<section id="HA2B259F63E47497B945E1E062BB0B0F0" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Simplified Medical Out-of-pocket Obligations Through Hassle-free Payments Act</short-title></quote> or the <quote><short-title>SMOOTH Payments Act</short-title></quote>.</text></section> 
<section id="HBBEADF1C089548BBAA2B68B7BCF67EE9"><enum>2.</enum><header>Smoothing out-of-pocket costs for qualified health plan enrollees</header> 
<subsection id="H509709C4C4364E6F8ACE5020858EE872"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/36B">Section 36B(c)(3)(A)(i)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>shall not include a qualified health plan which is a catastrophic plan described in section 1302(e) of such Act.</quote> and inserting</text> <quoted-block style="OLC" id="H1772390AD56443C2BE77097642CBEE32" display-inline="yes-display-inline"><text display-inline="yes-display-inline">shall not include—</text> 
<subclause id="H3D7D56457AA5443D80AD6E98636435CA"><enum>(I)</enum><text display-inline="yes-display-inline">any qualified health plan which is a catastrophic plan described in section 1302(e) of such Act, or</text></subclause> <subclause id="H82AB914C5F31403D8229CD82897BD1FF"><enum>(II)</enum><text>any qualified health plan offered by a health insurance issuer that does not offer at least one qualified health plan which provides to each individual enrolled in such plan the option to elect to—</text> 
<item id="HE95A5143E2A24336BA726758E6AF318B"><enum>(aa)</enum><text>pay $0 in cost-sharing at the time that such individual is furnished an item or service for which benefits are available under the plan, and</text></item> <item id="H5742A967B1BF4C4395D111F2A645AF75"><enum>(bb)</enum><text>pay cost-sharing under the plan in monthly amounts which are capped in a manner similar to the manner provided in subparagraph (E) of section 1860D–2(b)(2) of the Social Security Act, or in any other manner prescribed by the Secretary of Health and Human Services.</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCAE3A6C386E34E4798DFE355C2B0632F"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after December 31, 2026.</text> </subsection></section> </legis-body></bill>
