<section id="H79C8385DD57E4BB49C68F765190DDC1A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Getting Innovations to Patients During Shutdowns Act</short-title></quote>.</text></section> <section id="HBF3E2567DC4C458093279F91076B77BE"><enum>2.</enum><header>Special rules to provide for continued review of human drug and device submissions during a lapse of appropriations</header> <subsection id="H6EDC30BE6DDE4FE2B2CF9EC6D555E6D3"><enum>(a)</enum><header>Human drug submissions</header><text display-inline="yes-display-inline">Section 736(e) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/379h">21 U.S.C. 379h(e)</external-xref>) is amended—</text> 
<paragraph id="HA05261CFE7524C14B77BBFB2480B61EF"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>A human drug application</quote> and inserting the following:</text> <quoted-block style="OLC" id="H8149D472C3384F1999488315B6AC364D" display-inline="no-display-inline"> <paragraph id="H7C2F14FC7557467EB44CAA26D052AA83"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A human drug application</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5FD403F199F54D18AC8E8F79725C4B5C"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HE81BFB65981B46A7906C7497DD5D7EC7" display-inline="no-display-inline"> <paragraph id="HDE92CB4535E945AC8FC42F07A5283E09"><enum>(2)</enum><header>Special rule for lapse of appropriations</header> <subparagraph id="HA6E4608B24A94165ACD707D92DDAD0C2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), during any period for which there is a lapse of appropriations for the programs and activities of the Food and Drug Administration, or for the collection of fees used to support the process for the review of drug applications, the Secretary—</text> 
<clause id="H0A57BAD1BD5144DEAD5162720160ECA5"><enum>(i)</enum><text display-inline="yes-display-inline">may accept for filing an application or supplement described in paragraph (1) if the application or supplement is complete except for the payment of a fee required under subsection (a); and</text></clause> <clause id="H9178A0333FB546F78E6B9B49C4103436"><enum>(ii)</enum><text display-inline="yes-display-inline">shall extend the deadline for the payment of such fee to the date that is 7 days after the last day of such period.</text></clause></subparagraph> 
<subparagraph id="HE4BBBE84C2464DF49BE2971DC0C15B3E"><enum>(B)</enum><header>Effect of failure to pay fees on or before extended deadline date</header><text display-inline="yes-display-inline">If the Secretary accepts an application or supplement subject to an extended deadline for the payment of a fee under subparagraph (A), and the person subject to the fee does not pay the fee on or before the date of the extended deadline—</text> <clause id="H64BE78305FB44D6D960DE4302083425F"><enum>(i)</enum><text>the Secretary shall consider the application or supplement to be incomplete and deem the application or supplement not accepted; and</text></clause> 
<clause id="H4B68CACD74514C9081616E4CB01320EB"><enum>(ii)</enum><text>in no case shall the Secretary clear, authorize, or approve the application or supplement (or any related application or supplement) until such fee is paid.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H42D0EB3B75C646F4A98818278AA2C0B6"><enum>(b)</enum><header>Device submissions</header><text>Section 738(f)(1) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/379j">21 U.S.C. 379j(f)(1)</external-xref>) is amended—</text> 
<paragraph id="H3D43D54E6C9D4898B788D19FE2C6F937"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>A premarket application</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HE95E1770EA2F4D3EB2589CD0862CC348"> <subparagraph id="H6846C334A98A4BC394A573C1974412B3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A premarket application</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HECCD05B03D3C4B908A6BB6137003BAF1"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H3BBDB17643A841869836065A6CBDCE50"> <subparagraph id="H32D6DFAC370041049C56F90DC814EA36"><enum>(B)</enum><header>Special rule for lapse of appropriations</header> <clause id="H1BF71921711946BFA2FF876F994CF44E"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), during any period for which there is a lapse of appropriations for the programs and activities of the Food and Drug Administration, or for the collection of fees used to support the process for the review of device applications, the Secretary—</text> 
<subclause id="HDEE6137AEA85450A908349D4A2E45170"><enum>(I)</enum><text display-inline="yes-display-inline">may accept a submission described in subparagraph (A) if the submission is complete except for the payment of a fee required under subsection (a)(2) or (a)(3) relating to the submission; and</text></subclause> <subclause id="H113FCF0B7AC74D798D5208F3C0144A20"><enum>(II)</enum><text display-inline="yes-display-inline">shall extend the deadline for the payment of such fee to the date that is 7 days after the last day of such period.</text></subclause></clause> 
<clause id="H0C08E0C78D4F46D1913637DB6FFA8B2E"><enum>(ii)</enum><header>Effect of failure to pay fees on or before extended deadline date</header><text display-inline="yes-display-inline">If the Secretary accepts a submission subject to an extended deadline for the payment of a fee under clause (i), and the person subject to the fee does not pay the fee on or before the date of the extended deadline—</text> <subclause id="H2E28F6B00CAA45A580D5A6F4F9EB70EA"><enum>(I)</enum><text>the Secretary shall deem the submission not accepted; and</text></subclause> 
<subclause id="H5120E4307AE547AAB1BB4944E452576A"><enum>(II)</enum><text>in no case shall the Secretary clear, authorize, or approve the submission (or any related submission) until such fee is paid.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> </legis-body></bill>
