<section id="H1B2303541E41412C980268EA095510B8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Responsibility and Accountability for Unchecked Dereliction Act</short-title></quote> or the <quote><short-title>FRAUD Act</short-title></quote>.</text></section> <section id="H062B7A5102354D6CB81239032393355E"><enum>2.</enum><header>Duty to report fraud involving Federal funds</header> <subsection id="H08AAB9B021F345D2B7D7B9E1A2D83AE5"><enum>(a)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Not later than 180 days after receiving a fraud warning involving covered Federal funds, a covered official shall report such warning to the Director of the Federal Bureau of Investigation.</text></subsection> 
<subsection id="HAC81C34846F442F282EAA2D29C230A42"><enum>(b)</enum><header>Condition of receipt of Federal funds</header><text display-inline="yes-display-inline">In order to be eligible to receive Federal funds for a fiscal year, the chief executive of a State shall certify to the head of the Federal agency providing such funds that during the previous fiscal year the covered officials of the State have substantially complied with the requirement under subsection (a).</text> </subsection> <subsection id="HB50825AB12A84C54B52CD7178DD31320"><enum>(c)</enum><header>Offense</header><text>Whoever, being a covered official, knowingly—</text> 
<paragraph id="HCFA7517EBCA24B4B88B72CEBDEF314DA"><enum>(1)</enum><text>violates the requirement under subsection (a); or</text></paragraph> <paragraph id="H657873084E0E44F595CC7B1E8130752E"><enum>(2)</enum><text display-inline="yes-display-inline">obstructs, interferes with, or impedes a Federal, State, or Inspector General investigation involving fraud involving covered Federal funds,</text></paragraph> <continuation-text continuation-text-level="subsection">shall be fined under title 18, United States Code, imprisoned for not more than 10 years, or both.</continuation-text></subsection> 
<subsection id="HADD1E17809DF4C7A83C6BFF3D23DA725"><enum>(d)</enum><header>Debarment</header><text display-inline="yes-display-inline">The head of an agency that oversees the distribution of Federal funds, with respect to which a covered official has been convicted of an offense under subsection (c), may prohibit such covered official from overseeing the distribution of such funds.</text> </subsection> </section> <section id="H2C3426183B2E43B9A1E0B23E9253EC95"><enum>3.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to—</text> 
<paragraph id="HD155A8A771AB4ADC893C76B1E24FC333"><enum>(1)</enum><text>authorize the Federal Government to remove a State official from elected office; or</text></paragraph> <paragraph id="H04F3AED9B9604614B58933B1E41DF268"><enum>(2)</enum><text>violate principles of federalism under the Tenth Amendment to the Constitution of the United States.</text></paragraph></section> 
<section id="HF2F88ACEA5844EF49FFDF126D78AB275" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HEB00A1CB9E014420B03329DB9EF1C255"><enum>(1)</enum><header>Covered official</header><text display-inline="yes-display-inline">The term <term>covered official</term> means—</text> 
<subparagraph id="HAF36C33B59734BB9BD38D375D3F7C1DE"><enum>(A)</enum><text display-inline="yes-display-inline">the Governor of a State;</text></subparagraph> <subparagraph id="HC854B20F1CFB4E2090DED68332C4F03C"><enum>(B)</enum><text>the head of a State agency that administers, oversees, distributes, or certifies expenditures of covered Federal funds; and</text></subparagraph> 
<subparagraph id="HEE044F8A6CE34D4C9C37E1B8891659BF"><enum>(C)</enum><text>any State Inspector General, or equivalent State official established by law, with statutory responsibility for investigating, auditing, or overseeing covered Federal funds.</text></subparagraph></paragraph> <paragraph id="H6360CC6E761A4F2B8E494DCFF6EA6F2C"><enum>(2)</enum><header>Fraud warning</header><text display-inline="yes-display-inline">The term <term>fraud warning</term> means a written allegation of a specific instance of fraud involving covered Federal funds, supported by documentary evidence, which may include a written finding, a referral, an audit, an investigative report, or a whistleblower complaint, alleging the misuse, theft, diversion, or improper expenditure of not less than $250,000 in covered Federal funds.</text></paragraph> 
<paragraph id="H6BF4807990D74AE7BECF09E2AB60EBAB"><enum>(3)</enum><header>Covered Federal funds</header><text display-inline="yes-display-inline">The term <term>covered Federal funds</term> means any Federal funds provided to a State or State agency through a grant, cooperative agreement, reimbursement program, direct appropriation, or other Federal funding mechanism.</text></paragraph></section> </legis-body></bill>
