<subsection id="H25595BDE839841DCB16135FBEF9F4956"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Improving the Lives of the American People Act</short-title></quote>.</text></subsection></section> <section id="H1DFDE07D120F4DD8A89ACD047551499D"><enum>2.</enum><header><inline-comment display="no">119h6731ih</inline-comment>Restrictions on trade and ownership of covered investments</header> <subsection id="H6C2EA4679E4A4B6DA49613CFEC537680"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Restore Trust in Government Act</short-title></quote>.</text></subsection> 
<subsection id="H29457833D9C74501BE03DA489BD8FC0A" display-inline="no-display-inline"><enum>(b)</enum><header>Table of contents</header><text display-inline="yes-display-inline">The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">chapter 131</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> <toc regeneration="no-regeneration"> <toc-entry level="subchapter">Subchapter IV. Penalties.</toc-entry></toc></subsection> <subsection id="H23800921B6E043A9AB31C4BA54C7B999" display-inline="no-display-inline"><enum>(c)</enum><header>Restrictions</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">Chapter 131</external-xref> of title 5, United States Code, is amended by adding at the end a new subchapter:</text>

<subchapter id="H9F7D18B71C984786B5C1AE21DECC8126"><enum>IV</enum><header>Restrictions on trade and ownership of covered investments</header> 
<section id="H8DA794167E7940BDB946CD0CAC41C98F"><enum>13151.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text> <paragraph id="H3EA82237C339405F8C802AB0CC7D72C3" display-inline="no-display-inline"><enum>(1)</enum><header>Commodity</header><text>The term <term>commodity</term>—</text> 
<subparagraph id="H1ED682B11EB74C5EB501F9328060B40D"><enum>(A)</enum><text>has the meaning given the term in section 1a of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a</external-xref>); and</text></subparagraph> <subparagraph id="HF4A63CDB450E4FF79C692815FC9038A0"><enum>(B)</enum><text>does not include a precious metal (as defined in section 1027.100 of title 31, Code of Federal Regulations).</text></subparagraph></paragraph> 
<paragraph id="HAFCDA1BB22AA4AD88872AC92D24618CB"><enum>(2)</enum><header>Covered individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term> means any of the following:</text> <subparagraph id="H837B1B316B024E3BBE24BBCB88EE7F87" commented="no"><enum>(A)</enum><text>A Member of Congress, as defined in section 13101.</text></subparagraph> 
<subparagraph id="HE126431EA9AE4CC0A125643037C70F36" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">A dependent child (as defined in section 13101) or a spouse of a Member of Congress.</text></subparagraph> <subparagraph id="H0C626A9FF29647D38CB96161B87A3CAB"><enum>(C)</enum><text display-inline="yes-display-inline">A trustee of a trust in which an individual described in subparagraph (A) or (B) has a beneficial interest in the principal or income of the trust as described in <external-xref legal-doc="usc" parsable-cite="usc/26/1403">section 1403(b)(5)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph> 
<subparagraph id="H81A090A1E7834CD9BC744F883AB4B74A"><enum>(D)</enum><text display-inline="yes-display-inline">The President, or the spouse or a dependent child (as defined in section 13101) of the President.</text></subparagraph> <subparagraph id="HC8735232048841CEB1CAC56F418A8692"><enum>(E)</enum><text display-inline="yes-display-inline">The Vice President, or the spouse or a dependent child (as defined in section 13101) of the Vice President.</text></subparagraph></paragraph> 
<paragraph id="HD718B1D662B44FEF85F842B312F0982C"><enum>(3)</enum><header>Covered investment</header><text>The term <term>covered investment</term>—</text> <subparagraph id="H7EE17603458D453589730BDA603FC98A"><enum>(A)</enum><text display-inline="yes-display-inline">means an investment in a security, a commodity, a future, or any comparable economic interest acquired through synthetic means, such as the use of a derivative, including an option, warrant, or other similar means; and</text></subparagraph> 
<subparagraph id="HEB27F62AA1924C089CCC2A48E3AF86F6"><enum>(B)</enum><text>does not include—</text> <clause id="H1BEDA82EDAD344C197B077132E3BB926"><enum>(i)</enum><text display-inline="yes-display-inline">a widely held investment fund described in section 13104(f)(8) that is diversified and publicly traded on a national or regional stock exchange;</text></clause> 
<clause id="H00C677184DD9400FBBEE0F0BD362E26C"><enum>(ii)</enum><text>a United States Treasury bill, note, or bond;</text></clause> <clause id="HEC8492CABB9E4BDBBE1757F512D293B1"><enum>(iii)</enum><text>a State or municipal government bill, note, or bond;</text></clause> 
<clause id="HCFBCC36782574BBE9356A7985E50D315"><enum>(iv)</enum><text>any compensation received by a spouse or a dependent child described in paragraph (2) from an employer of the spouse or dependent child;</text></clause> <clause id="HCCAE0B9623E64089994EA60176C6B9A6" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">an interest in a small business concern and, in the case of an investment in a family farm or ranch that qualifies as an interest in a small business concern, a future or commodity directly related to the farming activities and products of the farm or ranch;</text></clause> 
<clause id="H1842B4DC966648D1A5EDFA4F474660BE"><enum>(vi)</enum><text>an interest in a limited liability company created for the sole purpose of purchasing or holding real estate that serves as the personal residences of the Member of Congress;</text></clause> <clause id="H9437F04599AC4F339D9404B1F0C2D494"><enum>(vii)</enum><text display-inline="yes-display-inline">any share of Settlement Common Stock issued under section 7(g)(1)(A) of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1606">43 U.S.C. 1606(g)(1)(A)</external-xref>); or</text></clause> 
<clause id="H509643B96AD54F4E847B0A1C5150B20A"><enum>(viii)</enum><text display-inline="yes-display-inline">any share of Settlement Common Stock, as defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>).</text></clause></subparagraph></paragraph> <paragraph id="HACE78169107B4176A9508A822C49F839"><enum>(4)</enum><header>Diversified</header><text display-inline="yes-display-inline">The term <term>diversified</term>, with respect to an investment fund, means such fund does not have a stated policy of concentrating its investments in any industry, business, single country other than the United States, or bonds of a single State within the United States except for the State in which the Member of Congress resides.</text></paragraph> 
<paragraph id="H0D0C73CF1C654067BECCD400ECE2C387" display-inline="no-display-inline"><enum>(5)</enum><header>Future</header><text>The term <term>future</term> means a financial contract obligating the buyer to purchase an asset or the seller to sell an asset, such as a physical commodity or a financial investment, at a predetermined future date and price.</text></paragraph> <paragraph id="H51DCE1677034474E99D2C8401D85CE26" display-inline="no-display-inline"><enum>(6)</enum><header>Security</header><text>The term <term>security</term> has the meaning given the term in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>).</text></paragraph> 
<paragraph id="HE2E2345C6CD9423DBECBA95B9FDACDAD"><enum>(7)</enum><header>Small Business Concern</header><text display-inline="yes-display-inline">The term <term>small business concern</term> has the meaning given that term under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph> <paragraph id="HF6FD295D7B274B81A359CC88D4FE0DE0"><enum>(8)</enum><header>Supervising ethics office</header><text>The term <term>supervising ethics office</term> has the meaning given the term in section 13101.</text></paragraph></section> 
<section id="H6714FA96A4D14D9FA351E2BD207A635E"><enum>13152.</enum><header>Trade and ownership of covered investments</header> 
<subsection id="H83F60FE2F96045F28468747746FCC965" display-inline="no-display-inline"><enum>(a)</enum><header>Conduct during federal service</header><text>Except as described in subsection (b)(1)(B) and subsections (e) through (g), no covered individual may, directly or indirectly, own or trade a covered investment.</text></subsection> <subsection id="H4373666F5EED46489A631B8C90CC6647"><enum>(b)</enum><header>Compliance</header> <paragraph id="HF5AC55B07B294637B51A94B4F876774B"><enum>(1)</enum><header>Requirement</header><text>To comply with subsection (a)—</text> 
<subparagraph id="HB20DC5B3BC0A47778D2DB925DD9319F2"><enum>(A)</enum><text>a covered individual may not purchase a covered investment; and</text></subparagraph> <subparagraph id="H9F831FAAA8834EE8B215B4D9AA68A6A5"><enum>(B)</enum><text>a covered individual shall divest of any covered investment by the effective date established in paragraph (2) at fair market value.</text></subparagraph></paragraph> 
<paragraph id="H3087B4320644427EADE879D9DDD9A5EE"><enum>(2)</enum><header>Effective date</header><text>The effective date is established as follows:</text> <subparagraph id="HB7522EABCE2546578D990F595712BE8C"><enum>(A)</enum><text display-inline="yes-display-inline">180 days for an individual who is a covered individual on the date of enactment of the Restore Trust in Government Act.</text></subparagraph> 
<subparagraph id="H16FBD26FFB0C4FAFAA3F83CFE87A4E2A"><enum>(B)</enum><text display-inline="yes-display-inline">90 days within the date on which an individual becomes a covered individual if such date occurs after the date of enactment of the <short-title>Restore Trust in Government Act</short-title>.</text></subparagraph></paragraph></subsection> <subsection id="HE3112A78BF1C4EDEBEC31AFC8054902B" display-inline="no-display-inline"><enum>(c)</enum><header>Certificates of divestiture</header> <paragraph id="H0A0277F188894A13BFD93E55F53C2065"><enum>(1)</enum><header>Application of certificate of divestiture program</header><text>For purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/1043">section 1043</external-xref> of the Internal Revenue Code of 1986—</text> 
<subparagraph id="H84CE1DA3AC194B20A148D4AE0D81D6F9"><enum>(A)</enum><text>this section shall be treated as a Federal conflict of interest statute;</text></subparagraph> <subparagraph id="H7C57BE77F9FC4C369B4584B7B17C570E"><enum>(B)</enum><text>any covered individual described in section 13151(2)(A) shall be treated as an eligible person described in section 1043(b)(1)(A) of such Code; and</text></subparagraph> 
<subparagraph id="HF38D7E87F1C74D9292685B2173D0B974"><enum>(C)</enum><text display-inline="yes-display-inline">any spouse or dependent child described in section 13151(2)(B) shall be treated as an eligible person described in section 1043(b)(1)(B) of such Code.</text></subparagraph></paragraph> <paragraph id="H194BFC1F33C74D229AA8B9E8DE885A50"><enum>(2)</enum><header>Issuance of certificate of divestiture</header> <subparagraph id="HC79C0888FC074375BE0AE57D67B98D9E"><enum>(A)</enum><header>In general</header><text>Each supervising ethics office shall issue a certificate of divestiture to each covered individual required to divest under this subchapter upon submission of proof of compliance by such individual with the requirements to divest or any extensions granted by the supervising ethics office.</text></subparagraph> 
<subparagraph id="H6A717E6B8CA14DEC8979352074C28F88"><enum>(B)</enum><header>Eligibility</header><text>Such certificate shall include an identification of each specific property eligible for the application of the certificate of divestiture program as determined by the supervising ethics office.</text></subparagraph></paragraph></subsection> <subsection id="H781A7C8EB5D24B5DB3BAC5A4EBB9D1CE"><enum>(d)</enum><header>Income tax</header><text display-inline="yes-display-inline">A loss from a transaction or holding involving a covered financial instrument that is conducted in violation of this section may not be deducted from the amount of income tax owed by the covered individual.</text></subsection> 
<subsection id="HC329A0B5791044D6AC8827EB8ECF9DBD"><enum>(e)</enum><header>Occupational exception</header><text display-inline="yes-display-inline">A spouse or dependent child of a covered individual as described in section 13151(2)(B) may trade any covered investment if such covered investment is not owned by a covered individual and if such trade is performed as a function of the primary occupation of the spouse or dependent child.</text></subsection> <subsection id="HA6BDE6AE68D54C8C83616972B33D992F"><enum>(f)</enum><header>Trusts</header> <paragraph id="HC05D36CF5DED4FBAB327125C3DFD6EE0"><enum>(1)</enum><header>Qualified blind trust</header><text display-inline="yes-display-inline">Any covered investment held in a qualified blind trust as defined in section 13104(f)(3) shall be divested in accordance with subsection (b)(1)(B) by the effective date established in subsection (b)(2).</text></paragraph> 
<paragraph id="H242AE29566784D5AAEC19318EB171B73"><enum>(2)</enum><header>Family trust</header><text>A supervising ethics office may grant an exemption for covered investments held in a family trust only if—</text> <subparagraph id="H2B0E804943D74D5DBAD620F1BA240E9F"><enum>(A)</enum><text>no covered individual—</text> 
<clause id="H6F4D695B5D79468D82B374E333933C0E"><enum>(i)</enum><text>is a grantor of the family trust;</text></clause> <clause id="HD7466D161C264E8D838DC7FBD32039FF"><enum>(ii)</enum><text>contributed any covered investment to the family trust; or</text></clause> 
<clause id="H38AB4DA2CFB541F99F346D1A871CDE46"><enum>(iii)</enum><text>has any authority over a trustee of the family trust, including the authority to appoint, replace, or direct the actions of such a trustee; and</text></clause></subparagraph> <subparagraph id="H4BD3C26FEDCD4DD692E05E5BF76F6B74"><enum>(B)</enum><text>the grantor of the family trust is or was a family member of the covered individual.</text></subparagraph></paragraph> 
<paragraph id="HEB4C3527360844C9B172999BB66C4E17"><enum>(3)</enum><header>Requests</header><text>A covered individual seeking an exemption under paragraph (2) shall submit to the applicable supervising ethics office a request for the exemption, in writing, certifying that the conditions described in that paragraph are met.</text></paragraph></subsection> <subsection id="H145293BC9574474E820ED4C3BF6E54C8"><enum>(g)</enum><header>Assets acquired in special circumstances</header><text display-inline="yes-display-inline">In the event that a covered individual acquires a covered investment after the date of enactment of the <short-title>Restore Trust in Government Act</short-title> other than by purchase (such as by marriage, inheritance, divorce settlement, or other circumstance), the covered individual shall have 90 days from the date on which such investment was acquired to divest such covered investment at fair market value.</text></subsection> 
<subsection id="H2752C630B0B84790B7C6C1F9B5292926"><enum>(h)</enum><header>Extension</header><text display-inline="yes-display-inline">A supervising ethics office may grant a covered individual an extension of time to comply with a divestment deadline under this subchapter if a covered investment cannot be divested by such deadline due to low liquidity, vesting schedules, or contractual restrictions.</text></subsection> <subsection id="H356471EEBA2E42CB82889631316B38B5"><enum>(i)</enum><header>Interpretative guidance</header><text>The supervising ethics office shall issue interpretive guidance on any relevant term not defined in this subchapter.</text></subsection></section> 
<section id="HA89764195CB142A69B279464E8EEA10E"><enum>13153.</enum><header>Penalties</header> 
<subsection id="HEA068CDD9DB9426192B278856C69AE3F" commented="no"><enum>(a)</enum><header>In general</header> 
<paragraph id="HD4A2ED329A7645538E45707F78B91102"><enum>(1)</enum><header>Penalties</header><text>Any covered individual who violates the restrictions on trading or ownership of covered investments in section 13152 shall, at the direction of the supervising ethics office—</text> <subparagraph id="HE109E2C19F9243B89C4ED38A7C7E6FFE"><enum>(A)</enum><text>pay a fee equal to ten percent of the value of the covered investment; and</text></subparagraph> 
<subparagraph id="HD2A80709F5724543A1DD15FA223D2490"><enum>(B)</enum><text display-inline="yes-display-inline">disgorge the profits of any transaction that violates the provisions of this subchapter.</text></subparagraph></paragraph> <paragraph id="H3CF15D6F1A4D42DDAE5F19A044EEE463"><enum>(2)</enum><header>Payment of penalty to Treasury</header><text display-inline="yes-display-inline">A penalty imposed under paragraph (1)(B) shall be payable into the Treasury of the United States.</text></paragraph></subsection> 
<subsection id="H6DCC4ABFF5434106B78F9DF2C1A58238"><enum>(b)</enum><header>Payment restrictions</header><text display-inline="yes-display-inline">A Member of Congress may not pay any of the penalties under this section by using amounts from the following sources:</text> <paragraph id="H44079FD34B2241558F431BF32B25BAFD"><enum>(1)</enum><text>The Members’ Representational Allowance.</text></paragraph> 
<paragraph id="H447A0489975A487FB0CD2BC34FCAEB64"><enum>(2)</enum><text display-inline="yes-display-inline">The Senators’ Official Personnel and Office Expense Account.</text></paragraph> <paragraph id="H4CCC1611E53F4E64A04276A761F9DE43"><enum>(3)</enum><text display-inline="yes-display-inline">Any contribution (as defined in section 301(8) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101(8)</external-xref>)) accepted as a candidate, and any other donation received as support for activities of the individual as a holder of Federal office.</text></paragraph></subsection> 
<subsection id="H33276AEB038045978B7618C7DD488ACE"><enum>(c)</enum><header>Publication</header><text>Each supervising ethics office shall publish on a publicly available website a description of—</text> <paragraph id="H7EC1E0F84A2F48E093B762065826A5D9"><enum>(1)</enum><text>each fine assessed by the supervising ethics office pursuant to this section;</text></paragraph> 
<paragraph id="HBF597612DE2549739026FE3B8BF5D210"><enum>(2)</enum><text>the reason why each such fine was assessed; and</text></paragraph> <paragraph id="H9A47A5D57AB145FCBA829F6B5860C01F"><enum>(3)</enum><text>the result of each assessment.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

      section-type="subsequent-section">
      <enum>3.</enum>
      <header>Prohibiting Members of the House of Representatives from owning individual
        stocks</header>
 <text display-inline="no-display-inline">Rule XXIII of the Rules of the House of Representatives (known as the <quote>Code of Official Conduct</quote>) is amended by redesignating clause 22 as clause 23 and inserting after clause 21 the following:</text>

          <enum>(22)</enum>
          <header>Prohibiting members of the house of representatives from owning individual
            stocks</header>
 <text display-inline="yes-display-inline">A Member, Delegate, or Resident Commissioner may not own the common stock of any individual public corporation. The <short-title>Restore Trust in Congress Act</short-title> shall apply as if enacted into law.</text>

<section id="H9CB5C505D71C43EC91E0E600E6FB9D8A"><enum>4.</enum><header><inline-comment display="no">119H4763</inline-comment> Protected Time Off</header> 
<subsection id="H14E65D2256FE4439B1C04A30DEA512A0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HC40FFAE2383A46D6B9A35C5D790712E9"><enum>(1)</enum><header>Commerce</header><text display-inline="yes-display-inline">The terms <term>commerce</term> and <term>industry or activity affecting commerce</term> mean any activity, business, or industry in commerce or in which a labor dispute would hinder or obstruct commerce or the free flow of commerce, and include <quote>commerce</quote> and any <quote>industry affecting commerce</quote>, as defined in paragraphs (1) and (3) of section 501 of the Labor Management Relations Act, 1947 (<external-xref legal-doc="usc" parsable-cite="usc/29/142">29 U.S.C. 142(1)</external-xref> and (3)).</text></paragraph> 
<paragraph id="H59DF0D8E896D427DBD60914D605C58D5"><enum>(2)</enum><header>Covered employee</header><text display-inline="yes-display-inline">The term <term>covered employee</term> means an individual who is—</text> <subparagraph id="H690D6EB277EC41AE8E187F61352CF763" display-inline="no-display-inline"><enum>(A)</enum> <clause id="HF7C2BF52B64E45A2A357DF5AA863DB68" commented="no" display-inline="yes-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">an employee who is not covered under any other provision of this paragraph, except that a reference in such section to an employer shall be considered a reference to an employer described in paragraph (3)(A)(i)(I);</text></clause> 
<clause id="H1B51A7DF1B534BAE965C885B60EFD3D9" display-inline="no-display-inline"><enum>(ii)</enum><text>an employee of the Government Accountability Office; or</text></clause> <clause id="H02E7E749A67B4391BFE46F43D4510B0C" commented="no"><enum>(iii)</enum><text>an employee of a covered employer described in paragraph (3)(B)(i)(IV);</text></clause></subparagraph> 
<subparagraph id="H2710FFFE8F494997851FF04D5177554B" display-inline="no-display-inline"><enum>(B)</enum><text>a State employee described in section 304(a) of the Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16c(a)), other than an applicant for employment;</text></subparagraph> <subparagraph id="HA228154F61D4448C881D8093E9F5782C"><enum>(C)</enum><text>a covered employee (as defined in section 411(c) of title 3, United States Code);</text></subparagraph> 
<subparagraph id="H66D42DF698BB483CBADFF2D5AE6D2014"><enum>(D)</enum><text display-inline="yes-display-inline">a covered employee (as defined in section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>)), other than an applicant for employment; or</text></subparagraph> <subparagraph id="H04A586C69F534748973A0F4C774EF2F7"><enum>(E)</enum><text>a Federal officer or employee covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code (without regard to the limitation in section 6381(1)(B) of that title).</text></subparagraph></paragraph> 
<paragraph id="H4707280DAECA4329B3BA1D921501F731"><enum>(3)</enum><header>Employer</header> 
<subparagraph id="HFD0EAEA173974DACB432C497EBB27894"><enum>(A)</enum><header>In general</header><text>The term <term>employer</term> means any person who is—</text> <clause id="H6C29AB3154C6428696AB88EC328BE916"><enum>(i)</enum> <subclause id="HFA9D7690EEAD4900AE629BCF951BEA35" commented="no" display-inline="yes-display-inline"><enum>(I)</enum><text>a covered employer who is not described in any other subclause of this clause;</text></subclause> 
<subclause id="H6697D4F4A58E42F2934428CC9D2F11F6" indent="up1"><enum>(II)</enum><text>an entity employing a State employee described in section 304(a) of the Government Employee Rights Act of 1991;</text></subclause> <subclause id="HE811BC4489D74420BB201CE8C86CC1F4" indent="up1"><enum>(III)</enum><text>an employing office, as defined in section 101 of the Congressional Accountability Act of 1995;</text></subclause> 
<subclause id="H02789E9BD8304F0581EE8093D0309A2D" indent="up1"><enum>(IV)</enum><text>an employing office, as defined in section 411(c) of title 3, United States Code; or</text></subclause> <subclause id="H00A4F1D196A74CFDA02BFE4D07C2C283" indent="up1"><enum>(V)</enum><text>an employing agency covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code; and</text></subclause></clause> 
<clause id="H52FADDB95D884AB3AE8E776E87E1B527"><enum>(ii)</enum><text>engaged in commerce (including government), or any industry or activity affecting commerce (including government).</text></clause></subparagraph> <subparagraph id="H0A67F321AD3D46608EE4C9AA7E18794E"><enum>(B)</enum><header>Covered employer</header> <clause id="H7608021F27BB4C9A9B9D7313E50ED865"><enum>(i)</enum><header>In general</header><text>In subparagraph (A)(i)(I), the term <term>covered employer</term>—</text> 
<subclause id="H02417A614A694D26AE443742728FAC70"><enum>(I)</enum><text>means any person engaged in commerce or in any industry or activity affecting commerce who employs 1 or more employees for each working day during each of 20 or more calendar workweeks in the current or preceding year;</text></subclause> <subclause id="H67853AC6AB0D467AA408C18856F73F19"><enum>(II)</enum><text>includes the Government Accountability Office and the Library of Congress;</text></subclause> 
<subclause id="H5D31217F6BAC4DA6A798B9F1F513E597"><enum>(III)</enum><text>includes—</text> <item id="H643EF9AC21F047D3824D93974974E5E6"><enum>(aa)</enum><text>any person who acts, directly or indirectly, in the interest of an employer covered by this clause to any of the employees of such employer; and</text></item> 
<item id="HB2DE9C8259924036AAD40F029897ACFE"><enum>(bb)</enum><text>any successor in interest of such an employer; and</text></item></subclause> <subclause id="H7DA805C797EA458B8D5A377A2AD26630" commented="no"><enum>(IV)</enum><text display-inline="yes-display-inline">includes any carrier (as such term is defined in section 1 of the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/151">45 U.S.C. 151</external-xref>)) and any carrier by air (as described in section 201 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/45/181">45 U.S.C. 181</external-xref>)).</text></subclause></clause> 
<clause id="H13CBA9B0D077462D80F34656C5451D69"><enum>(ii)</enum><header>Public agency</header><text>For purposes of clause (i), a public agency, as defined in section 3(x) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(x)</external-xref>), shall be considered to be a person engaged in commerce or in an industry or activity affecting commerce.</text></clause></subparagraph> <subparagraph id="H4D54B44E44C24FC7902A4B3B734DDF0C"><enum>(C)</enum><header>Predecessors</header><text>Any reference in this paragraph to an employer shall include a reference to any predecessor of such employer.</text></subparagraph></paragraph> 
<paragraph id="H5D49E6F5465D478A9E4676B0062BB701"><enum>(4)</enum><header>FLSA definitions</header><text>The terms <term>employ</term>, <term>employee</term>, <term>person</term>, and <term>State</term> have the meanings given the terms in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text></paragraph> <paragraph id="H6A68E83AD96B4BD9970E59B53B4C6499"><enum>(5)</enum><header>Paid annual leave</header><text>The term <term>paid annual leave</term>—</text> 
<subparagraph id="HFD7C5814D93E4A6FA8E422F04B94107D"><enum>(A)</enum><text display-inline="yes-display-inline">means paid vacation leave and paid personal leave provided to an employee by the employer of such employee to be used during period in which the employee would otherwise work; and</text></subparagraph> <subparagraph id="H548C928D69C44EC18FBB027DC1C28C61"><enum>(B)</enum><text display-inline="yes-display-inline">does not include—</text> 
<clause id="H9473B528EE3C4A5289610C32D92AADE2"><enum>(i)</enum><text>paid or unpaid family and medical leave provided by the employer or required by Federal, State, or local law;</text></clause> <clause id="H83744406CFD747C0905CCEB5848BA226"><enum>(ii)</enum><text>leave provided under the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601</external-xref>, et seq.);</text></clause> 
<clause id="H385D85AFE612483AA3147CAC3C601E16"><enum>(iii)</enum><text display-inline="yes-display-inline">sick leave provided by the employer or required by Federal, State, or local law;</text></clause> <clause id="HB0069CAC713745F499455BD4D4655303"><enum>(iv)</enum><text display-inline="yes-display-inline">bereavement leave provided by the employer or required by Federal, State or local law;</text></clause> 
<clause id="HAB037DB41B5946398C3DD8111C3A4110"><enum>(v)</enum><text>leave provided by the employer or required by Federal State, or local law for purposes related to adoption or fostering of a child;</text></clause> <clause id="H9AEEF234CB1B460C876A88C4CBC6ADF2"><enum>(vi)</enum><text>leave related to domestic violence, sexual assault, or stalking provided by the employer or required by Federal, State, or local law;</text></clause> 
<clause id="HB9D2C47578EB46038A09B8DF5582508A"><enum>(vii)</enum><text>leave provided by the employer or required by Federal, State, or local law with respect to a public health emergency;</text></clause> <clause id="H4825176B8A43489B897AE6D10AA0AF5C"><enum>(viii)</enum><text>absence or paid leave under workers' compensation or a disability plan;</text></clause> 
<clause id="H9FF2D9B8AFB141F7AFC870BE9E6FA686"><enum>(ix)</enum><text>leave provided by the employer or leave required to be provided by Federal, State, or local law for holidays established by Federal, State, or local law; or</text></clause> <clause id="H290685493CD34B87BFED08D36E371533"><enum>(x)</enum><text>leave provided by the employer or required by Federal, State, or local law for jury duty, civic duty, or to vote.</text></clause></subparagraph></paragraph> 
<paragraph id="H855397E1CD4047EB84E093C96821EAD1"><enum>(6)</enum><header>Rail carrier</header><text>The term <term>rail carrier</term> has the meaning given such term in section 10102 of title 49, United States Code.</text></paragraph> <paragraph id="HD59CA56FDC434FFBA473CFE2EEB26D6C"><enum>(7)</enum><header>Secretary</header><text>Unless otherwise specified, the term <term>Secretary</term> means the Secretary of Labor.</text></paragraph></subsection> 
<subsection id="HD06B754FB20B4DBFB26CE639D4726FEF"><enum>(b)</enum><header>Earned annual leave</header> 
<paragraph id="H279F07E46E834764816E8B896F6F0EA1"><enum>(1)</enum><header>Earning of paid annual leave</header> 
<subparagraph id="H5FFC53412FE54BCEB60590C2DE93D0AF"><enum>(A)</enum><header>Earning of annual leave</header><text display-inline="yes-display-inline">An employer shall provide each employee employed by the employer not less than 1 hour of paid annual leave for every 25 hours worked.</text></subparagraph> <subparagraph id="H27CB87F8C4234A66BC8672E3A478832C"><enum>(B)</enum><header>Limitation</header> <clause id="H5B86EDAD7FFA4389B13B3858A965F8F2"><enum>(i)</enum><header>In general</header><text>For purposes of complying with subparagraph (A), an employer may not be required to provide more than 80 hours of paid annual leave to an employee during any 12-month period.</text></clause> 
<clause id="HBBE8FB4EC5A94B928B51F8C368F31731" commented="no"><enum>(ii)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed to preclude an employer from providing more than 80 hours of paid annual leave.</text></clause></subparagraph> <subparagraph id="H846204E3221F40A196C9F59B4EAB5F80"><enum>(C)</enum><header>Commencement of earning paid annual leave</header><text>An employee shall begin to earn paid annual leave at the commencement of employment of such employee.</text></subparagraph> 
<subparagraph id="H720C59366320467EB41F56577D6E845B"><enum>(D)</enum><header>Overtime exempt employee</header><text display-inline="yes-display-inline">For purposes of this subsection, where an employer is not required by the Fair Labor Standards Act of 1938 to maintain and preserve records of hours worked because an employee is exempt from minimum wage or overtime requirements under such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)</external-xref>), the employee shall be deemed to work 40 hours in each workweek.</text></subparagraph></paragraph> <paragraph id="H09CD819CC2004903A5B18D59CD5A52A0"><enum>(2)</enum><header>Use of paid annual leave</header> <subparagraph id="HABDE8BB1BF724C218076045A64D30099"><enum>(A)</enum><header>In general</header><text>Paid annual leave may be used by an employee for any reason.</text></subparagraph> 
<subparagraph id="H100CD033F0924E5383192F96A007A291"><enum>(B)</enum><header>Timing</header><text display-inline="yes-display-inline">Subject to subparagraphs (B) and (C) of paragraph (3), an employee may use paid annual leave earned by the employee as it is accrued.</text></subparagraph> <subparagraph id="H23FC05B7D32948E6ADAA49C060B90A3B"><enum>(C)</enum><header>Rate of compensation</header> <clause id="HC7829B15E7A14482BFEEA4B770065980"><enum>(i)</enum><header>In general</header><text>An employee using paid annual leave shall be compensated, for the period that the employee is using such leave, at the regular rate at which the employee would have been paid for such period if the employee were not using paid annual leave.</text></clause> 
<clause id="H976AA337610F401DB0C71A8B8EA376BE"><enum>(ii)</enum><header>Tipped employee</header><text display-inline="yes-display-inline">For the purposes of clause (i), with respect to a tipped employee (as defined in section 3(t) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(t)</external-xref>)), such an employee shall be compensated, for the period that such employee is using paid annual leave, at a rate equivalent to the higher of—</text> <subclause id="HB009C413F92D44E3B0363678D97A83FB"><enum>(I)</enum><text>the Federal minimum wage;</text></subclause> 
<subclause id="H1B0D45309E154929BFDC7F1BF924CE38"><enum>(II)</enum><text>the applicable State minimum wage;</text></subclause> <subclause id="HE8D178F872E34E29B00C4505E4574958"><enum>(III)</enum><text>the applicable local or municipal minimum wage;</text></subclause> 
<subclause id="HE757B3F1677D4244BF03642EB569EE00"><enum>(IV)</enum><text>any other wage required by law; or</text></subclause> <subclause id="H88890DEA1BA1443284E1CC747ED24E16"><enum>(V)</enum><text display-inline="yes-display-inline">the regular rate at which the employee is employed.</text></subclause></clause></subparagraph> 
<subparagraph id="HA992BCCB9E3648C2867885B61E56A8A2"><enum>(D)</enum><header>Loaning of annual leave</header> 
<clause id="H35EBBBEB62944D4FB1EE4B64D66FD8D2"><enum>(i)</enum><header>Loaned leave</header><text>An employer may loan paid annual leave to an employee for use by such employee in advance of the employee earning such annual leave.</text></clause> <clause id="HC8AD45A26F604EBB844EF4F7214E39D7"><enum>(ii)</enum><header>Reimbursement for loaned leave</header><text>An employer may require an employee of such employer to reimburse the employer for any annual leave loaned under clause (i) that such employee has not earned at the time of separation. Such reimbursement shall be at the rate described in subparagraph (C).</text></clause></subparagraph> 
<subparagraph id="HA65731F0C8554C94AF88261918152308"><enum>(E)</enum><header>Increments of use of paid annual leave</header><text>An employer shall allow employees to use paid annual leave in increments of the smaller of—</text> <clause id="H9223BC66B9444D28BD2DEAF464B0EBAB"><enum>(i)</enum><text>hourly increments; or</text></clause> 
<clause id="H556C03CF19CA48799F9FBC9F514DF38A"><enum>(ii)</enum><text>the smallest increment of time that the employer’s payroll system uses to account for absences or use of other time.</text></clause></subparagraph> <subparagraph id="H759F75104DCD4731AF1A6D2826A53F93"><enum>(F)</enum><header>Benefits retained during leave</header><text display-inline="yes-display-inline">An employer shall maintain any employment benefits (as defined in section 101(5) of the Family and Medical Leave Act of 1993) provided to an employee during any period in which the employee takes paid annual leave, and such benefits shall be provided in the same manner as if the employee had continued in employment continuously for the duration of such leave.</text></subparagraph></paragraph> 
<paragraph id="H8418808284A84FDB8FD02DB1F19E299C"><enum>(3)</enum><header>Procedures for use of paid annual leave</header> 
<subparagraph id="HC4097EFB48AD49F2BBB78B45B81B93CA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraphs (B) and (C), an employee may use paid annual leave upon the verbal or written request of the employee.</text></subparagraph> <subparagraph id="H2802F902CE93453FBCB851726A03E1C2"><enum>(B)</enum><header>Employee notification</header> <clause id="HA628EC16955740A087B89670F3975399"><enum>(i)</enum><header>Employee notification</header><text>An employee shall provide notice to the employer to use paid annual leave.</text></clause> 
<clause id="HEE926B2E83134F95B0455D1D26D5C4B5"><enum>(ii)</enum><header>Notice described</header><text>The Secretary shall create sample notices for the purpose described in clause (i).</text></clause> <clause id="HC683F3AFDE654D1DAA708A56EDDA1032"><enum>(iii)</enum><header>Timing of notice</header><text display-inline="yes-display-inline">An employer may not require an employee to provide notice in excess of 2 weeks in advance of the use of such leave.</text></clause> 
<clause id="H4E6FEA2C51F84462800ECA70D7787910"><enum>(iv)</enum><header>Unforeseeable use of leave</header><text>In the case of an unforeseeable use of leave, an employee shall not be required to provide the notice required under clause (i).</text></clause></subparagraph> <subparagraph id="H5CFA9A1BC66A40A2BF7D9B6A836AC043"><enum>(C)</enum><header>Reasonable restrictions</header> <clause id="H2CB0FED787E5424A8A307686B5CE9E0E"><enum>(i)</enum><header>In general</header><text>An employer may place limited, reasonable restrictions for the scheduling of paid annual leave for a bona fide business reason and may reject a scheduling request for such leave for a bona fide business reason, so long as the employer—</text> 
<subclause id="HCCD949A6C37248C8AE1DECFF2E483DB9"><enum>(I)</enum><text>provides other reasonable alternative times, as described in clause (ii), for the employee to schedule such leave; and</text></subclause> <subclause id="H06BB16337AEB4A9DBE743BF332D6418F"><enum>(II)</enum><text>and complies with the notice requirement described in clause (iii).</text></subclause></clause> 
<clause id="H949AA5F5D5C44AAFB63D698EE26B8440"><enum>(ii)</enum><header>Reasonable alternatives</header><text>A reasonable alternative time described in this subparagraph is a date other than the date the employee requested to use paid annual leave that is within 30 days of such date.</text></clause> <clause id="H0C0ECF3BEC514053AA79697F4DB6C888"><enum>(iii)</enum><header>Denial notice</header><text display-inline="yes-display-inline">In the case that an employer denies a request of an employee to use paid annual leave, the employer shall, not later than 5 business days after the day the employee made such request, provide to the employee a written notice—</text> 
<subclause id="H00AD8C15DB1D4FB494BF56444CF11D07"><enum>(I)</enum><text>detailing the bona fide business reason for such denial; and</text></subclause> <subclause id="H4092B6A964404869B34EA8378FAEA897"><enum>(II)</enum><text>that provides the reasonable alternative time described in clause (ii).</text></subclause></clause> 
<clause id="H55AD997AD47C425988B28214E3A6F402"><enum>(iv)</enum><header>Can not prevent use of expiring leave</header><text display-inline="yes-display-inline">Such reasonable alternative time may not be offered to prevent the use of paid annual leave that is set to expire.</text></clause></subparagraph> <subparagraph id="H9725F0DCD82E4464A969B313C6FC2B3D"><enum>(D)</enum><header>Purpose of use of paid annual leave</header><text>An employer may not require an employee to disclose the purpose or reason for which the employee is using paid annual leave.</text></subparagraph> 
<subparagraph id="H6790E7F3FE4B47D795AD9781394E21FF"><enum>(E)</enum><header>Carryover</header><text>An employer shall permit an employee of such employer to carry over up to 40 hours of any accrued and unused paid annual leave to the following 12-month period.</text></subparagraph> <subparagraph id="H47390609FEFB47988943ECD3B9FDDCFF"><enum>(F)</enum><header>Prohibition on finding cover</header><text>An employer may not require, as a condition of taking paid annual leave, that an employee search for or find a replacement employee to cover the hours during which the employee is using such annual leave.</text></subparagraph> 
<subparagraph id="H91C88F24A2FE4F228675E284407CFC71"><enum>(G)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than 180 after the date of enactment of this Act, the Secretary shall provide guidance to employers on compliance with subparagraph (C), including defining the terms limited reasonable restriction, a bona fide business reason, and a reasonable alternative time.</text></subparagraph></paragraph> <paragraph id="H0C97DA7BED404663AEAC4066580BAEF3"><enum>(4)</enum><header>Procedures regarding leave for employee separation</header> <subparagraph id="H2F4C8C2FFBBF4CBB98F05094E5BFD6A9"><enum>(A)</enum><header>Compensation</header><text>In the case that an employee separates from an employer and such employee has unused paid annual leave, the employer shall provide financial compensation at a rate that is the higher of—</text> 
<clause id="HC0ED71FB01794B29AA8D72FF1ED44AFC"><enum>(i)</enum><text>the average regular rate received by such employee during the last 3 years of the employee’s employment; or</text></clause> <clause id="H67972ABF9ACB4110A9F8B23F5E254335"><enum>(ii)</enum><text>the final regular rate received by the employee.</text></clause></subparagraph> 
<subparagraph id="HD26A177E4C874368B7CDE5A1934EA7F0"><enum>(B)</enum><header>Reinstatement</header><text display-inline="yes-display-inline">If an employee separates from employment with an employer and is rehired within 12 months after that separation by the same employer—</text> <clause id="H801D00380A434AB4AD718C695BEC40C1"><enum>(i)</enum><text>in the case that the employee had paid annual leave in excess of 80 hours that was not compensated under subparagraph (A), the employer shall reinstate such leave for the employee; and</text></clause> 
<clause id="HCD28D38727364FB9A2E26828879E8AD5"><enum>(ii)</enum><text>the employee shall be entitled to use such leave and earn additional paid annual leave at the recommencement of employment with the employer.</text></clause></subparagraph></paragraph></subsection> <subsection id="H09379C2A04134F80A4BE04E36EDBA3AD"><enum>(c)</enum><header>Employer notice and system requirements</header> <paragraph id="H9181BF68326546D29D89013410FD3F3E"><enum>(1)</enum><header>Notice requirement</header><text>An employer shall notify each employee about the paid annual leave policy of such employer, which shall include the information described in paragraph (2), by—</text> 
<subparagraph id="H57CEAF37F4E7499A82C483337A291D23"><enum>(A)</enum><text>providing such information, in writing, to each employee on or before the first day of employment of such employee;</text></subparagraph> <subparagraph id="HFF92C71445644C299F70683D62A20FC2"><enum>(B)</enum><text>including such information in any employee handbook; and</text></subparagraph> 
<subparagraph id="HD971E7C252D44C93A7E72211969C6B2C"><enum>(C)</enum><text>posting a notice containing such information in a physical conspicuous place on the premises of the employer or a virtual conspicuous place, where notices to employees are customarily posted.</text></subparagraph></paragraph> <paragraph id="HDC8622BD271E47FDA3B9184EE46B7F64"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The information provided pursuant to paragraph (1) shall include—</text> 
<subparagraph id="H470B9A5F5F144358A8ABF049F15DC726"><enum>(A)</enum><text>any paid annual leave policy of such employer, including any paid annual leave policy that provides paid annual leave in excess of the requirements of this section;</text></subparagraph> <subparagraph id="HF64950AC478D4D8AA2AD74C5F9203480"><enum>(B)</enum><text>information pertaining to the filing of an action under subsection (e);</text></subparagraph> 
<subparagraph id="H5591F476AA8046B0AADE11D1F4F4E40C"><enum>(C)</enum><text>details of any notice requirement the employer may require, as described in subsection (b)(3)(B); and</text></subparagraph> <subparagraph id="H020A072EABAF41999F3FA630B72FFC96"><enum>(D)</enum><text>information regarding—</text> 
<clause id="H697A90F99E2645068064ACCAB906CE3B"><enum>(i)</enum><text>the protections that an employee has in exercising rights under this section; and</text></clause> <clause id="H253362C48F0E4CD6A917E50AC37354D0"><enum>(ii)</enum><text>how the employee can contact the Secretary (or other appropriate authority as described in subsection (e)) if any such rights are violated.</text></clause></subparagraph></paragraph> 
<paragraph id="HCC4CF222B4764C05AB45BCD6840F5BE1"><enum>(3)</enum><header>System requirement</header><text>An employer shall establish a system, such as through an online portal, written request, or through pay stubs, to inform each employee of the employer how much paid annual leave each employee has earned.</text></paragraph></subsection> <subsection id="HBEE940BE3CF942888C249544E6E1A46E" commented="no"><enum>(d)</enum><header>Prohibited acts</header> <paragraph id="HC1FAFBF971C046EFB5C58E90C6776206" commented="no"><enum>(1)</enum><header>Interference with rights</header><text display-inline="yes-display-inline">It shall be unlawful for any employer to—</text> 
<subparagraph id="HF72C95A9CC684B9988F5D3153E4F5663" commented="no"><enum>(A)</enum><text>violate any provision of subsection (b) or (c);</text></subparagraph> <subparagraph id="H3950371BB16B4888BD1B02FCFC156D24" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">discharge or discriminate against (including to retaliate against) any individual, including a job applicant, for exercising, or attempting to exercise, any right provided under this section;</text></subparagraph> 
<subparagraph id="HD00F6123DCDA403C8D60345E9C9D077B" commented="no"><enum>(C)</enum><text>use the taking of paid annual leave provided under this section as a negative factor in an employment action, such as hiring, promotion, reducing hours or numbers of shifts, or a disciplinary action; or</text></subparagraph> <subparagraph id="H30398EB3DD5049CD9694893D0CB0C880" commented="no"><enum>(D)</enum><text>count the use of such leave under a no-fault attendance policy or any other absence-control policy.</text></subparagraph></paragraph> 
<paragraph id="HFFE24918414C4F9ABA166DB644558A75" commented="no"><enum>(2)</enum><header>Interference with proceedings or inquiries</header><text>It shall be unlawful for any person to discharge or in any other manner discriminate against (including retaliating against) any individual, including a job applicant, because such individual—</text> <subparagraph id="HD8DEEB90773848FBB1DD94870346D344" commented="no"><enum>(A)</enum><text>has filed an action under subsection (e), or has instituted or caused to be instituted any proceeding, under this section;</text></subparagraph> 
<subparagraph id="H6FCC5288DF7C475591B41E9B3F7C7F46" commented="no"><enum>(B)</enum><text>has given, or intends to give, any information in connection with any inquiry or proceeding relating to any right provided under this section; or</text></subparagraph> <subparagraph id="HE8345682F48E47BA9D0FAA054130993E" commented="no"><enum>(C)</enum><text>has testified, or intends to testify, in any inquiry or proceeding relating to any right provided under this section.</text></subparagraph></paragraph> 
<paragraph id="HE821CDD60B324ED68830B5264C7CCC00"><enum>(3)</enum><header>Impermissible consideration</header><text display-inline="yes-display-inline">A violation of paragraph (1) or (2) shall be established when a complaining party demonstrates that any action described in subparagraphs (A), (B), or (C) of paragraphs (1) or (2) was a motivating factor in any such action taken against the complaining party, even though other factors also motivated the action.</text></paragraph></subsection> <subsection id="H892B8CACC8044BDB9591FF3884728726"><enum>(e)</enum><header>Enforcement and investigative authority</header> <paragraph id="H76ED69D49CFA43E5B0B39EF9D2B09517"><enum>(1)</enum><header>In general</header> <subparagraph id="H2EC5BA73F0694BC7A758745141B5115D" commented="no"><enum>(A)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection—</text> 
<clause id="HB1CE93DC217C4A1CA01478857A0AA818" commented="no"><enum>(i)</enum><text>the term <term>employee</term> means a covered employee described in clause (i), (ii), or (iii) of paragraph (2)(B); and</text></clause> <clause id="H244B9B0448E44E14BEECEBA21CAC4174" commented="no"><enum>(ii)</enum><text>the term <term>employer</term> means an employer described in item (aa) or (bb) of paragraph (1)(C)(ii)(I).</text></clause></subparagraph> 
<subparagraph id="HA572E11D18D3422D8208215B25A65132"><enum>(B)</enum><header>Investigative authority</header> 
<clause id="H5BAA295E86CD439C8BC0B1618424866B"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">To ensure compliance with this section, or any regulation or order issued under this section, the Secretary shall have, subject to clause (iii), the investigative authority provided under section 11(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(a)</external-xref>), with respect to employers, employees, and other individuals affected by an employer.</text></clause> <clause id="HDBB3A98DAF7444308561CF4C7A437E20"><enum>(ii)</enum><header>Obligation to keep and preserve records</header><text>An employer shall make, keep, and preserve records pertaining to compliance with this section in accordance with section 11(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(c)</external-xref>) and in accordance with regulations prescribed by the Secretary.</text></clause> 
<clause id="HCAC2A96EDD914EB9A18B9F94CAA4F733"><enum>(iii)</enum><header>Required submissions generally limited to an annual basis</header><text>The Secretary may not require an employer to submit to the Secretary any books or records more than once during any 12-month period, unless the Secretary has reasonable cause to believe there may exist a violation of this act or any regulation or order issued pursuant to this section, or is investigating a charge pursuant to subparagraph (D).</text></clause> <clause id="H3F7841A0020040BF865FA0552B8F0C72"><enum>(iv)</enum><header>Subpoena authority</header><text>For the purposes of any investigation provided for in this paragraph, the Secretary shall have the subpoena authority provided for under section 9 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/209">29 U.S.C. 209</external-xref>).</text></clause></subparagraph> 
<subparagraph id="H8A26CA8B7932424FAAB4D452109C42DF"><enum>(C)</enum><header>Private right of action</header> 
<clause id="HA8DA209F64524908BB83DF8277B7F9B7"><enum>(i)</enum><header>In general</header><text>An action to recover damages or equitable relief prescribed in subparagraph (B) may be maintained against any employer in any Federal or State court of competent jurisdiction by an employee or individual or a representative for and on behalf of—</text> <subclause id="H37D5D5747ADA410080693A96E2A52577"><enum>(I)</enum><text>the employee or individual; or</text></subclause> 
<subclause id="H3316C5D3556B4288AE8CFAA4473BB69D"><enum>(II)</enum><text>the employee or individual and others similarly situated.</text></subclause></clause> <clause id="H6064F6A0B27D41DBBF607A1956C1FC5F"><enum>(ii)</enum><header>Liability</header><text>Any employer who violates subsection (d) shall be liable to any employee or individual affected—</text> 
<subclause id="H76513F84DEB94E23A92C4FA2C5F290BB"><enum>(I)</enum><text>for damages equal to—</text> <item id="H0FB21D19D2DC4E0DAA9CF94C9B4477E7"><enum>(aa)</enum><text>the amount of—</text> 
<subitem id="H58DD6BFD63D1403FAE5AFE590927BD9E"><enum>(AA)</enum><text>any wages, salary, employment benefits, or other compensation denied or lost by reason of the violation; or</text></subitem> <subitem id="HD869387508DD4124890C8E2F4F2EB557"><enum>(BB)</enum><text>in a case in which wages, salary, employment benefits, or other compensation have not been denied or lost, any actual monetary losses sustained as a direct result of the violation up to a sum equal to 80 hours of wages or salary for the employee or individual;</text></subitem></item> 
<item id="H8E21ACAEC9D041F4A35BFB5C413D73C5"><enum>(bb)</enum><text>the interest on the amount described in item (aa) calculated at the prevailing rate; and</text></item> <item id="HD6F6961251E44AA8A12F175644CA4880"><enum>(cc)</enum><text>an additional amount as liquidated damages; and</text></item></subclause> 
<subclause id="H2995778B1F9B4475A8D5C20AE06A33C8"><enum>(II)</enum><text>for such equitable relief as may be appropriate, including employment, reinstatement, and promotion.</text></subclause></clause> <clause id="H9CD59C1DBED849799405B44DCC4C74E2"><enum>(iii)</enum><header>Fees and costs</header><text>The court in an action under this subsection shall, in addition to any judgment awarded to the plaintiff, allow a reasonable attorney’s fee, reasonable expert witness fees, and other costs to be paid by the defendant.</text></clause> 
<clause id="HD4521B6D89844B61A8B3BF0AC60A510E"><enum>(iv)</enum><header>Limitations</header> 
<subclause id="H1D1CD1C4018143D284558EF1372AFACB"><enum>(I)</enum><header>In general</header><text>Except as provided in clause (ii), an action may be brought under subparagraph (B) or (C) not more than 2 years after the date of the last event constituting the alleged violation for which the action is brought.</text></subclause> <subclause id="HB7277D69C92B4A799AC13F4EFD37A209"><enum>(II)</enum><header>Willful violation</header><text>In the case of an action brought for a willful violation of subsection (d) (including a willful violation relating to rights provided under subsection (b)), such action may be brought not more than 3 years after the last event constituting the alleged violation for which such action is brought.</text></subclause> 
<subclause id="HA8031AB0CEEA4575B52821768BE262A7"><enum>(III)</enum><header>Commencement</header><text>In determining when an action is commenced under subparagraph (B) or (C) for the purposes of this subsection, the action shall be considered to be commenced on the date when the complaint is filed.</text></subclause></clause></subparagraph> <subparagraph id="HA7F5BE9328334C7A813B92F23FACDB6C"><enum>(D)</enum><header>Actions by the Secretary</header> <clause id="HACCBBDBA61374D76ACCD435C92EEF5BD"><enum>(i)</enum><header>Administrative actions</header><text display-inline="yes-display-inline">The Secretary shall receive, investigate, and attempt to resolve complaints of violations of subsection (e) in the same manner that the Secretary receives, investigates, and attempts to resolve complaints of violations of sections 6 and 7 of the Fair Labor Standards Act of 1938 (29 U.S.C. 206 and 207).</text></clause> 
<clause id="HE69194503CAF42BD8B9703AFC38EE0CF"><enum>(ii)</enum><header>Civil action</header><text>The Secretary may bring an action in any court of competent jurisdiction to recover the damages described in paragraph (1)(C)(ii).</text></clause> <clause id="H82B8EB61E5984DE7A063C0398A952C31"><enum>(iii)</enum><header>Sums recovered</header><text>Any sums recovered by the Secretary pursuant to clause (ii) shall be held in a special deposit account and shall be paid, on order of the Secretary, directly to each employee or individual affected. Any sums not paid to an employee or individual affected because of the inability to do so within a period of 3 years shall be deposited into the Treasury of the United States as miscellaneous receipts.</text></clause> 
<clause id="H5DC8B3AC114B402BA9CA177EB4744453" commented="no"><enum>(iv)</enum><header>Action for injunction by Secretary</header><text>The district courts of the United States shall have jurisdiction, for cause shown, in an action brought by the Secretary—</text> <subclause id="H9E25857F65474685A19B38140A95519A" commented="no"><enum>(I)</enum><text>to restrain violations of subsection (d) (including a violation relating to rights provided under subsection (b)), including the restraint of any withholding of wages, salary, employment benefits, or other compensation, plus interest, found by the court to be due to employees or individuals eligible under this section; or</text></subclause> 
<subclause id="H69384D8CA07F4BCB9F69F30F5B40B3C1" commented="no"><enum>(II)</enum><text>to award such other equitable relief as may be appropriate, including employment, reinstatements, and promotion.</text></subclause></clause> <clause id="H223B9E75A41E420FB3B141B12998641B"> <enum>(v)</enum> <header>Solicitor of Labor</header> <text>The Solicitor of Labor may appear for and represent the Secretary on any litigation brought under this subsection.</text>
            </clause></subparagraph></paragraph> 
<paragraph id="H73B4FDE5DCC24FB889B3A177A8AA8338" commented="no"><enum>(2)</enum><header>Government Accountability Office and Library of Congress</header><text>Notwithstanding any other provision of this section, in the case of the Government Accountability Office and the Library of Congress, the authority of the Secretary under this subsection shall be exercised respectively by the Comptroller General of the United States and the Librarian of Congress.</text></paragraph> <paragraph id="HAD487E937C7543DFA3D95EB62CF63580" commented="no"><enum>(3)</enum><header>Employees covered by Congressional Accountability Act of 1995</header><text>The powers, remedies, and procedures provided in the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) to the Board (as defined in section 101 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>)), or any person, alleging a violation of section 202(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312(a)(1)</external-xref>) shall be the powers, remedies, and procedures this section provides to that Board, or any person, alleging an unlawful employment practice in violation of this section against an employee described in subsection (a)(2)(D).</text></paragraph> 
<paragraph id="HA473FBA41CE041B5AF934E9BC7C83B58" commented="no"><enum>(4)</enum><header>Employees covered by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code</header><text>The powers, remedies, and procedures provided in title 5, United States Code, to an employing agency, provided in chapter 12 of that title to the Merit Systems Protection Board, or provided in that title to any person, alleging a violation of chapter 63 of that title, shall be the powers, remedies, and procedures this section provides to that agency, that Board, or any person, respectively, alleging an unlawful employment practice in violation of this section against an employee described in subsection (a)(2)(E).</text></paragraph> <paragraph id="HD95B620BE8A44EB9ACF24AE62E1EF7BD" commented="no"><enum>(5)</enum><header>Remedies for State employees</header> <subparagraph id="H665E109725E64948BD53AEF3038E442A" commented="no"> <enum>(A)</enum> <header>Waiver of sovereign immunity</header> <text>A State’s receipt or use of Federal financial assistance for any program or activity of a State shall constitute a waiver of sovereign immunity, under the 11th Amendment of the Constitution or otherwise, to a suit brought by an employee of that program or activity under this section for equitable, legal, or other relief authorized under this section.</text>
          </subparagraph> 
<subparagraph id="HDE6E3B2AAF1F4890B3D05E49EAE07AE6" commented="no"><enum>(B)</enum><header>Official capacity</header><text>An official of a State may be sued in the official capacity of the official by any employee who has complied with the procedures of paragraph (1)(C), for injunctive relief that is authorized under this section. In such a suit, the court may award to the prevailing party those costs authorized by section 722 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1988">42 U.S.C. 1988</external-xref>).</text></subparagraph> <subparagraph id="H542B2BDEECA64C3E951B77727F6B177E" commented="no"><enum>(C)</enum><header>Applicability</header><text>With respect to a particular program or activity, subparagraph (A) applies to conduct occurring on or after the day, after the date of enactment of this Act, on which a State first receives or uses Federal financial assistance for that program or activity.</text></subparagraph> 
<subparagraph id="H85C4A5CE73C04B3C992BF409C37CF69D" commented="no"><enum>(D)</enum><header>Program or activity defined</header><text>In this paragraph, the term <term>program or activity</term> has the meaning given the term in section 606 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-4a">42 U.S.C. 2000d–4a</external-xref>).</text></subparagraph></paragraph> <paragraph id="HB6F3F4AD961543A495309A54C6961394"><enum>(6)</enum><header>Collective bargaining agreement resolution</header><text display-inline="yes-display-inline">In addition to the enforcement mechanisms set forth in this section, an employee or labor organization may also use a grievance and arbitration procedure of a collective bargaining agreement to enforce collectively bargained provisions relating to paid annual leave.</text></paragraph></subsection> 
<subsection id="H0D298882018C4836B71CCF324A7D1BCA"><enum>(f)</enum><header>Effect on other laws and existing agreements</header> 
<paragraph id="H6BDC5C431DD242B6B6A36630595FD5D3"><enum>(1)</enum><header>State or municipal laws</header> 
<subparagraph id="HFC42D5B08B53463FBE308770B367A772"><enum>(A)</enum><header>Greater leave rights</header><text>Nothing in this section shall be construed to supersede any provision of any State or local law that provides greater paid annual leave or other leave rights to employees or individuals than the rights established under this section.</text></subparagraph> <subparagraph id="H9AB14C5A03FE4CE7AD570C1AFF02CC96"><enum>(B)</enum><header>Distinguish between types of leave</header><text>For the purposes of this paragraph, a State or municipal law that does not distinguish between time earned for paid annual leave and time earned for sick leave shall be deemed a law that provides lesser paid annual leave or other rights to employees or individuals than the rights established under this section.</text></subparagraph></paragraph> 
<paragraph id="HF6B4CBFC8B2E4889A3C8B61892546E38"><enum>(2)</enum><header>More protective agreements</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to diminish the obligation of an employer to comply with any contract, collective bargaining agreement, or any employment benefit program or plan that provides greater paid annual leave or other leave rights to employees or individuals than the rights established under this section.</text></paragraph> <paragraph id="H44647FB4D3BB470383BB4A2B0123022B"><enum>(3)</enum><header>Less protective agreements</header><text>The rights established for employees under this section shall not be diminished by any contract, collective bargaining agreement, or any employment program or plan.</text></paragraph></subsection> 
<subsection id="H6BCCF4521E3D44D2A86D2652DCC3A825"><enum>(g)</enum><header>Awareness campaign</header> 
<paragraph id="HCEC47AAAF62D4DAB8F1F372FA441AF33"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall carry out a public awareness campaign to inform the public about the paid annual leave established under this section, which shall include information about—</text> <subparagraph id="H21DE1690CC6442B780B396E0FBE605A4"><enum>(A)</enum><text>the rights provided to an employee under this section; and</text></subparagraph> 
<subparagraph id="H32D7E65DECCD42AA91C16800DE685D25"><enum>(B)</enum><text>resources available to an employee if the employee believes the rights provided under this Act have been violated.</text></subparagraph></paragraph> <paragraph id="H1971EC670058430C9EAA8BEB066F116E"><enum>(2)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this section.</text></paragraph></subsection> 
<subsection id="H7A5836DD6B744FB9B45713F983E0385B"><enum>(h)</enum><header>Effective dates</header> 
<paragraph id="H47E058EFDFE74E028516A8A29258D424"><enum>(1)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect 180 days after the date of enactment of this Act.</text></paragraph> <paragraph id="H8B8F759ACACA4EF3A8D36F4BD0BA42AD"><enum>(2)</enum><header>Collective bargaining agreements</header><text>In the case of a collective bargaining agreement in effect on the effective date prescribed under paragraph (1), the Act shall take effect on the earlier of—</text> 
<subparagraph id="HBC696788B68D499BB0EF936E3ECF4779"><enum>(A)</enum><text>the date of the termination of such agreement;</text></subparagraph> <subparagraph id="HA91AFA6E192146C2B4E12FB889217D28"><enum>(B)</enum><text>the date of any amendment, made on or after such effective date, to such agreement; or</text></subparagraph> 
<subparagraph id="H8636CBFCFEBB4482871666C4DE8AA999"><enum>(C)</enum><text>the date that occurs 18 months after such effective date.</text></subparagraph></paragraph></subsection></section> <section id="H8BDF6235BF6B44AC81DBFF6AF194A9AB"><enum>5.</enum><header>Clean energy production credit</header> <subsection id="HA636B5FF42B44EA6B08608D34AD2E7A1"><enum>(a)</enum><header>Restoration of phase out</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/45Y">Section 45Y(d)(3)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>calendar year 2032.</quote> and inserting</text> 
<quoted-block style="OLC" id="HBF8B6E55F0D044F281E81DB73D380058" display-inline="yes-display-inline"><text display-inline="yes-display-inline">means the later of—</text> <subparagraph id="H6CAF2AB1B89D44238C206F7461A660FA"><enum>(A)</enum><text display-inline="yes-display-inline">the calendar year in which the Secretary determines that the annual greenhouse gas emissions from the production of electricity in the United States are equal to or less than 25 percent of the annual greenhouse gas emissions from the production of electricity in the United States for calendar year 2022, or</text></subparagraph> 
<subparagraph id="H2C18707A2E4B4EDF80348F391971F443"><enum>(B)</enum><text>2032.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H8B2DF19A33E842B2A6D687CB2F695866"><enum>(b)</enum><header>Restoration of credit for wind and solar facilities</header><text>Section 45Y(d) of such code is amended—</text> 
<paragraph id="H323DD299C14542D1BF81C831DE8C55EA"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>Subject to paragraph (4), the amount</quote> and inserting <quote>The amount</quote>, and</text></paragraph> <paragraph id="H33DF4E1233284EFCAF390F340B167DA6"><enum>(2)</enum><text>by striking paragraph (4).</text></paragraph></subsection> 
<subsection id="H33BFC17A9E0C4B7E9F51D73DDF36812C"><enum>(c)</enum><header>Restoration of credit for wind and solar leasing arrangements</header><text display-inline="yes-display-inline">Section 45Y of such code is amended by striking subsection (h).</text></subsection> <subsection id="HC071F95B88DF43FEA7980F808470A4F2"><enum>(d)</enum><header>Repeal of provision for existing studies</header><text display-inline="yes-display-inline">Section 45Y(b)(2)(C) of such code is amended by striking clause (iii).</text></subsection> 
<subsection id="HFA4A462ED63C49D79DE0284DFBD257AC"><enum>(e)</enum><header>Effective dates</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect as if included in section 70512 of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>.</text></subsection></section> <section id="H2ACA876BCB9747B59F24646A38E5EEAB"><enum>6.</enum><header>Clean electricity investment credit</header> <subsection id="HA7775F9386304EC1850034F4999CBBA1"><enum>(a)</enum><header>Repeal of termination for wind and solar facilities</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/48">Section 48(e)</external-xref> of the Internal Revenue Code of 1986 is amended—</text>

<subsection id="H8BEAFD770C0941038C0B5321CC3C14E0"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="H41854AE427664136A8B44CC495C56D56"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish within the Department an Intelligence Transparency and Oversight Program Office (in this section referred to as the <quote>Office</quote>) to carry out the following:</text> <subparagraph id="HFF966667A97B4F018841AF26C08E7AD4" commented="no"><enum>(A)</enum><text>Review and assess information concerning intelligence activities of the Department, including relating to the timeliness, objectivity, and independence from political considerations of such activities.</text></subparagraph> 
<subparagraph id="H8D6A173CA70548279795DA16E4A9DD99"><enum>(B)</enum><text>Facilitate departmental decisions regarding making information publicly available in a manner that enhances public understanding of such activities.</text></subparagraph></paragraph> <paragraph id="HF2ACA20DE2B54DA1AABA37FE41034DD4"><enum>(2)</enum><header>Ombuds</header><text>The Office shall be headed by an Ombuds, who shall—</text> 
<subparagraph id="HDA259D1928F44C3FB262761ACF8D7394"><enum>(A)</enum><text>be a senior, career employee;</text></subparagraph> <subparagraph id="H3368F3F48428458BAB7B958E9063154D"><enum>(B)</enum><text>not hold any other position within the Department;</text></subparagraph> 
<subparagraph id="H6409DF9D18E44A0280BCD781238D35DC"><enum>(C)</enum><text>have a background in—</text> <clause id="HB4F276A974914EEFBA38D3DFB043AB6F"><enum>(i)</enum><text>intelligence;</text></clause> 
<clause id="H6FE52E6C34014F32903361BA2927592D"><enum>(ii)</enum><text>civil rights enforcement; and</text></clause> <clause id="H930AE66D5F9042E38CE7886ECBAE4188"><enum>(iii)</enum><text display-inline="yes-display-inline">addressing matters of intelligence timeliness, objectivity, and politicization;</text></clause></subparagraph> 
<subparagraph id="H9F2BBC659F654585AD36B614E6C54D0F"><enum>(D)</enum><text display-inline="yes-display-inline">report directly to the Under Secretary for Intelligence and Analysis; and</text></subparagraph> <subparagraph id="HB8BD7EE3210A41C59A383C071517A3BE"><enum>(E)</enum><text display-inline="yes-display-inline">report directly to Congress with respect to any urgent concerns.</text></subparagraph></paragraph></subsection> 
<subsection id="HF3884CAC6163476593E40F5A3101DF28"><enum>(b)</enum><header>Duties of the Ombuds</header><text>The Ombuds shall have the following duties:</text> <paragraph id="H275E7BA4BB984B579B2F93315C5AB875" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Serve, in consultation with the Privacy Officer appointed under section 222 and the Officer for Civil Rights and Civil Liberties, as the Department’s principal advisor regarding the following:</text> 
<subparagraph id="HD413338A52B940FCA6EF6A8A11C1DD9D" commented="no"><enum>(A)</enum><text>Safeguarding objectivity in intelligence activities of the Department.</text></subparagraph> <subparagraph id="H4866CC71D9034389B2DB406C8A5228C5" commented="no"><enum>(B)</enum><text>Ensuring such activities are independent from political considerations.</text></subparagraph></paragraph> 
<paragraph id="H16ECFBC42E0D44F98B9C36592280188A" commented="no"><enum>(2)</enum><text>Remain current and well-informed of issues affecting intelligence activities.</text></paragraph> <paragraph id="H3E12E0153AC347DD88990DCACBC744F9" commented="no"><enum>(3)</enum><text>Promote awareness among intelligence components of the Department of the requirement that all intelligence activities of the Department shall be—</text> 
<subparagraph id="HD4C9FC6B3C854B509B0A5D51E9C222DE" commented="no"><enum>(A)</enum><text>conducted in a manner consistent with the protection of privacy rights, civil rights, and civil liberties; and</text></subparagraph> <subparagraph id="H8786A54084C8487F8214D14FBFF2D1EB" commented="no"><enum>(B)</enum><text>objective and independent from political considerations.</text></subparagraph></paragraph> 
<paragraph id="H222260B2985B441E8CB6D97F94819FD0" commented="no"><enum>(4)</enum><text>Provide, without fear of retaliation, confidential forums to hear and help resolve individual and organizational concerns regarding intelligence activities of the Department, including relating to real or perceived occurrences of civil rights or civil liberties abuses, or politicization of analysis, biased reporting, or lack of objectivity in intelligence collection or analysis.</text></paragraph> <paragraph id="H0043F5DBDE4744D69B87EF72D6F891E0" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">Initiate reviews and make recommendations to the heads of the intelligence components of the Department, as appropriate, related to the matters described in paragraph (4).</text></paragraph> 
<paragraph id="H01BD7724C9EB4BA7B793BDB30D6C6EDE" commented="no"><enum>(6)</enum><text>Facilitate departmental decisions regarding making information publicly available in a manner that enhances public understanding of the intelligence activities of the Department, while continuing to protect information when disclosure of such information would harm homeland security.</text></paragraph> <paragraph id="H2EA4BCD422544B4FA034316AA2FCF069" commented="no"><enum>(7)</enum><text>Ensure that the functions performed by the Ombuds are complementary to existing functions within the Department.</text></paragraph></subsection> 
<subsection id="H7B556F9A91B8426997F9985283C3958E" commented="no"><enum>(c)</enum><header>Coordination with intelligence components of the Department</header> 
<paragraph id="HB83B077370B14818B2070F6239F2D1CF" commented="no"><enum>(1)</enum><header>In general</header><text>The heads of the intelligence components of the Department shall each establish procedures to provide formal responses to recommendations submitted to such officials by the Ombuds pursuant to subsection (b)(5) within 60 days of receiving such recommendations.</text></paragraph> <paragraph id="H873CF14BDDDA44B3B3CA5286B21E09AD" commented="no"><enum>(2)</enum><header>Access to information</header><text>The Secretary shall establish procedures to provide the Ombuds access to all departmental information necessary to execute the responsibilities of the Ombuds under this section. The Ombuds may submit to the Secretary a request for such information, and not later than 60 days after receiving such a request, the Secretary shall provide the Ombuds with such information.</text></paragraph></subsection> 
<subsection id="H4B8EE2E92A1C435F8963BAFBE804E5D3" commented="no"><enum>(d)</enum><header>Annual reports</header><text display-inline="yes-display-inline">Not later than one year after the enactment of this Act and annually thereafter, the Ombuds shall submit to the Committee on Homeland Security and the Permanent Select Committee on Intelligence of the House of Representatives and the Committee on Homeland Security and Governmental Affairs and the Select Committee on Intelligence of the Senate a report on its activities, findings, and recommendations of the Ombuds over the immediately preceding 12-month period.</text></subsection> <subsection id="H9FEABD688AC243179A46C3E9B91578F7"><enum>(e)</enum><header>Definition</header><text>In this section the term <term>intelligence activity</term> means the collection, gathering, processing, analysis, production, or dissemination of information, including homeland security information, terrorism information, and weapons of mass destruction information.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H93DD1703C9174AFA8E95DC507B696432"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 713 the following new item:</text> <quoted-block style="OLC" id="HBCF993A6D5914D27A5D244FED144EB58" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 714. Intelligence transparency and oversight program office; Ombuds.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H4D0CD3176A9C469FB5B0159A569CCBAE"><enum>(c)</enum><header>Assessment of the major threats to the national security</header><text display-inline="yes-display-inline">The Director of the Central Intelligence Agency, in consultation with the heads of such other elements of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)) as the Director considers appropriate, shall submit to the Permanent Select Committee on Intelligence of the House of Representatives and the Select Committee on Intelligence of the Senate an assessment of the major threats to the national security of the United States.</text></subsection></section> 
<section id="H04A80776B1F84F569820156422E6BF15"><enum>11.</enum><header>Fiscal year 2027 increase in basic military pay</header> 
<subsection id="H32E9F9BFAE6F4CAA82197ABC390AE3F1"><enum>(a)</enum><header>Waiver of section 1009 adjustment</header><text>The adjustment in the rates of monthly basic pay authorized for members of the uniformed services, to become effective during fiscal year 2027 and required by section 1009 of title 37, United States Code, shall not be made.</text></subsection> <subsection id="H4DF9A0ACB6BA47FDA8C8E2924B42E191"><enum>(b)</enum><header>Increase in basic pay</header><text>Effective on October 1, 2026, the rates of monthly basic pay for members of the uniformed services are increased by four percent.</text></subsection></section> 
<section id="H018F8C9B4BA5410087355A1E3E6AEBAE"><enum>12.</enum><header>Increase in rates of wartime disability compensation</header><text display-inline="no-display-inline">Effective on October 1, 2026, the Secretary of Veterans Affairs shall increase, by three percent, the dollar amounts in effect on September 30, 2026, for the payment of wartime disability compensation under section 1114 of title 38, United States Code.</text></section> <section id="H1A5044919E824678ABDE7F7600E23E2F" section-type="subsequent-section"><enum>13.</enum><header><inline-comment display="no">119H494</inline-comment>To protect the government’s critical infrastructure and train a cybersecurity workforce</header><text display-inline="no-display-inline">Section 302 of the Cybersecurity Enhancement Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/15/7442">15 U.S.C. 7442</external-xref>) is amended—</text>

<section id="HBB9FAF3638494BB898D0FF9DA3214758" section-type="subsequent-section"><enum>14.</enum><header><inline-comment display="no">119H2865</inline-comment> Prohibition of oil and gas leasing in certain areas of outer Continental Shelf</header><text display-inline="no-display-inline">Section 8 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H24E24678542E4154AA238FB3CB8C3DCC"> <subsection id="HCE14BC65DC2E4A34997B0864E1900703"><enum>(q)</enum><header>Prohibition of oil and gas leasing in certain areas of outer Continental Shelf</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section or any other law, the Secretary may not issue a lease for the exploration, development, or production of oil or natural gas in any area of the outer Continental Shelf off the coast of the State of Maine, New Hampshire, Massachusetts, Rhode Island, or Connecticut.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H127300DABED74448935031532E4AD8E8" commented="no"><enum>15.</enum><header>Prohibition on creditors and consumer reporting agencies concerning medical information</header><text display-inline="no-display-inline">The final rule issued by the Bureau of Consumer Financial Protection titled <quote>Prohibition on Creditors and Consumer Reporting Agencies Concerning Medical Information (Regulation V)</quote> (90 Fed. Reg. 3276; published January 14, 2025) shall have the force and effect of law.</text></section> <section id="H33E22CAD34C74608904CEC524F15AFDD" commented="no"><enum>16.</enum><header>Invest in small businesses</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Administrator of the Small Business Administration may provide to small business concerns (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>))—</text> 
<paragraph id="HF9FC6B0E2CAD4B9DB28BBAE5000AC13A" commented="no"><enum>(1)</enum><text>assistance on how to hire graduates from dual or concurrent enrollment programs; and</text></paragraph> <paragraph id="H5DE103B209D34E788B236E2CEA055767" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">information on dual or concurrent enrollment programs about how students and graduates of such programs can access resources and services of small business development centers (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)) to start and expand a small business concern.</text></paragraph></section> 
<section id="H3326BF67B5204AA1B554F4C9C658DD76" display-inline="no-display-inline"><enum>17.</enum><header>Appropriations to preserve comprehensive early education for children</header> 
<subsection id="H4CE38026635F458D96168169216AEDD2"><enum>(a)</enum><header>Appropriation</header><text display-inline="yes-display-inline">There is hereby appropriated, out of any money in the Treasury not otherwise appropriated, such amounts as may be necessary for the Administration for Children and Families to carry out activities under the Head Start Act at the levels specified for such account and under the authority and conditions provided in applicable appropriations Acts for the Department of Health and Human Services for fiscal year 2026, to remain available through September 30, 2028.</text></subsection> <subsection id="HA09060403AC44991901B58531DA94950"><enum>(b)</enum><header>Limitation</header><text>None of the funds made available by this section shall be used to initiate or resume any project or activity for which appropriations, funds, or other authority were specifically prohibited during fiscal year 2026.</text></subsection> </section> 
<section id="H47A4B24C9D4D4A8BB05F7E0C19F8FC99"><enum>18.</enum><header>Requirement in President’s budget submission and concurrent budget resolution with respect to cost of living</header> 
<subsection id="H8C17927838764AF4AB0569C8D9DBB1BE"><enum>(a)</enum><header>President’s budget submission</header><text display-inline="yes-display-inline">Section 1105(a) of title 31, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HAB2FB6DC8F214AE38B0EE2677F3E16D7" style="USC"> <paragraph id="HBA122E9246674FED839F80129AB7AA2D"><enum>(39)</enum><text display-inline="yes-display-inline">an analysis of proposals for the fiscal year for which the budget is submitted to lower the cost of living with respect to healthcare, utilities, groceries, housing, transportation, and postsecondary educational opportunities during such fiscal year.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB9A014EFF54047F288E50CB9653D9092"><enum>(b)</enum><header>Budget resolution</header><text display-inline="yes-display-inline">Section 301(a) of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/632">2 U.S.C. 632(a)</external-xref>) is amended—</text> <paragraph id="H5EA999B4F195410892C6831838A79C7A"><enum>(1)</enum><text>in paragraph (6), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HB0AC2E3F74DB43318348FE3933C36B25"><enum>(2)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="H6CA19875A64C49278ACE2E8D468006DB"><enum>(3)</enum><text>by adding at the end the following:</text>
