<section id="H87A5BB1AEEFA4D62A3A66D850888AFE1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Limiting Excessive Government Obstruction Act</short-title></quote>.</text> </section> <section id="HB9978389D8624994AD0D260FB894A315"><enum>2.</enum><header>Agency adjudications</header> <subsection id="H76BB45F436A64DAE969C7C14F26F9DEB"><enum>(a)</enum><header>Adjudications</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">Chapter 7</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/706">section 706</external-xref> the following: </text>

<section id="HDD52CEBCC0CE4F1EA8F877927BD724D8"><enum>706A.</enum><header>Special rules for certain agency adjudications</header> 
<subsection id="HBE6AD09D6B35473CA4A2E1A2EC4173ED"><enum>(a)</enum><header>Agency adjudication</header> 
<paragraph id="HAB2016A7CD8C402DA1F3008B7446E5A3"><enum>(1)</enum><header>Demurrer</header><text>Except as provided in subsection (c), a party against whom an agency adjudication is initiated may file with the adjudicator a demurrer.</text></paragraph> <paragraph id="H043F2CF6E07C49688B74B31C868A1C8E"><enum>(2)</enum><header>Final order of dismissal</header><text>If the party makes a filing described in paragraph (1), the adjudicator shall issue a final order of dismissal with prejudice.</text></paragraph></subsection> 
<subsection id="H36E7EA9A45924BDC971A92E221AF772D"><enum>(b)</enum><header>Civil action</header> 
<paragraph id="HB48418EC6E374A3096F5264606ED6EE8"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after an agency adjudication is dismissed with respect to a party under subsection (a), the agency may commence a civil action against such party in the district court for the district in which the alleged violation occurred setting forth the violations alleged in such agency adjudication. No such action may be commenced after the expiration of such 90-day period.</text></paragraph> <paragraph id="H0277C8B4622E4E0599E4E07008D9108C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Jury trial</header><text display-inline="yes-display-inline">A defendant in an action described in paragraph (1) shall be entitled to a trial by jury.</text></paragraph> 
<paragraph id="H3DA5C78A3C3B4F2B941416D8CDC103E0" commented="no"><enum>(3)</enum><header>Defense</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, it shall be a defense to an action described in paragraph (1) that an alleged violation of an agency rule, order, or consent decree was reasonable under the circumstances.</text></paragraph></subsection> <subsection id="H9185059661C245748CF1E66C74ACAF96" display-inline="no-display-inline"><enum>(c)</enum><header>Exceptions</header> <paragraph id="H10C36F23CB0146C28501A18CBAEF3E2B"><enum>(1)</enum><header>In general</header><text>This section does not apply with respect to any matter pertaining to—</text> 
<subparagraph id="HB9C2CA9301CA42629C8706867156B6F1"><enum>(A)</enum><text>the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act);</text></subparagraph> <subparagraph id="H282D2B67D1A34127AEF9115A765DF873"><enum>(B)</enum><text>national security;</text></subparagraph> 
<subparagraph id="H1DCEC907B52549D0B4B01DE1807C3514"><enum>(C)</enum><text>the Internal Revenue Code of 1986;</text></subparagraph> <subparagraph id="HF2D6C343C1514BBABAEAB4EF9F2DDFC2"><enum>(D)</enum><text>bankruptcy;</text></subparagraph> 
<subparagraph id="HE354CCBD319B44A7949C601DD78E845F"><enum>(E)</enum><text>patent; or</text></subparagraph> <subparagraph id="HA171C5B2D1EF4C8F92A8464E7718F1F2"><enum>(F)</enum><text>a Federal benefit.</text></subparagraph></paragraph> 
<paragraph id="H16BFE3532CF5414084A5AFA0B824BC49"><enum>(2)</enum><header>Federal benefit defined</header><text display-inline="yes-display-inline">In this section, the term <term>Federal benefit</term> means any retirement, welfare, health, disability, public or assisted housing, postsecondary education, food assistance, unemployment benefit, or any other similar benefit for which payments or assistance are provided to an individual, household, or family eligibility unit by an agency of the United States or by appropriated funds of the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H72840F9DA9B84476B3B2AADC0BA03414"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 701(b)(2) of title 5, United States Code, is amended by striking <quote><quote>relief</quote>, and <quote>agency action</quote></quote> and inserting <quote><quote>relief</quote>, <quote>party</quote>, <quote>adjudication</quote>, and <quote>agency action</quote></quote>.</text></subsection>
