<section id="H829DEEEDD2FA4BF1AAE81CCA77264A36" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Patriot Day Remembrance Flag Act</short-title></quote>.</text></section> <section id="HD8F2716491EA4DE7AF02665BD58B3B61"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H85C4C75F00104F2BABA1C23E475139B9"><enum>(1)</enum><text display-inline="yes-display-inline">September 11, 2001, will forever be one of the darkest days in the history of the United States.</text></paragraph> <paragraph id="HE1BBF61D2F2F47F28915057A5D3A482D"><enum>(2)</enum><text display-inline="yes-display-inline">Nearly 3,000 people, including citizens of over 90 nations, died as a direct result of the 9/11 terrorist attacks at the World Trade Center in New York, New York, the Pentagon in Arlington County, Virginia, and in Somerset County, Pennsylvania.</text></paragraph> 
<paragraph id="H3F3C36A0A7564DBB8D86F3745BFC68F4"><enum>(3)</enum><text display-inline="yes-display-inline">The first responders who served heroically at Ground Zero in the City of New York paid a heavy toll, with over 400 fire, police, and rescue members making the ultimate sacrifice.</text></paragraph> <paragraph id="H767C20F990E645F5B63FC7B9259BE7AA"><enum>(4)</enum><text display-inline="yes-display-inline">The Freedom Flag was designed by a Virginian on September 20, 2001, to foster the establishment of a national symbol of remembrance that honors and remembers the victims, heroic first responders, and all who were affected by the events of September 11, 2001.</text></paragraph> 
<paragraph id="H78FCBB1E341A4652BC8EADE99035A9B9"><enum>(5)</enum><text display-inline="yes-display-inline">The meaning of the Freedom Flag is illustrated by the colors and symbols of the flag, which are—</text> <subparagraph id="H819D42CC201D4D7E962AFE82688CC0D7"><enum>(A)</enum><text display-inline="yes-display-inline">an <quote>Old Glory</quote> blue background symbolizing all Americans united together for freedom;</text></subparagraph> 
<subparagraph id="H5E0FFFA8B5114FE9B60B37384AE0A44C"><enum>(B)</enum><text>one white star symbolizing all who live and died for freedom;</text></subparagraph> <subparagraph id="HF301069A7B834EC6828B4E6857EA248E"><enum>(C)</enum><text>five white bars symbolizing the Pentagon and the organized protection of our freedom;</text></subparagraph> 
<subparagraph id="HEEF2A6EADDFE4C14B75F157A97D16D3A"><enum>(D)</enum><text>one top <quote>Old Glory</quote> red stripe symbolizing the bloodshed of the people who perished at the Pentagon and the crew and passengers killed on American Airlines Flight 77;</text></subparagraph> <subparagraph id="HA7758FCF611B4EBEB2A798DF5F174FCD"><enum>(E)</enum><text>two broad <quote>Old Glory</quote> red stripes symbolizing the Twin Towers and the bloodshed of the people who perished at the World Trade Center and on American Airlines Flight 11 and United Airlines Flight 175;</text></subparagraph> 
<subparagraph id="HD3E4A968E9254375AB229DB008BD540C"><enum>(F)</enum><text>one bottom <quote>Old Glory</quote> red stripe symbolizing the bloodshed of the crew and passengers who perished on United Airlines Flight 93 in Pennsylvania; and</text></subparagraph> <subparagraph id="H9AD45B5263D6438B82F3A192B6285DA2"><enum>(G)</enum><text>three white stripes symbolizing the rescue workers, firefighters, police officers, Port Authority employees, and others who worked tirelessly during and after the terrorist attacks.</text></subparagraph></paragraph> 
<paragraph id="HE2D0EE6923324B5A925DD7AF516AD937"><enum>(6)</enum><text display-inline="yes-display-inline">On October 25, 2001, a flag maker sewed the first Freedom Flag and unveiled the flag on December 16, 2001.</text></paragraph> <paragraph id="HB105512C2C6F4FAF924E2E423B7F1BD8"><enum>(7)</enum><text display-inline="yes-display-inline">On November 12, 2001, the Freedom Flag was officially adopted by the Virginia Historical Society as part of a special exhibition in conjunction with the Smithsonian Institution to commemorate the events of 9/11.</text></paragraph> 
<paragraph id="H1935D4ABF774465697ACEA405CFCE15C"><enum>(8)</enum><text display-inline="yes-display-inline">The design of the 9/11 Remembrance Flag adheres to the five principles of <quote>Good Flag Design</quote> defined by the North American Vexillological Association.</text></paragraph> <paragraph id="H68E2A303078541658B7D37E2B7B45111"> <enum>(9)</enum> <text display-inline="yes-display-inline">In 2018, the Virginia General Assembly voted unanimously to add the 9/11 Remembrance Flag to the Code of Virginia as Virginia’s official flag of remembrance of the events of September 11, 2001, making it our nation’s first codified 9/11 remembrance flag when it was signed into law on March 30, 2018.</text>
      </paragraph> 
<paragraph id="H801DF15317E3457B88CF60FBF525D0D8"><enum>(10)</enum><text display-inline="yes-display-inline">The 9/11 Remembrance Flag has also been adopted by the legislatures of Oklahoma (May 16, 2022) and Delaware (Sept. 8, 2022), and has flown or been displayed on 9/11 and for Patriot Day lessons in all 50 states, including at thousands of schools, fire/rescue stations, police stations, and civic institutions.</text></paragraph> <paragraph id="HCBD488D5ECC8401482B8FB76312379A3"><enum>(11)</enum><text display-inline="yes-display-inline">Over 7,000 members of the Armed Forces of the United States have made the ultimate sacrifice in the Global War on Terrorism since September 11, 2001.</text></paragraph> 
<paragraph id="H8F3C27AC3FBB431B861AA2AE63E1A3EF"><enum>(12)</enum><text display-inline="yes-display-inline">The aftermath of 9/11 cleanup activities continues to take a toll on first responders, including over 3,000 who have perished due to 9/11-related illness since the attacks.</text></paragraph> <paragraph id="HC09695D8F8354D58A90E3EFB7C4D50F3"><enum>(13)</enum><text display-inline="yes-display-inline">The symbols of the Freedom Flag serve as a meaningful educational tool and a unifying emblem of patriotism and remembrance.</text></paragraph> 
<paragraph id="H8CB90221937049648D49FA509B93B0DE"><enum>(14)</enum><text display-inline="yes-display-inline">Nearly 100,000,000 Americans have been born since September 11, 2001, or were too young to remember the events that occurred on that day.</text></paragraph> <paragraph id="H6DA61ACE2C5D436A802B8CAF7BD7AB26"><enum>(15)</enum><text display-inline="yes-display-inline">The Freedom Flag memorializes the courageous and ongoing response of all Americans to threats against our freedom.</text></paragraph> 
<paragraph id="H9D3219372C47450CA65F8B1DEBCC1951"><enum>(16)</enum><text display-inline="yes-display-inline">The Freedom Flag is a symbol of our Nation’s concern and commitment to remembering all of the lives lost as a result of the terrorist attacks of September 11, 2001.</text></paragraph></section> <section id="HA8B1DD72A065480AB185E91DE0E47507" section-type="subsequent-section"><enum>3.</enum><header>Freedom Flag</header> <subsection id="H7D8BF499E4094F83947CB933298240C7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/9">Chapter 9</external-xref> of title 36, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" display-inline="no-display-inline" id="H99E95F00F0874CECA40A8A9720E8E795"> 
<section id="H4F77BF5EE7F548918A69B4E49FBE64D1"><enum>905.</enum><header>Freedom Flag</header> 
<subsection id="HA3AD9C86C1904036845352C35C0A90EA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Freedom Flag is designated as the national symbol of remembrance for September 11, 2001, and to support educational efforts of teaching future generations about the tragic events and many lives lost on such date, including programming through the 9/11 Memorial Museum and the Pentagon Memorial Foundation.</text></subsection> <subsection id="H76F1AAFA305A4D85958FA575D9D7D765"><enum>(b)</enum><header>Required display</header><text display-inline="yes-display-inline">The Freedom Flag shall be displayed each year on Patriot Day, from September 11 through the end of September at—</text> 
<paragraph id="H4578B6E10EA14C478F65635324AD2E85"><enum>(1)</enum><text>the Capitol;</text></paragraph> <paragraph id="H0449B84E277C459CA298AF3CEC4DDD0A"><enum>(2)</enum><text>the White House;</text></paragraph> 
<paragraph id="HF492451829B44C51B98C34FE7D0DB56B"><enum>(3)</enum><text>each national cemetery;</text></paragraph> <paragraph id="H7CCB2F862D6B49A989B4F9AB10FD4A9C"><enum>(4)</enum><text>each major military installation, as designated by the Secretary of Defense;</text></paragraph> 
<paragraph id="H4FA4D0755CB7434687D1AC312740EA07"><enum>(5)</enum><text>the building containing the official office of—</text> <subparagraph id="H47595A7EB4ED4256906CCA0CC147C47B"><enum>(A)</enum><text>the Secretary of State;</text></subparagraph> 
<subparagraph id="HC32C4A30C8A44EC289A2B058F77BDB6C"><enum>(B)</enum><text>the Secretary of Defense; and</text></subparagraph> <subparagraph id="H7CDCC46458B44D18A487010D3B7E09A1"><enum>(C)</enum><text>the Secretary of Veterans Affairs; and</text></subparagraph></paragraph> 
<paragraph id="H4780EFA1C44A46ED8A98206A1DAA467C"><enum>(6)</enum><text>each United States Postal Service post office.</text></paragraph></subsection> <subsection id="H752884B75897468C97BA3E9F58EEB060"><enum>(c)</enum><header>Display visible to public</header><text display-inline="yes-display-inline">The Freedom Flag shall be displayed pursuant to subsection (b) in a manner designed to ensure visibility to the public.</text></subsection> 
<subsection id="H5CD2AE9C2AA34D83B85E4D3A57E3F62C"><enum>(d)</enum><header>Order of precedence</header><text>Notwithstanding any other provision of law, the Freedom Flag shall follow the POW/MIA Flag in any order of precedence.</text></subsection> <subsection id="H0E73C63F557A42098C7A40EC6C04416E"><enum>(e)</enum><header>Flag materials</header><text display-inline="yes-display-inline">The disposal and retirement of the Freedom Flag shall comply with Veterans Affairs retirement and flag disposal practices.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H78A0B03719A745D088215D084C7254FE"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/9">chapter 9</external-xref> of title 36, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H69E69316AE1B4D55A6A3D546D0264EF7"> <toc regeneration="no-regeneration"> <toc-entry level="section">905. Freedom Flag.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body></bill>
