<section id="H86482E8F655441D6AD1CF602CDBD7EDC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Support Our Miners Act</short-title></quote>.</text></section> <section id="H889201CBDE6C4CF1BCB76CBD74B9F6AE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HCEBDB6E7D69745658BF0EA80ABE819B1"><enum>(1)</enum><text display-inline="yes-display-inline">Tens of thousands of coal miners across the country are disabled by, or have died from, black lung disease. Such miners and their families rely on black lung benefits as provided under section 412 of the Black Lung Benefits Act (<external-xref legal-doc="usc" parsable-cite="usc/30/922">30 U.S.C. 922</external-xref>) to pay for their healthcare and to provide monthly compensation.</text></paragraph> <paragraph id="HDD7B6A5DEC59408294DA4185ADB6F37D"><enum>(2)</enum><text display-inline="yes-display-inline">When section 412 of the Black Lung Benefits Act (<external-xref legal-doc="usc" parsable-cite="usc/30/922">30 U.S.C. 922</external-xref>) was enacted in 1969, a miner received about $144.50 per month to help support their cost of living, equating to about $1,252.53 annually in today’s currency, adjusting for inflation.</text></paragraph> 
<paragraph id="HEB2C0383AFA74BE1993BC5D40705B494"><enum>(3)</enum><text display-inline="yes-display-inline">The benefit rate, as established in 1969, has not kept up with the cost of living. Today, miners receive nearly 40 percent less than the value of the original amount adjusting for inflation.</text></paragraph></section> <section id="H5E7ABD280BE943AC843F3AFEC2361ED0"><enum>3.</enum><header>Adequate benefits for miners</header><text display-inline="no-display-inline">Section 412(a) of the Black Lung Benefits Act (<external-xref legal-doc="usc" parsable-cite="usc/30/922">30 U.S.C. 922(a)(1)</external-xref>) is amended in the first paragraph—</text> 
<paragraph id="H12B5821BC4C644468E6B7FE05B5D533D"><enum>(1)</enum><text>by striking <quote>during the disability</quote> and inserting <quote>during the disability:</quote>; </text></paragraph> <paragraph id="H8E8A298653484ECE8E1C56103119CDB6"><enum>(2)</enum><text>by striking <quote>at a rate</quote> and inserting the following:</text>

<subparagraph id="HFDB2E8CE5231484EA6FCF3B4056384A8"><enum>(A)</enum><text display-inline="yes-display-inline">For any calendar year preceding 2026, at a rate </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H4333EC93231540C9A61FDB3C772F0C6B"><enum>(3)</enum><text>by striking <quote>step 1.</quote> and inserting </text> 
<quoted-block style="OLC" id="H421092DE1E5841238E1B49BE0985A86B" display-inline="yes-display-inline"><text display-inline="yes-display-inline">step 1.</text> <subparagraph id="HEED5D1456E52496EA155A4859AB121DE"><enum>(B)</enum><text>For calendar year 2026, for each month after the date of enactment of the <short-title>Support Our Miners Act</short-title> for which benefits are payable to such miner, at a monthly pay rate equal to the quotient of—</text> 
<clause id="H4C9ACE46B827427B8AA3369CCD35FF40"><enum>(i)</enum><text>$15,030, and</text></clause> <clause id="HCC431FAB0B234497BFFAB14D7E2E2136"><enum>(ii)</enum><text>12.</text></clause></subparagraph> 
<subparagraph id="HABBE83E202CF46D8B4D0FE5E14A18B76"><enum>(C)</enum><text>For calendar year 2027 and each succeeding calendar year—</text> <clause id="H8C0DC3101CA14BBAA14E8651D3056C74"><enum>(i)</enum><text>at an annual rate equal to the product of—</text> 
<subclause id="H2AE4F5AA67554B9FAF049F42FC692CF4"><enum>(I)</enum> 
<item id="H9E2697B32FB1443DA503D48528B559E6" display-inline="yes-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">for calendar 2027, $15,030; or</text></item> <item id="HD5D256D3486C414C80DB0E7124147267" indent="up1"><enum>(bb)</enum><text>for a calendar year after calendar year 2027, the annual rate determined under this subparagraph for the calendar year immediately preceding the calendar year for which the determination is being made under this subparagraph, and</text></item></subclause> 
<subclause id="H72B54622B65C4C4CA229B2414AFEFCD9" display-inline="no-display-inline"><enum>(II)</enum><text>the greater of one or the ratio of— </text> <item id="H321DDEA324D042859EF0A3301AC92EAA"><enum>(aa)</enum><text display-inline="yes-display-inline">the Consumer Price Index for Urban Wage Earners and Clerical Workers, as published by the Bureau of Labor Statistics, for the calendar year immediately preceding the calendar year for which the determination is being made under this subparagraph; to</text></item> 
<item id="HB222DBD869AD4C46BE96F879A848CE4A"><enum>(bb)</enum><text display-inline="yes-display-inline">such Consumer Price Index for the second calendar year preceding the calendar year for which the determination is being made under this subparagraph; and</text></item></subclause> </clause> <clause id="H18953E37C95D4FED92DF58A145DE8525"><enum>(ii)</enum><text>at a monthly rate equal to the quotient of—</text> 
<subclause id="H29C58C70563F4A9092432C4F2DE32DA8"><enum>(I)</enum><text display-inline="yes-display-inline">the annual rate determined under clause (i) for the calendar year for which the determination is being made under this subparagraph; and</text></subclause> <subclause id="HB1CC4151D50A43BBA9ACE45EB714FB68"><enum>(II)</enum><text>12.</text></subclause></clause> </subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph> </section>
