<section id="H7C5A3F9F741349AB81F9B097AD949C96" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civil Preparedness for Agroterrorism Exercise Act of 2026</short-title></quote>.</text></section> <section id="H7EBB8A711DA649F8BE9A08C0A3D2C03A"><enum>2.</enum><header>Exercise on agroterrorism</header> <subsection id="H4EA1669C7F214AF9A813DFE644B71A23" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to, or as part of exercise programs currently carried out by the Department of Homeland Security, to enhance domestic preparedness for and collective response to terrorism, promote the dissemination of homeland security information, and test the security posture of the United States, the Secretary of Homeland Security, acting through appropriate offices and components of the Department and in coordination with the heads of appropriate Federal departments and agencies, shall, not later than four years after the date of the enactment of this section, conduct an exercise related to the prevention, response to, recovery from, and mitigation of an act of agroterrorism.</text></subsection> 
<subsection id="HC34A8F58161B41238A825EA1D0E37E2B"><enum>(b)</enum><header>Exercise requirements</header><text>The exercise required under subsection (a) shall—</text> <paragraph id="HBF2FB09E8B514C849AACFBFA34C3F732"><enum>(1)</enum><text>include a scenario involving—</text> 
<subparagraph id="H841707432F90495A9D15C69D077C52F0" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">developing preparedness for agroterrorists attempting to unlawfully transport into the United States a biological agent capable of adversely affecting the operations of—</text> <clause id="H0A517105F81941E78CAFE84F94B7C022" commented="no"><enum>(i)</enum><text>the agriculture and food critical infrastructure sector; or</text></clause> 
<clause id="HDD3E60B09C4B4F54AD20435DA368EBC5" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">other related economic sectors;</text></clause></subparagraph> <subparagraph id="HCF33523653E449A0A67A49776A73A5EF" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">developing preparedness for agroterrorists deploying within the United States a biological agent capable of adversely affecting the operations of—</text> 
<clause id="H8847AF733EC74B4B9D4C3466DBA4EC35" commented="no"><enum>(i)</enum><text>the agriculture and food critical infrastructure sector; or</text></clause> <clause id="H8F92059BE1E54477A02A05E0A2A4CB9B" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">other related economic sectors; and</text> </clause></subparagraph> 
<subparagraph id="H3B5BB55472CC459EB99640CD1BF57F47" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">collective action by participants to determine the most effective response in managing and mitigating the effects of widespread disruption to the agriculture and food critical infrastructure sector or other related economic sectors as a result of agroterrorism, including through—</text> <clause id="H3E74E88D3BA34339BE273CFF02083421" commented="no"><enum>(i)</enum><text>effectively deploying incident command involving the entities specified in paragraph (2);</text></clause> 
<clause id="H50389294588E4FC882B442144493C64F" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">identifying key resources necessary to respond to, and recover from, and mitigate widespread disruption of the agriculture and food critical infrastructure sector or other related economic sectors as a result of agroterrorism; and</text></clause> <clause id="H9C2FA33EF19841619A1888B90B79A356" commented="no"><enum>(iii)</enum><text>determining an efficient and effective allocation of such key resources, and addressing capability and capacity gaps at all levels of government; and</text></clause></subparagraph></paragraph> 
<paragraph id="HFEAC870781CC4996A7FE84816B207E52"><enum>(2)</enum><text>include coordination with appropriate—</text> <subparagraph id="H4EE9C5D2756340368D873A79626328DA"><enum>(A)</enum><text>Federal departments and agencies;</text></subparagraph> 
<subparagraph id="H6CFC81CC6D5241A7A2F18D7EC7820AFB">
                        <enum>(B)</enum>
 <text>State, local, Tribal, and territorial agencies;</text> </subparagraph> <subparagraph id="H7611485929A144A2AEB60EB08BF764CB" commented="no"><enum>(C)</enum><text>private sector owners and operators of—</text> 
<clause id="H73E0738DAF204446BE93947BC26C6A6E" commented="no"><enum>(i)</enum><text>food and agricultural facilities;</text></clause> <clause id="H4379E741931543618677F3422940271A" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">other components of the agriculture and food critical infrastructure sector; and</text></clause> 
<clause id="HA71FF2F572F7473F90017F5F548828F1" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">components of other related economic sectors;</text> </clause></subparagraph> <subparagraph id="HA2E8A11849B24B089A2D18BD27DC9A52"><enum>(D)</enum><text display-inline="yes-display-inline">representatives of and practitioners from the emergency preparedness and response community; and</text> </subparagraph> 
<subparagraph id="H6FF441E5270B4A83A8404B869DEC9D60" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">other stakeholders in, and subject matter experts of, the defense of the agriculture and food critical infrastructure sector from agroterrorism.</text></subparagraph></paragraph> </subsection> <subsection id="H92BF3D603D0D44DF84F663D551965692" commented="no"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the completion of the exercise required under subsection (a), the Secretary of Homeland Security shall, consistent with the protection of classified information, submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate an after-action report that contains the following:</text> 
<paragraph id="HEB4A889131224ED0A34C9F8DFE2C5610" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The findings of such exercise, together with associated plans and a timeline for incorporating lessons learned into future operations of the Department of Homeland Security to counter and deter agroterrorism.</text></paragraph> <paragraph id="H97D424C114044F80B0569FA118A1BA41" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Recommended legislative actions for improving the security posture of the United States and the future operations of the Department to counter and deter agroterrorism.</text></paragraph></subsection> 
<subsection id="HD452F1C728B3452697280616E6B44A49"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HA1227D6135A043A4BF6AD11D1E8245A0"><enum>(1)</enum><header>Agroterrorism</header><text display-inline="yes-display-inline">The term <quote>agroterrorism</quote> means an act of terrorism (as such term is defined in section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>)) that threatens to target or targets the agriculture and food critical infrastructure sector of the United States.</text></paragraph> 
<paragraph id="HE23C280C42FF429CA6464FA2C11770AA" commented="no"><enum>(2)</enum><header>Agroterrorist</header><text>The term <quote>agroterrorist</quote> means any actor who commits an act of agroterrorism.</text></paragraph> <paragraph id="H80B74176415C4293800EBF64D1D5165F"><enum>(3)</enum><header>Biological agent</header><text display-inline="yes-display-inline">The term <quote>biological agent</quote> has the meaning given such term in section 178 of title 18, United States Code.</text></paragraph> 
<paragraph id="H308ED1247B284270B46124A1DC539797"><enum>(4)</enum><header>Critical infrastructure</header><text display-inline="yes-display-inline">The term <quote>critical infrastructure</quote> has the meaning given such term in section 1016(e) of <external-xref legal-doc="public-law" parsable-cite="pl/107/56">Public Law 107–56</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c(e)</external-xref>).</text></paragraph></subsection></section> </legis-body></bill>
