<section id="HE72AE0C95E4D44A7B6A6F43155014675" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Kidney Disease Education Access Expansion Act of 2026</short-title></quote>.</text> </section> <section id="H462403E1BAFE4DC8A043B3F4FFAA3466"><enum>2.</enum><header>Expanding coverage of kidney disease education services under Medicare</header> <subsection id="H3C3DCF510C1344D88CF23DC9DAAACF85"><enum>(a)</enum><header>Kidney disease education services and kidney disease screening</header> <paragraph id="HFAAA0736341347EFA8277378B6F90B0C"><enum>(1)</enum><header>Providers of kidney disease education services</header><text>Section 1861(ggg)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ggg)(2)(A)</external-xref>) is amended to read as follows:</text>

<subparagraph id="HCB8874222C544B85B2F185BE8C36126A" commented="no"><enum>(A)</enum><text>The term <term>qualified person</term> means—</text> <clause id="H712D335D13724431A165554B83A168F7" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">a physician (as defined in section 1861(r)(1)) or a physician assistant, registered nurse, nurse practitioner, or clinical nurse specialist (as defined in section 1861(aa)(5)), who furnishes services for which payment may be made under the fee schedule established under section 1848;</text></clause> 
<clause id="H2AF32BD0789F4C389DB9974FBB8751DB"><enum>(ii)</enum><text display-inline="yes-display-inline">a provider of services located in a rural area (as defined in section 1886(d)(2)(D));</text></clause> <clause id="HACAA54071E4F450E9FE74A3A0F0BA915" commented="no"><enum>(iii)</enum><text>a clinical social worker (as defined in section 1861(hh)(1));</text></clause> 
<clause id="H2AEE402D3F4A49C089BB1C51D1D68D9A" commented="no"><enum>(iv)</enum><text>a registered dietitian or nutrition professional (as defined in section 1861(vv)); or</text></clause> <clause id="H7451FA2E6CDB486199C484EFECADBDAC"><enum>(v)</enum><text display-inline="yes-display-inline">any other individual, such as a community health worker, who is trained (in a manner determined appropriate by the Secretary) to assist in the delivery of kidney disease education services under the direction of a qualified entity described in any of clauses (i), (iii), or (iv).</text></clause> </subparagraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H973E46D5D34A4C4A9184AA6E4ABAD63A"><enum>(2)</enum><header>Eligibility for kidney disease education services</header><text display-inline="yes-display-inline">Section 1861(ggg)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ggg)(1)(A)</external-xref>) is amended by striking <quote>an individual with stage IV chronic kidney disease who, according to accepted clinical guidelines identified by the Secretary, will require dialysis or a kidney transplant</quote> and inserting <quote>an individual with hypertension, diabetes, any stage of chronic kidney disease, or other risk factors for kidney disease progression or kidney failure as determined by the qualified entity</quote>.</text></paragraph> <paragraph id="HA3ACE8CEEFE34BC7B18CB9CF66E413C5"><enum>(3)</enum><header>Scope of kidney disease education services</header> <subparagraph id="H59A80286D57542EC9ECDEB35AFA30311"><enum>(A)</enum><header>Permitting group services and presence of caregivers</header><text display-inline="yes-display-inline">Section 1861(ggg)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ggg)(1)(A)</external-xref>), as amended by <internal-xref idref="H973E46D5D34A4C4A9184AA6E4ABAD63A" legis-path="2.(a)(2)">paragraph (2)</internal-xref>, is further amended—</text> 
<clause id="HBB1F929EA7B1459D9BA1C166F1997679"><enum>(i)</enum><text>by inserting <quote>in an individual or group setting</quote> after <quote>furnished</quote>; and</text></clause> <clause id="HB4AC7E01C2DE47CA9D3ECA68655B49D6"><enum>(ii)</enum><text>by inserting <quote>(and, at the option of the individual, in the presence of such individual’s caregiver)</quote> before the semicolon at the end.</text></clause></subparagraph> 
<subparagraph id="HF392F1167E8541F7B5EEC327CFED4F03"><enum>(B)</enum><header>Expanding scope of services</header><text display-inline="yes-display-inline">Section 1861(ggg)(1)(C)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ggg)(1)(C)(i)</external-xref>) is amended—</text> <clause id="HBE446FC25663492AA3FFE972B84490DE"><enum>(i)</enum><text display-inline="yes-display-inline">in subclause (II), by striking <quote>and</quote> at the end; and</text></clause> 
<clause id="H2D53F17F396A4AD4A7FF2698642614D0"><enum>(ii)</enum><text>by adding at the end the following new subclauses:</text> <quoted-block id="H9CD2FAF266004F1593D050278522C383" style="OLC"> <subclause id="H172046B2F29D4BE4B87AFC38ACFE08FB" indent="up1"><enum>(IV)</enum><text>therapeutic options to slow kidney function decline in individuals with kidney disease who are at risk of kidney disease progression or kidney failure;</text></subclause> 
<subclause id="H20F4FA485FDA4EB4A05FA1C1213105ED" commented="no" indent="up1"><enum>(V)</enum><text>caregiver training and support for new transplant recipients;</text></subclause> <subclause id="HAAC062DE11864035B9BB90B9D48844DF" indent="up1" commented="no"><enum>(VI)</enum><text display-inline="yes-display-inline">basic transition assistance for individuals who have received a kidney transplant, including education on general post-transplant self-care, coordination of follow-up care, and referral to a transplant nephrologist or other appropriate transplant specialist for ongoing clinical management of transplant-related medical needs; and</text></subclause> 
<subclause id="H58879DB170B34C0F87D543932783D56D" commented="no" indent="up1"><enum>(VII)</enum><text>such other topics as the Secretary deems appropriate for patient safety and optimal transplant outcomes;</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph> </subsection> <subsection id="HBF0089D1A4FF42AF8799A0853C944EEB"><enum>(b)</enum><header>Initial preventive physical examination</header><text>Section 1861(ww)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ww)(2)</external-xref>) is amended—</text> 
<paragraph id="H2AE0738380F24A2B85665AD04AFC9FDD"><enum>(1)</enum><text>in subparagraph (N), by adjusting the margin of such subparagraph 2 ems to the left;</text></paragraph> <paragraph id="HED8168E1846E47A183848994273426AC"><enum>(2)</enum><text>by redesignating subparagraph (O) as subparagraph (P); and</text></paragraph> 
<paragraph id="H9988CF50081C4A3BBC6D9946F99EC87D"><enum>(3)</enum><text>by inserting after subparagraph (N) the following new subparagraph:</text> <quoted-block id="H8878A600695C4EF6BCF8C565F0820609" style="OLC"> <subparagraph id="H786CF83FB4534C5B847111FA153DF2A4" indent="up1" commented="no"><enum>(O)</enum><text>Screening for chronic kidney disease, kidney failure, and rare kidney diseases (as determined by the Secretary) and kidney disease education services as described in subsection (ggg).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB04C42CA8C17479FBFEC016DBDA3C26C"><enum>(c)</enum><header>Annual wellness visit</header><text>Section 1861(hhh)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(hhh)(2)</external-xref>) is amended—</text> <paragraph id="H222CEF18BB384924801E37DED998DCE9"><enum>(1)</enum><text>in subparagraphs (G) and (H), by adjusting the margin of each such subparagraph 1 em to the left;</text></paragraph> 
<paragraph id="H1820DA545F514CD09CF3D602E7F9DA82"><enum>(2)</enum><text>by redesignating subparagraph (I) as subparagraph (J); and</text></paragraph> <paragraph id="HC838CAABB80148CC9ACE53A648CB5E60"><enum>(3)</enum><text>by inserting after subparagraph (H) the following new subparagraph:</text> 
<quoted-block style="OLC" id="H843DE3DDF4EB4A05B1947B9317724A07" display-inline="no-display-inline"> 
<subparagraph id="HEE092D6C6FD846DE96AFB5E9E3790D3A" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">Screening for chronic kidney disease and kidney failure through routine metabolic and urinary assessments consistent with standard clinical practice, as determined by the Secretary, and through such additional screening tests or assessments (which may include new and emerging diagnostic tools) as the Secretary determines appropriate, and a referral, as appropriate, for kidney disease education services as described in subsection (ggg).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HCE99753395E0433FA87F0DE462AB72BD" commented="no"><enum>(d)</enum><header>Number of kidney disease education sessions</header><text>Section 1861(ggg)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ggg)(4)</external-xref>) is amended by striking <quote>more than 6 sessions of kidney disease education services under this title</quote> and inserting <quote>a number of sessions of kidney disease education services under this title that exceeds the number of such sessions that the Secretary, in consultation with individuals described in paragraph (1)(A), caregivers, and qualified persons (as defined in paragraph (2)), determines is appropriate</quote>.</text> </subsection> 
<subsection id="HB9FCDF75353146E5B729C6E6C449EA67"><enum>(e)</enum><header>Furnishing kidney disease education services through telehealth</header><text>Section 1834(m)(4)(F) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(4)(F)</external-xref>) is amended by inserting <quote>, kidney disease education services (as defined in section 1861(ggg))</quote> before <quote>, and any additional service</quote>.</text> </subsection> <subsection id="H39066CC4BEB542C787454E5CC59BF02C"><enum>(f)</enum><header>Payment rules</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text> 
<paragraph id="H8A6E17E87EE94F6AA0EC1EAFFEEFE4D5"><enum>(1)</enum><text>in subparagraph (GG), by striking <quote>and</quote> at the end; and</text></paragraph> <paragraph id="H9E1F8450E5E7405081F7799FE3E5E47E" commented="no"><enum>(2)</enum><text>by inserting <quote>, and (II) with respect to kidney disease education services (as defined in section 1861(ggg)(1)), the amount paid shall be 100 percent of the lesser of the actual charge for the services or the amount determined under the payment basis determined under section 1848</quote> before the semicolon at the end.</text> </paragraph></subsection> 
<subsection id="HFD0DA04763764A4985F2E3F52E1F97D4"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to services furnished on or after January 1, 2027.</text></subsection> </section> <section id="H051A1F92C8B94D1F931275AE94886FC7" commented="no"><enum>3.</enum><header>Kidney disease education effectiveness working group; kidney disease education assessment</header> <subsection id="HF090E49755044AAD8F00482767F47CC1" commented="no"><enum>(a)</enum><header>Kidney disease education effectiveness working group</header> <paragraph id="H8789DE0E38A64E1BB459BB69DF071ECE" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Kidney Disease Education Access Expansion Act of 2026</short-title>, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall convene a working group to develop and evaluate methodologies for measuring patient benefit and educational effectiveness from kidney disease education services under section 1861(ggg) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ggg)</external-xref>).</text></paragraph> 
<paragraph id="H6D2FF10097F94BCCAF142E6C693E817D" display-inline="no-display-inline" commented="no"><enum>(2)</enum><header>Composition</header><text>The working group shall consist of—</text> <subparagraph id="H373AEA2F7ECB42BFB7E777FDE7FE854F" commented="no"><enum>(A)</enum><text>qualified entities that furnish kidney disease education services;</text></subparagraph> 
<subparagraph id="HC126B258879148229ADC4AB10767563E" commented="no"><enum>(B)</enum><text>individuals with kidney disease and their caregivers;</text></subparagraph> <subparagraph id="H84691C0F9451480E96607A12D1D782F5" commented="no"><enum>(C)</enum><text>health care technology specialists;</text></subparagraph> 
<subparagraph id="HCEAE1FA267CC47A9B94C70305C8FABA9" commented="no"><enum>(D)</enum><text>learning and educational assessment specialists; and</text></subparagraph> <subparagraph id="HBC982B0EA6564329856595341317A108" commented="no"><enum>(E)</enum><text>representatives from the Centers for Medicare &amp; Medicaid Services.</text></subparagraph></paragraph> 
<paragraph id="H7C1C8858BE0C4EDF88295A4A98AA9924" commented="no"><enum>(3)</enum><header>Duties</header><text>The working group shall—</text> <subparagraph id="HAC4B9D2F60AA4991A7A8701533499E86" commented="no"><enum>(A)</enum><text>develop evidence-based methodologies for assessing patient comprehension, behavior change, and clinical outcomes resulting from kidney disease education services;</text></subparagraph> 
<subparagraph id="HEB8CDF87B94A4827845563C46A86A602" commented="no"><enum>(B)</enum><text>account for diverse learning styles and the impact of kidney disease on cognitive function in developing assessment tools;</text></subparagraph> <subparagraph id="HCB5F401FD84940CBA2A9461D8F8E8B87" commented="no"><enum>(C)</enum><text>recommend standardized metrics for evaluating the effectiveness of different educational approaches and delivery methods; and</text></subparagraph> 
<subparagraph id="H47D8401D3D4F4C61868B2A9BADCA4436" commented="no"><enum>(D)</enum><text>provide recommendations for quality improvement strategies based on patient-centered outcomes.</text></subparagraph></paragraph> <paragraph id="H57A9EFBD1991440F9209EB489098AE05" commented="no"><enum>(4)</enum><header>Report</header><text>Not later than 18 months after the working group is convened under <internal-xref idref="H8789DE0E38A64E1BB459BB69DF071ECE" legis-path="3.(a)(1)">paragraph (1)</internal-xref>, the working group shall submit a report to the Secretary and Congress and make publicly available its recommendations for measuring and improving kidney disease education effectiveness.</text></paragraph> </subsection> 
<subsection id="HEF22909E18D04BDF8EC769774C6EC9EE" commented="no"><enum>(b)</enum><header>Kidney disease education assessment</header> 
<paragraph id="HA31AEC6482F24B299A41411F942EBD00" commented="no"><enum>(1)</enum><header>Establishment of assessment framework</header><text display-inline="yes-display-inline">Not later than 2 years after the Secretary receives the report of the working group under <internal-xref idref="H57A9EFBD1991440F9209EB489098AE05" legis-path="3.(a)(4)">subsection (a)(4)</internal-xref>, the Secretary shall, taking into account the recommendations included in such report, establish a comprehensive assessment framework to evaluate the success and effectiveness of kidney disease education services provided under section 1861(ggg) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ggg)</external-xref>).</text></paragraph> <paragraph id="HE5EDCCCB46A447F889BDB436FAA323A8" display-inline="no-display-inline" commented="no"><enum>(2)</enum><header>Scope of authority</header><text>In establishing and implementing the assessment framework under <internal-xref idref="HA31AEC6482F24B299A41411F942EBD00" legis-path="3.(b)(1)">paragraph (1)</internal-xref>, the Secretary shall—</text> 
<subparagraph id="HCD1B1EB05BD845FEA928337FA4ECA95E" commented="no"><enum>(A)</enum><text>determine the specific methodologies, tools, and metrics to be used in assessing patient outcomes, educational effectiveness, and program success;</text></subparagraph> <subparagraph id="HC9093F23BC754F5792EAA75C2399BEDE" commented="no"><enum>(B)</enum><text>establish the frequency and timing of assessments, which may vary based on qualified entity type, patient population served, or other relevant factors;</text></subparagraph> 
<subparagraph id="H1CB5FE4592C9422090EFC9FDFEB7AF3B" commented="no"><enum>(C)</enum><text>specify data collection requirements and procedures for qualified entities providing kidney disease education services;</text></subparagraph> <subparagraph id="HB9EEAE21DBBA4CC5BA12D76DA118CEC8" commented="no"><enum>(D)</enum><text>modify assessment criteria and procedures as needed based on evidence, outcomes data, or changes in clinical practice guidelines;</text></subparagraph> 
<subparagraph id="H952A12601D7C4667929B2E8F5A127470" commented="no"><enum>(E)</enum><text>establish reporting requirements for assessment results and their use in program improvement; and</text></subparagraph> <subparagraph id="H1D09C6A717094441AF65C6A7A188549C" commented="no"><enum>(F)</enum><text>coordinate with relevant Federal agencies, professional organizations, and stakeholders to ensure assessment activities align with broader health care quality initiatives.</text></subparagraph></paragraph> 
<paragraph id="H80DF334365724899B6F04B1A136291F0" commented="no"><enum>(3)</enum><header>Implementation flexibility</header><text>The Secretary may implement the assessment framework under <internal-xref idref="HA31AEC6482F24B299A41411F942EBD00" legis-path="3.(b)(1)">paragraph (1)</internal-xref> through guidance, regulations, pilot programs, or other mechanisms as deemed appropriate, and may phase implementation across different qualified entity types or geographic regions as necessary.</text></paragraph> <paragraph id="H1693F6F59C9B4634B7EDC6CA2A1F8AE0" commented="no"><enum>(4)</enum><header>Continuous improvement</header><text>The Secretary shall use assessment results to identify opportunities for program improvement, best practices, and evidence-based modifications to kidney disease education services, and may adjust payment policies, coverage criteria, or quality measures based on assessment findings.</text></paragraph></subsection> </section> 
<section id="H617B81F130FE48319B83D6EA092623C6"><enum>4.</enum><header>Including kidney disease education services as a preventive service under private health insurance</header> 
<subsection id="H6FBF545E738C43A39993EEC9859A11A3"><enum>(a)</enum><header>In general</header><text>Section 2713(a) of the Public Health Service Act (42 U.S.C. 300gg—13(a)) is amended—</text> <paragraph id="H95DF33B4780B40B284C77B4E4C800939"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HAE1825392FAF43CBA8891CF32628A874"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting a semicolon;</text></paragraph> <paragraph id="H5BB4246C6D014DA2A5C7B700DF9D4992"><enum>(3)</enum><text>in paragraph (4), by striking the period at the end and inserting a semicolon;</text></paragraph> 
<paragraph id="HB741E784A46C4D3783F8D20B09349B58"><enum>(4)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="HEA5B1962E5B343928A8B06ED49C4FAB7"><enum>(5)</enum><text>by adding at the end the following new paragraph:</text>
