<section id="H8B86298F05C9488B832B448BC1C8CD33" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Buy Now Pay Later Consumer Protection Act of 2026</short-title></quote>.</text></section> 
<section id="H098A66BA76DE4606954B8A65E8354B8D"><enum>2.</enum><header>Buy now, pay later loans included in definition of credit card</header> 
<subsection id="H1BFB5E5B74B445A9997374E8AF5B0ACD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 103 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1602">15 U.S.C. 1602</external-xref>) is amended—</text> <paragraph id="HF61EBAC07C324A14B5ED4B72ABA6B3EE"><enum>(1)</enum><text>in subsection (l), by adding at the end the following: <quote>The term includes a buy now, pay later loan.</quote>;</text></paragraph> 
<paragraph id="H93C510675B4A4ED7B0B96E1A4D78BA83"><enum>(2)</enum><text>in subsection (o), by adding at the end the following: <quote>The term includes a person who issues a buy now, pay later loan.</quote>; and</text></paragraph> <paragraph id="HB953EED4AB1745208C80DF683CAB6927"><enum>(3)</enum><text>by adding at the end the following:</text>

<subsection id="HBF6C47E4D70D4B42A3D8A1984AB21AD4" display-inline="no-display-inline"><enum>(ff)</enum><header>Buy now, pay later loan</header><text>The term <term>buy now, pay later loan</term> means a closed-end consumer loan for goods or services that—</text> <paragraph id="H26B4B956BC27466094C620E5598E522B"><enum>(1)</enum><text>is repaid in not more than 4 interest-free installments;</text></paragraph> 
<paragraph id="HAC1C037A87DE455D9C6C69D34676508F"><enum>(2)</enum><text>does not impose a finance charge; and</text></paragraph> <paragraph id="H25A88477C54D46C79566CE076764FF40"><enum>(3)</enum><text display-inline="yes-display-inline">is provided to a consumer, at the time such consumer seeks to purchase goods or services, to finance the purchase of such goods or services. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDA2CD3D990B1440297F93CF62D47F57C"><enum>(b)</enum><header>Rulemaking</header> 
<paragraph id="H7D376E3F646D49B5B7A610ABA53B8142"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Bureau of Consumer Financial Protection shall issue rules to carry out the amendments made by this section.</text></paragraph> <paragraph id="H1EFFF41D8BF945FFBAE06D71E716E568"><enum>(2)</enum><header>Requirements</header><text>The rules issued under paragraph (1) shall—</text> 
<subparagraph id="H430A86B56C314075A3D4AB588C1A9372">
            <enum>(A)</enum>
 <text>be in accordance with the interpretive rule entitled <quote>Truth in Lending (Regulation Z); Use of Digital User Accounts To Access Buy Now, Pay Later Loans</quote> published by the Bureau of Consumer Financial Protection in the Federal Register on May 31, 2024 (89 Fed. Reg. 47068); and</text>
          </subparagraph> 
<subparagraph id="H6DE87A19FB4C4BDFB19658FE9A72AC2F"><enum>(B)</enum><text display-inline="yes-display-inline">apply subpart B of part 1026 of title 12, Code of Federal Regulations, and part 1026.60 of title 12, Code of Federal Regulations, to issuers of buy now, pay later loans (as defined in subsection (ff) of section 103 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1602">15 U.S.C. 1602</external-xref>), as added by this section).</text></subparagraph></paragraph></subsection></section> </legis-body></bill>
