<section id="H0C17026BA5E746F7A36143C3BC6578A3" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hands Off Elections Act of 2026</short-title></quote>.</text></section> 
<section id="H58E343DBF0874401B5CCCBE93C0C7264"><enum>2.</enum><header>Prohibition on Federal employees intervening in election administration</header> 
<subsection id="HC72D641291B04E4696F537488AA2DA47"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">An employee of a Executive agency may not participate or direct another employee to participate in the administration of an election for Federal office unless such employee—</text> <paragraph id="H691041282DD84F6997B9F8D44AED01B6"><enum>(1)</enum><text>is authorized to participate in the administration pursuant to Federal law, including pursuant to—</text> 
<subparagraph id="HCCA8F41AAA0441E8A096BE756086A076"><enum>(A)</enum><text>the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/20901">52 U.S.C. 20901 et seq.</external-xref>);</text></subparagraph> <subparagraph id="H33BC556F8A614C128675DC61536CF0B2"><enum>(B)</enum><text display-inline="yes-display-inline">the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20501">52 U.S.C. 20501 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="H6D8C84B5B3764BE9B103F3A7FC4AFE72"><enum>(C)</enum><text display-inline="yes-display-inline">the Uniformed and Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/52/20301">52 U.S.C. 20301 et seq.</external-xref>); and</text></subparagraph> <subparagraph id="H0FE85863D48C467EBABFBEA554A58F8F"><enum>(D)</enum><text display-inline="yes-display-inline">section 1566 of title 10, United States Code; or</text></subparagraph></paragraph> 
<paragraph id="H53229002F11F411D88F82A6F8200E74B"><enum>(2)</enum><text>does not participate in the administration in their capacity as an employee of a Executive agency.</text></paragraph></subsection> <subsection id="H4CE8A8AD386B4D5291E36C2165207306"><enum>(b)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The chief law enforcement officer of a State may bring a civil action in the appropriate district court of the United States for injunctive relief for a violation of subsection (a).</text></subsection> 
<subsection id="H7CFC4E6ED1A3487EB2F64A5978401DAC"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to prevent a Federal employee from assisting with cybersecurity measures to preserve the integrity of voting systems.</text></subsection> <subsection id="H5AD3EC244E9644F5B7D37BD8A07509B1"> <enum>(d)</enum> <header>Executive agency defined</header> <text>In this section, the term <quote>Executive agency</quote> shall have the meaning given such term in section 105 of title 5, United States Code, but shall not include the United States Postal Service.</text>
