which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">chapter 131</external-xref> of title 5, United States Code, to restrict Members of Congress and their spouses and dependents from profiting off prediction markets, and for other purposes.</official-title></form><legis-body id="H1A817CEF725C4F65A708815EB1653053" style="OLC"><section id="H5645D2D2602A41388B3B5DF8437D34B4" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Lawmakers From Predicting Act</short-title></quote>. </text></section><section id="HD90933BBA8AE4A7DBFEC15B64B1C93AF"><enum>2.</enum><header>Restrictions on trading on prediction markets</header><subsection id="H50D1A142921A4AFBBE0DE42DAA365833"><enum>(a)</enum><header>Restrictions</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">Chapter 131</external-xref> of title 5, United States Code, is amended by adding at the end the following new subchapter:</text><quoted-block style="USC" id="H1FE51F7E94CD4AEA93CF74E5A2B7F493" display-inline="no-display-inline"><subchapter id="HC73A82FFF9874C5F9739778B891F05E2"><enum>IV</enum><header>Restrictions on trading on prediction markets</header><section id="H922EDD11333F470EB1A06F9AF8E45A0C"><enum>13151.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text><paragraph id="H73A41236EF62439A82BBC909A015CEF8"><enum>(1)</enum><header>Covered individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term> means any of the following:</text><subparagraph id="H98B1F1CE689C46D197CF758A60476558" commented="no"><enum>(A)</enum><text>A Member of Congress as defined in section 13101.</text></subparagraph><subparagraph id="H59D40683F3FD40EAB70EDBB6BF6D36D2" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">A dependent child as defined in such section 13101 or a spouse of a Member of Congress.</text></subparagraph></paragraph><paragraph id="H39DCA37AD9AC4685A46C81B60613A8C4"><enum>(2)</enum><header>Supervising ethics office</header><text display-inline="yes-display-inline">The term <term>supervising ethics office</term> has the meaning given the term in section 13101.</text></paragraph></section><section id="H55FC458D6BED4C3A9B09A960C74F8D82"><enum>13152.</enum><header>Trading on prediction markets</header><subsection id="H8CBA2C53F4384224911CA4D13C5B7499" display-inline="no-display-inline"><enum>(a)</enum><header>Conduct during Federal service</header><text display-inline="yes-display-inline">No covered individual may enter into, or offer to enter into an agreement, contract, or transaction that provides for any purchase, sale, payment, or delivery that is dependent on the occurrence, nonoccurrence, or the extent of the occurrence of—</text><paragraph id="HF0336B0EDA3D428EAA0E561177701E2B"><enum>(1)</enum><text>a specific government policy;</text></paragraph><paragraph id="HDEA70FB773C54798B3E85C18C0025C57"><enum>(2)</enum><text>a government action;</text></paragraph><paragraph id="H722D73DF936F44BDB7CA942D5936900D"><enum>(3)</enum><text>a political outcome; or</text></paragraph><paragraph id="HB64540FF8D004518BECCDB97A65E26AD"><enum>(4)</enum><text display-inline="yes-display-inline">any other event which has come to the attention of a covered individual as a result, directly or indirectly, of the service of a Member of Congress in the United States Congress, regardless of any connection to the congressional duties of such Member. </text></paragraph></subsection><subsection id="H118CA8A94D05470F9172E70D6A5046A1"><enum>(b)</enum><header>Interpretative guidance</header><text>The supervising ethics office shall issue interpretive guidance on any relevant term not defined in this subchapter.</text></subsection></section><section id="H449ADBC7B6E94BE384E748F9DDCD9E0B"><enum>13153.</enum><header>Enforcement</header><subsection id="HBF4D2118B17B4D16A4A61D4E6140FE03"><enum>(a)</enum><header>Penalties</header><text display-inline="yes-display-inline">Any covered individual who violates the restrictions in section 13152 shall, at the direction of the supervising ethics office, incur a fee, as calculated in subsection (b), to be paid by the Member of Congress who—</text><paragraph id="HAE4B7D84238843F1B78994FCA0E5883D"><enum>(1)</enum><text>caused the violation; or</text></paragraph><paragraph id="H714D630F3AC84A5E8425BC5F98D8A29D"><enum>(2)</enum><text display-inline="yes-display-inline">is the spouse or parent of a covered individual who caused the violation.</text></paragraph></subsection><subsection id="HCE06E85DE787414BA2A26EBB5AC0D20A" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Calculation of fees</header><text display-inline="yes-display-inline">The fee required under subsection (a) shall be equal to the sum of—</text><paragraph id="HE1C5E3B96D5C4195B419CD294FE94D40"><enum>(1)</enum><text display-inline="yes-display-inline">$2,000 or ten percent of the value of the agreement, contract, or transaction which violates section 13152, whichever is greater; and</text></paragraph><paragraph id="H7411534EE1FB461F9313059384181917"><enum>(2)</enum><text display-inline="yes-display-inline">the net gain realized, if any, from the agreement, contract, or transaction which violates section 13152 during the period beginning on the most recent date on which the individual became a covered individual and ending on the date of disposition of such agreement, contract, or transaction, as determined by the supervising ethics office.</text></paragraph></subsection><subsection id="H0E14B64DEB15498EA97A517D1BD89ED9"><enum>(c)</enum><header>Payment restrictions</header><text display-inline="yes-display-inline">A covered individual may not pay any of the penalties under this section from the following sources:</text><paragraph id="HA8C1E2F990B6417182537A5E923FF04E"><enum>(1)</enum><text>The Members’ Representational Allowance.</text></paragraph><paragraph id="H58055228BF92447392835525AFA6F9A7"><enum>(2)</enum><text display-inline="yes-display-inline">The Senators’ Official Personnel and Office Expense Account.</text></paragraph><paragraph id="H131FC3A9C5EE4A2E9F9D05E3B54F4CA1"><enum>(3)</enum><text display-inline="yes-display-inline">Any contribution (as defined in section 301(8) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101(8)</external-xref>)) accepted as a candidate, and any other donation received as support for activities of the individual as a holder of Federal office.</text></paragraph></subsection><subsection id="HD8D2CE4E242A4000AA59BE11530B3ED3" display-inline="no-display-inline"><enum>(d)</enum><header>Miscellaneous receipts</header><text display-inline="yes-display-inline">Any amounts collected in fees authorized by this section shall be deposited in the general fund of the Treasury as miscellaneous receipts in accordance with section 3302(b) of title 31, United States Code.</text></subsection><subsection id="H7C71661B980648F79971334DE9EBD085"><enum>(e)</enum><header>Referral</header><text display-inline="yes-display-inline">The supervising ethics office has the authority to refer a former Member of Congress to the Department of Justice and section 13106 shall be applied in the same manner and to the same extent as a violation under such section if such former Member resigns or retires before paying the fee under this section.</text></subsection><subsection id="H0F52ED6E7156472D88F053E2453703A9"><enum>(f)</enum><header>Interpretative guidance</header><text>Each supervising ethics office may issue interpretative guidance on this subchapter and in issuing such guidance may consider mitigating or aggravating circumstances.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF7AE860A5FD442C48B5C44E50FA24BAB"><enum>(b)</enum><header>Table of contents</header><text display-inline="yes-display-inline">The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">chapter 131</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H323CE712DEDF462386179AC4B86E4000" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="subchapter">Subchapter IV—Restrictions on trading on prediction markets</toc-entry><toc-entry level="section">13151. Enforcement.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB9552376368D4C1C916DF480F80BFACC"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
