<section id="H4184D3AC24DC4BA9BCBCB42271D4C93C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Environmental Monitoring and Remediation Technology Assessment Initiative Authorization Act of 2026</short-title></quote> or the <quote><short-title>EMRTAI Authorization Act of 2026</short-title></quote>.</text></section> <section id="H31D1349F5137496496863853C59FB039"><enum>2.</enum><header>Environmental remediation and critical material recovery program</header> <subsection id="HB2A79952978D490A88028DC6E6BFA0E8" commented="no"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency shall carry out a program to investigate, evaluate, and support processes, methods, and systems which may be utilized in—</text> 
<paragraph id="H7AB31CE5B5564C569C5FAB3D75939A89" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the identification of sources of critical materials at contaminated sites, including contaminated media and solid waste sources at such sites; and</text></paragraph> <paragraph id="HA9B1650496E843B496B9DE705BEB7524" commented="no"><enum>(2)</enum><text>the recovery of such critical materials from such sites.</text> </paragraph></subsection> 
<subsection id="HE71B8978E0E94F7AA4BDE0814C107583"><enum>(b)</enum><header>Assistance</header><text>In carrying out the program under subsection (a), the Administrator may provide assistance, including by entering into contracts and cooperative agreements and making awards, to persons, State, local, and Tribal government entities, and nonprofit organizations.</text></subsection> <subsection id="H6CD91CFF896E46A8B359187D3ED2D062" commented="no"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Administrator may not, under such program, provide assistance—</text> 
<paragraph id="H7D1D205A9CB744DE83C272381EA6EF08" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">in the aggregate, in an amount that exceeds $10,000,000 in any fiscal year; or</text> </paragraph> <paragraph id="H56B2AB7FA165422EB4684B10C43AAA7B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">to any person, State, local, or Tribal government entity, or nonprofit organization, in an amount that exceeds $3,000,000.</text></paragraph></subsection> 
<subsection id="H8EB337B15AF34C309D0F59F1AFC0A4AB" display-inline="no-display-inline"><enum>(d)</enum><header>Evaluation of applications</header><text>The Administrator shall establish a system for evaluating applications for assistance provided under subsection (b) that includes the following criteria:</text> <paragraph id="H08570312BB1A40E88364A9B1C262AB20" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The extent to which the assistance furthers the identification of nontraditional, domestic sources of critical materials at contaminated sites pursuant to subsection (a).</text></paragraph> 
<paragraph id="H8E1422B1387C42E48BE023246AFBE603"><enum>(2)</enum><text display-inline="yes-display-inline">The extent to which the assistance advances processes, methods, and systems for—</text> <subparagraph id="HC2C3CB203F7D401F90F54594A129A84F" commented="no"><enum>(A)</enum><text>recovering critical materials from sources at contaminated sites that may be identified pursuant to subsection (a); and</text></subparagraph> 
<subparagraph id="HB49BDC0C44A44331A1588234571FAE30"><enum>(B)</enum><text>monitoring environmental contamination and remediation of such contaminated sites in the recovery of such critical materials.</text></subparagraph></paragraph> <paragraph id="HB4FBE51162A347BB92CCF7A88FCAACB6"><enum>(3)</enum><text display-inline="yes-display-inline">The extent to which the assistance strengthens national security through the development of domestic critical material supply chains.</text></paragraph> 
<paragraph id="H36012CC750C64AAAA350359E375277AB"><enum>(4)</enum><text>The extent to which the assistance supports remediation of one or more contaminated sites, especially such sites that are on the National Priorities List.</text> </paragraph> <paragraph id="H89D7EBAC846D4D6CB5C6C626D5D8A8A6"><enum>(5)</enum><text display-inline="yes-display-inline">The extent to which the assistance protects human health and the environment.</text></paragraph></subsection> 
<subsection id="H54DDBF2FB9AF465EA53F7DF3FF74E771"><enum>(e)</enum><header>Critical material defined</header><text display-inline="yes-display-inline">In this section, the term <term>critical material</term> has the meaning given such term in section 7002(a) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>).</text></subsection> <subsection id="H817D3ADEF449498FB3EBD36FA19FD63D"><enum>(f)</enum><header>Sunset</header><text display-inline="yes-display-inline">The program under subsection (a) shall terminate on the date that is 10 years after the date of enactment of this section.</text></subsection></section>
