<section id="HF9B52B46DF1B451594F2C51B2A3FFC5B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State Standing Committee Act</short-title></quote>.</text></section> <section id="H8C2E0482E3394F4587E1966B5AE65A1F"><enum>2.</enum><header>State Standing Committee of the Environmental Protection Agency</header><text display-inline="no-display-inline">The Environmental Research, Development, and Demonstration Authorization Act of 1978 is amended—</text> 
<paragraph id="H9F08A6D6F56442B281B3EE1BF2F8CD5C"><enum>(1)</enum><text>by inserting after section 8 (<external-xref legal-doc="usc" parsable-cite="usc/42/4365">42 U.S.C. 4365</external-xref>) the following new section:</text> <quoted-block style="OLC" id="H737C780235F449CF8DBCE59617334F5F" display-inline="no-display-inline"> <section id="H7E5D65B997E74E2EAFD8B4CCE4E4133B"><enum>8A.</enum><header>State Standing Committee</header> <subsection id="H822C5222FBD244CE8269708A08CAAD23"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Environmental Protection Agency the State Standing Committee (in this section referred to as the <quote>Committee</quote>).</text></subsection> 
<subsection id="HFA3A6345F1B44A71BA57AA009421A787"><enum>(b)</enum><header>Membership</header> 
<paragraph id="H5DD9ECB77B78413DA8080405EB4D0A29"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Committee shall be composed of one member from each State, Federal district, Federal territory, or Federally recognized Tribe (as such term is defined in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>)).</text></paragraph> <paragraph id="H19B01FE97D984A758370FC3B027EE1A7"><enum>(2)</enum><header>Qualifications</header><text>Each member of the Committee shall satisfy the following requirements:</text> 
<subparagraph id="HC5BAC82929EB488DA7997A9EEACA457F"><enum>(A)</enum><text>Reside in the State, Federal district, or Federal territory, or be a member of the Federally recognized Tribe, such member represents under paragraph (1).</text></subparagraph> <subparagraph id="H3BF562EB5C924FF8B592A3BE50D5DB00"><enum>(B)</enum><text>Be an employee of a government agency that satisfies the following requirements:</text> 
<clause id="H8CD9E862B21745F8ACB2B16B1BB03E9B"><enum>(i)</enum><text>Is of such State, Federal district, Federal territory, or Federally recognized Tribe, as the case may be.</text></clause> <clause id="H0407AE4A3E3E434599B76372D8DDA8B5"><enum>(ii)</enum><text>Is an environmental agency, natural resource agency, agricultural agency, or other agency responsible for regulatory compliance with environmental standards.</text></clause></subparagraph> 
<subparagraph id="HCC885AEE308B43E2A9616C6372C7901F"><enum>(C)</enum><text display-inline="yes-display-inline">Be qualified by education, training, or experience to evaluate scientific or technical information relevant to such State, Federal district, Federal territory, or Federally recognized Tribe, as the case may be.</text></subparagraph></paragraph> <paragraph id="HD7CC48A0D7664909982C8850E07FE75D"><enum>(3)</enum><header>Prohibitions</header><text display-inline="yes-display-inline">A member of the Committee may not be any of the following:</text> 
<subparagraph id="H7D692F92822E4B4A8CF890B715DC47A5"><enum>(A)</enum><text>A member or employee of the Science Advisory Board established under section 8 (in this section referred to as the <quote>Board</quote>).</text></subparagraph> <subparagraph id="H96CAA38211AD41C3883DDF3DCB515ECB"><enum>(B)</enum><text>Except as provided in paragraph (2)(B), an employee of the Federal Government.</text></subparagraph></paragraph></subsection> 
<subsection id="HFA85671B88344039A820BADA4494474B"><enum>(c)</enum><header>Appointment</header> 
<paragraph id="H70F67B0860654B75A5197DFCC5C39445"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency (in this section referred to as the <quote>Administrator</quote>) and the Board shall appoint through an open, competitive, and merit-based process the members of the Committee, who shall serve without pay and on a voluntary, ad hoc basis.</text></paragraph> <paragraph id="HCACFF401501642CA91587EFA65328907"><enum>(2)</enum><header>Vacancies</header><text display-inline="yes-display-inline">If a vacancy exists on the Committee, not later than 90 days after the date on which such vacancy began, the Administrator and the Board shall fill such vacancy in the manner in which the original appointment was made.</text></paragraph></subsection> 
<subsection id="HA7B306383C27431F95790D2A97946E27"><enum>(d)</enum><header>Advice</header> 
<paragraph id="H96221693BF4C41BD805A2F5DF40FB119"><enum>(1)</enum><header>Committee</header><text>The Committee may provide to the Administrator and the Board scientific or technical advice, including majority and minority views, as applicable, on matters specified in subsection (h), regardless of the following:</text> <subparagraph id="H02AFDC81EDC34196B60E0D6FC41CE47F"><enum>(A)</enum><text>Whether such matters are referred to the Committee by the Administrator or the Board.</text></subparagraph> 
<subparagraph id="HBD6654BD2D6A48F8A07350673AC2D6D0"><enum>(B)</enum><text>Whether the Committee reaches a majority consensus with respect to such advice.</text></subparagraph></paragraph> <paragraph id="H3288089550F542BFBC0D5FA14750408D"><enum>(2)</enum><header>Member</header> <subparagraph id="HC97D48083D1E463FB6263D6E80336F18"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), a member of the Committee may provide to the Administrator and the Board scientific or technical advice on matters specified in subsection (h) if such advice concerns, to the extent practicable, the State, Federal district, Federal territory, or Federally recognized Tribe such member represents under subsection (b)(1).</text></subparagraph> 
<subparagraph id="H14BF82A1B99A4025ADC6B01F8D036B0D"><enum>(B)</enum><header>Prohibitions</header><text>Neither the Committee nor a member of the Committee may prohibit advice from being provided pursuant to subparagraph (A).</text></subparagraph></paragraph></subsection> <subsection id="HD0AD582B822A4105A5FB3C84E0626111"><enum>(e)</enum><header>Working groups</header><text>The Committee may establish working groups with respect to matters specified in subsection (h) that concern one or more States, Federal districts, Federal territories, or Federally recognized Tribes.</text></subsection> 
<subsection id="HE99183F76F38406FAECEDA72A1DB0476"><enum>(f)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 30 days after advice is provided pursuant to paragraph (1) or (2)(A) of subsection (d), the Administrator shall make publicly available on a website of the Environmental Protection Agency such advice.</text></subsection> <subsection id="H6DB3F98029D9408A89A7AA8373075B0B"><enum>(g)</enum><header>Federal Advisory Committee Act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code, (commonly referred to as the Federal Advisory Committee Act) does not apply to the Committee.</text></subsection> 
<subsection id="H445DC72DD2DA4894B8B052CE48D51B44"><enum>(h)</enum><header>Matters specified</header><text display-inline="yes-display-inline">The matters specified in this subsection are matters under any of the following:</text> <paragraph id="H0E4BBBCA15854B1690D6962C6809483B"><enum>(1)</enum><text>The Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>).</text></paragraph> 
<paragraph id="H6AA30E148A0C4A239F5D673287C7E5EB"><enum>(2)</enum><text>The Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>).</text></paragraph> <paragraph id="H98EEA6A53E0B421CAB8CA5E7A8421359" commented="no"><enum>(3)</enum><text>The Resource Conservation and Recovery Act of 1976.</text></paragraph> 
<paragraph id="H05CE5648F9EA458C8791EA443448184D"><enum>(4)</enum><text>The Noise Control Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/42/4901">42 U.S.C. 4901 et seq.</external-xref>).</text></paragraph> <paragraph id="H6BDF27F151314968B4A9B7752D269596"><enum>(5)</enum><text>The Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601 et seq.</external-xref>).</text></paragraph> 
<paragraph id="HA85F961A43234A9BA41F5AB109775F94"><enum>(6)</enum><text display-inline="yes-display-inline">The Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136 et seq.</external-xref>).</text></paragraph> <paragraph id="H2CB0E94BBA844D72BE7C5753CE51551A"><enum>(7)</enum><text>The Comprehensive Environmental Response, Compensation, and Liability Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>).</text></paragraph> 
<paragraph id="H98C04F961E534B55B9B29B7C77848307"><enum>(8)</enum><text>The Pollution Prevention Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13101">42 U.S.C. 13101 et seq.</external-xref>).</text></paragraph> <paragraph id="HBCF492236A7249339AA7354861E226A9"><enum>(9)</enum><text>The Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>).</text></paragraph> 
<paragraph id="H286580F8426A440FB722AC8AFD5505B7"><enum>(10)</enum><text>Subsection (e)(2)(C) of section 8.</text></paragraph> <paragraph id="H55E4C2AA7C014EE8A52FE3E5BAE2AF1D"><enum>(11)</enum><text>Any other authority of the Administrator.</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5328B98256C1499EA0C5BB6C92279C51"><enum>(2)</enum><text>in section 8 (relating to the Science Advisory Board)—</text> <subparagraph id="H516F5181AEAD40B897BE6BFD9FF978E6"><enum>(A)</enum><text>in subsection (a), by striking <quote>the Administrator,</quote> and all that follows through the period and inserting <quote>the Administrator or an appropriate committee of Congress.</quote>;</text></subparagraph> 
<subparagraph id="H31BBBCAE2DE345FA89E0B0AB6ACC5A0D"><enum>(B)</enum><text>in subsection (c)(1) (relating to matters before the Board)—</text> <clause id="H8034E3FE3B4147F2ACFC92D37220B9C1"><enum>(i)</enum><text>by striking the comma after <quote>Resource</quote>;</text></clause> 
<clause id="H3F3EAEECD6EC41039AAC2569372A1F0B"><enum>(ii)</enum><text>by inserting <quote>of 1972</quote> after <quote>Noise Control Act</quote>; and</text></clause> <clause id="H6DFC96CC9B2F49488584EDB1E7B3F93F"><enum>(iii)</enum><text>by inserting <quote>the Federal Insecticide, Fungicide, and Rodenticide Act, the Comprehensive Environmental Response, Compensation, and Liability Act, the Pollution Prevention Act of 1990,</quote> after <quote>Substances Control Act,</quote>;</text></clause></subparagraph> 
<subparagraph id="H9C5115D3244D48E78514B7C1C38AC01F"><enum>(C)</enum><text>by amending subsection (i) to read as follows:</text> <quoted-block style="OLC" id="H855DDC5D79D04F7C90800DEC20591ED3" display-inline="no-display-inline"> <subsection id="HD23E5EF129C742A1AD305C587227BD3F"><enum>(i)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this sentence and annually thereafter, the Administrator shall submit to each appropriate committee of Congress a report regarding the membership and activities of, and the advice and comments provided by, the following for the annual period covered by such report:</text> 
<paragraph id="H428C15A03A324DA8866C3FC82B353E69"><enum>(1)</enum><text>The Board, including each committee and investigative panel established under subsection (e).</text></paragraph> <paragraph id="H15283B0874C445EB86E5DFD012D71069"><enum>(2)</enum><text display-inline="yes-display-inline">The State Standing Committee under section 8A.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H405ECB8A5AD444D1B9774C895CE87C9C"><enum>(D)</enum><text>by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="HC79D6667703547E1B090D80D271EFC23" display-inline="no-display-inline"> <subsection id="H94CF33E6588D4A28BE9DC97F754DFE24"><enum>(j)</enum><header>Appropriate committee of Congress defined</header><text display-inline="yes-display-inline">In this section, the term <term>appropriate committee of Congress</term> means any of the following:</text> 
<paragraph id="HEE6503ADDAD9448989778C0AD28D8C76"><enum>(1)</enum><text>The Committee on Science, Space, and Technology of the House of Representatives.</text></paragraph> <paragraph id="H08977E4D61EE462D97F724483F2B182B"><enum>(2)</enum><text>The Committee on Environment and Public Works of the Senate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section>
