22BC2"> <enum>(g)</enum> <text display-inline="yes-display-inline">The Secretary shall seek to enter into memoranda of understanding with the appropriate local, State, and Federal law enforcement agencies to facilitate the exercise of authority by Department police officers on Department property under the jurisdiction of such agencies.</text>
                                        </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8AB72FC4EE45487D845DE5FC1D9665EF"><enum>(c)</enum><header>Authorities of Department police officers</header><text>Section 902(a) of such title is amended—</text> <paragraph id="H91E7DBF9F64A40908EF1726A910D5219"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text> 
<subparagraph id="HA0C83D5771B1445AAAAFC05E05B13CDA"><enum>(A)</enum><text>in subparagraph (F), by striking <quote>(E)</quote> and inserting <quote>(G)</quote>;</text></subparagraph> <subparagraph id="HF0B8140599C1481596D227A0E2C9D67E"><enum>(B)</enum><text>by redesignating subparagraphs (C) through (F) as subparagraphs (E) through (H), respectively; and</text></subparagraph> 
<subparagraph id="H1D461D61016E47379AD2A5B4E7232095"><enum>(C)</enum><text>by inserting after clause (B) the following new clauses:</text> <quoted-block style="USC" id="H16CA4A9B084149E0B560E7ABDD808A23" display-inline="no-display-inline"> <subparagraph id="HBCCC0D006A5B4DCEB3B062C74C10C7EB" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Protect veterans, officials and employees of the Department, other individuals, and Department property;</text></subparagraph> 
<subparagraph id="H0C4065E7F0704ABA991A17FD1752EF96" indent="up1"><enum>(D)</enum><text>Ensure the physical security and operational continuity of facilities of the Department;</text></subparagraph> <subparagraph id="HF78728F7E2364015831E247A0CB4F20C" indent="up1"><enum>(E)</enum><text>Carry out other such security functions as are expressly authorized by statute;</text> </subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HEF494E65A88C499A93DCDA744C856842"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text> <quoted-block style="USC" id="HCF7DCD7E5ED44EA8ACEED5DC99234B93" display-inline="no-display-inline"> <paragraph id="H32DF9EE5050F484DBC051C4AC9788724" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The authorities under paragraph (1) may be exercised off Department property only when—</text> 
<subparagraph id="H661F43E9C61B47149B4C8DBCECD2BC82"><enum>(A)</enum><text>necessary to protect officials or employees of the Department and Department property;</text></subparagraph> <subparagraph id="HA2D0EC3A61084422B2B7EA567801739A"><enum>(B)</enum><text>in hot pursuit; or</text></subparagraph> 
<subparagraph id="H46B21BD9CA99479DBC4B722632021201"><enum>(C)</enum><text>pursuant to a written agreement under section 901(g) of this title.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HBA51677592464B29B86346C9D69DA3C0"><enum>(d)</enum><header>Facility security; oversight</header><text>Such section is further amended by adding at the end the following new subsections:</text> 
<quoted-block style="USC" id="H357D5872630F46A38B6BA207AE1F5C6A" display-inline="no-display-inline"> 
<subsection id="H061761D1BD20483891F84FB18EE47A03"><enum>(e)</enum><header>Facility security modernization</header><text display-inline="yes-display-inline">The Secretary shall implement measures to enhance security at facilities of the Department, including—</text> <paragraph id="HFB5C93053B9245389B60824762145587"><enum>(1)</enum><text>access controls;</text></paragraph> 
<paragraph id="H7B3E93F3CE82458087A2ADF0764FEA4C"><enum>(2)</enum><text>surveillance systems;</text></paragraph> <paragraph id="H59E4D2BFED47490CA83B6B1B1EC8417F"><enum>(3)</enum><text>rapid response protocols; and</text></paragraph> 
<paragraph id="HA9966D08E76347C3A7F8ECAFA0DC5B0E"><enum>(4)</enum><text>coordination with other law enforcement agencies.</text></paragraph></subsection> <subsection id="HCDF14AD7EE014CA081231D675DC605B0"><enum>(f)</enum><header>Congressional oversight and report</header> <paragraph id="H143EEBE48FBE405585D30225933FF83A" display-inline="yes-display-inline"><enum>(1)</enum><text>Upon request of the Committee on Veterans’ Affairs of the House of Representatives or the Senate, the Secretary, without delay or nonstatutory conditions, shall provide—</text> 
<subparagraph id="H511D242D732447C48A5287013682C6DB" indent="up1"><enum>(A)</enum><text>policies and directives under this chapter;</text></subparagraph> <subparagraph id="HEB7C404F1FC84D2595F0014D33DE5056" indent="up1"><enum>(B)</enum><text>data on arrests and use of force by Department police officers; and</text></subparagraph> 
<subparagraph id="H113C6F287982444B8CA52F64A325F2A4" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">briefings regarding the operations of Department police officers.</text></subparagraph></paragraph> <paragraph id="H8C857500738A4307BDE53354ED90B932" indent="up1"><enum>(2)</enum><text>The Secretary shall submit to Congress an annual report including—</text> 
<subparagraph id="H0BFBAC7CC161448CA45BF2C413F65572"><enum>(A)</enum><text>a description of staffing levels of Department police officers;</text></subparagraph> <subparagraph id="H9B42F64281524B2A815C62ACD1647FCA"><enum>(B)</enum><text>an identification of capability gaps among Department police officers;</text></subparagraph> 
<subparagraph id="H58CEDA9510034B2DA8117F1806A6F128"><enum>(C)</enum><text>a description of the training of Department police officers; and</text></subparagraph> <subparagraph id="HE53FADD8A823434D9D8DAB34A399D275"><enum>(D)</enum><text>a description of enforcement activity of Department police officers in the year preceding the report.</text></subparagraph> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC08D4EBA39D047849C83D8B31EB18EF8"><enum>(e)</enum><header>Police security and operations account</header> 
<paragraph id="H94182F2DC6C94113A55A941A97509123"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Chapter 9 of such title is amended by adding at the end the following new section:</text> <quoted-block style="USC" id="H1397679532054CB4B1609EF7065ABAFD" display-inline="no-display-inline"> <section id="H2E7A430FE7A742C68FD7E79E8211DFE3"><enum>906.</enum><header>Veterans Affairs Police and Security Operations Account</header> <subsection id="HB3EDEA77C0FE4697B59FCCA49E8ECC61"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is hereby established in the Treasury a separate account to be known as the <quote>Veterans Affairs Police and Security Operations Account</quote>.</text></subsection> 
<subsection id="H6FC0BD4AD794461ABFBE89B10CBB930B"><enum>(b)</enum><header>Deposits</header><text>There shall be deposited in the account such amounts as may be appropriated pursuant to subsection (c).</text></subsection> <subsection id="HAEF35AA3216F42498ADA249310F5366C"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the account amounts for the following purposes:</text> 
<paragraph id="H11B6CCB5816E4A7E8142AE5B3BAA6D36"><enum>(1)</enum><text>Employment and training of Department police officers.</text></paragraph> <paragraph id="H0FAD4CC15B0247FCA133D1FA171774BD"><enum>(2)</enum><text>Security infrastructure.</text></paragraph> 
<paragraph id="HF583DFD0DC1D49DD804D49CB472A1F41"><enum>(3)</enum><text>Interagency coordination.</text></paragraph></subsection> <subsection id="HDFF452F6852347038F96E46ADDFCFD14"><enum>(d)</enum><header>Sunset</header><text>This section shall cease to have effect on the date that is three years after the date of the enactment of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE6AAF4C3CD5B45858C9B639DED216A3F"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents at the beginning of such chapter is amended by adding at the end the following new item:</text> <quoted-block style="USC" id="HF8A2D91F640640CCB42E88D7AA633B57" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">906. Veterans Affairs Police and Security Operations Account.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HE06E33767D7A4B4DB439B692DF064600"><enum>(f)</enum><header>Implementation</header><text display-inline="yes-display-inline">Not later than 180 days after the enactment of this Act, the Secretary shall prescribe regulations to enforce the amendments made by this Act.</text></subsection> 
<subsection id="HACB65D5FBD7D481E82D75BD74728DFE9"><enum>(g)</enum><header>Report</header><text>Not later than two years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report evaluating—</text> <paragraph id="HC1B18D45A4FE44FE9FF0E60F7C49447A"><enum>(1)</enum><text>the effectiveness of the authorities provided under sections 901 and 902 of title 38, United States Code;</text></paragraph> 
<paragraph id="H6CC8B716EFA1423997DB7D9AA9F27C3F"><enum>(2)</enum><text>coordination with Federal, State, and local law enforcement;</text></paragraph> <paragraph id="H57BAE1F613864791B7F01DBFD2A9B629"><enum>(3)</enum><text>the adequacy of the training and operational standards of Department of Veterans Affairs police officers; and</text></paragraph> 
<paragraph id="HD852DA6442554DEC98A4C9146EE84F52"><enum>(4)</enum><text display-inline="yes-display-inline">recommendations for the continuation, modification, or termination of the authorities provided under such sections.</text></paragraph></subsection> </section> </legis-body></bill>
