<section id="HDA53498CA3FB444281454A69DF1837DD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Better Care, Better Cost Act</short-title></quote>.</text></section> <section id="H9C4D866C11CF47C48BB99F8DB7FE1675"><enum>2.</enum><header>Requiring States to take into account performance when assigning individuals to managed care entities under the Medicaid program</header> <subsection id="H404200E9889141E38E89B6446E6BEEA3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1932(a)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-2">42 U.S.C. 1396u–2(a)(4)</external-xref>) is amended-—</text> 
<paragraph id="H8E2ACC1749D743AAA83D5F646D9A0E17"><enum>(1)</enum><text>in subparagraph (D)(ii)(II), by striking <quote>the equitable</quote> and all that follows through the period and inserting <quote>the performance score of such entities, as determined under the system established by the State under subparagraph (E).</quote>; and</text></paragraph> <paragraph id="H3587BC5C6EEB43C0B7418C9E5DB231A5"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="H0D54A663D2CC4A40B59B775838314BB9"><enum>(E)</enum><header>Performance</header> 
<clause id="H19A2004C78CE4DBA8D05F2284DCF5194"><enum>(i)</enum><header>In general</header><text>A State shall—</text> <subclause id="H54AFB813FB0A4A909576F8E99F780F1C"><enum>(I)</enum><text>establish a system to evaluate the performance of managed care entities participating under the State plan (or wavier of such plan) of such State; and</text></subclause> 
<subclause id="HD8B119D087674AC4A4892A00CF1603F3"><enum>(II)</enum><text>on an annual basis, publish a report—</text> <item id="H3FBF4FBD4F21409F9CB840CDB63DF8F8"><enum>(aa)</enum><text>evaluating the differences in default enrollments made taking into account the performance scores of managed care entities under this subparagraph compared to such enrollments that would have been made had such scores not been taken into account; and</text></item> 
<item id="H12649B10A66E4ACDAE2B3733E07EA1E2"><enum>(bb)</enum><text>quantifying any estimated reduction in expenditures under such plan (or waiver) attributable to taking into account such scores in default enrollments.</text></item></subclause></clause> <clause id="HF92AC3D746BE4558898D072DE5C0F87F"><enum>(ii)</enum><header>Score</header><text>Under the system established by a State under clause (i), the State shall assign a performance score for each managed care entity described in such clause based on such cost and outcome measures and such individual satisfaction measures as determined appropriate by the State. Measures used under such system may include, with respect to individuals enrolled under such entity, measures of the performance of such entity (compared to the risk-adjusted expected performance of such entity) with respect to the following:</text> 
<subclause id="H0A949DDA8597411C8B94BEEC791980C1"><enum>(I)</enum><text>Expenditures for medical assistance.</text></subclause> <subclause id="HCAC692ADBBBA4934B2B6EAB9C8E9D5F7"><enum>(II)</enum><text>Potentially avoidable hospital readmissions.</text></subclause> 
<subclause id="HAF1FD16C9D394319A6A787B6BFD565DE"><enum>(III)</enum><text>Potentially avoidable emergency department visits.</text></subclause> <subclause id="H9698282DCA5644FFBCF21BB17ECFF520"><enum>(IV)</enum><text>Potentially avoidable hospital admissions.</text></subclause> 
<subclause id="HA0AC42CD3A8E4EE7942045E773A934D5"><enum>(V)</enum><text>Satisfaction scores from such individuals and the rate at which such individuals elect to terminate enrollment with such entity. </text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H8D8FAD3DB36C43C88BDB2CBFE700F91B"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to the enrollment of individuals in managed care entities under a State plan under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>), or under a waiver of such plan, on or after January 1, 2028.</text> </subsection></section>
