<section id="H3D8B898BA61C4A58A5EF42500ED23C13" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Keep Food Containers Safe from PFAS Act of 2026</short-title></quote>.</text></section> <section id="H1D5E0AA5CFB0467783F33C7E82FC6DBA"><enum>2.</enum><header>Prohibition against food packaging containing intentionally added PFAS</header> <subsection id="HF2C3373BC73544C6A3675FB6F33A4F74"><enum>(a)</enum><header>In general</header><text>Section 301 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HB7991E169E944E6ABCDCC637F67197C0"><enum>(jjj)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H1A6E1BFB30B04C5EA03FE7684AA245E3"><enum>(1)</enum><text>The introduction or delivery for introduction into interstate commerce of food packaging containing intentionally added PFAS.</text></paragraph> <paragraph id="HDD6B094C8BA241BD946BBB0188DEFF08" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In this paragraph, the term <term>PFAS</term> means a class of fluorinated organic chemicals containing at least one fully fluorinated methyl or methylene carbon atom.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H18E023F9BAEE48DB898350DF5162A051"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendment made by subsection (a) applies beginning on January 1, 2027.</text></subsection></section> </legis-body></bill>
