<section id="HA8A425869D4B44D7BEBADA70F16B6BC9" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fixing Egregiously Expensive Suits Act of 2026</short-title></quote> or as the <quote><short-title>FEES Act of 2026</short-title></quote>.</text></section> 
<section id="H0FB922DD515740E4B447D039E650662A"><enum>2.</enum><header>Modification of Equal Access to Justice provisions</header> 
<subsection id="H3E9C9C56782A4910ACBE02751125A988"><enum>(a)</enum><header>Agency proceedings</header> 
<paragraph id="HEF89F651BA484B0A979F19957B13578F"><enum>(1)</enum><header>Eligibility parties</header><text display-inline="yes-display-inline">Section 504(a)(1) of title 5, United States Code, is amended by inserting after <quote>prevailing party</quote> the following: <quote>who has a direct and personal monetary interest in the adjudication, including because of personal injury, private property damage, or unpaid agency disbursement,</quote>.</text></paragraph> <paragraph id="H4865F402CC6E4F3099414EC81F4D9C1B"><enum>(2)</enum><header>Limitation on awards</header><text>Section 504(a) of title 5, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H84B4E87BB18342BEBBEB56BAF9D7D57E" style="OLC"> 
<paragraph id="HBEB07CBEBBE84C46B03E57C2E7AF939D" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">A party may not receive an award of fees and other expenses under this section—</text> <subparagraph id="HB8FE14781B554F3E908BDEDD85FAC6BF"><enum>(A)</enum><text>in excess of $200,000 in any single adversary adjudication, or</text></subparagraph> 
<subparagraph id="HA48911BD771146A28C9C9752E294D21A"><enum>(B)</enum><text>for more than 3 adversary adjudications initiated in the same calendar year,</text></subparagraph><continuation-text continuation-text-level="paragraph">unless the prevailing party has filed and prevailed in a class action lawsuit or the Social Security Administration or Department of Veterans Affairs is a party in such action.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HF07CCB0C133B450485AB7869FD7997E3"><enum>(b)</enum><header>Civil actions</header><text display-inline="yes-display-inline">Section 2412(d)(1) of title 28, United States Code, is amended—</text> 
<paragraph id="HCDAA9096A39343A885700A590538792B"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text> <subparagraph id="H4A201D33FB544DF1920DC214216E0ACF"><enum>(A)</enum><text>by striking <quote>in any civil action</quote> and all that follows through <quote>jurisdiction of that action</quote> and inserting <quote>in the civil action</quote>; and</text></subparagraph> 
<subparagraph id="HEC8AA1E07BDD4D439DF088865F540AC0"><enum>(B)</enum><text>by striking <quote>shall award to a prevailing party other than the United States</quote> and inserting the following: <quote>, in any civil action (other than cases sounding in tort), including proceedings for judicial review of agency action, brought by or against the United States in any court having jurisdiction of that action, shall award to a prevailing party who has a direct and personal monetary interest in the civil action, including because of personal injury, private property damage, or unpaid agency disbursement, other than the United States,</quote>;</text></subparagraph></paragraph> <paragraph id="H3A021D56FFAC45ED8C613CBC73ACFE92"><enum>(2)</enum><text>in subparagraph (C)—</text> 
<subparagraph id="HEF8F8997DE2341F592E31CDBDA962122"><enum>(A)</enum><text>by striking <quote>, in its discretion, may reduce the amount to be awarded pursuant to this subsection, or deny an award,</quote> and inserting <quote>shall reduce the amount to be awarded under this subsection, or deny an award, commensurate with pro bono hours and related fees and expenses, or</quote>;</text></subparagraph> <subparagraph id="H3DF76FCF945D411AB2786798350A33BE"><enum>(B)</enum><text>by striking <quote>unduly and</quote>; and</text></subparagraph> 
<subparagraph id="HC028C7CCDE53466E83C7B1C4000EB101"><enum>(C)</enum><text>by striking <quote>controversy.</quote> and inserting <quote>controversy or acted in an obdurate, dilatory, mendacious, or oppressive manner, or in bad faith.</quote>; and</text></subparagraph></paragraph> <paragraph id="H682A0ABAD1964DD6813134F34136DF65"><enum>(3)</enum><text>by adding at the end, the following:</text> 
<quoted-block style="USC" id="H014B88D52FAB40BC8AA93FC5EA48F9BB" display-inline="no-display-inline"> 
<subparagraph id="HB41DFBCED6F8468E8631EEE2FEB31CE1"><enum>(E)</enum><text display-inline="yes-display-inline">An individual or entity may not receive an award of fees and other expenses under this subsection in excess of—</text> <clause id="HC29055FD4EC84DD5B61A981CA1E0418B"><enum>(i)</enum><text>$200,000 in any single civil action, or</text></clause> 
<clause id="H111F1BA40E73431AA07163ADE0B02208"><enum>(ii)</enum><text display-inline="yes-display-inline">for more than 3 civil actions initiated in the same calendar year, unless the prevailing party has filed and prevailed in a class action lawsuit or the Social Security Administration or Department of Veterans Affairs is a party in such action.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HF845BD7234A7484F92B92C4621758130"><enum>(c)</enum><header>Effective date</header><text>The amendments made by—</text> 
<paragraph id="HEB3EF3F0F0CE4818857EABA9AD62B477"><enum>(1)</enum><text>paragraphs (1) and (2) of subsection (a) shall apply with respect to adversary adjudications commenced on or after the date of the enactment of this Act; and</text></paragraph> <paragraph id="H925B409556A74BEB95343384466C7EDC"><enum>(2)</enum><text>subsection (b) shall apply with respect to civil actions commenced on or after such date of enactment.</text></paragraph></subsection></section> 
<section id="HE0AA1A9AEFDE4D029E79397351DE495A"><enum>3.</enum><header>Settlement agreements and consent decrees</header> 
<subsection id="H5B551DA9561B4D19B2A0D3AA5419C46E"><enum>(a)</enum><header>Limitation on attorneys’ fees and litigation costs</header><text display-inline="yes-display-inline">A settlement agreement or consent decree resulting in a regulation or guidance document with respect to which a Federal agency is a party may not include the payment of attorneys’ fees or litigation costs.</text></subsection> <subsection id="H7C76CBC1DD9C49D6AA1C12F393265AE9"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H6DA0D7789D5C4435B7D3B20B42C41251"><enum>(1)</enum><header>Guidance document</header><text>The term <term>guidance document</term>—</text> <subparagraph id="H155A274376B2412F9CDC29EE8F980F70"><enum>(A)</enum><text>means an agency statement of general applicability (other than a regulation that has the force and effect of law promulgated in accordance with the notice and public procedure under section 553 of title 5, United States Code) that—</text> 
<clause id="H9FE7437BF3F74342BD527A9EF2E4DCBD"><enum>(i)</enum><text>does not have the force and effect of law; and</text></clause> <clause id="HF0765BECCA9148409307661DDEA1E90F"><enum>(ii)</enum><text>sets forth—</text> 
<subclause id="H5431E69B5A1F4EFB95C6506139950FDF"><enum>(I)</enum><text>an agency decision or a policy on a statutory, regulatory, or technical issue; or</text></subclause> <subclause id="H8408C52150C74E5B8914C6E9AD434478"><enum>(II)</enum><text>an interpretation of a statutory or regulatory issue; and</text></subclause></clause></subparagraph> 
<subparagraph id="HCB2503322FF241C0B84AA36195D8CD73"><enum>(B)</enum><text>may include—</text> <clause id="HD7DEB9C74F95415FAD9E2E39633BCA87"><enum>(i)</enum><text>a memorandum;</text></clause> 
<clause id="HD4C83F8E1B8546AEA5C4E3CE6086DC6B"><enum>(ii)</enum><text>a notice;</text></clause> <clause id="H1E66E35E14394D65BFF6C39BC0737907"><enum>(iii)</enum><text>a bulletin;</text></clause> 
<clause id="HFD1DFDF0E1E64A62A30FC1EDBE60F828"><enum>(iv)</enum><text>a directive;</text></clause> <clause id="H3AE12C3765F6435C8814BE4B0C36FFF8"><enum>(v)</enum><text>a news release;</text></clause> 
<clause id="H0AA73DAF79AF43C5905E5BA1C4EE83CB"><enum>(vi)</enum><text>a letter;</text></clause> <clause id="HACFEF5FC56934736AA6E5EF684ACF5F4"><enum>(vii)</enum><text>a blog post;</text></clause> 
<clause id="HA2D02D37F744459CB9B384EA384C52D8"><enum>(viii)</enum><text>a no-action letter;</text></clause> <clause id="H37D7EF5FE98345B1807D963C0F57905E"><enum>(ix)</enum><text>a speech by an agency official;</text></clause> 
<clause id="H73EFBEBD1A8442FEAE636ACC9D062E53"><enum>(x)</enum><text>an advisory;</text></clause> <clause id="H53C7280E94B94442AA7BBBB063A79A4C"><enum>(xi)</enum><text>a manual;</text></clause> 
<clause id="HA97A77DA5CB44F72BB0134E72565447C"><enum>(xii)</enum><text>a circular; or</text></clause> <clause id="H3CFCDCC6E9684DD5ACD49709737405D2"><enum>(xiii)</enum><text>any combination of the items described in clauses (i) through (xii).</text></clause></subparagraph></paragraph> 
<paragraph id="HE5DC4780A2104870A59DD5E6640C2F39"><enum>(2)</enum><header>Regulation</header><text>The term <term>regulation</term>—</text> <subparagraph id="H514537B9A092473BBFCBB9E042DF9228"><enum>(A)</enum><text>means an agency statement of general applicability and future effect, which the agency intends to have the force and effect of law, that is designed to implement, interpret, or prescribe law or policy or to describe the procedure or practice requirements of an agency;</text></subparagraph> 
<subparagraph id="H0FBF08F476B544249935AB4BE672095D"><enum>(B)</enum><text>includes regulations issued pursuant to—</text> <clause id="H1124B8A20A57496DB34DF85B25545995"><enum>(i)</enum><text>an informal rulemaking under section 553 of title 5, United States Code;</text></clause> 
<clause id="H8659B3106D80471BB0140ED7AD4255D4"><enum>(ii)</enum><text>a formal rulemaking under sections 556 and 557 of title 5, United States Code; and</text></clause> <clause id="H5AA788CA32734CFF8130745D93E0B9DA"><enum>(iii)</enum><text>any combination of the informal rulemaking described in clause (i) and the formal rulemaking described in clause (ii); and</text></clause></subparagraph> 
<subparagraph id="HF0C78E128EB5400CBA292FFB141EF4A0"><enum>(C)</enum><text>does not include—</text> <clause id="H2CBEEA09E65848CBAEE8D80B95D1E59F"><enum>(i)</enum><text>regulations that pertain to a military or foreign affairs function of the United States, other than procurement regulations and regulations involving the import or export of non-defense articles and services;</text></clause> 
<clause id="HB89FB6C5B343463D951B76F05B8121B1"><enum>(ii)</enum><text>regulations or regulations that are limited to agency organization, management, or personnel matters; or</text></clause> <clause id="H7438C1E8308B47DE8012BDCB2802C52A"><enum>(iii)</enum><text>any other category of regulations exempted by the Administrator of Office of Information and Regulatory Affairs.</text></clause></subparagraph></paragraph></subsection></section> 
<section id="HC51A2F8AB13246E6BB88E6044947C2C1"><enum>4.</enum><header>Independent review and assessment</header> 
<subsection id="H87B48281B377429C8B48CF97AE3ECFF0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this Act, the Secretary of Interior shall assemble an independent scientific panel to conduct an assessment of the impacts of the provisions of this Act on the ecological, social, and economic sustainability of federally managed lands; including factors including—</text> <paragraph id="HEBB4AABA7C614A048ADD522DE4E3746D"><enum>(1)</enum><text>Federal forest and rangeland health;</text></paragraph> 
<paragraph id="HF844D53D3A7042B294593C4C5A6F6C4F"><enum>(2)</enum><text>susceptibility of Federal forests and rangelands to catastrophic wildfire and insect infestation;</text></paragraph> <paragraph id="HE535611F77D249B18FA34B067AB3C832"><enum>(3)</enum><text>biological diversity;</text></paragraph> 
<paragraph id="H54BB99D23C7C47E1886050D6EB9F656D"><enum>(4)</enum><text>watershed quality; and</text></paragraph> <paragraph id="H3BA16F4477A34FD7B4AC86EC16613AA0"><enum>(5)</enum><text>economic productivity of Federal forests and rangelands.</text></paragraph></subsection> 
<subsection id="H2D14BB20BECC4B559C92C450F07A616F"><enum>(b)</enum><header>Report</header><text>The panel shall report its conclusions upon completion of the assessment to the Committee on Natural Resources of the House of Representatives and to the Committee on Energy and Natural Resources of the Senate.</text></subsection> <subsection id="HA0F1A1A62B444ECC947536E4751615FA"><enum>(c)</enum><header>Scientific panel members</header><text>The panel shall consist of 5 members, appointed by the Secretary—</text> 
<paragraph id="H5BE9A8D62949457B84AF944EE24E34E6"><enum>(1)</enum><text>at least two of whom shall be hunters or anglers;</text></paragraph> <paragraph id="HEE86B558D3874723BFD59A69CC6E0FDA"><enum>(2)</enum><text>at least one of whom shall be affiliated with the forest products industry;</text></paragraph> 
<paragraph id="HF6DA52BFC2A043D3B1019E7243C8FE2D"><enum>(3)</enum><text>at least one of whom shall be affiliated with a rural water utility; and</text></paragraph> <paragraph id="H833C3A715F4C458A9FAA03E6222A9EF1"><enum>(4)</enum><text>at least one of whom shall be a wildlife biologist.</text></paragraph></subsection></section>
