<section id="H0CBEDAFE956A4DCCB1D7BC7507A30136" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Spot the Fakes Act</short-title></quote>.</text></section> <section id="HD30D3B1E53FF4A3784E536F059F3A58C"><enum>2.</enum><header>Requirement to label AI-generated content as AI</header> <subsection id="H2BFD26B7B6584710BB094CAA6499C638"> <enum>(a)</enum> <header>Requirement To label as AI</header> <text display-inline="yes-display-inline">A person that owns or controls AI-generated content shall label such content as AI-generated within the metadata of the output or by any other technological means to provide indelible verification of provenance as determined appropriate by the Director of the National Institute of Standards and Technology.</text>
      </subsection> 
<subsection id="H39821E4120024A73863B788C4DDFAE57" commented="no"><enum>(b)</enum><header>Required method of disclosure</header><text>Not later than 6 months after the date of the enactment of this section, the Commission, in consultation with the Director of the National Institute of Standards and Technology, shall issue regulations that determine the method for how the label required under subsection (a) is shown in the metadata or by other technological means.</text> </subsection> <subsection id="H7D2593176C4240EDACD04AB0E07F2530" commented="no"><enum>(c)</enum><header>Enforcement by Federal Trade Commission</header> <paragraph id="H33E8D11155854E099B1D60D875E9F430" commented="no"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of subsection (a) or a regulation promulgated under such subsection shall be treated as a violation of a regulation under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph> 
<paragraph id="H7D7179392D074B92BFC12C9FF167E2C5" commented="no"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Federal Trade Commission shall enforce subsection (a) and any regulation promulgated under such subsection in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act. Any person who violates such subsection or a regulation promulgated under such subsection shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph> </subsection> <subsection id="H07A0D5F8A7B6483EA3CFF57877008E45"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H23FB4A49AD7D4B34883623FCD95EC45B"><enum>(1)</enum><header>Artificial Intelligence; AI</header><text>The terms <term>artificial intelligence</term> and <term>AI</term> have the meaning given the term <term>artificial intelligence</term> in the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph> <paragraph id="HF6169F28AE6F436B9AC54B8A4EAF7569"><enum>(2)</enum><header>AI-generated content</header><text display-inline="yes-display-inline">The term <term>AI-generated content</term> includes any video, image, audio, text, or any other medium that is generated by artificial intelligence.</text></paragraph> 
<paragraph id="HA1AFA4CF565C4618A3A1F97ECD626674"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph> <paragraph id="H0A9ECC5D40A94F4D9D18B6A8A697257E"><enum>(4)</enum><header>Metadata</header><text>The term <term>metadata</term> has the meaning given that term in section 3502 of title 44, United States Code.</text></paragraph></subsection></section>
