<section id="HAE6B64674FC441618DF28FEBA7F337F0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recognizing Engineered Alternatives as Lab-Created Butter Act</short-title></quote> or the <quote><short-title>REAL Butter Act</short-title></quote>.</text></section> <section id="HCC753C87215F468097ED2C90746F22A9"><enum>2.</enum><header>Ensuring consumer choice by requiring truthful labeling of lab-created butter</header><text display-inline="no-display-inline">Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H8A6F5B19621D413BB52075C0435F56D6"><enum>(z)</enum> 
<paragraph id="H4C8ADC6467DE413AAF515D4545396373" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">If it is a synthesized butter product or contains such a product and its label does not bear immediately before the name of the product <quote>lab-created butter</quote> or <quote>contains lab-created butter</quote>, respectively.</text></paragraph> <paragraph id="H2C06E7AD238645E283BF2731B654BE89" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this paragraph:</text> 
<subparagraph id="HBD41BFA8A97E4A1B907D1C32BD6EFE01"><enum>(A)</enum><text display-inline="yes-display-inline">The term ‘synthesized butter product’ means a product that—</text> <clause id="H860C5D95D7DE469392BE6A1CED083774"><enum>(i)</enum><text display-inline="yes-display-inline">is marketed as butter, but utilizes sources of milkfat that are synthesized through non-agricultural processes; and</text></clause>

                <enum>(ii)</enum>
 <text display-inline="yes-display-inline">fails to conform to the standard of identity for butter specified in the Act of March 4, 1923 (42 Stat. 1500).</text>
              </clause></subparagraph> 
<subparagraph id="HB61B759FF9134F3E9FF7B7E879EC1230">
              <enum>(B)</enum>
 <text display-inline="yes-display-inline">The term <term>butter</term> has the meaning given such term in the Act of March 4, 1923 (42 Stat. 1500).</text>
