<section id="HFACD1BF5D08040B1A349543F513BD465" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fresh Bucks for Fresh Produce Act</short-title></quote>.</text></section> <section id="HB95B747C215B478EBA2D75C7D2F75036"><enum>2.</enum><header>Fresh Bucks Pilot Program</header> <subsection id="HA8A35B3F88BF405D98AB40B962026B6C"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall establish and implement a program, to be known as the Fresh Bucks Pilot Program, to award grants to States for the purpose of providing monthly payments to connect households with produce in their communities.</text></subsection> 
<subsection id="H807E6281096544DFA7B4F5ABF381043D"><enum>(b)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this section, a State shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require. At minimum, the application shall include a plan by the State to reach low-access areas and expand retailer participation (such as through the use of mobile markets, delivery models, and partnerships with community organizations or clinics).</text></subsection> <subsection id="H83DEC1C861BD4067AFDE492C78EF5F34"><enum>(c)</enum><header>Selection</header> <paragraph id="HACEE1CCCE5F4403EB7ABC24B8A70B923"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish and make publicly available a description of the criteria that the Secretary will use in evaluating applications submitted under subsection (b).</text></paragraph> 
<paragraph id="H99A3C73C645149FDA6CAF362C792FEB6"><enum>(2)</enum><header>Preference</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give preference to applications that prioritize food insecure communities.</text></paragraph> <paragraph id="H2C4F6782A6B7435A8173C8B20BC64AFA"><enum>(3)</enum><header>Geographic diversity</header><text>In awarding grants under this section, the Secretary shall ensure that a grant is awarded to at least 1 State in each of the following regions:</text> 
<subparagraph id="H1A60CE1B20174C5C840420D73254FFA3"><enum>(A)</enum><text>The Pacific Northwest region.</text></subparagraph> <subparagraph id="H259D5057E1DA4FF39B94F63F3D3E7528"><enum>(B)</enum><text>The Northeast region.</text></subparagraph> 
<subparagraph id="HCE6243D0525A48389426B868AE03F150"><enum>(C)</enum><text>The Western region.</text></subparagraph> <subparagraph id="H6674DF6228C74F2EA1D68F77405D5604"><enum>(D)</enum><text>The Midwest region.</text></subparagraph> 
<subparagraph id="H19B0AA795DDD4F598EE3A4C361931487"><enum>(E)</enum><text>The Southern region.</text></subparagraph></paragraph></subsection> <subsection id="HE9DB127A92CE4C30943EA40928437E47"><enum>(d)</enum><header>Use of funds</header><text>A State receiving a grant under this section may only use the grant to establish and implement a program (in this section referred to as a <quote>State program</quote>) to make the monthly payments described in subsection (f), including—</text> 
<paragraph id="H44B6AD0D821F4B9FA29D1C0834D0AE18"><enum>(1)</enum><text>associated administrative costs, such as—</text> <subparagraph id="HB21494108C4F4D07BED436648695BDA5"><enum>(A)</enum><text>hiring staff;</text></subparagraph> 
<subparagraph id="H8140C178481C4237A7CFC38BBB0EE093"><enum>(B)</enum><text>coordinating with community-based organizations;</text></subparagraph> <subparagraph id="H9B7EBDC4ABED453295EBD0D495E06547"> <enum>(C)</enum> <text>contracting with electronic benefits transfer card providers;</text>
                    </subparagraph> 
<subparagraph id="HFD35C8BA53CF461FB7128F2A1E046E3B"><enum>(D)</enum><text>acquiring and using necessary technology systems (such as card processors); and</text></subparagraph> <subparagraph id="H695D7B7AFFFD4A40B57ACD489897C99C"><enum>(E)</enum><text>marketing and participant materials that are culturally relevant, plain-language, and offered in multiple languages;</text></subparagraph></paragraph> 
<paragraph id="HFBD97302214B4A96A3DEB8B84B4A7674"><enum>(2)</enum><text>providing technical and implementation assistance (including in the form of financial assistance) to eligible retailers; and</text></paragraph> <paragraph id="H1A47BEC5B1494F67B126F2BE93193FB6"><enum>(3)</enum><text>collecting and reporting to the Secretary the data described in subsection (h)(2).</text> </paragraph></subsection> 
<subsection id="HDA6A37C1A91448C3AC96BA6C06832501"><enum>(e)</enum><header>Components of State programs</header><text>In administering a State program, a State, in consultation with the Secretary, shall develop and implement the following:</text> <paragraph id="HCCA9FD609A564BEF8FD1D003EA5E2A5A"><enum>(1)</enum><text display-inline="yes-display-inline">Household eligibility guidelines for the receipt from the State of the monthly payments described in subsection (f), which shall require that—</text> 
<subparagraph id="H022CAD98147045DA9B1CA6F5EC49832F"><enum>(A)</enum><text display-inline="yes-display-inline">in order to receive a payment from the State under the State program, a household shall submit to the State an application;</text></subparagraph> <subparagraph id="H10CD1C82069D4FDA8F487FCF59CE3BF7"><enum>(B)</enum><text>only 1 such application may be submitted per household; and</text></subparagraph> 
<subparagraph id="H80D3B8BD179941CC85489B08C0677091"><enum>(C)</enum><text>a household is eligible to submit such an application only if the household makes 80 percent or less of the area median income (as determined by the Secretary, in consultation with the Secretary of Housing and Urban Development).</text></subparagraph></paragraph> <paragraph id="HA2A6D88C18D14DDA89B490ED987EC7FC"><enum>(2)</enum><text>Households receiving benefits under the SNAP program shall be deemed to meet the income requirement described in paragraph (1)(C). A State shall—</text> 
<subparagraph id="H29B1CA08B3404663AFD9CDAE5413BD70"><enum>(A)</enum><text>incorporate an opt-in or auto-enrollment mechanism with respect to such households; and</text></subparagraph> <subparagraph id="HE483FAEEE22E4079991D4A5A01CCA6C2"><enum>(B)</enum><text>minimize the amount of additional paperwork required for such households.</text></subparagraph></paragraph> 
<paragraph id="H829FBE586E794BE58E45DF0A1AA5196D"><enum>(3)</enum><text>An application for the receipt from the State of the monthly payments described in subsection (f) that is short, low-barrier, and mobile-friendly.</text></paragraph> <paragraph id="H11D39112F5864D6199C75157C47E133D"><enum>(4)</enum><text>The avoidance of duplicative verification where States already have income data (such as through the SNAP program, Medicaid, or child care subsidies programs).</text></paragraph> 
<paragraph id="HA91D13C91D6B44B788B1208DA8EBF175"><enum>(5)</enum><text>Strong guardrails to reduce churn, including establishing clear timelines, simple renewal, grace periods, and strong customer support.</text></paragraph> <paragraph id="H35404E3DEE614C5D8DB5C7A14298D004"> <enum>(6)</enum> <text>The use of electronic benefits transfer card technology for the disbursement of the monthly payments described in subsection (f).</text>
                </paragraph> 
<paragraph id="HA9336BC268E44687A1F5328AB7EF98EE"><enum>(7)</enum><text>The provision of technical assistance to eligible retailers.</text></paragraph></subsection> <subsection id="H25577B28C968483999DDE3F37906D4BD"><enum>(f)</enum><header>Monthly payments to households</header> <paragraph id="H918ECBEFB5A14FA18E8C37E20B5FB0F1"><enum>(1)</enum><header>In general</header><text>In administering a State program, a State shall make payments to eligible households, on a recurring monthly basis, to purchase qualifying food from eligible retailers.</text></paragraph> 
<paragraph id="HE6F9183CFFD947AE8DB3EC54E66A0E3D"><enum>(2)</enum><header>Amount; duration</header><text>A payment under this subsection shall be $60 and may only be used during a 30-day period.</text></paragraph> <paragraph id="H67972E3669434BEF81F6E03E63A11ED6"><enum>(3)</enum><header>Supplement not supplant</header><text>A payment under this subsection shall supplement, not supplant, other benefits received by eligible households.</text></paragraph>

                    <enum>(4)</enum>
                    <header>Methods of payments</header>
 <text display-inline="yes-display-inline">In making payments under this subsection, a State may use existing disbursement methods for other programs (such as an electronic benefits transfer card).</text>
                </paragraph></subsection> 
<subsection id="H3D122846AF3A41A8A2F22E61CDD38947"><enum>(g)</enum><header>Consultation with local groups</header><text>In administering a grant under this section, a State shall work in consultation with local community-based organizations and health clinics to reach households most impacted by food insecurity.</text></subsection> <subsection id="HD3D92B9272A6430E9241643CB67B1A9F"><enum>(h)</enum><header>Study and report</header> <paragraph id="HA26369B83EB44A6BAB1A36960C08D83E"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary shall conduct a study to assess the effectiveness and outcomes of the Fresh Bucks Pilot Program.</text></paragraph> 
<paragraph id="H68E84B91067A4BEB903F9792DC8F13CA"><enum>(2)</enum><header>Data</header><text>In conducting the study under paragraph (1), the Secretary shall collect from States receiving grants under this section the following data with respect to eligible households receiving payments:</text> <subparagraph id="HC1B99E907286460C8BD2F5D82DBBE230"><enum>(A)</enum><text>Average household size, income, and other demographics.</text></subparagraph> 
<subparagraph id="H56B25947553D41C6AE166B8AA02E8B8F"><enum>(B)</enum><text>Average amount of payments used per month.</text></subparagraph> <subparagraph id="H0A402243817F4107A61B9CBF4BD867E7"><enum>(C)</enum><text>Household food security before and after participation.</text></subparagraph> 
<subparagraph id="H4D34A740D655435E8FE19E572C225FB0"><enum>(D)</enum><text>Daily fruit and vegetable consumption.</text></subparagraph> <subparagraph id="H7E0E02AAB3604EF39966D80106F4B8E5"><enum>(E)</enum><text>Where households spent payments.</text></subparagraph> 
<subparagraph id="HA78A109EB715450DBAA62272ADE8D35D"><enum>(F)</enum><text display-inline="yes-display-inline">Barriers to access, such as—</text> <clause id="HBE97EE9C7A2446CC83081354A6142F57"><enum>(i)</enum><text>distance to eligible retailers;</text></clause> 
<clause id="H0BFA83D1CBE64EAA9B94CD583A39C3E7"><enum>(ii)</enum><text>transportation constraints;</text></clause> <clause id="H9801EABE91C14F199B33DDEDB45086FB"><enum>(iii)</enum><text>eligible retailer density and hours; and</text></clause> 
<clause id="H5B539B3F90A34E2AA682A0272B02D257"><enum>(iv)</enum><text>the availability and price of qualifying foods.</text></clause></subparagraph> <subparagraph id="H3A39683F71774CDBB5E4858CDDD3E43A"><enum>(G)</enum><text>Number of eligible households on a waitlist to receive payments.</text></subparagraph> 
<subparagraph id="H75FDA248002B443E8B9636A301F77891"><enum>(H)</enum><text>Such other data as the Secretary determines appropriate.</text></subparagraph></paragraph> <paragraph id="HE04C26338075464196F6AFEB7744FC3B"><enum>(3)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not earlier than 6 months after the date of enactment of this Act, but not later than 12 months after such date of enactment, the Secretary shall submit to Congress a report that describes the initial results of the study under paragraph (1).</text></paragraph> 
<paragraph id="HA69BFC28FB524E80833F43E72D50D2C6"><enum>(4)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this Act, the Secretary shall submit to Congress a report that describes the final results of the study under paragraph (1). Such report shall include a recommendation regarding the feasibility of continuing the Fresh Bucks Pilot Program and expanding the number of participating States or the amount of monthly payments.</text></paragraph></subsection> <subsection id="H947C37FC1D4048C3A027FD506CBB5194"><enum>(i)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H2FE6CD85AA1A4C578EFB4030F5E2BEDD"><enum>(1)</enum><header>Eligible household</header><text display-inline="yes-display-inline">The term <term>eligible household</term> means a household that meets the income requirement described in subsection (e)(1)(C).</text></paragraph> <paragraph id="H705BB920345042AD9D8836EF3FCCE71A"><enum>(2)</enum><header>Eligible retailer</header><text display-inline="yes-display-inline">The term <term>eligible retailer</term> means—</text> 
<subparagraph id="H24877B80E2DA41F584F47DF965B684CF"><enum>(A)</enum><text>a farmers market;</text></subparagraph> <subparagraph id="H1D520761F20946A186810680F49E1A13"><enum>(B)</enum><text>an independent grocer;</text></subparagraph> 
<subparagraph id="H2B2EE4CA53D54037BBD146F18A8DA674"><enum>(C)</enum><text>a farm stand;</text></subparagraph> <subparagraph id="HC9BD08A7C0504400959CD3C998ABF08B"><enum>(D)</enum><text>a supermarket; and</text></subparagraph> 
<subparagraph id="HC61B2ECEDEE14A7CAC35A10818632165"><enum>(E)</enum><text>such other retailers as the Secretary determines appropriate.</text></subparagraph></paragraph> <paragraph id="HE583E83540E14EEC9E10769B227D9C5E"><enum>(3)</enum><header>Household</header> <subparagraph id="HD3B2FC367B57477CAC4E18D5D467005E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>household</term> means a group of 1 or more individuals living together who customarily purchase food and prepare meals for consumption together at home.</text></subparagraph> 
<subparagraph id="HBAE94B3AA2084964858396231EABA99F"><enum>(B)</enum><header>Special rule</header><text>For the purposes of this paragraph, an individual who has not attained the age of 18 and who is attending an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) shall be deemed to be part of the household of the individual’s parents or caregivers.</text></subparagraph> </paragraph> <paragraph id="H008BAFF741EF401CB4E6CBE4C8D9B983"><enum>(4)</enum><header>Qualifying food</header><text>The term <term>qualifying food</term> means—</text> 
<subparagraph id="H586C2CDF4E004704B4ADAF19BB65911B"><enum>(A)</enum><text>any fresh, frozen, or dried fruit or vegetable with no added fat, sugar, or salt;</text></subparagraph> <subparagraph id="H794D71CA3E4C402DB44421A69F3CDBE4"><enum>(B)</enum><text display-inline="yes-display-inline">an herb; and</text></subparagraph> 
<subparagraph id="HAF3B2A96DA2C40EBB8DB377D1688EDA0"><enum>(C)</enum><text>a plant start that grows a food described in subparagraph (A).</text></subparagraph></paragraph> <paragraph id="HBA8A60B13FF64FB7A042C08EB9A7C88D"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph> 
<paragraph id="H91B1FDEF18FA40A1A9665DE2456404E8"><enum>(6)</enum><header>SNAP program</header><text display-inline="yes-display-inline">The term <term>SNAP program</term> means the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text></paragraph> <paragraph id="HFC05B9DEEAE24D06B7FD5A624066B438" commented="no"><enum>(7)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, and the territories and possessions of the United States.</text> </paragraph></subsection> 
<subsection id="H2AF8A03E972542C999FE738E9B01FC75"><enum>(j)</enum><header>Termination</header><text display-inline="yes-display-inline">The Fresh Bucks Pilot Program shall terminate on the date that is 5 years after the date of enactment of this Act.</text></subsection></section> </legis-body></bill>
