<section id="H086A8702178E43D1A93A4CCACC07CF3F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increasing Tribal Input on Nutrition Act of 2026</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HB1B1E5ED035247DF8C19830287BBCA1B"><enum>2.</enum><header>Tribal consultation and representation; supply chain disruptions</header> <subsection id="HA210F0AC866948B4B21786321E806AD9"><enum>(a)</enum><header>Food distribution program on Indian reservations</header><text>Section 4(b) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2013">7 U.S.C. 2013(b)</external-xref>) is amended—</text> 
<paragraph id="HE6B49DCFB34B48B0A86D6A1BF689660D"><enum>(1)</enum><text>by striking <quote>tribal organization</quote> each place it appears and inserting <quote>Tribal organization</quote>;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5FD8E0C88F294756BCB9D2EE10A755C4"><enum>(2)</enum><text>by redesignating paragraph (7) as paragraph (9); and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD40FDA903B3D42DAAE341AB4454CAA6F"><enum>(3)</enum><text>by inserting after paragraph (6) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HFB68E80CD6A143829DB24A9EC884DC12"> <paragraph id="H4AD7A4A5636D4A639DF339140B308F88" commented="no"><enum>(7)</enum><header>Tribal inclusion in contracting process</header><text>Prior to conducting evaluation of contracts under the food distribution program on Indian reservations under this subsection, the Secretary shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H44237DE0EA644726885324A4CF601B25"><enum>(A)</enum><text display-inline="yes-display-inline">consult with Indian Tribes and Tribal organizations and ensure their feedback is integrated into the evaluation; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H622E86D64E6B48009F9DB2B046BECD9C"><enum>(B)</enum><text display-inline="yes-display-inline">consider feedback from Indian Tribes and Tribal organizations throughout the evaluation process.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HAB23A77B35E246689130D5C6EFA5A404"><enum>(8)</enum><header>Supply chain disruptions</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="HED83DDBAC55E4874A456F320D4F7F364"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of supply chain disruption</header> 
<clause commented="no" display-inline="no-display-inline" id="H80D7A4D804414984A45C5BB754C93F04"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>In this paragraph, the term <term>supply chain disruption</term> means a shortage of foods that impedes the distribution of commodities, as determined by the Secretary.</text></clause> <clause commented="no" display-inline="no-display-inline" id="H45FFE3F50E644944BFD02EFB02F90A0B"><enum>(ii)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>supply chain disruption</term> includes a supplemental food shortage due to a multifood warehouse issue that affects contracting, production, manufacture, sourcing, procurement, transportation, or storage of food and impedes the function of the food distribution program on Indian reservations under this subsection, as determined by the Secretary.</text></clause></subparagraph> 
<subparagraph id="H793B73F986244C08BC5487EC9E7D8660"><enum>(B)</enum><header>Emergency assistance</header><text>If the Secretary determines that there is a supply chain disruption, the Secretary—</text> <clause commented="no" display-inline="no-display-inline" id="H06D3EC6D08E54D04B9F05A233BC59359"><enum>(i)</enum><text display-inline="yes-display-inline">shall, not later than 45 days after the date on which the Secretary makes that determination, designate an emergency warehouse contractor to provide the required food capacity in a timely manner; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H32CE761EC146451EAF31C096F4714540"><enum>(ii)</enum><text display-inline="yes-display-inline">may provide direct payments or reimbursements to an Indian Tribe or Tribal organization administering the food distribution program on Indian reservations under this subsection to purchase food in accordance with subparagraph (D).</text></clause></subparagraph> <subparagraph id="HC2BAF05515064635944B5E8A56D1EFC7"><enum>(C)</enum><header>Payments</header><text>The total amount of payments provided under subparagraph (B)(ii) to an Indian Tribe or Tribal organization shall not exceed the amount of funding that the Secretary would otherwise expend for that Indian Tribe or Tribal organization during the same time period under the food distribution program on Indian reservations under this subsection.</text></subparagraph> 
<subparagraph id="HE69E304EBAF146DDB15178586CE437B6"><enum>(D)</enum><header>Procurement of agricultural commodities</header> 
<clause commented="no" display-inline="no-display-inline" id="H22A24A4BC2E5411D9CAA143B50EE6840"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any agricultural commodities purchased by an Indian Tribe or Tribal organization using payments under subparagraph (B)(ii) shall satisfy the conditions described in clause (ii), unless waived by the Secretary.</text></clause> <clause commented="no" display-inline="no-display-inline" id="H264820788CD7466E96C483B37CD079EB"><enum>(ii)</enum><header>Conditions described</header><text display-inline="yes-display-inline">The conditions referred to in clause (i) for agricultural commodities are the following:</text> 
<subclause id="HE498A770F0394A9E89C21EB277926902"><enum>(I)</enum><text>The agricultural commodities are domestically produced.</text></subclause> <subclause id="H7083C10EA4364110B617A7ACD2B3294D"><enum>(II)</enum><text>The agricultural commodities supplant, not supplement, the type of agricultural commodities in existing food packages for that Indian Tribe or Tribal organization.</text></subclause> 
<subclause id="H73C6388541FE427D957C82D57A7BFBED"><enum>(III)</enum><text>The agricultural commodities are of similar or higher nutritional value as the type of agricultural commodities that would be supplanted in the existing food package for that Indian Tribe or Tribal organization.</text></subclause> <subclause id="H7D8D40CEF1A14412B53FAFCA41823017"><enum>(IV)</enum><text>The agricultural commodities meet any other criteria determined by the Secretary.</text></subclause></clause></subparagraph> 
<subparagraph id="H06B0F3E896B54C038FA1F6967A970875"><enum>(E)</enum><header>Notification; publication</header><text>If the Secretary designates an emergency warehouse contractor under subparagraph (B)(i), the Secretary shall—</text> <clause commented="no" display-inline="no-display-inline" id="H40BB5400A5E643D9B3AA7B61BA234F3F"><enum>(i)</enum><text display-inline="yes-display-inline">notify each affected Tribal organization or State agency of the designation, including an explanation of the determination of the Secretary of a supply chain disruption; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HCF1DD7CE87DF46C880CE1169D67A6FB8"><enum>(ii)</enum><text>make that designation, and explanation of the determination, publicly available on the website of the Department of Agriculture.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HF43811F323854D0DAA061F93D93A03C2"><enum>(b)</enum><header>Commodity supplemental food program</header><text>Section 5 of the Agriculture and Consumer Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/93/86">Public Law 93–86</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H7C8F98568DDF4A1587D51BC04FFE3D56"><enum>(n)</enum><header>Consultation with Indian Tribes</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H5AEC71C624A7410083C0A03F8F97DAF2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall implement the commodity supplemental food program in a manner that is responsive to the needs of the members of Indian Tribes and Tribal organizations by conducting annual consultations with Indian Tribes and Tribal organizations.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H2AB37B9B38CE41088EEC98A7E77476D5"><enum>(2)</enum><header>Amendments to State plans</header> <subparagraph commented="no" display-inline="no-display-inline" id="H75DEFE16513046EABF5C9D81765FBDFF"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">With respect to submitting any amendment to a State plan pursuant to section 247.6 of title 7, Code of Federal Regulations (or a successor regulation), a State agency is encouraged—</text> 
<clause commented="no" display-inline="no-display-inline" id="H4D187E9071CA4340B501FD35D6A50283"><enum>(i)</enum><text display-inline="yes-display-inline">prior to that submission, to consult in good faith with applicable Indian Tribes or Tribal organizations on the content of the amendment; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HBD7DCAABDFE449EF952B41908A95728D"><enum>(ii)</enum><text>to include in the submission documentation evidencing that consultation.</text></clause></subparagraph> 
<subparagraph id="H93B70EDE26B64A558DFB607667A2F528"><enum>(B)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance to State agencies, including by entering into cooperative agreements, on how to properly conduct consultations pursuant to subparagraph (A), including relating to—</text> <clause id="H01073AECC1924C60A355A67E105FE6E0"><enum>(i)</enum><text>providing proper notice as to when a consultation will take place;</text></clause> 
<clause id="H279186E14D70402A86135BC95AB7F92F"><enum>(ii)</enum><text>ensuring consultations are with Tribal officials; and</text></clause> <clause id="HCBB4EED348E0400A9EA041231E006971"><enum>(iii)</enum><text>releasing a collaborative agenda in advance of the consultation.</text></clause></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H6B34A816214D453CA57979585A8BE4EB"><enum>(o)</enum><header>Supply chain disruptions</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HEC926B93926C4164A3F06026D44D2896"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of supply chain disruption</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H06B849094D7F4C13BA95DA3C002ED37E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>In this paragraph, the term <term>supply chain disruption</term> means a shortage of foods that impedes the distribution of commodities, as determined by the Secretary.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H31172FDD80E7416A82EA697B156406E2"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>supply chain disruption</term> includes a supplemental food shortage due to a multifood warehouse issue that affects contracting, production, manufacture, sourcing, procurement, transportation, or storage of food and impedes the function of the commodity supplemental food program, as determined by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H9ACA6D10DDB04819B95EE457944E55DD"><enum>(2)</enum><header>Emergency warehouse contractor</header><text>If the Secretary determines that there is a supply chain disruption, the Secretary shall, not later than 45 days after the date on which the Secretary makes that determination, designate an emergency warehouse contractor to provide the required food capacity in a timely manner.</text></paragraph> <paragraph id="H9F14314C80044C5C81066F92F216D19C"><enum>(3)</enum><header>Notification; publication</header><text>If the Secretary designates an emergency warehouse contractor under paragraph (2), the Secretary shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDC7F47E4DEB242A6A5F929B96907D240"><enum>(A)</enum><text display-inline="yes-display-inline">notify each affected Tribal organization or State agency of the designation, including an explanation of the determination of the Secretary of a supply chain disruption; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H33E1A9FE964D49F78A380DEA27F8E8F4"><enum>(B)</enum><text>make that designation, and explanation of the determination, publicly available on the website of the Department of Agriculture.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
