<section id="HFA5CB71E8D434C308850FC68EE683262" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Care and Cost Coordination Act of 2026</short-title></quote>.</text></section> 
<section id="H23CECD4EB3ED450D9079500D211A0634"><enum>2.</enum><header>Memorandum of understanding for reciprocal access to certain health care data between the Secretary of Veterans Affairs and the Secretary of Health and Human Services</header> 
<subsection id="HE5B157276C9E4129ACECAAC3B4FD5CBF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall, for purposes of coordinating the costs, care, and management of hospital care and medical services furnished under the laws administered by the Secretary of Veterans Affairs, seek to enter into a memorandum of understanding with the Secretary of Health and Human Services with respect to reciprocal access between the Veterans Health Administration and the Centers for Medicare and Medicaid Services to data and information on veterans who are concurrently enrolled in the patient enrollment system under section 1705(a) of title 38, United States Code, and—</text> <paragraph id="HF4DB996940194DFD87A6881267D93B48"><enum>(1)</enum><text>the Medicare program; or</text></paragraph> 
<paragraph id="HB17DFEB0E41946229B6BC4536109C155"><enum>(2)</enum><text>a Medicare Advantage plan.</text></paragraph></subsection> <subsection id="HAC32DB7E48C04F66A7812E504CEBFFFC"><enum>(b)</enum><header>Agreement</header><text display-inline="yes-display-inline">The memorandum of understanding required under subsection (a) shall include an agreement through which—</text> 
<paragraph id="HFE46AF30D34641BEA0DE4E3E9A49B9FF"><enum>(1)</enum><text>the Secretary of Veterans Affairs transmits to the Secretary of Health and Human Services—</text> <subparagraph id="H8A532932C9BB41FB922DA45DEA8B0FF5"><enum>(A)</enum><text>information relating to veterans who are—</text> 
<clause id="HAEBBFBC7A9C84C7B85B6378E6FE51601"><enum>(i)</enum><text>enrolled in such system for patient enrollment; and</text></clause> <clause id="HE3DCEE9D6CEE454583CE55B415745C0E"><enum>(ii)</enum><text>in receipt of hospital care or medical services under laws administered by the Secretary of Veterans Affairs; and</text></clause></subparagraph> 
<subparagraph id="H9EEFD9F70C484DAF815B51FD05579E8F"><enum>(B)</enum><text>such other information as the Secretary of Veterans Affairs determines appropriate, including billing codes and diagnostic codes for such hospital care or medical services; and</text></subparagraph></paragraph> <paragraph id="H8C7DBF89B1D14A13A0AA58E4340FD6DD"><enum>(2)</enum><text>the Secretary of Health and Human Services—</text> 
<subparagraph id="H9F7FD3595D794ACDBB421D9C3624965E"><enum>(A)</enum><text>uses information transmitted pursuant to paragraph (1) to identify veterans who are concurrently enrolled in such system for patient enrollment and—</text> <clause id="HF19C441774CB49A398DD920A5091E0AC"><enum>(i)</enum><text>the Medicare program; or</text></clause> 
<clause id="HB225963A54934A07A489DA153F78BFAE"><enum>(ii)</enum><text>a Medicare Advantage plan; and</text></clause></subparagraph> <subparagraph id="H96366370EF624C8880A10857A221C0CB"><enum>(B)</enum><text>transmits to the Secretary of Veterans Affairs—</text> 
<clause id="H528557A9692D4ECEAD65798C35128C22"><enum>(i)</enum><text>a list of the veterans identified pursuant to subparagraph (A); and</text></clause> <clause id="H7213E16449AD4F1B825365C9946C7C21"><enum>(ii)</enum><text>such other information as the Secretary of Health and Human Services determines appropriate.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H255082680B35497597876EE28BFA5825" commented="no"><enum>(c)</enum><header>Care coordination under Veterans Community Care Program for concurrently enrolled veterans</header><text display-inline="yes-display-inline">The Secretary shall use information transmitted to the Secretary by the Secretary of Health and Human Services under the agreement required under subsection (b) to inform utilization management under the Community Care Next Generation Procurement Contract, or other successor contract awarded under the Veterans Community Care Program under section 1703 of title 38, United States Code, to—</text> <paragraph id="H11C54C9719A74B70AEFE383BCB28202F"><enum>(1)</enum><text>avoid duplicative health care to such veterans;</text></paragraph> 
<paragraph id="H74AF4C3278204648AE66E0F4495995BF"><enum>(2)</enum><text>avoid erroneous or duplicative payments for health care furnished to such veterans; and</text></paragraph> <paragraph id="H167444D4D6CF4082A75CCA9059C6A130"><enum>(3)</enum><text>inform veterans of beneficial or follow-up to services furnished pursuant to the Medicare program or a Medicare Advantage.</text> </paragraph></subsection> 
<subsection id="H2065D8863C8E47F4B3CFB4B42FFCFB6F" commented="no"><enum>(d)</enum><header>Calculation of benchmark payments</header><text display-inline="yes-display-inline">Section 1853(c)(1)(D)(iii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-23">42 U.S.C. 1395w–23(c)(1)(D)(iii)</external-xref>) is amended by adding at the end the following new sentence: <quote>In developing the estimate described in the preceding sentence, the Secretary shall use the information transmitted to the Secretary by the Secretary of Veterans Affairs pursuant to the memorandum of understanding required under the Veterans Care and Cost Coordination Act of 2026.</quote>.</text></subsection> <subsection id="H65B1208E2E48488B9D924E8C2676D68C" commented="no"><enum>(e)</enum><header>Report</header><text>Not later than one year after the date on which the Secretary of Veterans Affairs enters into the memorandum of understanding required under subsection (a), and on an biennial basis thereafter during the period such memorandum is effective, the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report that includes—</text> 
<paragraph id="H48A8D8C8E961461ABE372A4161A1630E" commented="no"><enum>(1)</enum><text>a summary of the activities of the Secretary carried out pursuant to such memorandum; and</text></paragraph> <paragraph id="H5499C91DF0484A2B8D866390E26BE62E" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of the Secretary with respect to the effectiveness of such memorandum in avoiding duplicative, improper, or erroneous billings or payments for hospital care and medical services furnished under the laws administered by the Secretary.</text></paragraph> </subsection> 
<subsection id="HE8AD1335C5D54AE9A683D0DD49C73461"><enum>(f)</enum><header>Medicare Advantage plan defined</header><text>In this section, the term <quote>Medicare Advantage plan</quote> means a Medicare Advantage plan under the program established under part C of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-21">42 U.S.C. 1395w–21 et seq.</external-xref>).</text> </subsection> </section> </legis-body></bill>
