<section id="HE731E92FE6D1497EB623D3DDE9285F94" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Regulatory Modernization Act of 2026</short-title></quote>.</text></section> <section id="HC1CAB3F4022A4ECDA906D60EAD607F81"><enum>2.</enum><header>Improvements relating to mandatory Nuclear Regulatory Commission hearings</header> <subsection id="H73106C7E54794615AABA61CA68CDBC0F"><enum>(a)</enum><header>Hearings and judicial review</header><text>Section 189 a. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2239">42 U.S.C. 2239(a)</external-xref>) is amended—</text> 
<paragraph id="H72C11A48835C4725962ABDB897FD124D"><enum>(1)</enum><text>in paragraph (1)(A)—</text> <subparagraph id="HEDC008F8E1B84D24BA64EB843D662F21"><enum>(A)</enum><text>by striking <quote>In any proceeding under this Act</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="HB9E6EB6C89A14AA4B567A9A97AA8E223" display-inline="no-display-inline"> 
<clause id="H7137275798B04F728893393BC5989FB1" indent="up3"><enum>(i)</enum><text display-inline="yes-display-inline">In any proceeding under this Act</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H67686BBFA1244688810B5DD66615AD91"><enum>(B)</enum><text>in clause (i) (as so designated), by striking <quote>The Commission shall hold a hearing</quote> and all that follows through <quote>upon a determination by the Commission that the amendment involves no significant hazards consideration.</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="H89E4F82D8EC7471EBFE30AF8523D6798" display-inline="no-display-inline"> 
<clause id="H3966A8BB8C1846F188EDD55248E1E293" indent="up3"><enum>(ii)</enum><text display-inline="yes-display-inline">The Commission may, in the absence of a request for a hearing by any person whose interest may be affected, issue a construction permit, an operating license, a combined construction permit and operating license, an amendment to a construction permit, an amendment to an operating license, or an amendment to a combined construction permit and operating license under section 103, 104 b., 104 c., or 185 b. for a facility or a testing facility, without a hearing, but upon thirty days notice and publication once in the Federal Register of its intent to do so. The Commission may dispense with such thirty days notice and publication with respect to any application for an amendment to a construction permit, an amendment to an operating license, or an amendment to a combined construction permit and operating license upon a determination by the Commission that the amendment involves no significant hazards consideration.</text></clause> <clause id="H4712E3B8BA554E808985B75F09FAFA19" indent="up3" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">The Commission may use informal adjudicatory procedures for any hearing held by the Commission pursuant to this subparagraph.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HBB76E4ABAD2948128868BD0BC1FE4292"><enum>(2)</enum><text>in paragraph (1)(B)(iv)—</text> <subparagraph id="H5DC97E7C29B8425EAF5D24327D219C33"><enum>(A)</enum><text>by inserting <quote>informal</quote> before <quote>hearing procedures</quote>; and</text></subparagraph> 
<subparagraph id="HE43582BA0B02488999FA0A0D6B128239"><enum>(B)</enum><text>by striking <quote>, whether informal or formal adjudicatory,</quote>; and</text></subparagraph></paragraph> <paragraph id="HAA842B6A8ECC4646A7D05FBC4734813D"><enum>(3)</enum><text>in the second sentence of paragraph (2)(A), by striking <quote>required hearing</quote> and inserting <quote>hearing held by the Commission under this section</quote>.</text></paragraph></subsection> 
<subsection id="H210A8B36A44748FF892EA9732E18EC7A" commented="no"><enum>(b)</enum><header>Construction permits and operating licenses</header><text display-inline="yes-display-inline">Section 185 b. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2235">42 U.S.C. 2235(b)</external-xref>) is amended by striking <quote>After holding a public hearing under section 189 a. (1)(A),</quote> and inserting <quote>After the thirty days notice and publication period or holding a hearing, as applicable, under section 189 a. (1)(A),</quote>.</text></subsection> <subsection id="H6F9EFEF729A04E77A8004749FE402C77"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to all applications and proceedings pending before the Nuclear Regulatory Commission on or after the date of enactment of this section.</text></subsection></section> 
<section id="H1074987F5D77496CA7B590D4BADD9036"><enum>3.</enum><header>Construction-at-risk authorization for uranium enrichment facilities</header> 
<subsection id="HC8ED317ED93A4E34A5495E7BFEF80B43"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text> <paragraph id="HC212A18991B544F1B1AF75841FBEAD49"><enum>(1)</enum><text display-inline="yes-display-inline">the prohibition on the importation of uranium from the Russian Federation pursuant to the Prohibiting Russian Uranium Imports Act (<external-xref legal-doc="public-law" parsable-cite="pl/118/62">Public Law 118–62</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011</external-xref> note et seq.) should continue to apply; and</text></paragraph> 
<paragraph id="H46A96F39FC014E5BA714162E6B1AD2BA"><enum>(2)</enum><text display-inline="yes-display-inline">this section, and the amendments made by this section, should be carried out in a manner consistent with such prohibition.</text></paragraph></subsection> <subsection id="HC4E907BF614D41D3857FDEA9AE24C28C"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">Section 193 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2243">42 U.S.C. 2243</external-xref>) is amended—</text> 
<paragraph id="HABD874F78D8D48C483584AC6667A2D9C" commented="no"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HFBC441F74D3E459A8FE53218B2D9C160"> <subsection id="H243C7A03941A45A7B72AD25944087C86" commented="no"> <enum>(a)</enum> <header>At-Risk construction</header> <paragraph id="H42FE8BBD99684CAC83F4E21EE2368BC0"> <enum>(1)</enum> <header>In general</header> <text>Commencement of construction of a uranium enrichment facility prior to the issuance of a license under sections 53 and 63 for that facility shall be permitted under the same terms and conditions applicable to other fuel cycle facilities licensed under such sections.</text>
              </paragraph>
              <paragraph id="H059ED02D68ED45558E8C2321CA43DCA5">
                <enum>(2)</enum>
                <header>Rule of construction</header>
 <text display-inline="yes-display-inline">Nothing in this subsection shall be construed to affect—</text>
                <subparagraph id="H29FA4EDCADA34D178B36C0C5CAECCA37">
                  <enum>(A)</enum>
 <text>the authority of the Nuclear Regulatory Commission to regulate construction as necessary for issuing a license under sections 53 and 63 for a uranium enrichment facility, including the authority to deny an application for such a license for the failure of an applicant to construct such a facility in accordance with regulatory requirements; or</text>
                </subparagraph>
                <subparagraph id="H4B7C72293B0647119B9CAF27FBC7625F">
                  <enum>(B)</enum>
 <text display-inline="yes-display-inline">the right of any person whose interest may be affected by a proceeding under this Act to a hearing under section 189.</text>
                </subparagraph>
              </paragraph>
            </subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H3D8367C8848D489DA356639BDD249CB2"><enum>(2)</enum><text>by striking subsection (b);</text></paragraph> <paragraph id="H6A7E4C9C11E949329C54C6FC155DD05B"><enum>(3)</enum><text>by redesignating subsections (c) through (f) as subsections (b) through (e), respectively; and</text></paragraph> 
<paragraph id="H1CCD11D6178C4DD791129A5B86BA7D9C"><enum>(4)</enum><text>in the first sentence of subsection (b), as so redesignated, by striking <quote>construction and</quote>.</text> </paragraph> </subsection> <subsection id="H2A0A2D5D91524551BE843D49E7E13DC9"><enum>(c)</enum><header>Regulations required</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Nuclear Regulatory Commission shall issue or revise regulations to carry out this section and the amendments made by this section.</text></subsection></section>
