<section id="H26BF64DF36E342F997649F957E6F2FE4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Columbia River Salmon Act of 2026</short-title></quote>.</text></section> <section id="H4F9EECD753234BEC8BE0C342D26A214E" section-type="subsequent-section"><enum>2.</enum><header>Intentional lethal take by certain Indian Tribes of certain pinnipeds in Columbia River</header> <subsection id="H72250AD181324762A3CF08340E2952DD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 120 of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1389">16 U.S.C. 1389</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H7268EC3D799840CE87282C5DCAD81965"><enum>(k)</enum><header>Intentional lethal take by certain Indian Tribes of certain pinnipeds in Columbia River</header>
<paragraph id="HED13C5B58DB24974B9FE775C6870B65D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a covered Indian Tribe may intentionally lethally take covered pinnipeds on covered waters.</text></paragraph> <paragraph id="HF780CED8EAD84712B01B7E8189357675"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">With respect to the intentional lethal take of covered pinnipeds on covered waters, a covered Indian Tribe—</text>
<subparagraph id="H5C149243146146119E55CB15A202AEC4"><enum>(A)</enum><text>may carry out such take—</text> <clause id="H216129AA34674586B7BEF7462DDC5FCB"><enum>(i)</enum><text>without limitation on—</text>
<subclause id="HE80F15B19702453FBB2323DD651707B7"><enum>(I)</enum><text display-inline="yes-display-inline">the number of covered pinnipeds the covered Indian Tribe may take; or</text></subclause> <subclause id="H5B34F6A29DD74F26A35CD80F3209D979"><enum>(II)</enum><text display-inline="yes-display-inline">when the covered Indian Tribe may take covered pinnipeds; and</text></subclause></clause>
<clause id="HCABEE3CDA1C94F2A928AFCA4801ABB67"><enum>(ii)</enum><text>notwithstanding whether the covered pinnipeds are individually identifiable; and</text></clause></subparagraph> <subparagraph id="HDA7B718CAC524AEDA3A4A6D076CB2E17"><enum>(B)</enum><text>shall carry out such take—</text>
<clause id="H3AF25B246CB9430EBBDCDF6D3F551F1E"><enum>(i)</enum><text display-inline="yes-display-inline">in a manner the covered Indian Tribe determines to be humane; and</text></clause> <clause id="HE5814FFC4BD14F6A87628BC09FB28BC9"><enum>(ii)</enum><text display-inline="yes-display-inline">using methods the covered Indian Tribe determines appropriate.</text></clause></subparagraph></paragraph>
<paragraph id="H93D582981B384FF2A84967BABB918882" commented="no"><enum>(3)</enum><header>Designees</header><text display-inline="yes-display-inline">A covered Indian Tribe may designate a person to intentionally lethally take covered pinnipeds on covered waters in accordance with the requirements of paragraph (2) on behalf of the covered Indian Tribe.</text></paragraph> <paragraph id="H768C1E7DDBD04F39A5499DBC33A5E09C"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed to limit existing Tribal rights or authorities under treaties, executive orders, or other provisions of law.</text></paragraph>
<paragraph id="HD0ECA0E2A32D47E5A89B1C83BEBAD917"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H1A3E2E405A304BA290C4BAC8D1DC4F93"><enum>(A)</enum><header>Covered Indian Tribe</header><text display-inline="yes-display-inline">The term <term>covered Indian Tribe</term> means an Indian Tribe (as such term is defined in section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>)) that has ancestral ties to any part of covered waters.</text></subparagraph>
<subparagraph id="H71E5235DFEEF4F29A60E75B42A0B467D"><enum>(B)</enum><header>Covered pinniped</header><text>The term <term>covered pinniped</term> means a—</text> <clause id="H1C87921A013C49AEB7DA419D30C55A91"> <enum>(i)</enum> <text>California sea lion (Zalphus californianus); and</text>

                  <enum>(ii)</enum>
 <text>Steller sea lion (Eumetopias jubatus) that is part of the Eastern Distinct Population Segment of Steller sea lions.</text>
                </clause></subparagraph>
<subparagraph id="H2EF280269EEC4988A89271D20A3EC628"><enum>(C)</enum><header>Covered waters</header><text>The term <term>covered waters</term> means the mainstem and tributaries of the Columbia River in the States of Washington and Oregon from River Mile 0 to the McNary Dam.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body></bill>
