<section id="HB0F101ED5BB142779A5309D8681E8737" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Northwest Endangered Salmon Predation Prevention Act of 2026</short-title></quote>.</text></section> <section id="H817805CD874B479D85A385FF31426595" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Adaptive pinniped management</header> <subsection id="H98E11FF37D5144D3AC45D0E29FAD4EB1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 120 of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1389">16 U.S.C. 1389</external-xref>) is amended—</text> 
<paragraph id="H89D9FCBD9D664E4193E7904133C0A844"><enum>(1)</enum><text>in subsection (f)—</text> <subparagraph id="HAC6746D618594E8A839946B3C0144B62"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Temporary</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Provide adaptively managed</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="HEF48448B391C4D26A75DF9665A898BC4"><enum>(B)</enum><text>by striking <quote>sea lions</quote> each place it appears and inserting <quote>pinnipeds</quote>;</text></subparagraph> <subparagraph id="H3A299F0E4DFC4EE3A68CE22D2AE313E2"><enum>(C)</enum><text>by striking <quote>sea lion</quote> each place it appears and inserting <quote>pinniped</quote>;</text></subparagraph> 
<subparagraph id="H2E802B17E7B546B183E39C37F221B301"><enum>(D)</enum><text>in paragraph (4), to read as follows:</text> <quoted-block style="OLC" id="H93EF4FFFE1BA4F28A7A910DB150F3EC4" display-inline="no-display-inline"> <paragraph id="H1C98F408470E4CB7A151C0829D83E820"><enum>(4)</enum><header>Requirements</header><text display-inline="yes-display-inline">Intentional lethal takings under this subsection shall be carried out—</text> 
<subparagraph id="H79C9DDAE4BBA4577A4A3B04BAE4BB49B"><enum>(A)</enum><text>in a manner the Secretary, in consultation with eligible entities, determines appropriate; and</text></subparagraph> <subparagraph id="H48E62047414045288A890B752DB98B4A"><enum>(B)</enum><text>in accordance with each term and condition included in the applicable permit issued under this subsection.</text> </subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H5A88AFDE015442F0B94404524EDA1E9B"><enum>(E)</enum><text>in paragraph (5), to read as follows:</text> <quoted-block style="OLC" id="HF9754DC7E75C420AA53133CD1A80181F" display-inline="no-display-inline"> <paragraph id="H489EC9C3239D459B81A9C515C70663C1"><enum>(5)</enum><header>Suspension of permitting authority; report</header> <subparagraph id="H4EC99F4A54FD4AE181A4A93D1C521E2E"><enum>(A)</enum><header>Suspension of permitting authority</header><text>If, 5 years after the date of the enactment of the <short-title>Northwest Endangered Salmon Predation Prevention Act of 2026</short-title>, the Secretary, after consulting with State and tribal fishery managers, determines that lethal removal authority is no longer necessary to protect salmonid and other fish species from pinniped predation, the Secretary shall suspend the issuance of permits under this subsection.</text></subparagraph> 
<subparagraph id="HBDD222160EBE4AC491A216E4C4A897A3"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the <short-title>Northwest Endangered Salmon Predation Prevention Act of 2026</short-title> and annually thereafter, the Secretary shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report detailing—</text> <clause id="HCE720000EFBD48B49772589BAA3911E4"><enum>(i)</enum><text>the population status of pinnipeds in the Columbia River and its tributaries in the States of Washington and Oregon; and</text></clause> 
<clause id="HA0803A1EF7B0443F944473BC11430AED"><enum>(ii)</enum><text>the extent to which predation by such pinnipeds on salmonid and other fish species are preventing the recovery of such species that are listed as threatened species or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph> <subparagraph id="H83115E2FEFF8450387F68EF7998AB0FF"><enum>(F)</enum><text>in paragraph (6)—</text> 
<clause id="H653CBD11845344F3B87EBFC1654491BE"><enum>(i)</enum><text>in subparagraph (A)—</text> <subclause id="HFB4CFE0577C1483DA6A585F5B03CD344"><enum>(I)</enum><text>in clause (i), by striking <quote>, from river mile 112 to the McNary Dam</quote>; and</text> </subclause> 
<subclause id="H44D5CF03E1B749CD8FB1C7B0DC6C2B37"><enum>(II)</enum><text>in clause (ii), by striking <quote>from river mile 112 to the McNary Dam</quote>;</text> </subclause></clause> <clause id="H4AD0653AA4B445A38231CDD8DE8C4913"><enum>(ii)</enum><text>in subparagraph (B)—</text> 
<subclause id="H7273CCA455FF40849B6777110115F021"><enum>(I)</enum><text>by striking <quote>above river mile 112 and below McNary Dam</quote>; and</text></subclause> <subclause id="H0477C62D614C41EDA1ED72238F241E36"><enum>(II)</enum><text>by striking <quote>above Bonneville Dam and below McNary Dam</quote>; and</text></subclause></clause> 
<clause id="HFBF23BFF90B34F05AEE3CABD3B85B3EB"><enum>(iii)</enum><text>in subparagraph (C)—</text> <subclause id="H7BF649EFA5C54CA6A5A1D422DEB9B4A1"><enum>(I)</enum><text>by striking <quote>above river mile 112 and below McNary Dam</quote>; and</text></subclause> 
<subclause id="HFD8BCBD2495E43999461164DB0BE11CB"><enum>(II)</enum><text>by striking <quote>above Bonneville Dam and below McNary Dam</quote>; </text> </subclause></clause></subparagraph> <subparagraph id="H6268F4EA2E3A4017A40E061FBA3D264A"><enum>(G)</enum><text>in paragraph (7), by striking <quote>upstream of river mile 112 and downstream of McNary Dam,</quote> and inserting <quote>in the Columbia River</quote>;</text> </subparagraph> 
<subparagraph id="H8D5CC2B0507C4254AE2201572F0D521E"><enum>(H)</enum><text>in paragraph (8), by striking <quote>upstream of river mile 112 and downstream of McNary Dam,</quote>; and</text> </subparagraph> <subparagraph id="HD17F1A28D77C4CF3A2F74F5FA0BBCADE"><enum>(I)</enum><text>by adding at the end the following:</text>

<paragraph id="H0E653C28F4D34B7E9E03B34445B9586C"><enum>(10)</enum><header>Columbia River Pinniped Exclusion Technology Accelerator</header> 
<subparagraph id="HF35056DF6CC64D1FB530524BD2176560"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Secretary, in coordination with the Secretary of the Interior and the governors of the States of Oregon, Washington, and Idaho, shall establish and maintain within the National Marine Fisheries Service a program to be known as the <quote>Columbia River Pinniped Exclusion Technology Accelerator</quote>.</text> </subparagraph> <subparagraph id="H5805F8EABD3246B88830C5EA465AF0CA"><enum>(B)</enum><header>Purpose</header><text>The purpose of the Columbia River Pinniped Exclusion Technology Accelerator is to stimulate innovation in the development of pinniped exclusion technology applicable to the mainstem of the Columbia River and its tributaries in the States of Washington and Oregon that—</text> 
<clause id="H0B46B9A0DB184AFFA7068EF306DCED43"><enum>(i)</enum><text display-inline="yes-display-inline">prevents a majority of pinnipeds from proceeding upstream into—</text> <subclause id="H5EDE5034A131444CB11D663672999EF4"><enum>(I)</enum><text>habitat of salmon and other anadromous fish; and</text></subclause> 
<subclause id="HEA84BE4C9A28484C89C1207C4F223D1F"><enum>(II)</enum><text>brackish and freshwater environments that support juvenile salmonid outmigration;</text> </subclause></clause> <clause id="H9782E4A6033248E38584CFCC0E7CECF4"><enum>(ii)</enum><text display-inline="yes-display-inline">does not impede commercial, recreational, or Tribal navigation; and</text> </clause> 
<clause id="H48E08A35F08A4F7A89C37C3D85CB537F"><enum>(iii)</enum><text display-inline="yes-display-inline">does not affect the migration, passage, or movement of species of salmon or other anadromous fish.</text></clause></subparagraph> </paragraph> <after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H9A6900B1E96641B4B3E4F79DBFC801F8"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="HCB86996574FA45E4B59FF301C6FE3B34" display-inline="no-display-inline"> 
<subsection id="HD8FE5EEE657A4DF6B1FFC55D3931FE65"><enum>(k)</enum><header>Intentional lethal take by certain entities of certain pinnipeds in certain waters in State of Washington</header> 
<paragraph id="H5320CDE2AB7C4DBF9D10639F4BF1E1BA"><enum>(1)</enum><header>In general</header> 
<subparagraph id="HF6CB70423088410BB7652195D832066A"><enum>(A)</enum><header>Issuance of permits</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, an eligible entity may apply to the Secretary for a permit issued under this subsection and the Secretary may issue permits to eligible entities to authorize the intentional lethal taking on covered waters by such eligible entities of covered pinnipeds for the purpose of protecting covered fish.</text> </subparagraph> <subparagraph id="H28026ABC1776404691E48AC038823226"><enum>(B)</enum><header>Permit procedures</header><text display-inline="yes-display-inline">The Secretary shall establish procedures to coordinate issuance of permits under subparagraph (A), including with respect to—</text> 
<clause id="HE1E1658DF58741549CBE557C2F0A8C31"><enum>(i)</enum><text>application procedures and timelines;</text></clause> <clause id="HD14CB3BB94744DA6A1451782FBE3DB57" commented="no"><enum>(ii)</enum><text>delegation and revocation of permits to and between eligible entities;</text> </clause> 
<clause id="HD6527175F52C45888D0EC96AA140E991"><enum>(iii)</enum><text>monitoring;</text></clause> <clause id="HED7DD39352874FC588537696102E5EEA"><enum>(iv)</enum><text>periodic review; and</text></clause> 
<clause id="HDD1F4E6750164B5FAC33CEE4761B7C44"><enum>(v)</enum><text>geographic, seasonal take, and species-specific considerations.</text></clause></subparagraph></paragraph> <paragraph id="H89F288B015C14B70B42594E11F79C945"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">Subject to paragraph (3), an eligible entity may carry out an intentional lethal taking of a covered pinniped pursuant to a permit issued to the eligible entity under paragraph (1) only—</text> 
<subparagraph id="H002FC74E876040FABC4407FB733E050E" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in a manner the Secretary, in consultation with eligible entities, determines appropriate; and</text> </subparagraph> <subparagraph id="HC3264CA66A3B4214BF946EC8FD4C77C1"><enum>(B)</enum><text>in accordance with each term and condition included in the permit.</text></subparagraph></paragraph> 
<paragraph id="H1E846B9FBD9341E4AA0FA52E936F55F5"><enum>(3)</enum><header>Humane methods</header><text display-inline="yes-display-inline">Intentional lethal takings under this subsection shall be—</text> <subparagraph id="HC7EB1768B669470B8955D424B388F36C"><enum>(A)</enum><text>humane; and</text></subparagraph> 
<subparagraph id="H6703AA8D7A58414E92C29A15DB1A0A84"><enum>(B)</enum><text>implemented by—</text> <clause id="HE48E73BF2788497B9FB2F9802E8C94E9"><enum>(i)</enum><text>State agencies;</text></clause> 
<clause id="H5C061828EFF6436AB863E17DF9B1997A"><enum>(ii)</enum><text>qualified individuals under contract to such agencies; or</text></clause> <clause id="H362394357BE448A69449994735F16114"><enum>(iii)</enum><text>individuals employed by eligible entities. </text></clause></subparagraph></paragraph> 
<paragraph id="H6253DE24EC0C41F587CD52148A94639E"><enum>(4)</enum><header>Delegation authority</header><text display-inline="yes-display-inline">The Secretary, upon the request of an eligible entity that is issued a permit under paragraph (1), may allow such eligible entity to delegate to any other eligible entity its authority under such permit with respect to the intentional lethal taking on covered waters of covered pinnipeds for the purpose described in that paragraph.</text> </paragraph> <paragraph id="HD5D93F02CE8446A6BA3B5CE84B4EE2B2"><enum>(5)</enum><header>Term</header><text display-inline="yes-display-inline">A permit issued under paragraph (1)—</text> 
<subparagraph id="H76A3FB5AB86B45AF9821BB2455B34A06"><enum>(A)</enum><text>shall be effective for a period of not more than 5 years; and</text></subparagraph> <subparagraph id="HC182797F7902471B91110E9F19ACF676"><enum>(B)</enum><text>may be renewed by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HA0316315A1D1477B84482031F6E1F32D"><enum>(6)</enum><header>Suspension of permitting authority</header> 
<subparagraph id="H5D96E2005EA3446A932AFBA22B3EC54C"><enum>(A)</enum><header>In general</header><text>If, after the 5-year period beginning on the date of the enactment of the <short-title>Northwest Endangered Salmon Predation Prevention Act of 2026</short-title>, the Secretary, after consulting with State and tribal fishery managers, determines that lethal removal authority is no longer necessary to protect salmonid and other fish species from pinniped predation, the Secretary shall suspend the issuance of permits under this subsection. </text></subparagraph> <subparagraph id="HD4BBD2AA0882416EA6D4B4A30EC71820"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the <short-title>Northwest Endangered Salmon Predation Prevention Act of 2026</short-title> and annually thereafter, the Secretary shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report detailing—</text> 
<clause id="H72DECCBC85614438806D45BED4AAC1BD"><enum>(i)</enum><text display-inline="yes-display-inline">the population status of pinnipeds in covered waters; and</text></clause> <clause id="H5633B3CAB7D3424C9E9C6EBC3D4BF48C"><enum>(ii)</enum><text>the extent to which predation by such pinnipeds on salmonid and other fish species are preventing the recovery of such species that are listed as threatened species or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></clause></subparagraph></paragraph> 
<paragraph id="HB60167228A66488AAFE9FDD6DC741315"><enum>(7)</enum><header>Limitations on annual takings</header><text display-inline="yes-display-inline">The Secretary shall apply the process for determining limitations on annual take of sea lions under subsection (c) to determinations on limitations under this subsection, and the cumulative number of covered pinnipeds authorized to be taken each year under all permits in effect under this subsection shall not exceed 10 percent of the annual potential biological removal level for covered pinnipeds.</text></paragraph> <paragraph id="HBDE1E9D55BF947BB97C24F458415D96A"><enum>(8)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="HAC53248496C64AFE96CA38B0FED05341" commented="no"><enum>(A)</enum><header>Covered fish</header><text>The term <term>covered fish</term> means an individual of a species of—</text> <clause id="HF3CA45B92A9D44C89D720824C0FC16E2" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">salmon, steelhead, or euchalon that is listed as an endangered species or a threatened species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></clause> 
<clause id="HE634202FF5D04F55B96344C52E98144A" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">fish that is a species of concern. </text></clause> </subparagraph> <subparagraph id="HC29C6465F16349149A8D5B14EB4E4D19"><enum>(B)</enum><header>Covered Indian Tribe</header><text display-inline="yes-display-inline">The term <term>covered Indian Tribe</term> means each federally recognized Indian Tribe with treaty-reserved fishing rights in the western portion of the State of Washington.</text> </subparagraph> 
<subparagraph id="HA5D25E98D3774409B7792604EBE30D09"><enum>(C)</enum><header>Covered pinniped</header><text display-inline="yes-display-inline">The term <term>covered pinniped</term> means a harbor seal (<italic>Phoca vitulina</italic>), California sea lion (<italic>Zalophus califonianus</italic>), or Steller sea lion (<italic>Eumetopias jubatus</italic>) that is part of a population or stock that is not categorized under this Act as depleted or strategic.</text></subparagraph> <subparagraph id="HE3A2E40FF83846D7A35E462584273F56"><enum>(D)</enum><header>Covered waters</header><text display-inline="yes-display-inline">The term <term>covered waters</term>—</text> 
<clause id="H1FEA1117DAAD46C6B25E7F058977AFCC"><enum>(i)</enum><text>means each river and stream in the State of Washington that flows into the marine waters of the State, including—</text> <subclause id="H0B86909134E8462D88CC3B46C39B27FE"><enum>(I)</enum><text>estuaries and bays attendant or adjacent to such marine waters;</text></subclause> 
<subclause id="H9BF0EB7EB25044EC86243C5A69CC1441"><enum>(II)</enum><text>the Puget Sound; and</text></subclause> <subclause id="H19BCE9A0231243EFB75484ABE45C5AEF"><enum>(III)</enum><text>the Pacific Coast of the State; and</text> </subclause></clause> 
<clause id="HFA232E3D65CC401A81C297BC73F57435"><enum>(ii)</enum><text>does not include the—</text> <subclause id="H3D51E88D95654F60960B82C26B68E9B5"><enum>(I)</enum><text>Columbia River; or</text></subclause> 
<subclause id="H6D8AA880C3E245DC9536960878D246C9"><enum>(II)</enum><text>any tributary of the Columbia River.</text></subclause></clause></subparagraph> <subparagraph id="HB3C9B52BC0FC4443BC69227289421E8C"><enum>(E)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> 
<clause id="HF15F75A5EFF44AE18F91367207031D47"><enum>(i)</enum><text>the State of Washington; and</text></clause> <clause id="H1DA5BD27D9644BBAB4DE57AB0DBC59B3"><enum>(ii)</enum><text>each covered Indian Tribe.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3F040EFADF1849279831B174E7E3C5E1"><enum>(b)</enum><header>Study; report</header> 
<paragraph id="H89742B012E904A498286CD4C64E924D5"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the National Marine Fisheries Service, in consultation with the eligible entities and heads of Federal agencies the Secretary determines appropriate, shall carry out a study regarding the effect of actions authorized by section 120(f) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1389">16 U.S.C. 1389(f)</external-xref>), as amended by this section, on the recovery of species of salmon and steelhead that are listed as endangered species or threatened species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) in the mainstem and tributaries of the Columbia River in the States of Washington and Oregon.</text></paragraph> <paragraph id="H9D7B03480AD94EFEA7DB1A622BC06A64"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 10 years after the date of the enactment of this section, the Secretary, acting through the Director of the National Marine Fisheries Service, in consultation with the eligible entities and heads of Federal agencies the Secretary determines appropriate, shall submit to Congress a report regarding the results of the study carried out under paragraph (1).</text></paragraph></subsection> 
<subsection id="H04276AE3BBC94485B353067CAAE6E257"><enum>(c)</enum><header>Regulations</header><text>The Secretary may issue such regulations as are necessary to carry out this section, including the amendments made by this section.</text></subsection> <subsection id="H5521D84787D941A780385BC545024B3C"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act may be construed to enlarge, confirm, adjudicate, modify, or otherwise affect any treaty or other right of an Indian Tribe.</text></subsection> 
<subsection id="H00A5E72C58A24B458554BCC05EF438DC"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H9BF13B715D484F6E8AE43098F4A2E60B"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> has the meaning given the term in section 120(f)(6)(A) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1389">16 U.S.C. 1389(f)(6)(A)</external-xref>), as amended by this section.</text></paragraph>
