<section id="HABFEB3496DE54722BF4EBA46DF456F06" section-type="section-one"><enum>1.</enum><header>Pilot program for use by CBP at land ports of entry along the Arizona border of artificial intelligence through an anomaly detection algorithm</header> 
<subsection id="H04430F0CA2EA4D409D3F7AE278871B31" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, the Commissioner of U.S. Customs Border Protection (CBP) shall implement a pilot program to implement an anomaly detection algorithm that uses artificial intelligence to improve the screening, efficiency, inspection, and interdiction of illicit drugs and contraband at land ports of entry along the Arizona border. The anomaly detection algorithm shall be tested and assessed for the purpose of assisting CBP officers in such screening, inspection, and interdiction for such illicit drugs and contraband.</text></subsection> <subsection id="HF1782D95FE2F4F6E8A639FFDC0F702B0" commented="no"><enum>(b)</enum><header>Assessment</header><text display-inline="yes-display-inline">After implementing the pilot program under subsection (a), the Commissioner of CBP shall test and collect data regarding the anomaly detection algorithm’s ability to—</text> 
<paragraph id="HC31EBF44E4BF4B4189B2E2EFE1EB0448" commented="no"><enum>(1)</enum><text>assist with inefficiencies and understaffing of CBP officers;</text></paragraph> <paragraph id="H757D00D92FA34DF1A8D25E44E01EFD6E" commented="no"><enum>(2)</enum><text>improve thoroughness of inspections;</text></paragraph> 
<paragraph id="H254E64DE933D469ABFFAF71DAAC981C8" commented="no"><enum>(3)</enum><text>improve accuracy of illicit drug and contraband detection;</text></paragraph> <paragraph id="H722610859E89424FB7C02B5CDF6E5596" commented="no"><enum>(4)</enum><text>improve efficiency and processing times;</text></paragraph> 
<paragraph id="H5909A76A559D4485A787621C5B86C45A" commented="no"><enum>(5)</enum><text>improve intelligence efforts; and</text></paragraph> <paragraph id="H4F5FD7A6E674490ABC2A300228CE80EA" commented="no"> <enum>(6)</enum> <text>strengthen border security by combating trafficking of illicit drugs and contraband.</text>
                </paragraph></subsection> 
<subsection id="HA471AC82CDCC4FD697D38863C0C5AD95" commented="no"><enum>(c)</enum><header>Cybersecurity management</header><text>The Secretary of Homeland Security shall ensure the use of anomaly detection algorithm under this section—</text> <paragraph id="H17EB2EC0981548A492F60EB481F9E9E2" commented="no"><enum>(1)</enum><text>satisfies all Department of Homeland Security cybersecurity requirements; and</text></paragraph> 
<paragraph id="HDB81CC0A9AC94A38AA2739FCA3DCAE95" commented="no"><enum>(2)</enum><text>is subject to rigorous and ongoing cyber risk management.</text></paragraph></subsection> <subsection id="H32DA19F5CC7149F696D9FD3405F002A5" commented="no"><enum>(d)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Commissioner of CBP may work with the Secretary of Homeland Security, the Director of the Cybersecurity and Infrastructure Security Agency, or the head of any other Federal Government department or agency in the development, testing, and implementation of the anomaly detection algorithm.</text></subsection> 
<subsection id="HF98C4385F31F443580B12AD2361C6308" commented="no"><enum>(e)</enum><header>Private sector involvement</header><text>The Commissioner of CBP may solicit input and assistance from representatives of the private sector regarding the implementation of the pilot program under this section.</text></subsection> <subsection id="H445F7ACD483C4B488C405209BA7EF16E"><enum>(f)</enum><header>Termination</header><text>The pilot program under this section shall terminate on the date that is two years after the date of the enactment of this Act.</text></subsection> 
<subsection id="H6447B2AF199645FE9DDDBB5CFBD76F43" commented="no"><enum>(g)</enum><header>Reports</header> 
<paragraph id="H21EB84FB40244633BCB9237CAC25A5AE"><enum>(1)</enum><header>Progress reports</header><text display-inline="yes-display-inline">Not later than 180 days after the implementation of the pilot program under this section and biannually thereafter until the termination of such pilot program, the Commissioner of CBP shall submit to Congress a report that includes, as practicable, the following:</text> <subparagraph id="HF59622628E2441248BB07FA42E48E6FF"><enum>(A)</enum><text>Quantifiable metrics for the following:</text> 
<clause id="HA06D937F33E6498FA7151EFD7A6E3D17" commented="no"><enum>(i)</enum><text>The data collected in subsection (b).</text></clause> <clause id="HC6FAA90169C64C51B9735ECA2F5EAE69" commented="no"><enum>(ii)</enum><text>The probability of accurate detection and false alarm rate of the anomaly detection algorithm.</text></clause> 
<clause id="H9307F61537144EFC82D964464D754B62" commented="no"><enum>(iii)</enum><text>Operational costs of the anomaly detection algorithm.</text></clause> <clause id="HBB43425F771D418BB92274075B8DB810" commented="no"><enum>(iv)</enum><text>Estimated cost savings due to technological enhancements, if applicable from the anomaly detection algorithm.</text></clause></subparagraph> 
<subparagraph id="H9815C3B8BD534912AC150CC081EDD7A7"><enum>(B)</enum><text>Information relating to any successes or failures of such pilot program relating to the following:</text> <clause id="HF9704166957D41D08714BAB513DB9C28"><enum>(i)</enum><text>Cybersecurity management under subsection (c).</text></clause> 
<clause id="H9885CEE72AD746868815E6A208DD97E6"><enum>(ii)</enum><text>Coordination under subsection (d).</text></clause> <clause id="H0E7384E6CAA4472BA9C17F97168D48D2"><enum>(iii)</enum><text>Private sector involvement under subsection (e).</text></clause></subparagraph></paragraph> 
<paragraph id="H583F75D7F8C441EF96D710CDE7FF573D"><enum>(2)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 60 days after the termination of the pilot program under this section, the Commissioner of CBP shall submit to Congress a final report that includes the quantifiable metrics described in paragraph (1)(A) and the information described in paragraph (1)(B), together with recommendations for expanding the use of the anomaly detection algorithm, considering cost effectiveness.</text> </paragraph></subsection> <subsection id="HA2655B2F54DB459DBE3DA08D8167A425"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H2BA424CF17184740A39D6B924599B442" commented="no"><enum>(1)</enum><header>Anomaly detection</header><text display-inline="yes-display-inline">The term <quote>anomaly detection</quote> means the process of identifying rare events or outliers that deviate significantly from the norm in a collection of data.</text></paragraph> <paragraph id="H02038D3BCC6943859A678B75C805AD3B"><enum>(2)</enum><header>Artificial intelligence</header><text>The term <quote>artificial intelligence</quote> has the meaning given such term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph> </subsection></section>
