<section id="H91A51239009B456B9DDA4B45AD3CF767" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Anchors Away Act</short-title></quote>.</text></section> <section id="HD9D6879149BC47FA8DFF869188439789"><enum>2.</enum><header>Citizenship at birth for certain persons born in the united states</header> <subsection id="H55D6E2EE9A5A4BB3923BEF64547C8C72"><enum>(a)</enum><header>In general</header><text>Section 301 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1401">8 U.S.C. 1401</external-xref>) is amended—</text>
<paragraph id="HD2E0DAB80C0E43EEA302920329490B75">
                    <enum>(1)</enum>
 <text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general.—</header-in-text></quote> before <quote>The following</quote>;</text>
                </paragraph>
<paragraph id="H16E3A2AF64C143E38EDC0D01C8268D88"><enum>(2)</enum><text>by redesignating subsections (a) through (h) as paragraphs (1) through (8), respectively; and</text></paragraph> <paragraph id="HF6052FD9B14243C698E7F2EAC3915CA2"><enum>(3)</enum><text>by adding at the end the following:</text>

<subsection id="HA1F6F8166B3543A78B8457886B1235AA"><enum>(b)</enum><header>Definition</header><text>Acknowledging the right of birthright citizenship established by section 1 of the 14th amendment to the Constitution, a person born in the United States shall be considered <quote>subject to the jurisdiction</quote> of the United States for purposes of subsection (a)(1) if the person is born in the United States of parents, one of whom is—</text> <paragraph id="HE49C376A580E4C4AA50BEE28AE6DE8BC"><enum>(1)</enum><text>a citizen or national of the United States;</text></paragraph>
<paragraph id="H9F6AD856D6574019BD92D6DA3C17FD9F"><enum>(2)</enum><text>an alien lawfully admitted for permanent residence in the United States whose residence is in the United States; or</text></paragraph> <paragraph id="HE30F61BA0E484E34A0E7D7FC46B2B353"> <enum>(3)</enum> <text>an alien with lawful status under the immigration laws performing active service in the Armed Forces (as defined in section 101 of title 10, United States Code).</text>
              </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H6649C26BB955460994C697A3D48E4270"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall not be construed to affect the citizenship or nationality status of any person born before the date of the enactment of this Act.</text></subsection> <subsection id="H56EA1AB1DA98428F861C3B92A1063E3E"><enum>(c)</enum><header>Severability</header><text>If any provision of this section, or the application of such provision to any person or circumstance, is held to be unconstitutional, the remainder of this section, and the application of the provisions of this section to any other person or circumstance, shall not be affected thereby.</text></subsection></section>
<section id="H987D629850584FD797774D5A06960371"><enum>3.</enum><header>Inadmissibility of certain pregnant aliens</header><text display-inline="no-display-inline">Section 212(a)(10) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(10)</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="HD6A3D6468EAE47CFBFDA25ED34FD2FB3" style="OLC"> <subparagraph id="H88FEAF10E17546368BBBB1084D0A62C1"><enum>(F)</enum><header>Pregnant aliens not married to United States citizens</header> <clause id="H0495086CCDFE457EBC7C2AEB52B15225"><enum>(i)</enum><header>In general</header><text>Any alien seeking admission to the United States as a nonimmigrant who is pregnant and is not married to a citizen of the United States is inadmissible.</text></clause>
<clause id="H2A4C887AABD84E0BA2A67BED4D48A582"><enum>(ii)</enum><header>Rule of construction</header><text>Nothing in this subparagraph may be construed to render inadmissible an alien seeking legitimate medical treatment relating to childbirth.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HA13554839784434C9BECE3C0170EA882"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall take effect on the date of the enactment of this Act and shall apply to—</text>
<paragraph id="H8B04E8EE9FE146BDB2545824814BD57B"><enum>(1)</enum><text>any person born on or after such date of enactment; and</text></paragraph> <paragraph id="H80A5C927B58B4850B2D6BA2B0FD70D53"><enum>(2)</enum><text>any application for admission to the United States made on or after such date of enactment.</text></paragraph></section>
<section id="H5DE30A16EB634C5389C6045F94FE9481"><enum>5.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the application of such provision to any person or circumstance, is held to be unconstitutional, the remainder of this Act, and the application of the provisions of this Act to any other person or circumstance, shall not be affected thereby.</text></section> </legis-body></bill>
