<section id="HA052A5ACE6CB4785A87B080935252E7B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Voluntary Consumer AI Disclosure Pilot Act</short-title></quote>.</text></section> <section id="H00EA66DB5D7947788910921D99FF0149"><enum>2.</enum><header>Pilot program</header><text display-inline="no-display-inline">Section 22A of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278h-1">15 U.S.C. 278h–1</external-xref>) is amended—</text> 
<paragraph id="HB179869AFB864537BE618BF7E04D2B26"><enum>(1)</enum><text>by redesignating subsections (c) through (h) as subsections (d) through (i), respectively;</text></paragraph> <paragraph id="H54DD39DFCC4D4EA4A45DC8356C476B82"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection:</text>

            <enum>(c)</enum>
            <header>Pilot program; consumer disclosure for real-Time interaction</header>
            <paragraph id="HBA75C74B0D9446C78552DC866D59F259">
              <enum>(1)</enum>
              <header>In general</header>
 <text>Not later than 1 year after the date of the enactment of this subsection, the Director shall carry out the following:</text>
              <subparagraph id="HC06533DB29ED43A8BF395FC231CF0B85">
                <enum>(A)</enum>
 <text>Establish a pilot program—</text> <clause id="HE8FF7B20F8F04D3E95D3BBE3BA6722F6"> <enum>(i)</enum> <text>to evaluate voluntary approaches for provenance and disclosures of content produced or manipulated by artificial intelligence, including how a private sector entity may disclose to a user of a product or service of such entity—</text>
                  <subclause id="HDD757EB6F3C5418D97FAB9B44D2A34E8">
                    <enum>(I)</enum>
 <text>any content generated by an artificial intelligence system with which such user may engage; and</text>
                  </subclause>
                  <subclause id="HB747BF3CF62E405B8F11D9FDF2B362D5">
                    <enum>(II)</enum>
 <text>instances of any direct, real-time interaction by such user with such system; and</text>
                  </subclause>
                </clause>
                <clause id="H9C18903BA38444C58D3D8FA45DE639C5">
                  <enum>(ii)</enum>
 <text>that is informed by consumer product labeling programs in existence as of such date of establishment.</text>
                </clause>
              </subparagraph>
              <subparagraph id="H59745E53A83E4D238E4B30E258265B6C">
                <enum>(B)</enum>
 <text>Based on such pilot program, support the development of guidelines, best practices, and voluntary standards for the disclosure of content produced or manipulated by artificial intelligence described in subparagraph (A).</text>
              </subparagraph>
              <subparagraph id="HC666D2766734497FB6D5D5EBE7C0C184">
                <enum>(C)</enum>
 <text>Not later than 180 days after completing the pilot program under subparagraph (A), submit to the Committee on Science, Space, and Technology, and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the outcomes of the pilot program, including—</text>
                <clause id="HD993B4BDB3AB438D8B9BCD8B2A12ADBC">
                  <enum>(i)</enum>
 <text>findings regarding the feasibility, usefulness, and limitations of the disclosure and content provenance approaches evaluated through the pilot program; and</text>
                </clause>
                <clause id="H388F2E5D18264DDDA12C9CC8D90356A9">
                  <enum>(ii)</enum>
 <text>recommendations, if any, for further congressional or administrative action.</text>
                </clause>
              </subparagraph>
            </paragraph>
            <paragraph id="HA46F2BE845DF4AC882E6EB634B9EFC51">
              <enum>(2)</enum>
              <header>Consultation</header>
 <text>In carrying out paragraph (1), the Director shall carry out the following:</text>
              <subparagraph id="HCFBFA41553614E34AAC14F69981B3A8E">
                <enum>(A)</enum>
 <text>Consult with the heads of appropriate Federal departments and agencies.</text> </subparagraph> <subparagraph id="H84A66AF1BF36473E8716E0BDC4518991"> <enum>(B)</enum> <text>Seek to consult with the following:</text>
                <clause id="H7B2FB33C9A344BFD89D4642466ADDC6E">
                  <enum>(i)</enum>
 <text>Appropriate private sector entities of different sizes.</text> </clause> <clause id="H68CF4AB4D7B94373A5FAF54161B63F37"> <enum>(ii)</enum> <text>Civil society.</text>
                </clause>
                <clause id="H7C5FDE06FEEF47308B13FFA22C1CB6EB">
                  <enum>(iii)</enum>
 <text>Academia.</text> </clause> </subparagraph> </paragraph> </subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H4E5EAF14DF8E4D81B61F1F215EA6EC16"><enum>(3)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H7308E992DB024AFABB706B5FD8A2E1C6"><enum>(j)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H60679044FB5E45928AA26CB7A5A00B81"><enum>(1)</enum><header>Artificial intelligence</header><text>The term <term>artificial intelligence</term> has the meaning given the term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph>

                            <enum>(2)</enum>
                            <header>Artificial intelligence system</header>
 <text>The term <term>artificial intelligence system</term> means a data system, software, hardware, application, tool, service, or utility that operates in whole or in part using artificial intelligence.</text>
                        </paragraph> 
<paragraph id="H4A87899491124E9E8BB36AB015FEE423"><enum>(3)</enum><header>Content provenance</header><text>The term <term>content provenance</term> means the chronology of the origin and history associated with digital content.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
