subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 and an Act to provide for reconciliation pursuant to title II of H. Con. Res. 14 (<external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>) to provide certain benefits to noncitizens, and for other purposes.</official-title></form><legis-body id="HB309402F07414C2989DCD84E792B0D7B" style="OLC"> 
<section id="H144ADF41936447529A8ED1087E21D94E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lifting Immigrant Families Through Benefits Access Restoration Act</short-title></quote> or the <quote><short-title>LIFT the BAR Act</short-title></quote>.</text></section> <section id="HA976AF980F50445EBD589EEA6446CA9E"><enum>2.</enum><header>Availability of basic assistance to lawfully present noncitizens</header> <subsection id="H0D82F03F02B8414EAAFED81230EC36B9"><enum>(a)</enum><header>Elimination of arbitrary eligibility restrictions</header> <paragraph id="H814D2AC649B44C0DA9CDA2D72DDD3C5B"><enum>(1)</enum><header>PRWORA repeals</header><text>Sections 402, 403, 411, 412, 421, and 422 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1612">8 U.S.C. 1612</external-xref>, 1613, 1621, 1622, 1631, and 1632) are repealed.</text></paragraph> 
<paragraph id="HE741F164707E4DBAB29D2B0FB9C60C03" commented="no"><enum>(2)</enum><header>Public Law 119–21 repeals</header> 
<subparagraph id="H4480C4BD13144B45B6A7BB631A37005C" commented="no"><enum>(A)</enum><header>SNAP eligibility</header><text display-inline="yes-display-inline">Section 10108 of an Act to provide for reconciliation pursuant to title II of H. Con. Res. 14 (<external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>) is repealed and the provision of law amended by such section is restored as if such section had never been enacted.</text></subparagraph> <subparagraph id="H8234B55A8AD5494690CF028D608F2F39" commented="no"><enum>(B)</enum><header>Medicaid and chip eligibility</header><text display-inline="yes-display-inline">Section 71109 of an Act to provide for reconciliation pursuant to title II of H. Con. Res. 14 (<external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>) is repealed, the provisions of law amended by such section are restored as if such section had never been enacted, and the unobligated balances of amounts appropriated or otherwise made available by section are rescinded.</text></subparagraph> 
<subparagraph id="H5C8D2303C2AC4DF98C5D940DFA683A41" commented="no"><enum>(C)</enum><header>Limiting medicare eligibility coverage of certain individuals</header><text display-inline="yes-display-inline">Section 71201 of an Act to provide for reconciliation pursuant to title II of H. Con. Res. 14 (<external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>) and section 1899C of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395mmm">42 U.S.C. 1395mmm</external-xref>), as added by such section 71201, are repealed.</text></subparagraph></paragraph></subsection> <subsection id="H7C1950CFC43147F797D00548C5AAC1E8"><enum>(b)</enum><header>Notification and information reporting</header><text>Section 404 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1614">8 U.S.C. 1614</external-xref>) is amended by striking <quote>, 402, or 403</quote>.</text></subsection> 
<subsection id="H9DB89569407248119FD7DA9ECFABC06D"><enum>(c)</enum><header>Qualified noncitizens</header><text>Title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1601">8 U.S.C. 1601 et seq.</external-xref>) is amended—</text> <paragraph id="H0754623ECFAB40E19386425E3AEA86FD"><enum>(1)</enum><text>in the header, by striking <quote><header-in-text level="title" style="OLC">Aliens</header-in-text></quote> and inserting <quote><header-in-text level="title" style="OLC">Noncitizens</header-in-text></quote>;</text></paragraph>

<subparagraph id="HD73DFD7173724247B2971C6582B061F5"><enum>(C)</enum><text>who is granted special immigrant juvenile status as described by section 101(a)(27)(J) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(J)</external-xref>);</text></subparagraph> <subparagraph id="H5DA9DC217CEB4DA19A871F06187C0CBA"><enum>(D)</enum><text display-inline="yes-display-inline">who has a pending, bona fide application for nonimmigrant status under section 101(a)(15)(U) of the Immigration and Nationality Act (8 U.S.C 1101(1)(15)(U)); </text></subparagraph> 
<subparagraph id="H4F5DAA6BFB7C4609AA9E5161EA4292DA"><enum>(E)</enum><text>who was granted relief under the Deferred Action for Childhood Arrivals program; or</text></subparagraph> <subparagraph id="HA7837D72EA2F4D57AA5B139382581272"><enum>(F)</enum><text>any other person who is not a citizen of the United States but who resides in a State or territory of the United States and is federally authorized to be present in the United States.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H14A98B5F973B4D869F81DC43BF4FE37D"><enum>(3)</enum><text>by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="H967397CDBAA9409D872A444C0826BC2F" display-inline="no-display-inline"> <subsection id="H6FFBDF67735248F4BFB5687536381035"><enum>(d)</enum><header>Noncitizen</header><text display-inline="yes-display-inline">For the purposes of this title, the term <term>noncitizen</term> means any individual who is not a citizen of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4CCEB310208B487F97FDB20E74BD263D"><enum>(e)</enum><header>Child nutrition programs</header><text>Section 742 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1615">8 U.S.C. 1615</external-xref>) is amended—</text> <paragraph id="HCA171ABE364D49D6A0D252C3D4707D2D"><enum>(1)</enum><text>in subsection (a)—</text>

<subparagraph id="HE615D60718B74956B4B8E1AF6D970C63"><enum>(C)</enum><text>by striking <quote>the school breakfast program under section 4 of the</quote> and inserting <quote>any program under</quote>; and</text></subparagraph></paragraph> <paragraph id="H0A3937093CF248E9ACF6B5EFC02F9C44"><enum>(2)</enum><text>in subsection (b)(1)—</text> 
<subparagraph id="H5A3726B8B9984DD994AF99DA64306725"><enum>(A)</enum><text>by striking <quote>Nothing in this Act shall prohibit or require a State to provide to an individual who is not a citizen or a qualified alien, as defined in section 431(b),</quote> and inserting <quote>A State shall not deny</quote>; and</text></subparagraph> <subparagraph id="H507E5B9874E94153AA7F837ADDD6AD77"><enum>(B)</enum><text>by striking <quote>paragraph (2)</quote> and inserting <quote>paragraph (2) on the basis of an individual’s citizenship or immigration status</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HB70B0877C0BC4183BA537E4FC4E7D2AC" commented="no"><enum>(f)</enum><header>Exclusion of medical assistance expenditures for citizens of freely associated States</header><text>Section 1108(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308(h)</external-xref>) is amended—</text> <paragraph id="HDB7582758D144CE0B116C2F4DF0A0DD8" commented="no"><enum>(1)</enum><text>by striking <quote>Expenditures</quote> and inserting:</text>

<paragraph id="H13066894F6514709BA8AC203C7BAAFBD" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to eligibility for benefits for the designated Federal program defined in paragraph (3)(C) (relating to the Medicaid program), paragraph (1) shall not apply to any individual who lawfully resides in 1 of the 50 States or the District of Columbia in accordance with the Compacts of Free Association between the Government of the United States and the Governments of the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau and shall not apply, at the option of the Governor of Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, or American Samoa as communicated to the Secretary of Health and Human Services in writing, to any individual who lawfully resides in the respective territory in accordance with such Compacts.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H6266DB3595324D45AAE675ED1BF0977E"><enum>(g)</enum><header>Child health insurance program</header><text display-inline="yes-display-inline">Section 2107(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)</external-xref>) is amended—</text>

<subsection id="H6BE773AB3D704C54ADA70751BEEEFCF8"><enum>(h)</enum><header>Conforming amendments</header> 
<paragraph id="HAB46E3C082A745F2835C02642F7237B5"><enum>(1)</enum><header>Supplemental food assistance program</header><text>The Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) is amended—</text> <subparagraph id="H9B8B623E57FE4123AF26AEBD6A232F90"><enum>(A)</enum><text>in section 5—</text> 
<clause id="H3114A5E7489544FE91A0946E3ECC17F5"><enum>(i)</enum><text>by striking subsection (i); and</text></clause> <clause id="H46EA6F9F311B41C389535E6FBCE6694F"><enum>(ii)</enum><text>by redesignating subsections (j) through (n) as subsections (i) through (m), respectively;</text></clause></subparagraph> 
<subparagraph id="H9B35D5A5CBD648678A17EB79C4260D9B"><enum>(B)</enum><text>in section 6—</text> <clause id="H88E6C3CAF5D34114843403038E83EA47"><enum>(i)</enum><text>in subsection (f), by striking <quote>an alien lawfully admitted for permanent</quote> and all that follows through the end of the subsection and inserting <quote>a noncitizen lawfully present in the United States.</quote>; and</text></clause>

<subparagraph id="H7E8CE52B71D244C3826F5BFFA7D3B212"><enum>(B)</enum><text>striking paragraph (4).</text></subparagraph></paragraph> <paragraph id="H35441158E0FF48ED94781A8A05AD8D01"><enum>(3)</enum><header>Housing assistance</header><text>Section 214(a) of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a(a)</external-xref>) is amended by—</text>

<subparagraph id="HC971141890B743DD95AEBBF5453F809B" display-inline="no-display-inline"><enum>(A)</enum><text>in the header—</text> <clause id="H2FE98820C441465E9CB4C470D3320C80"><enum>(i)</enum><text>by striking <quote><header-in-text level="section" style="OLC">Qualified Aliens</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Qualified Noncitizens</header-in-text></quote>; and</text></clause> 
<clause id="HFF50ADB4F1CD4BD78C48B224C4001061"><enum>(ii)</enum><text>by striking <quote><header-in-text level="section" style="OLC">Aliens</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Noncitizens</header-in-text></quote>; and</text></clause></subparagraph> <subparagraph id="HA057750BD1AD46EAB06D6973224EC252"><enum>(B)</enum><text>by striking <quote>alien</quote> each place it appears and inserting <quote>noncitizen</quote>.</text></subparagraph></paragraph> 
<paragraph id="H143E78E4159C4FC1A923EE3A6347D378"><enum>(5)</enum><header>Assistance not treated as debt absent fraud</header><text>Section 213A(b)(1)(A) of the Immigration and Nationality Act is amended by striking <quote>benefit,</quote> and inserting <quote>benefit by fraud,</quote>.</text></paragraph></subsection> <subsection id="HA6D1CF038A6640C092AA77B3957B7C66" display-inline="no-display-inline" commented="no"><enum>(i)</enum><header>Preserving State funding for medicaid</header><text display-inline="yes-display-inline">Section 71110 of an Act to provide for reconciliation pursuant to title II of H. Con. Res. 14 (<external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>) is repealed, the provision of law amended by such section is restored as if such section had never been enacted, and the unobligated balances of amounts appropriated or otherwise made available by section are rescinded.</text></subsection> 
<subsection id="H2728B1AC9A7649CF9EF1F5FE78696255" commented="no"><enum>(j)</enum><header>Premium tax credit</header> 
<paragraph id="H8C32A24AF41E4ED381BF78E4D0D87569" commented="no"><enum>(1)</enum><header>Restoration of allowance of premium tax credit for certain individuals</header> 
<subparagraph id="HF95461FE0E5247768FC807FCE639C296" commented="no"><enum>(A)</enum><header>In general</header><text>Section 71301 of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref> is repealed, and each provision of law amended by such section is amended to read as such provision would read if such section had never been enacted.</text></subparagraph> <subparagraph id="HAEF443D805C04F2CA34CEA793AEBD4EB" commented="no"><enum>(B)</enum><header>Effective date</header><text>Each amendment made by this paragraph shall take effect as if included in the provision of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref> to which such amendment relates.</text></subparagraph></paragraph> 
<paragraph id="H95F92C400B374A69A08C829FFB1AC09D" commented="no"><enum>(2)</enum><header>Restoration of allowance of premium tax credit during periods of medicaid ineligibility due to alien status</header> 
<subparagraph id="HFA19FCFC236D457DAF4D0DDB50D3AC35" commented="no"><enum>(A)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/36B">Section 36B(c)(1)</external-xref> of the Internal Revenue Code of 1986, as amended by section 71302 of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>, is amended by inserting after subparagraph (A) the following new subparagraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HB13E0E7E1075479890C10BC2DAB6D38C"> <subparagraph id="H05CA8909CAA64946B1B126D8DB2C480C" commented="no"><enum>(B)</enum><header>Special rule for certain individuals lawfully present in the United States</header><text display-inline="yes-display-inline">If—</text> 
<clause id="H70D05E16F2414412A1389AA8B1CD306F" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">a taxpayer has a household income which is not greater than 100 percent of an amount equal to the poverty line for a family of the size involved,</text></clause> <clause id="H283CBA4664EA4BA0A75B16DC5CBB5A4D" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the taxpayer is a non-citizen lawfully present in the United States,</text></clause> 
<clause id="H9DF724FDCD4A41B798D42983B63D145C" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">the taxpayer is ineligible for minimum essential coverage under section 5000A(f)(1)(A)(ii), and</text></clause> <clause id="HA3C8330D37C44C83B40301CF9E9C6F89" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">under the Medicaid eligibility criteria for non-citizens in effect on December 26, 2020, the taxpayer would be ineligible for such minimum essential coverage by reason of the taxpayer’s immigration status,</text></clause><continuation-text commented="no" continuation-text-level="subparagraph">the taxpayer shall, for purposes of the credit under this section, be treated as an applicable taxpayer with a household income which is equal to 100 percent of the poverty line for a family of the size involved.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HBD45E119DB7942C695B59B531A8F7279" commented="no"><enum>(B)</enum><header>Effective date</header><text>The amendment made by this paragraph shall apply to taxable years beginning after December 31, 2025.</text></subparagraph></paragraph></subsection> <subsection id="H5E239F67CFFE4093858891E3E525AF10" commented="no"><enum>(k)</enum><header>Federal agency guidance</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, each Federal agency, as applicable, shall issue guidance with respect to implementing the amendments made by this Act.</text></subsection> 
<subsection id="H5958D112E67E44CCB40426D1C3612292"><enum>(l)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the date of enactment of this Act and shall apply to services furnished on or after the date that is 180 days after the date on which any guidance is issued pursuant to subsection (k).</text></subsection></section> </legis-body></bill>
