<section id="HDFA49A41CDAB44CFAC697A6E208A34A4" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Combating Attacks on our National Alcoholic Drinks by Allies Act</short-title></quote> or the <quote><short-title>CANADA Act</short-title></quote>.</text></section> 
<section id="HDA404270435249EBB65538209824EC62"><enum>2.</enum><header>Investigation of restrictions on alcoholic beverage exports of the United States</header> 
<subsection id="H27545E980F8E4631B37C290640A4C556"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the United States Trade Representative shall initiate an investigation to determine whether a covered foreign country has ceased importation and distribution of alcoholic beverage exports of the United States in a manner that is actionable under section 301 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411</external-xref>).</text></subsection> <subsection id="HE754E270BDE845ECAB0A37B076D2FA12"><enum>(b)</enum><header>Consultations</header> <paragraph id="H0936C17473C04FF288FA38D026C671F9"><enum>(1)</enum><header>Before actionability determination</header><text>Before making a determination with respect to whether a covered foreign country has acted in a manner that is actionable under such section 301 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411</external-xref>) after an investigation initiated under subsection (a), the United States Trade Representative shall—</text> 
<subparagraph id="HF4A6D219E04C4103ABD19B08C704255D"><enum>(A)</enum><text>consult with—</text> <clause id="HFEE799BD1D4146C9A28666B42F2D68BD"><enum>(i)</enum><text display-inline="yes-display-inline">manufacturers of alcoholic beverages in the United States that are affected by limits imposed by covered foreign countries on importation and distribution of alcoholic beverage exports of the United States;</text></clause> 
<clause id="H4798227D95D5421BB371A38BE65896E6"><enum>(ii)</enum><text>the Secretary of Commerce;</text></clause> <clause id="HC7240343B4F6493BBF360D23F8EC896B"><enum>(iii)</enum><text>the Secretary of State; and</text></clause> 
<clause id="H08A245C40B594C88A3D453B9964B90F3"><enum>(iv)</enum><text>the United States International Trade Commission; and</text></clause></subparagraph> <subparagraph id="HAD5B5945D3F040ED9488DDA066184CCF"><enum>(B)</enum><text>seek information from trade associations and from domestic producers and distributors of alcoholic beverage exports of the United States, as determined relevant by the United States Trade Representative.</text></subparagraph></paragraph> 
<paragraph id="H2564E1EEEEFF48FF948293D3C1B16384"><enum>(2)</enum><header>Before enforcement determination</header><text>Before taking action with respect to a determination described in paragraph (1), the United States Trade Representative shall—</text> <subparagraph id="H58EAC0D0EA464CE58425C67A33B09847"><enum>(A)</enum><text>notify the appropriate committees of Congress of a proposed action with respect to such determination; and</text></subparagraph> 
<subparagraph id="HD6BA9218A4E3469699E57974CAA1839F"><enum>(B)</enum><text>consult with stakeholders that may be affected by such proposed action to ensure that such proposed action—</text> <clause id="H5F15A954CE254518B1719ADF9DE5E32F"><enum>(i)</enum><text>is targeted and proportionate; and</text></clause> 
<clause id="HB9C906A0617245559DE103B4E3E29848"><enum>(ii)</enum><text>minimizes potential unintended consequences for—</text> <subclause id="H647827A857804D8B884EBB0FF2F496A3"><enum>(I)</enum><text>consumers in the United States; and</text></subclause> 
<subclause id="H06F7324DACCC430FB39BD6335793431F"><enum>(II)</enum><text>allies of the United States.</text> </subclause></clause></subparagraph></paragraph> </subsection> <subsection id="HA1311FAD771D4D348A8A3E391B5AAE0A"><enum>(c)</enum><header>Negative determination</header><text>If the United States Trade Representative determines, after an investigation initiated under subsection (a), that a covered foreign country has not acted in a manner that is actionable under such section 301 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411</external-xref>), the United States Trade Representative shall submit to the appropriate committees of Congress a written report that explains such determination.</text></subsection></section> 
<section id="H3F7E025F6A824F32AE5607F1AC8BF331"><enum>3.</enum><header>Report</header> 
<subsection id="HE270320DF2FC4D7CB5A7C5C1A8891CB1"><enum>(a)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the United States Trade Representative shall submit to the appropriate committees of Congress a written report that includes—</text> <paragraph id="HA2C3F88D76DE490A8867F8AADA3E6658"><enum>(1)</enum><text>the status of each investigation initiated under section 2;</text></paragraph> 
<paragraph id="HC2B0B1F9C9AD40D0BAF28793FD72188A"><enum>(2)</enum><text>the policy of each covered foreign country with respect to the importation and distribution of alcoholic beverage exports of the United States; and</text></paragraph> <paragraph id="HBC5E989E28724ADE834C5614A53A77A3"><enum>(3)</enum><text>the findings of the United States Trade Representative regarding the impact of such policies on manufacturers of alcoholic beverages in the United States.</text></paragraph></subsection> 
<subsection id="HC4B2847D11974DD5A02D7FD3D76F0554"><enum>(b)</enum><header>Quarterly reports</header><text>Not later than 90 days after the date of enactment of this Act, and on a quarterly basis thereafter for 2 years, the United States Trade Representative shall submit to the appropriate committees of Congress a written report that includes—</text> <paragraph id="HE311147037854B3BA2DE0875F0925533"><enum>(1)</enum><text>a description of consultations held for the purpose of an investigation initiated under section 2(a);</text></paragraph> 
<paragraph id="HE86EB8C3B23C4FC5BA1BEE5A8F89E653"><enum>(2)</enum><text>any remedial or enforcement action taken under subsection (a) or (b) of section 301 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411</external-xref>) with respect to an investigation initiated under section 2(a); and</text></paragraph> <paragraph id="H3D507C7C39E54F0B9233FEF10F13745E"><enum>(3)</enum><text>the status of any engagement with a covered foreign country regarding trade issues related to alcoholic beverage exports of the United States.</text></paragraph></subsection> 
<subsection id="HF78622731AED4C07BAA1DE468E994FAD"><enum>(c)</enum><header>Public summary</header><text>The United States Trade Representative shall make publicly available a summary of the written reports required under this section, which shall not include confidential information provided by a stakeholder.</text></subsection></section> <section id="H860B0E83F1A24AE09C5FAF68CE0A20B9"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HECF8AD1591CC4A1B89F1442F04B35D19"><enum>(1)</enum><header>Alcoholic beverage</header><text>The term <quote>alcoholic beverage</quote> has the meaning given such term in section 203 of the Alcoholic Beverage Labeling Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/27/214">27 U.S.C. 214</external-xref>).</text> </paragraph> <paragraph id="HB987A8C39698473EBAD72DE4DCB377B9"><enum>(2)</enum><header>Appropriate committees of Congress</header><text>The term <quote>appropriate committees of Congress</quote> means—</text> 
<subparagraph id="H172F60E4B74842059AD8734FAA3E6F7C"><enum>(A)</enum><text>the Committee on Ways and Means of the House of Representatives; and</text></subparagraph> <subparagraph id="H80DD5ABA0C074F3EB17926979F95EE88"><enum>(B)</enum><text>the Committee on Finance of the Senate.</text></subparagraph></paragraph> 
<paragraph id="H09E1DF10F6454ED99E1FE15EFD94F072"><enum>(3)</enum><header>Covered foreign country</header><text>The term <quote>covered foreign country</quote>—</text> <subparagraph id="H2221B1BDECBD41E280030A12BB268A1D"><enum>(A)</enum><text>means a foreign country that has in effect a free trade agreement with the United States; and</text></subparagraph> 
<subparagraph id="H34934EDE20B444B99ED7F084C25872C3"><enum>(B)</enum><text>includes Canada.</text> </subparagraph></paragraph></section> </legis-body></bill>
