and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HC25D353165214CC7BD5CD32A35491E37"><enum>(B)</enum><text>by striking the period at the end and inserting the following:</text><quoted-block style="USC" id="H87959D54AB8B492D8F77F704554047C7" display-inline="yes-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><text>, and the financial institution may, when requesting such information, inform the applicant in writing that—</text><subparagraph id="H4469796C6C8A4B78A05C562B6F465787"><enum>(A)</enum><text display-inline="yes-display-inline">the Bureau of Consumer Financial Protection requires the financial institution to ask, collect, and report such information to the Federal Government annually pursuant to this section;</text></subparagraph><subparagraph id="HD3003DADB57649489BE403D0CA477963"><enum>(B)</enum><text>the applicant is not required to provide such information; and</text></subparagraph><subparagraph id="HEB6DF45A7BE84822BA0B413F2EA971B9"><enum>(C)</enum><text display-inline="yes-display-inline">the applicant’s response will not affect the financial institution’s evaluation of the request for credit.</text></subparagraph><paragraph id="H66A8BDF06BB3490C99818B1B9CFBF8F8"><enum>(2)</enum><header>Model form</header><text display-inline="yes-display-inline">The Director of the Bureau of Consumer Financial Protection shall establish a model form to be used in providing the information required to be provided to an applicant under paragraph (1). Such form shall—</text><subparagraph id="HE0DC69651EB84465A36E3AE8AC6463E7"><enum>(A)</enum><text>be in plain English; and</text></subparagraph><subparagraph id="H575D63D6A4E5460F959910EA926C75C2"><enum>(B)</enum><text>to the extent practicable, be no longer than a single page.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB32D0B4669A24079A788034730F5C9FB"><enum>(2)</enum><text>by striking subsection (d);</text></paragraph><paragraph id="H8A789EAC57904628ADF84378E6D517A3"><enum>(3)</enum><text>by redesignating subsections (e), (f), (g), and (h) as subsections (d), (e), (f), and (g), respectively; and</text></paragraph><paragraph id="H731A8A4DB0194C0E9D3919D6D10D22D9"><enum>(4)</enum><text>in subsection (d), as so redesignated—</text><subparagraph id="HB330339B05A44101BD8A46FA3D5E273D"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="H8D2B94F4F2AF4FC49B4ADA33B0AA07F6"><enum>(i)</enum><text>by striking subparagraphs (C), (G), and (H);</text></clause><clause id="HFADD35026EB94D46A5016632066FC89D"><enum>(ii)</enum><text>by redesignating subparagraphs (D), (E), and (F) as subparagraphs (C), (D), and (E), respectively;</text></clause><clause id="H29E7F5ADDEC5451EB40B8979024E3D1C"><enum>(iii)</enum><text>in subparagraph (D), as so redesignated, by adding <quote>and</quote> at the end; and</text></clause><clause id="H356F8E771208460A9354BBE3873296CA"><enum>(iv)</enum><text>in subparagraph (E), as so redesignated, by striking the semicolon and inserting a period;</text></clause></subparagraph><subparagraph id="H6A86D1AA20EA495DB3E452C9A208BA8C"><enum>(B)</enum><text>in paragraph (3), by striking <quote>paragraph (1)(E)</quote> and inserting <quote>paragraph (1)(D)</quote>; and</text></subparagraph><subparagraph id="HB900E5B3774249D294C397A7984D9D23"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HF13845376A094AA99A6EAD767CBA7491" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="H16259C1C4C9B41229DB187E09BF8919F"><enum>(5)</enum><header>Prohibition on information not reported by an applicant</header><text display-inline="yes-display-inline">A financial institution may not compile and maintain information described under subsection (b) that was determined by the financial institution using visual observation or any other manner other than being provided by an applicant.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB356E3ED10BE42EE9699870A68C76B9C"><enum>(5)</enum><text>in subsection (f), as so redesignated, by adding at the end the following:</text><quoted-block style="OLC" id="HA2857DABB49E4D80A36A47EE0F5255A3" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="H24FEFB0785204FA0A2646F2A6D1A9EE2"><enum>(4)</enum><header>Initial compliance date</header><subparagraph id="H22DDB438E6F44B09A80B9A66B0955045"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Bureau may not require a financial institution to comply with this section, or any rule issued under this section, until June 1, 2031.</text></subparagraph><subparagraph id="HD4A0F1A254A945EA91C4CFEE7CC2BF09"><enum>(B)</enum><header>Safe harbor</header><text display-inline="yes-display-inline">The Bureau may not enforce compliance with the requirements of this section during the 2-year period beginning on the date described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HDCEBF00164764299A9F049D661A1BA0B"><enum>(5)</enum><header>Exemption for small financial institutions</header><text display-inline="yes-display-inline">A financial institution is exempt from the requirements of this section if the financial institution—</text><subparagraph id="HB652713E30B5451F9D9256C0C5FFD106"><enum>(A)</enum><text>in each of the 2 previous calendar years, originated less than 2,500 credit transactions for small businesses; or</text></subparagraph><subparagraph id="HB838E829ACB74B56B44FF32F9EE541DC"><enum>(B)</enum><text display-inline="yes-display-inline">has less than $10,000,000,000 in assets.</text></subparagraph></paragraph><paragraph id="HFE4191B6C0984B11B3AE8302B363CFDD"><enum>(6)</enum><header>Treatment of response rate</header><text display-inline="yes-display-inline">The percentage of applicants providing a financial institution with the information described under subsection (b) may not be used as a factor in determining whether a financial institution is in compliance with the requirements under this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H5E34FB1DF7BD496E9593DD3ECD2C2DF0"><enum>(6)</enum><text display-inline="yes-display-inline">in subsection (g), as so redesignated, by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" id="H621093B6735B4796BB6FAAFCFDEDBDC0" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="H9C8AA9946DF94D249C8684A0445CE0D2"><enum>(2)</enum><header>Small business</header><text display-inline="yes-display-inline">The term <term>small business</term> means any entity with gross annual revenues of $1,000,000 or less in the most recently completed fiscal year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><endorsement display="yes"><action-date>June 18, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
