<section id="H17D04CA1ABEB4C8DBD5AC21C9626AFFC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No PFAS in Cosmetics Act</short-title></quote>.</text></section> <section id="H39299E3797A44549A78BE2210A8D4E43"><enum>2.</enum><header>Ban on perfluoroalkyl or polyfluoroalkyl substances</header> <subsection id="HAC09E69716FC4FFABCADD61111E6C918"><enum>(a)</enum><header>Adulteration</header><text display-inline="yes-display-inline">Section 601 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/361">21 U.S.C. 361</external-xref>) is amended by adding after paragraph (g) the following:</text>

<subsection id="H0052088BB28048268F235BB4729BE8A7"><enum>(h)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H2F60B168589745C09DDDCC69007CDBAD"><enum>(1)</enum><text>If it contains an intentionally added perfluoroalkyl or polyfluoroalkyl substance.</text></paragraph> <paragraph id="H8D09251E862E4F8EBE7B988C32E092B7" indent="up1"><enum>(2)</enum><text>In this paragraph:</text> 
<subparagraph id="HFA64E6A68A2340199D0B9F9ACC31FED6"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>perfluoroalkyl or polyfluoroalkyl substance</term> means a class of fluorinated organic chemicals containing at least one fully fluorinated methyl or methylene carbon atom.</text> </subparagraph> <subparagraph id="HB2C55F2148494F3B92E6B45F9D353395"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>intentionally added perfluoroalkyl or polyfluoroalkyl substance</term> means a perfluoroalkyl or polyfluoroalkyl substance that—</text> 
<clause id="H527F055EC739405FB1710DAA8A64F168"><enum>(i)</enum><text display-inline="yes-display-inline">has been intentionally added by a manufacturer or supplier to an ingredient, raw material, product, or packaging and has a functional or technical effect on the product or packaging; or</text></clause> <clause id="H152DC23F0CB94E3CBD2C3D9FC82E416C"><enum>(ii)</enum><text display-inline="yes-display-inline">is an intentional breakdown product of an added chemical.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H75E7E630E53849D6961B5C4B87479819"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Section 601(h) of the Federal Food, Drug, and Cosmetic Act, as added by subsection (a), shall apply beginning on January 1, 2027.</text></subsection> <subsection id="HD829C5B9A0324A0B881407AA88ADF3DC"><enum>(c)</enum><header>Conforming amendment</header><text>Section 3506 of the Modernization of Cosmetics Regulation Act of 2022 (subtitle E of title III of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) is hereby repealed.</text></subsection></section>
