<section id="H49EAF663C57A4385AB13A9FEF5BDF263" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vessel Identification Protection Act of 2026</short-title></quote>.</text></section> <section id="H0CE4A359038146B5A587883985A09089" section-type="subsequent-section"><enum>2.</enum><header>Unauthorized vessel identification numbers</header> <subsection id="H83DFD7FB4EF04A61B2C0B9CFE131D3A4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/25">Chapter 25</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/507">section 507</external-xref> the following:</text> 
<quoted-block style="USC" id="H94857C11904447288DAB6AF64E8FCEAE" display-inline="no-display-inline"> 
<section id="H2C15011B3675419698362FB0CBE1D844"><enum>507A.</enum><header>Altering, removing, or affixing unauthorized vessel identification numbers</header> 
<subsection id="HDE8D6323868F498F9CFBEC743470848C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a vessel or vessel part in or affecting interstate commerce, no person shall knowingly, with the purpose of obscuring the identity of a vessel or vessel part—</text> <paragraph id="H3D4C39A9EAED4DD99DEEEEDB324E7747"><enum>(1)</enum><text>remove, obliterate, tamper with, forge, counterfeit, alter, or obstruct the visibility of—</text> 
<subparagraph id="H8A29381B9AD24D499AE1F59D8128BB0A"><enum>(A)</enum><text>a hull identification number;</text></subparagraph> <subparagraph id="H076161F9BDC64D68A603E5A54659B3F6"><enum>(B)</enum><text>an identification number; or</text></subparagraph> 
<subparagraph id="H79267397903345F3908AEB370E89F7CE"><enum>(C)</enum><text>a decal or device affixed to a vessel or vessel part; or</text></subparagraph></paragraph> <paragraph id="H11C3E87D21FF42ABA086371C216175A7"><enum>(2)</enum><text>affix—</text> 
<subparagraph id="HC95163E3E01344ABB8C2A4BA08D31BD5"><enum>(A)</enum><text display-inline="yes-display-inline">a hull identification number or an identification number that has not been issued by the appropriate manufacturer, importer, State authority, or Federal authority to a vessel or vessel part; or</text></subparagraph> <subparagraph id="HF6E4052D4F304F67B34539C0A1DC2E84"><enum>(B)</enum><text>a decal or device that has not been issued by the appropriate manufacturer, importer, State authority, or Federal authority pursuant to chapters 41, 43 or 123 of title 46, United States Code, or regulations issued thereunder.</text></subparagraph></paragraph></subsection> 
<subsection id="H5E074CC04E194189A917765B41DC7E78"><enum>(b)</enum><header>Nonapplication</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to the removal of an identification number by a person who is—</text> <paragraph id="HEDADDB97D14641179B75784977F856F6"><enum>(1)</enum><text>authorized to remove the identification number by the United States Coast Guard; or</text></paragraph> 
<paragraph id="H954A5B00183F4D05B145DC7764C57A2A"><enum>(2)</enum><text>required to remove the identification number pursuant to Coast Guard regulations.</text></paragraph></subsection> <subsection id="H1586DECFDE3443D6AA96CAA4FC6396A4"><enum>(c)</enum><header>Penalty</header><text>Whoever violates subsection (a) shall be fined under this title, imprisoned not more than 5 years, or both.</text></subsection> 
<subsection id="HD1EE47CC5929415D9495D5B06B69FDB5"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H19740F12662D464AA603B9EF08730DD4"><enum>(1)</enum><header>Hull identification number</header><text>The term <quote>hull identification number</quote> has the meaning given such term in section 187.7 of title 33, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></paragraph> 
<paragraph id="HB2D88F32761C46DA9E09B4FF7439720A"><enum>(2)</enum><header>Identification number</header><text display-inline="yes-display-inline">The term <quote>identification number</quote> means a number or symbol that is inscribed or affixed for purposes of identification under chapter 41, 43, or 123 of title 46, United States Code, or regulations issued thereunder.</text></paragraph> <paragraph id="HDC915FDA828143B38626987F728AE48A"><enum>(3)</enum><header>Tampers with</header><text>The term <quote>tampers with</quote> includes covering a decal or device affixed to a vessel pursuant to chapters 41, 43, and 123 of title 46, United States Code, or regulations issued thereunder.</text></paragraph> 
<paragraph id="H5C29222417AB48FFA8B7277CB98664B8"><enum>(4)</enum><header>Vessel</header><text>The term <quote>vessel</quote> has the meaning given such term in section 115 of title 46, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HD573592821BD40B193A11AC061B60496"><enum>(b)</enum><header>Trafficking in certain vessels</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113">Chapter 113</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/2321">section 2321</external-xref> the following:</text>

<section id="H5B8EB4268B5742FE80CADCCBFBC4C09E"><enum>2321A.</enum><header>Trafficking in certain vessels</header> 
<subsection id="H94946A77B0E84C1F9829E176438985AD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever buys, receives, possesses, or obtains control of, with intent to sell or otherwise dispose of, a vessel in or affecting interstate commerce, knowing that an identification number or hull identification number for such vessel has been removed, obliterated, tampered with, forged, counterfeited, altered, or not issued by the appropriate manufacturer, importer, State or Federal authority shall be fined under this title or imprisoned not more than 10 years, or both.</text></subsection> <subsection id="H82699753E2FF4DA4B47DFE8437FC6829"><enum>(b)</enum><header>Nonapplication</header><text>Subsection (a) does not apply if the removal, obliteration, tampering, or alteration—</text> 
<paragraph id="H211B4FF918134BE6B72EE9318A7F5859"><enum>(1)</enum><text>is caused by collision, allision, or fire; or</text></paragraph> <paragraph id="H99E3D25338874A508A882A6978100FE4"><enum>(2)</enum><text>is not a violation of section 507A of this title.</text></paragraph></subsection> 
<subsection id="H5724C9016E8E42F5A2AB576D3F72B407"><enum>(c)</enum><header>Identification number</header><text>In this section, the terms <quote>identification number</quote>, <quote>hull identification number</quote>, and <quote>vessel</quote> have the meaning given such terms in section 507A of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> </legis-body></bill>
