<section id="H07CE6B7FF74945CFBBE3438408ADC7B2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Battery Recycling for America’s Competitive Economy Act</short-title></quote> or the <quote><short-title>BRACE Act</short-title></quote>.</text></section> <section id="H4840972C48CE4846BFBF174ED50DD4EB"><enum>2.</enum><header>End of life lithium-ion battery management</header> <subsection id="H5061209479C9472C846FE7487BCD265A"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text> 
<paragraph id="H663B541A696E41A19AF563D1FB66D077"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> <paragraph id="H70F88C33982247E7BC0BCDAE0EE8EACF"><enum>(2)</enum><header>Battery</header><text>The term <term>battery</term> has the meaning given such term in section 273.9 of title 40, Code of Federal Regulations (or any successor regulations).</text></paragraph> 
<paragraph id="HCC2216E586D640FCADA8BECDB5E2DDE9"><enum>(3)</enum><header>Destination facility</header><text>The term <term>destination facility</term> has the meaning given such term in section 273.9 of title 40, Code of Federal Regulations (or any successor regulations).</text></paragraph> <paragraph id="H63C0F48D6CD542E382FD075968A1738D"><enum>(4)</enum><header>Large quantity handler of universal waste</header><text>The term <term>large quantity handler of universal waste</term> has the meaning given such term in section 273.9 of title 40, Code of Federal Regulations (or any successor regulations).</text></paragraph> 
<paragraph id="HD8CB8EB79F4F4BB0BD806D5D7AD2C231"><enum>(5)</enum><header>Lithium-ion battery</header><text>The term <term>lithium-ion battery</term> means a battery that uses the movement of lithium ions between two electrodes to store and release energy.</text></paragraph></subsection> <subsection id="H89007942D0804CB693424B02E30FC5B4"><enum>(b)</enum><header>Interim requirements for lithium-ion batteries</header><text>Until the date on which the Administrator issues the rule pursuant to subsection (c), in lieu of the requirements described in section 273.60(a) of title 40, Code of Federal Regulations (or any successor regulations), a destination facility that stores lithium-ion batteries prior to recycling such lithium-ion batteries shall comply with—</text> 
<paragraph id="H89E650989D7C4F67936C4932D7DC0856"><enum>(1)</enum><text display-inline="yes-display-inline">the requirements described in sections 273.33(a)(1), 273.35, 273.36, and 273.37 of title 40, Code of Federal Regulations (or any successor regulations), which shall apply as if the destination facility were a large quantity handler of universal waste; and</text></paragraph> <paragraph id="HB66784D6E025422C9C85F03C15B43FE7"><enum>(2)</enum><text>the requirements described in section 273.60(b) of title 40, Code of Federal Regulations (or any successor regulations), which shall apply as if the destination facility did not store the lithium-ion batteries prior to recycling such lithium-ion batteries.</text></paragraph></subsection> 
<subsection id="H0C40C72CF6624B2BA01F815B1192D3CF"><enum>(c)</enum><header>Universal waste rulemaking for lithium-ion batteries</header> 
<paragraph id="H34FE5DEAF3D64C4AA42CE7784A2947C5"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall issue a rule regarding the management of lithium-ion batteries as universal waste.</text></paragraph> <paragraph id="HAF4B90F1823F45078510FD24EA13F8E0"><enum>(2)</enum><header>Contents</header><text>In issuing the rule pursuant to paragraph (1), the Administrator shall consider including in such rule, in addition to any other issue that arises as part of the notice and comment period for such rule, the following:</text> 
<subparagraph id="HE3D72392476C4286A179DF0479110935"><enum>(A)</enum><text>Universal waste requirements specially tailored for lithium-ion batteries.</text></subparagraph> <subparagraph id="HF1C5C0063E8447E390201903BFFC1CD7"><enum>(B)</enum><text>Elements of the interim requirements for lithium-ion batteries specified in subsection (b), as appropriate.</text></subparagraph> 
<subparagraph id="H42AA0F71E7EA4B90B996A820F308291C"><enum>(C)</enum><text>Any additional regulatory changes to support the recycling of lithium-ion batteries and recovery of critical minerals, while maintaining protections for health and the environment.</text></subparagraph> <subparagraph id="HCEDD81783A974F1083F4C438D26DF464"><enum>(D)</enum><text>Additional safety requirements needed to address gaps in existing protections.</text></subparagraph></paragraph> 
<paragraph id="H3BD3DA07C60341939ABA8463764B8ED4" commented="no"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to limit any future rulemaking of the Environmental Protection Agency regarding lithium-ion batteries.</text></paragraph></subsection></section> <section id="HAB72CC5F2D9141A0B18CB1C05BEC311B"><enum>3.</enum><header>Technical updates to the Mercury-Containing and Rechargeable Battery Management Act</header><text display-inline="no-display-inline">Section 104(a) of the Mercury-Containing and Rechargeable Battery Management Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14323">42 U.S.C. 14323(a)</external-xref>) is amended by striking <quote>the regulations promulgated by the Environmental Protection Agency at 60 Fed. Reg. 25492 (May 11, 1995), as effective on May 11, 1995</quote> and inserting <quote>part 273 of title 40, Code of Federal Regulations (or any successor regulations)</quote>.</text></section>
