<section id="HA41A887AD5094262AE04871C3F42673D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Load Forecasting Enhancement Act</short-title></quote>.</text></section> <section id="H258972ED553C4E9AA737AC1B42F1698E"><enum>2.</enum><header>Regional joint boards to study electric load forecasting</header> <subsection id="H1AA6E1764EE44C6CBC13989C6279DD07"><enum>(a)</enum><header>In general</header> <paragraph id="HDC1093F4135A421EB28D47617542AC3B"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Federal Energy Regulatory Commission shall establish—</text> 
<subparagraph id="H662AE6BFB20E4908A66D764B6F73A9A2"><enum>(A)</enum><text>regions determined appropriate by the Commission for purposes of studying electric load forecasting; and</text></subparagraph> <subparagraph id="HAD637BF3F7A549DB8CE93F79BF3D7F2A"><enum>(B)</enum><text>a joint board for each such region.</text></subparagraph></paragraph> 
<paragraph id="H85FC41DAB1804FCDB5D2539E80722ACD"><enum>(2)</enum><header>Regions</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Commission shall ensure that each State is included in a region established under such paragraph.</text> </paragraph></subsection> <subsection id="H60711B8288314B50A8E2AEEDF9A5A045"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">Each joint board established under this section shall be composed of—</text> 
<paragraph id="HBF8CDEE316AE47AB843CEB5DB3601E49"><enum>(1)</enum><text display-inline="yes-display-inline">1 representative from each State commission in the region for which the joint board is established; and</text> </paragraph> <paragraph id="H5E7EF8532ED44DDC93C06B200A2EF886"><enum>(2)</enum><text display-inline="yes-display-inline">1 member of the Commission, who shall serve as chair of the joint board.</text> </paragraph></subsection> 
<subsection id="HDB50FE2F158149E4903C9291B47FEEDA"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">Each joint board established under this section shall—</text> <paragraph id="HD31D599195934BFA87C7C0B0D64C81B2"><enum>(1)</enum><text display-inline="yes-display-inline">study issues relevant to identifying best practices for electric load forecasting that enhance the reliability and affordability of electric service to customers in the region for which the joint board is established, including, with respect to the region for which the joint board is established—</text> 
<subparagraph id="HB8B2E0DD6E8740F098E2B9DF1533C285" display-inline="no-display-inline"><enum>(A)</enum><text>the effects of electric load forecasting on the affordability of electric service;</text> </subparagraph> <subparagraph id="H770BF17E52FF40C6847898C9EE281560" display-inline="no-display-inline"><enum>(B)</enum><text>the reliability and resilience of electric service;</text></subparagraph> 
<subparagraph id="HAAD88155F8A44834B2DB21DD2EECCE04"><enum>(C)</enum><text>the methods used for collecting and modeling data relating to electric load forecasting;</text> </subparagraph> <subparagraph id="H982B368D64FF4F078AD6BB9B04A82F51"><enum>(D)</enum><text display-inline="yes-display-inline">the transparency of the data and methodologies used to forecast electric loads and the accuracy of such forecasts;</text></subparagraph> 
<subparagraph id="HA8DD17EEDA7C4BA29EBC35A9642B023F"><enum>(E)</enum><text>stakeholder engagement relating to electric load forecasting;</text> </subparagraph> <subparagraph id="H2334F8993D564B44A0E37E8B6B5EAE8D"><enum>(F)</enum><text>economic development projections that may affect the electric load;</text> </subparagraph> 
<subparagraph id="H171A09FB46054BA991BFB1B2B9FC9511"><enum>(G)</enum><text>the best available technologies, methodologies, and procedures for forecasting electric loads; and</text></subparagraph> <subparagraph id="HCF6F76043CA243D6AC0B13EF365CB970"><enum>(H)</enum><text display-inline="yes-display-inline">an evaluation of requests for electric service by industrial or commercial facilities with large loads, including whether such facilities have made financial commitments to an electric utility;</text> </subparagraph></paragraph> 
<paragraph id="HFBC1D29817114D828E4FF8F3E71E7AEB" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">identify such best practices; and</text> </paragraph> <paragraph id="H17988A65C5D444F3A805873A7EAB48BD"><enum>(3)</enum><text display-inline="yes-display-inline">report on such best practices to the Commission.</text> </paragraph> </subsection> 
<subsection id="H7B8D377FCC5C4CEEA71DCE00426ECF01"><enum>(d)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall publish and submit to Congress a report that includes—</text> <paragraph id="H11AC703940DB48B5A7C514412F87A9F7"><enum>(1)</enum><text>the best practices reported under subsection (c); and</text></paragraph> 
<paragraph id="H5D5FC817780C4ECD952B63211DDA372F"><enum>(2)</enum><text>recommendations for the consistent use across States of any such best practices by electric utilities.</text> </paragraph></subsection> <subsection id="H31565F9821F04C328EDC172AB7D833A6" commented="no"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">Each joint board established under this section shall terminate on the day after the date on which the Commission submits the report under subsection (d).</text></subsection> 
<subsection id="H6144851E2255442FB97D9B53191BD622"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the terms <term>electric utility</term>, <term>State</term>, and <term>State commission</term> have the meanings given such terms, respectively, in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></subsection></section> <section id="H3DB8E836860D4286AE5F08863A848B69"><enum>3.</enum><header>PURPA standard on electric load forecasting</header> <subsection id="H8E52DD0B891B4EE08124E577402A9D7C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 111 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621</external-xref>) is amended—</text> 
<paragraph id="HDAF098C2F5F345BCA167A7CBD382219D"><enum>(1)</enum><text>in subsection (d), by adding at the end the following:</text> <quoted-block style="OLC" id="H6E99BB63951A41FF89BEF5091544868D" display-inline="no-display-inline"> <paragraph id="HA661826A2F3C40ECA7CDA6E14A8E8935"><enum>(22)</enum><header>Electric load forecasting</header><text display-inline="yes-display-inline">The procedures used to forecast electric loads shall incorporate the recommendations published in the report of the Federal Energy Regulatory Commission pursuant to the Load Forecasting Enhancement Act.</text> </paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H12D3F36239F34BC99AE7150836320271"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H15C26A104F8F4FF08D9463359BD77377" display-inline="no-display-inline"> <subsection id="H9A83EE602FD34D00A6245EBB1EDA65BD"><enum>(e)</enum><header>Consideration and determination by nonregulated electric utilities</header><text display-inline="yes-display-inline">The requirement for consideration and determination referred to in the first sentence of subsection (a) shall not apply to a nonregulated electric utility with respect to the standard established by paragraph (22) of subsection (d).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HBCFA3E5219CF4611A7957A0535B1FE19"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H72E16BD7AC4446ACAEA2A996BB36298F"><enum>(1)</enum><header>Obligations to consider and determine</header><text display-inline="yes-display-inline">Section 112 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622</external-xref>) is amended—</text> <subparagraph id="HE633C5C7D22147039FDC32A71B943B37"><enum>(A)</enum><text>in subsection (b), by adding at the end the following:</text> 
<quoted-block style="OLC" id="HB69D328204F54AEEBA975F72D09948E0"> 
<paragraph id="HBE91AFE072074704B7575EA1E3D8AF34"><enum>(9)</enum> 
<subparagraph id="H1F357FD59B3F40379F4B367D3E066F1C" commented="no" display-inline="yes-display-inline"><enum>(A)</enum><text>Not later than 1 year after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority) shall commence consideration under section 111, or set a hearing date for consideration, with respect to the standard established by paragraph (22) of section 111(d).</text></subparagraph> <subparagraph id="HB9E5B4DD43D04DCE984101D1212BF60C" indent="up1"><enum>(B)</enum><text>Not later than 2 years after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority) shall complete the consideration and make the determination under section 111 with respect to the standard established by paragraph (22) of section 111(d).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HCFD312E9AA3C477FB3873AB60E07C083" commented="no"><enum>(B)</enum><text>in subsection (c)—</text> <clause id="H06E989CBC5FD4324AB978D502FA66101" commented="no"><enum>(i)</enum><text>by striking <quote>subsection (b)(2)</quote> and inserting <quote>subsection (b)</quote>; and</text></clause> 
<clause id="H10AF5AE8957F4C6D9A141AA58B458474" commented="no"><enum>(ii)</enum><text>by inserting <quote>In the case of the standard established by paragraph (22) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (22).</quote> after <quote>paragraph (21).</quote>; and</text></clause></subparagraph> <subparagraph id="H2420C75407F940B3AB1B0C235854BCE3"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HEB8F1E2AD5F84C12AC8E3897F63AED03"> 
<subsection id="H66390C26BFF94CC994BCD8AAA7E5F9CB"><enum>(i)</enum><header>Other prior State actions</header><text display-inline="yes-display-inline">Subsections (b) and (c) shall not apply to the standard established by paragraph (22) of section 111(d) in the case of any electric utility in a State if, before the date of enactment of this subsection—</text> <paragraph id="H1048175FEA8F4E3F81E40FED5BAF39B0"><enum>(1)</enum><text>the State has implemented for the electric utility the standard (or a comparable standard);</text></paragraph> 
<paragraph id="H615166C8396340689625ACD1C4564008"><enum>(2)</enum><text>the State regulatory authority for the State has conducted a proceeding to consider implementation of the standard (or a comparable standard) for the electric utility; or</text></paragraph> <paragraph id="HDBBC1EF6ED014C72960D8302C673A28B"><enum>(3)</enum><text>the State legislature has voted on the implementation of the standard (or a comparable standard) for the electric utility during the 3-year period ending on that date of enactment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HDF12B0C684DA4DF098B3D58BDD7BA6CC" display-inline="no-display-inline"><enum>(2)</enum><header>Prior and pending proceedings</header><text display-inline="yes-display-inline">Section 124 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2634">16 U.S.C. 2634</external-xref>) is amended by inserting <quote>In the case of the standard established by paragraph (22) of section 111(d), the reference contained in this section to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of paragraph (22).</quote> after <quote>paragraph (21).</quote>.</text></paragraph></subsection></section> <section id="H861FBF60D26E4F019DB722A0785C51A8"><enum>4.</enum><header>State energy conservation plans</header><text display-inline="no-display-inline">Section 362(c) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322(c)</external-xref>) is amended—</text> 
<paragraph id="H324B5D53F6C24461BE321EDB8DA70FD1"><enum>(1)</enum><text>in paragraph (6), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="HEED8143671C04333BE68A1F0774C7670"><enum>(2)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H0AB09A261FA4452695C868D18740E54A"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H5C1AD373F9B54BE1B62171E6CB0BF32C" display-inline="no-display-inline"> <paragraph id="H9F188A8572144A2FA81A6331E069CFAC"><enum>(8)</enum><text display-inline="yes-display-inline">procedures and programs to improve the accuracy, oversight, and transparency to stakeholders of the forecasting of electric loads by electric utilities (as such term is defined in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
