<section id="H1028C97D358243639D8839B35D34F019" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Find Our Families Act of 2026</short-title></quote>.</text></section> <section id="H1CAB93317CBB4354B7C207FA5206F1CB"><enum>2.</enum><header>U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement online detainee locator system</header> <subsection id="HF060232E63E34A4293D1B3B1F26ECCDF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security (in this section referred to as the <quote>Secretary</quote>) shall develop and maintain an online detainee locator system for individuals in the custody of U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement.</text> </subsection> 
<subsection id="H8A752370C8A04D1EB4E26161ECC78163"><enum>(b)</enum><header>Requirements for detainee locator system</header><text display-inline="yes-display-inline">The online detainee locator system developed under this section shall—</text> <paragraph id="HD4937CBEC5484247AE7EC0E4349E2CFA"><enum>(1)</enum><text>be made publicly accessible on the Department of Homeland Security website;</text></paragraph> 
<paragraph id="HD40ABF884C4D49DEAB1AB185A95F718D"><enum>(2)</enum><text>be made available in—</text> <subparagraph id="H32293C5077C84FA5B474A4FD7537FA8C"><enum>(A)</enum><text>English;</text></subparagraph> 
<subparagraph id="H6F1338E4815B4558867F9AAC1A064378"><enum>(B)</enum><text>Spanish;</text></subparagraph> <subparagraph id="H6FE86BE91EED4C7B8961B7D1D7DC620C"><enum>(C)</enum><text>Haitian Creole;</text></subparagraph> 
<subparagraph id="HE09CD17A66544DC48D5D4F6693B238F4"><enum>(D)</enum><text>any other language, as determined by the Officer for Civil Rights and Civil Liberties of the Department of Homeland Security, to be among the 10 most spoken first-languages of individuals based on data collected by U.S. Customs and Border Protection with respect to nationwide encounters at any point in the preceding fiscal year; and</text></subparagraph> <subparagraph id="HBFA64CB9003A40C5A4A9900E5AB213D9"><enum>(E)</enum><text>any other language necessary, pursuant to title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>), which prohibits discrimination on the basis of national origin;</text> </subparagraph></paragraph> 
<paragraph id="H22DAA8F675304CD59698315F43912586"><enum>(3)</enum><text display-inline="yes-display-inline">include a search function tool that permits a user of such system to search for an individual in the custody of U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement by inputting—</text> <subparagraph id="H9ABF1CD95F3847978DE90B03F96AC7FF" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the alien registration number of such individual;</text></subparagraph> 
<subparagraph id="H39A1855AF86A408388E97CD0264FFB91"><enum>(B)</enum><text>the complete name of such individual; or</text></subparagraph> <subparagraph id="HF7D8AA8FEE1B404082411D0DDADDD863"><enum>(C)</enum><text>the country of birth and date of birth of such individual; and</text></subparagraph> </paragraph> 
<paragraph id="HE49E5430D9034BA999D6ADFABD7FB1CF"><enum>(4)</enum><text display-inline="yes-display-inline">with respect to any search results produced by the search function tool described in paragraph (3), display non-exact matches for first and last names.</text> </paragraph> </subsection> <subsection id="H93FFAD509F82458795D1E3A9DAD1B2F4"><enum>(c)</enum><header>Required detainee information</header> <paragraph id="HC1A4C6C3DCC7469792F7997379E00013"><enum>(1)</enum><header>In general</header><text>Upon implementation of the online detainee locator system developed under this section, not later than 8 hours after an individual is detained by U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement, the Secretary shall make available to such system the following information:</text> 
<subparagraph id="HBB19C5412F264398BCCC16063D25B773"><enum>(A)</enum><text>The alien registration number of such individual.</text></subparagraph> <subparagraph id="HEFD83BD929CC42499D398E514CCD152F"><enum>(B)</enum><text>The complete name of such individual.</text></subparagraph> 
<subparagraph id="HBD73B6A55DCB4D6E84485D3BD7E35767"><enum>(C)</enum><text>The date of birth of such individual.</text></subparagraph> <subparagraph id="H3A71EE7705B342FEB257D834ED453E9A"><enum>(D)</enum><text>The country of birth of such individual.</text></subparagraph> 
<subparagraph id="H3966C8EF337849D2849C60EB9D73A24A"><enum>(E)</enum><text display-inline="yes-display-inline">The date and time such individual was taken into custody by U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement.</text></subparagraph> <subparagraph id="H96125083680349C8ABD2515B1E324830"><enum>(F)</enum><text>The name and address of the facility or location at in which such individual is located.</text></subparagraph> 
<subparagraph id="H1FDA7151A0BA4960BDD8B769DCA5A0DA"><enum>(G)</enum><text>The contact information for such facility or location including a telephone number.</text></subparagraph></paragraph> <paragraph id="HCB7733D1E3954447890A9846B15231FB"><enum>(2)</enum><header>Transfer</header><text display-inline="yes-display-inline">If U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement transfers an individual described in paragraph (1) to a different facility or location, or to a different Federal, State, local, or Tribal law enforcement agency, the Secretary shall make available, not later than 8 hours after commencement of such transfer, in addition to the information required under paragraph (1)—</text> 
<subparagraph id="H662F0F6D6C944E60A644929FFF0D289D"><enum>(A)</enum><text>any updated information with respect to paragraph (1)(E) through (G);</text></subparagraph> <subparagraph id="HEFE4C7283D0B4B1DBCBEFD7E1A05EED6"><enum>(B)</enum><text>a time-stamped log of any transfers of such individual; and</text></subparagraph> 
<subparagraph id="H5E13F04BCED741D98EF408BA818343F8"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a transfer that requires such individual to be in transit for more than 5 hours—</text> <clause id="H836AFA286C4C4E58B84D9824331CEC33"><enum>(i)</enum><text>the address of the facility or location from and to which such individual is being transferred;</text></clause> 
<clause id="H38A3058887D849308FF1F1F578C249DD"><enum>(ii)</enum><text>the mode of transportation being used to transfer such individual; and</text></clause> <clause id="HFC57E8C7E35147C7B624C0521337C529"><enum>(iii)</enum><text>the estimated time of arrival.</text></clause></subparagraph></paragraph> 
<paragraph id="H79B444358C804D8E810CC01F352FE1ED" commented="no"><enum>(3)</enum><header>Protection of minors</header><text>Any information described under paragraphs (1) or (2) that pertains to an individual under the age of 18, may not be made available to the online detainee locator system developed under this section.</text></paragraph></subsection> <subsection id="HF2D8FF7E8CA548C68B0F937874CB49DA"><enum>(d)</enum><header>Information Data retention</header><text display-inline="yes-display-inline">Any information made available under subsection (c) to the online detainee locator system developed under this section shall be retained on such system for not less than 60 days after an individual is—</text> 
<paragraph id="H56A50E1331364BCABB377B25C7883D12"><enum>(1)</enum><text>released from the custody U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement; or</text></paragraph> <paragraph id="H944958DB71D24FBCA27556D9529D4788"><enum>(2)</enum><text>removed from the United States.</text></paragraph></subsection> 
<subsection id="H0E06A3EC924449219985BD16FC318312" commented="no"><enum>(e)</enum><header>Compliance</header> 
<paragraph id="HBAF40956D9E640AC9C8D7EA933B35EFD" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall make available a publicly accessible and secure online form for any family member or legal representative of an individual in the custody of U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement to report, with respect to such individual, any missing, incorrect, or out-of-date information on the online detainee locator system developed under this section.</text></paragraph> <paragraph id="H871C72B666D048258C87C1D0C71E6E63" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than 1 week after receiving a report submitted pursuant to subsection (e)(1), the Secretary shall—</text> 
<subparagraph id="HE7703FAF84AD41488F2F3C9DEE775506"><enum>(A)</enum><text>acknowledge receipt of such report; and</text></subparagraph> <subparagraph id="H501820C44ED74A299A9134DFD6068366"><enum>(B)</enum><text>resolve such report.</text></subparagraph></paragraph></subsection> 
<subsection id="H7816218788DA417BADD9A4BBA5718AA3"><enum>(f)</enum><header>Penalty</header> 
<paragraph id="HC21A5CC4A6A04B53A61B8B4E4F4D583E"><enum>(1)</enum><header>In general</header><text>With respect to an employee that fails to comply with this section, the Director of Immigration and Customs Enforcement or the Commissioner of Customs and Border Protection shall investigate such failure, and as appropriate, may, pursuant to subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, United States Code—</text> <subparagraph id="H1F92C6D0822D40429B7056E4EFE55594"><enum>(A)</enum><text>furlough such employee;</text></subparagraph> 
<subparagraph id="HFAB8936C98A4455D88675C1BF64DC096"><enum>(B)</enum><text>reduce the pay or grade of such employee; or</text></subparagraph> <subparagraph id="H6E1F280C57F84937A56FDFF407A14DB7"><enum>(C)</enum><text>suspend such employee for not more than 30 days.</text></subparagraph></paragraph> 
<paragraph id="H68A5FC89CFFB4E62AFDBCCB51F06C8DB"><enum>(2)</enum><header>Further investigation</header><text>After an investigation pursuant to subsection (f)(1), the Director of Immigration and Customs Enforcement or the Commissioner of Customs and Border Protection shall refer such investigation to the Inspector General of the Department of Homeland Security for further investigation.</text></paragraph> <paragraph id="H25A6781A91984D74A04F0122F6DA4FF4" commented="no"><enum>(3)</enum><header>Contracts</header><text display-inline="yes-display-inline">The Secretary may not renew a contract for any facility or contractor that failed to provide timely or accurate data for the online detainee locator developed under this section.</text></paragraph></subsection></section> 
<section id="HBBBE56384D3B462EBAE3B78AE2919200" commented="no"><enum>3.</enum><header>U.S. Customs And Border Protection and U.S. Immigration and Customs Enforcement detainee medical care transfer reporting requirements</header> 
<subsection id="HD4D85D987BA046AC8972A69350C0202D" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For any individual in the custody of U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement who is transferred to a facility or location to receive medical attention, the Secretary shall notify a family member and any legal representative of such individual not later than 5 hours after such transfer is initiated and provide the following information:</text> <paragraph id="H97D31693A8F04762A7ED88E102426D7E" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The name, address, and telephone number of the facility or location to which such individual was transferred.</text></paragraph> 
<paragraph id="H40CE40EFB680414D82BAA1B803CAE8F1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The contact information for the relevant U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement office overseeing the—</text> <subparagraph id="H8CF1502C74454C04AF01E0074115AD23" commented="no"><enum>(A)</enum><text>transfer of such individual; and</text></subparagraph> 
<subparagraph id="H5D71FA67DB0C4D0883E6FD6F9C5AF021" commented="no"><enum>(B)</enum><text>medical attention being provided to such individual.</text></subparagraph></paragraph> <paragraph id="HA72A9257656C4D16AF9BFCAA5E98A206" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The date and time such individual arrived at such facility or location.</text></paragraph> 
<paragraph id="H6E0B7D2EEA724A1599E6F0C3C8C441EA" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">The symptoms, medical condition, or medical assessment that led U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement to transfer such individual to receive medical attention.</text></paragraph> <paragraph id="HAF5F16FC5FFF46DDA82D75985E5282B9" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">Any information on the medical status or diagnosis of such individual at the time of such notification, as provided by a medical provider at each facility or location to and from which such individual was transferred.</text></paragraph></subsection> 
<subsection id="H211F950CD6284789B13F8FD6D1F39CAD" commented="no"><enum>(b)</enum><header>Visitation access</header><text display-inline="yes-display-inline">A family member or legal representative may not be denied or obstructed from visiting an individual described in subsection (a) unless such individual affirmatively declines such visit.</text></subsection></section> <section id="HDB83C320B32445F3AFDA141993A4E054"><enum>4.</enum><header>U.S. Customs and Border Protection arrest reporting requirements</header> <subsection id="HB2AC92F2217B42B8A359B1358D29D459"> <enum>(a)</enum> <header>Arrest reporting</header> <text display-inline="yes-display-inline">For any individual arrested by U.S. Customs and Border Protection, the Secretary of Homeland Security shall make publicly accessible on the stats and summaries web page on the Department of Homeland Security website the following information:</text>
        <paragraph id="H2F832861E4CA4728AA83EAD4B05DA4F0">
          <enum>(1)</enum>
 <text>The location and date of the apprehension of such individual.</text> </paragraph> <paragraph id="HD26D6CF97A1543B7B19F783AA1B59C9A"> <enum>(2)</enum> <text>The method of apprehension of such individual.</text>
        </paragraph>
        <paragraph id="H3D747D0D5D694F85A8CFF43D9F49A545">
          <enum>(3)</enum>
 <text>Whether there was an administrative or judicial warrant prior to the arrest of such individual.</text>
        </paragraph>
        <paragraph id="H575A84A7020C4D7598E6D791996E8806">
          <enum>(4)</enum>
 <text>The country of birth of such individual.</text> </paragraph> <paragraph id="HB2B04EF6F9F14F15A077E898D15C3AAA"> <enum>(5)</enum> <text>The name and address of the facility or location at which such individual is located following such arrest.</text>
        </paragraph>
        <paragraph id="H769A3AD15A2C4D778CBC36EE0ED8C23B">
          <enum>(6)</enum>
 <text>The citizenship of such individual.</text> </paragraph> </subsection> <subsection id="HD69EB8A89DFE4D75953394346B3B36E5" commented="no"><enum>(b)</enum><header>Correction of errors</header> <paragraph id="HBDBF73D7CE944270B029913FEA95340C" commented="no"><enum>(1)</enum><text>The Secretary shall make available a publicly accessible and secure online form for any family member or legal representative of an individual arrested by U.S. Customs and Border Protection to report any missing or incorrect information made accessible under subsection (a).</text></paragraph> 
<paragraph id="H847F579BF84E42748CE35FD1F3653188" commented="no"><enum>(2)</enum><text>Not later than 1 week after receiving a report submitted pursuant to subsection (b)(1), the Secretary shall—</text> <subparagraph id="HAC266BC92FA4414FAD0F5057316847F9" commented="no"><enum>(A)</enum><text>acknowledge receipt of such report; and</text></subparagraph> 
<subparagraph id="HEE1566AE8DF4473AAB82B507B8EDA77A" commented="no"><enum>(B)</enum><text>resolve such report.</text></subparagraph></paragraph></subsection> <subsection id="HB01F9EFDEA16435FA3F0C99FB4465F82"><enum>(c)</enum><header>Report</header><text>Not later than 90 days after the date of enactment of this Act, and every 90 days thereafter, the Secretary shall review any U.S. Customs and Border Protection enforcement operation that is ongoing, or was active during the 90-day period prior to a review, and submit a report to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate that includes, with respect to each such operation—</text> 
<paragraph id="HFCC59F7292D64A87977F4CEDD769C365"><enum>(1)</enum><text display-inline="yes-display-inline">the number of U.S. Customs and Border Protection agents involved;</text></paragraph> <paragraph id="H6AEBAE880B394549A9F19AF4C256464C"><enum>(2)</enum><text>the number and type of any non-U.S. Customs and Border Protection agents or officers engaged in or supporting such operation;</text></paragraph> 
<paragraph id="HD7DA2856666546BE941896A00546F472"><enum>(3)</enum><text>the location of such operation;</text></paragraph> <paragraph id="HE10FB7A14C2740978CB49835BF3CBE5B"><enum>(4)</enum><text display-inline="yes-display-inline">the justification for such operation;</text></paragraph> 
<paragraph id="H586872617D694AF784159EF8DC4E4658"><enum>(5)</enum><text>the number of individuals arrested during such operation based on an administrative or judicial warrant;</text></paragraph> <paragraph id="HC847EDF66FFF497DADDB6353B7830DE5"><enum>(6)</enum><text display-inline="yes-display-inline">the number of warrantless arrests conducted during such operation;</text></paragraph> 
<paragraph id="HAA967D6FB80F4040861C220564D5A489"><enum>(7)</enum><text>the number of such warrantless arrests made pursuant to section 287(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357</external-xref>);</text> </paragraph> <paragraph id="H6B0AD80464A54F458EB28967B2FA0180"><enum>(8)</enum><text display-inline="yes-display-inline">the number of people arrested during any protests;</text></paragraph> 
<paragraph id="H7168E9C1421442728CFE02D269E8DE94"><enum>(9)</enum><text display-inline="yes-display-inline">the number of U.S. citizens and non-citizens arrested during such operation;</text></paragraph> <paragraph id="HCC9D57A7BEB945F6BF0BFEF6C6D84C05"><enum>(10)</enum><text display-inline="yes-display-inline">the monetary costs incurred by U.S. Customs and Border Protection or any other agency or entity involved by such operation; and</text></paragraph> 
<paragraph id="H209B793FC0624DED9809BA047E7560E3"><enum>(11)</enum><text display-inline="yes-display-inline">any contracts with public or private entities involved in such operation.</text></paragraph></subsection></section> </legis-body></bill>
