<section id="H5E37E95761E2409BBD151E3A75A92150" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Facilitating Access to Service and Timely Repairs for Wheelchairs Act</short-title></quote> or the <quote><short-title>FAST Repairs for Wheelchairs Act</short-title></quote>.</text> </section> <section commented="no" display-inline="no-display-inline" id="HA86CE3C3AC114C8998BC60B6AC787844"><enum>2.</enum><header>Removing prior authorization requirements under Medicare Advantage Plans</header><text display-inline="no-display-inline">Section 1852(a)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-22">42 U.S.C. 1395w–22(a)(1)(B)</external-xref>) is amended by adding at the end the following new clause:</text>

<clause commented="no" display-inline="no-display-inline" id="H672C6F3D19B94AD080AD7A5125700B07"><enum>(vii)</enum><header>Prohibition of prior authorization for maintenance and repairs to complex rehabilitation technology</header> 
<subclause commented="no" display-inline="no-display-inline" id="H93A73A7A253A43E885ADE41B3219F4EB"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of complex rehabilitation technology, for plan years beginning on or after January 1 following the date of enactment of this clause, an MA plan may not impose any prior authorization requirements, prescription requirements, or medical documentation requirements with respect to the coverage of repairs made to such a technology under such plan.</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HD769488269464C48BBC93C325B91CE18"><enum>(II)</enum><header>Clarification</header><text display-inline="yes-display-inline"><internal-xref idref="H93A73A7A253A43E885ADE41B3219F4EB" legis-path="(vii)(I)">Subclause (I)</internal-xref> shall not prohibit prior authorization for the initial evaluation of the medical necessity of the complex rehabilitation technology or the replacement of complex rehabilitation technology due to loss or irreparable damage, when such technology reaches its reasonable useful lifetime, or when such technology has been in use for 5 years.</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H21537F4F06534E2E8D013436B696D6BA"><enum>(III)</enum><header>Complex rehabilitation technology defined</header><text display-inline="yes-display-inline">For the purposes of this clause, the term <term>complex rehabilitation technology</term> means—</text> <item commented="no" display-inline="no-display-inline" id="H8F9F6E4E25544556AEDE4D1D53CF0850"><enum>(aa)</enum><text display-inline="yes-display-inline">certain complex rehabilitative power wheelchairs, complex rehabilitative manual wheelchairs, and certain manual wheelchairs, as those terms are used in section 1847(a)(2)(A); and</text></item> 
<item commented="no" display-inline="no-display-inline" id="HF59CDF2D5E9448A4B86D1B78909B4697"><enum>(bb)</enum><text display-inline="yes-display-inline">any related accessories to the items described in item (aa) when furnished in connection with such items.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
