<section id="HAAF28D178E064CD7BCFFE6065F2E83BE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>The Public Service Accountability Act</short-title></quote>.</text></section> <section id="H1781C8A5B87A477CA8A32DFBB200F4C0"><enum>2.</enum><header>Restrictions on trade and ownership of covered investments</header> <subsection id="H9C695A24D19247EEBEAB235567236BFC"><enum>(a)</enum><header>Table of contents</header><text display-inline="yes-display-inline">The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">chapter 131</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

<subsection id="H05D26A6E80B140DBA1E2358D415B3529"><enum>(b)</enum><header>Restrictions</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">Chapter 131</external-xref> of title 5, United States Code, is amended by adding at the end a new subchapter:</text> <quoted-block style="USC" id="H1A0B6D701952487DBAEB21D0E8D0AD1C" display-inline="no-display-inline"> <subchapter id="H7074BF613F974C90B28F398F9B0DDF79"><enum>IV</enum><header>Restrictions on trade and ownership of covered investments</header> <section id="H1B66AAA024FA442F93213307D04AC978"><enum>13151.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text> 
<paragraph id="H507F9C2BA75F49D7B35ACCD1EEAB36BA" display-inline="no-display-inline"><enum>(1)</enum><header>Commodity</header><text>The term <term>commodity</term>—</text> <subparagraph id="H32D5FA14DA2B42269A70787156EB8F2A"><enum>(A)</enum><text>has the meaning given the term in section 1a of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a</external-xref>); and</text></subparagraph> 
<subparagraph id="H1237BCDD97F842DA8F5312B680C600E6"><enum>(B)</enum><text>does not include—</text> <clause id="HF8EA327DD12E49799765BF2E43759D5B"><enum>(i)</enum><text>a precious metal (as defined in section 1027.100 of title 31, Code of Federal Regulations); or</text></clause> 
<clause id="H6966A75A5B9D45019678D18213E6ECEE"><enum>(ii)</enum><text display-inline="yes-display-inline">insurance for which the insured holds a lawful insurable interest.</text></clause></subparagraph></paragraph> <paragraph id="HB228D38663C94FFD8D1049CF2E24CC16"><enum>(2)</enum><header>Covered individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term> means any of the following:</text> 
<subparagraph id="H2AC0B8631E8D439992411320AE4C368F" commented="no"><enum>(A)</enum><text>A Member of Congress and an officer or employee of Congress (as defined in section 13101).</text></subparagraph> <subparagraph id="HAD5F5149591249B699ECF07D16898066" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">A dependent child as defined in such section 13101 or a spouse of a Member of Congress.</text></subparagraph> 
<subparagraph id="H49D2B8B8C6BF42039E1BA2F000C50A76"><enum>(C)</enum><text>A judicial employee and judicial officer (as those terms are defined in section 13101).</text></subparagraph> <subparagraph id="HA5592D3ADF5B4870A240E62DB3052E43"><enum>(D)</enum><text>An officer or employee described in section 13103(f)(3).</text></subparagraph> 
<subparagraph id="HBB08E2EC346342E78839C0D3EB7FA0B1"><enum>(E)</enum><text display-inline="yes-display-inline">A special Government employee (as that term is defined in section 202(a) of title 18).</text></subparagraph> <subparagraph id="HF9D90EC9A85C4662A23370E16303B556"><enum>(F)</enum><text display-inline="yes-display-inline">A senior executive (as that term is defined in section 3132(a)).</text></subparagraph> 
<subparagraph id="HCA97129AAAEE4375996F0A5E321894B3"><enum>(G)</enum><text display-inline="yes-display-inline">Any individual employed in a position described under sections 5312 through 5316 of title 5 (relating to the Executive Schedule).</text></subparagraph> <subparagraph id="HC3FF6B26A0E54477ACEFC5ABB8EA9D24"><enum>(H)</enum><text display-inline="yes-display-inline">Any individual employed in a position of a confidential or policy-determining character under schedule C of subpart C of part 213 of title 5, Code of Federal Regulations, or successor regulation.</text></subparagraph> 
<subparagraph id="HA7CB5E44F82E46F7A7853CE41A0FA29B"><enum>(I)</enum><text>The President.</text></subparagraph> <subparagraph id="H38A73FADF0F148AFACDB0EB28C7A0A23"><enum>(J)</enum><text>The Vice President.</text></subparagraph> 
<subparagraph id="H6951AF14011B4E3A885CF7239DDAC142"><enum>(K)</enum><text>A dependent child as defined in such section 13101 or a spouse of the President.</text></subparagraph> <subparagraph id="HBC27DA6362764082B6993B232CC4F3EB"><enum>(L)</enum><text>A dependent child as defined in such section 13101 or a spouse of the Vice President.</text></subparagraph></paragraph> 
<paragraph id="HC47BB54219E64D94B7C7B4EA3FCEAD19"><enum>(3)</enum><header>Covered investment</header><text>The term <term>covered investment</term>—</text> <subparagraph id="HC448203893184D90BC9AAB875F23F383"><enum>(A)</enum><text display-inline="yes-display-inline">means an investment in a security, a commodity, a future, or any comparable economic interest acquired through synthetic means, such as the use of a derivative, including an option, warrant, or other similar means; and</text></subparagraph> 
<subparagraph id="H35AFDA72EDCC4F04A3987395E1D16951"><enum>(B)</enum><text>does not include—</text> <clause id="H7D6E9B80C81240249F019EBE772DDA65"><enum>(i)</enum><text display-inline="yes-display-inline">a widely held investment fund described in section 13104(f)(8) that is diversified and publicly traded on a national or regional stock exchange;</text></clause> 
<clause id="H5F4C8FCCDDDF47B88EA0D935894B9740"><enum>(ii)</enum><text>a United States Treasury bill, note, or bond;</text></clause> <clause id="H5E205A66AAAC41318305B00C8682CE92"><enum>(iii)</enum><text>a State or municipal government bill, note, or bond;</text></clause> 
<clause id="H118CBA69E9B241588DD98EE9F80C1399"><enum>(iv)</enum><text>any compensation received by the spouse or dependent child of a covered official from their employer;</text></clause> <clause id="H2567819A82634F7A9AB8B7AD0038FB32" commented="no"><enum>(v)</enum><text>an interest in a small business concern;</text></clause> 
<clause id="HCA6D847305EB4C5FA513D6CDE5566F9A"><enum>(vi)</enum><text>an interest in a limited liability company created for the sole purpose of purchasing or holding real estate that serves as the personal residence of the Member of Congress;</text></clause> <clause id="HFAF747F18E6244088CD944EE51DAF794"><enum>(vii)</enum><text display-inline="yes-display-inline">any share of Settlement Common Stock issued under section 7(g)(1)(A) of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1606">43 U.S.C. 1606(g)(1)(A)</external-xref>); or</text></clause> 
<clause id="HF330EA664EF94B8CA2EBB47EF633DEB8"><enum>(viii)</enum><text display-inline="yes-display-inline">any share of Settlement Common Stock, as defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>).</text></clause></subparagraph></paragraph> <paragraph id="HCCFFBD0B8B074F5C850E4D4A69E92795"><enum>(4)</enum><header>Diversified</header><text display-inline="yes-display-inline">The term <term>diversified</term>, with respect to an investment fund, means such fund does not have a stated policy of concentrating its investments in any industry, business, single country other than the United States, or bonds of a single State within the United States except for the State in which the Member of Congress resides.</text></paragraph> 
<paragraph id="H624696AA52E34D348D6971EC80624F0E" display-inline="no-display-inline"><enum>(5)</enum><header>Future</header><text>The term <term>future</term> means a financial contract obligating the buyer to purchase an asset or the seller to sell an asset, such as a physical commodity or a financial investment, at a predetermined future date and price.</text></paragraph> <paragraph id="H22D99783F6A6476391C4314AB760A3D7" display-inline="no-display-inline"><enum>(6)</enum><header>Security</header><text>The term <term>security</term> has the meaning given the term in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>).</text></paragraph> 
<paragraph id="H74FCF7EE79CD4B378F7C3ADE43534091"><enum>(7)</enum><header>Small Business Concern</header><text display-inline="yes-display-inline">The term <term>small business concern</term> has the meaning given that term under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph> <paragraph id="HA55F171727544B17BCDF086C936489AA"><enum>(8)</enum><header>Supervising ethics office</header><text>The term <term>supervising ethics office</term> has the meaning given the term in section 13101.</text></paragraph></section> 
<section id="HB1F604402E634E3EA6A8650B7EB54E21"><enum>13152.</enum><header>Trade and ownership of covered investments</header> 
<subsection id="H8E6F582AC0D84276A358E95BDC7C7E58" display-inline="no-display-inline"><enum>(a)</enum><header>Conduct during federal service</header><text>Except as described in subsection (b)(1)(B) and subsections (d) and (e), no covered individual may—</text> <paragraph id="H6AF7B668C5C44111962E492844B0D55E"><enum>(1)</enum><text>directly or indirectly, own or trade a covered investment; or</text></paragraph> 
<paragraph id="H379D9384458941BFB79D2C8237E894F2">
                  <enum>(2)</enum>
 <text display-inline="yes-display-inline">enter into, or offer to enter into, an agreement, contract, swap, or transaction that provides for any purchase, sale, payment, or delivery of an excluded commodity that is dependent on the occurrence, nonoccurrence, or the extent of the occurrence of a specific event or contingency.</text>
                </paragraph></subsection> 
<subsection id="HB4E64FB2382F43AB82FB5B25434CAD6F"><enum>(b)</enum><header>Compliance</header> 
<paragraph id="H14ADF2B2698347EFA7F5E2235FFC6F26"><enum>(1)</enum><header>Requirement</header><text>To comply with subsection (a)—</text> <subparagraph id="H3AD2337519C34DB4BDF1B746B5C572DC"><enum>(A)</enum><text>a covered individual may not purchase a covered investment; and</text></subparagraph> 
<subparagraph id="H3D3C435D1A3747EDB2CEE2390B191345"><enum>(B)</enum><text>a covered individual shall divest of any covered investment by the effective date established in paragraph (2) at fair market value.</text></subparagraph></paragraph> <paragraph id="HB4C3B691B02E4ECDBB58F10835861AB0"><enum>(2)</enum><header>Effective date</header><text>The effective date is established as follows:</text> 
<subparagraph id="H3CEC47E929F24BDBBE09123160F16D04"><enum>(A)</enum><text>180 days for an individual who is a covered individual on the date of enactment of <short-title>The Public Service Accountability Act</short-title>.</text></subparagraph> <subparagraph id="HFA4FE29B345848A8A63622325453AAA2"><enum>(B)</enum><text display-inline="yes-display-inline">90 days within the date on which an individual becomes a covered individual if such date occurs after the date of enactment of <short-title>The Public Service Accountability Act</short-title>.</text></subparagraph></paragraph></subsection> 
<subsection id="HC401B3C78516412097E0201045C60F60" display-inline="no-display-inline"><enum>(c)</enum><header>Certificates of divestiture</header> 
<paragraph id="HEA1C4DD58950482EBC3C675C46E2F30C"><enum>(1)</enum><header>Application of certificate of divestiture program</header><text>For purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/1043">section 1043</external-xref> of the Internal Revenue Code of 1986—</text> <subparagraph id="H8DEE89ED47FF4182A32EE083B63C9C49"><enum>(A)</enum><text>this section shall be treated as a Federal conflict of interest statute; and</text></subparagraph> 
<subparagraph id="H7FBAF9CE28DB47B1904924DCA508F8FB"><enum>(B)</enum><text>any covered individual described in subparagraphs (A), (B), (K), or (L) of section 13151(2) shall be treated as an eligible person described in section 1043(b)(1)(A) of such Code.</text></subparagraph> </paragraph> <paragraph id="HF883AA8A729C4DB288A1C741704BE906"><enum>(2)</enum><header>Issuance of certificate of divestiture</header> <subparagraph id="H840E5BC7A8494F26859AD831F0AF5867"><enum>(A)</enum><header>In general</header><text>Each supervising ethics office shall issue a certificate of divestiture to each covered individual required to divest under this subchapter upon submission of proof of compliance by such individual with the requirements to divest or any extensions granted by the supervising ethics office.</text></subparagraph> 
<subparagraph id="HFDEC1395589546E0B58A7996D2A22F1F"><enum>(B)</enum><header>Eligibility</header><text>Such certificate shall include an identification of each specific property eligible for the application of the certificate of divestiture program as determined by the supervising ethics office.</text></subparagraph></paragraph></subsection> <subsection id="H5D3424B1CA1845DE927B823BC5A4300E"><enum>(d)</enum><header>Trusts</header><text display-inline="yes-display-inline">Any covered investment held in a qualified blind trust as defined in section 13104(f)(3) shall be divested in accordance with subsection (b)(1)(B) by the effective date established in subsection (b)(2).</text> </subsection> 
<subsection id="H2B80674F6C7B4AE29CC8FD583CF84F72"><enum>(e)</enum><header>Assets acquired in special circumstances</header><text display-inline="yes-display-inline">In the event that a covered individual acquires a covered investment after the date of enactment of the <short-title>The Public Service Accountability Act</short-title> other than by purchase (such as by marriage, inheritance, divorce settlement, or other circumstance), the covered individual shall have 90 days from the date on which such investment was acquired to divest such covered investment at fair market value.</text></subsection> <subsection id="H53405C221A1845DAA83D8415D66E28DC"><enum>(f)</enum><header>Interpretative guidance</header><text>The supervising ethics office shall issue interpretive guidance on any relevant term not defined in this subchapter.</text></subsection></section> 
<section id="HACDFEE0E146448DBA99B7602F1C17A30"><enum>13153.</enum><header>Penalties</header> 
<subsection id="H330E3D6593B844E793A1425523628EFB" commented="no"><enum>(a)</enum><header>In general</header> 
<paragraph id="H6A41B10ADADB43A881851D79E6870B51"><enum>(1)</enum><header>Penalties</header><text>Any covered individual who violates the restrictions on trading or ownership of covered investments in section 13152 shall, at the direction of the supervising ethics office—</text> <subparagraph id="HA32B3612EA3D4E3AB4A34572054F6F8C"><enum>(A)</enum><text>pay a fine of equal to 10 percent of the value of the covered investment; and</text></subparagraph> 
<subparagraph id="H9CAE1C07EB6A423694BF1B16771AD62F"><enum>(B)</enum><text display-inline="yes-display-inline">disgorge the profits of any transaction that violates the provisions of this subchapter.</text></subparagraph></paragraph> <paragraph id="H1F00554F8D7E48ADB149CC5B821940B0"><enum>(2)</enum><header>Payment of penalty to Treasury</header><text display-inline="yes-display-inline">A penalty imposed under paragraph (1)(B) shall be payable into the Treasury of the United States.</text></paragraph></subsection> 
<subsection id="H859C04BDC3FB406F908B9249C479852D"><enum>(b)</enum><header>Payment restrictions</header><text display-inline="yes-display-inline">A Member of the Congress may not pay any of the penalties under this section by using amounts from the following sources:</text> <paragraph id="H439BF8AF28DD43ED9A9704D36DCA4030"><enum>(1)</enum><text>The Members’ Representational Allowance.</text></paragraph> 
<paragraph id="H3D5C00C136664DE1BACA7EF89EEC262E"><enum>(2)</enum><text>The Senators’ Official Personnel and Office Expense Account.</text></paragraph> <paragraph id="H1720984126FF4F029C70E2240A821D5A"><enum>(3)</enum><text display-inline="yes-display-inline">Any contribution (as defined in section 301(8) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101(8)</external-xref>)) accepted as a candidate, and any other donation received as support for activities of the individual as a holder of Federal office.</text></paragraph></subsection> 
<subsection id="HAE8EF3BDB69247B5852EFE6CF3BC4BAE"><enum>(c)</enum><header>Publication</header><text>Each supervising ethics office shall publish on a publicly available website a description of—</text> <paragraph id="H4A1167CDBE264BDEBEEA3C76DE853525"><enum>(1)</enum><text>each fine assessed by the supervising ethics office pursuant to this section;</text></paragraph> 
<paragraph id="H080D0CBB78EC424BB33E5747B10DBB90"><enum>(2)</enum><text>the reason why each such fine was assessed; and</text></paragraph> <paragraph id="HC9D0361EFF46450BB5E47A9B35599370"><enum>(3)</enum><text>the result of each assessment.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H214CB5B7E49E4FCC982670986ECBBAF3"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">This Act and the amendments made by this Act shall not be construed to apply to any individual occupying a position under the General Schedule.</text></subsection></section> </legis-body></bill>
