<section commented="no" section-type="section-one" id="HF612B18C94A045FCBBA49544AB07B1F2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Open Meetings Act of 2026</short-title></quote>.</text></section> <section id="H38C7E2567A854C709BE68306E8B83E6E"><enum>2.</enum><header>Documentation requirement for meeting of certain conferences and councils</header> <subsection id="HF75AA8FB98794A148FFDF9CE77AC791B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/15">Chapter 15</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text>

<section id="H68024C6BFC324E5FB2B6E34CAF1A2CAC"><enum>336.</enum><header>Documentation requirement for meeting of certain conferences and councils</header>
<subsection id="H306C361C8546461584CC0CA550EC28E7"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>covered meeting</term> means a meeting of a conference or council undertaken pursuant to this chapter.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H9D50DD804EE843108F629393F1345535"><enum>(b)</enum><header display-inline="yes-display-inline">Notice Requirement</header> <paragraph id="H148F46FDF05A43D585134E2EB19B04FC"><enum>(1)</enum><header>In general</header><text>Not later than 30 days before a covered meeting, the Judicial Conference shall publish notice of the covered meeting on the internet website of the Judicial Conference, including the date, time, place, and agenda of the covered meeting.</text></paragraph>
<paragraph commented="no" id="H198E429B078C4109940BA55660BD4BA8"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The Judicial Conference may waive for good cause the requirement under paragraph (1). If the Judicial Conference waives the requirement under paragraph (1), the Judicial Conference shall publish an explanation for why the requirement was not met on the internet website of the Judicial Conference.</text></paragraph></subsection> <subsection id="HC6664E9100E04DB2B8FEB5B6068A7016"><enum>(c)</enum><header>Live audio streaming requirement</header> <paragraph id="HC029E4A35E6E4284AD7F5EA7E4A79330"><enum>(1)</enum><header>In general</header><text>Each covered meeting shall provide live audio streaming, accessible to the public without charge or registration.</text></paragraph>
<paragraph commented="no" id="H746412F7D2A646F1912F284621F4F154"><enum>(2)</enum><header>Record</header><text>The Judicial Conference shall maintain an archive of each live audio stream provided pursuant to paragraph (1).</text></paragraph> <paragraph id="H5FC0B5D4A68B4B0D8D42B61BCAD2CB6F"><enum>(3)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 7 days after the date of a covered meeting, the Judicial Conference shall publish on the internet website of the Judicial Conference an archive of the live audio stream required under paragraph (1) in a manner that is accessible to the public without charge or registration.</text></paragraph>
<paragraph id="HD6F1ABCC5BA94409BD218DE2782A8263"><enum>(4)</enum><header>Exception</header>
<subparagraph id="HD18916152AD249388AF576779B387BAF"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">During each covered meeting, the conference or council—</text> <clause commented="no" id="H41D642D9A44440258C6D7FFFE916C826"><enum>(i)</enum><text display-inline="yes-display-inline">shall resolve into a closed session when publication of the matter at issue is prohibited by law; or</text></clause>
<clause id="HD294CCB2949E4B7DAB0E464D0A3BB2AB"><enum>(ii)</enum><text>may, by a majority vote, resolve into a closed session as determined appropriate by the conference or council for consideration of a sensitive or confidential matter.</text></clause></subparagraph> <subparagraph id="H0688A23826674067B3E4380A866EED14"><enum>(B)</enum><header>Statement</header><text>Prior to resolving into a closed session under subparagraph (A), the conference or council shall state the reason for so resolving.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H3F39F8D0252A4946A2B2A412ABFAD91E"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/15">chapter 15</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H2DFCFAD3852046D18AC71DBB83CBF815"> <toc regeneration="no-regeneration"> <toc-entry level="section">336.
