        the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modernize and maintain the National Park Service, the United States Fish and Wildlife Service, the Bureau of Land Management, the Forest Service, and the Bureau of Indian Education in celebration of America’s 250th anniversary.</official-title></form><legis-body id="H238FDF9931CD4ADFBADA0B7EEB79F343" style="OLC"> 
<section id="H0FF838BCE9BE43088BAFB4F82667894D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Great American Outdoors Act 250</short-title></quote>.</text></section> <section id="H43A7FA02C0504768A5BFC1B3CDD8E64F"><enum>2.</enum><header>National parks and public lands maintenance and modernization</header> <subsection id="HCE11F4665CC94DA681737C4641D919BF"><enum>(a)</enum><header>In general</header><text>Subtitle II of title 54, United States Code, is amended by striking chapter 2004 and inserting the following:</text>

<chapter id="HD644220C657642AFAC360B9EF35233E3"><enum>2004</enum><header>AMERICA’S LEGACY RESTORATION FUND</header> 
<toc container-level="chapter-container" quoted-block="no-quoted-block" lowest-level="section" idref="HD644220C657642AFAC360B9EF35233E3" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"> 
<toc-entry idref="HA0469D8A88A44DF9AD86099D4756DAEF" level="section">200401. Definitions.</toc-entry> 
<toc-entry idref="H7695CDD17B2D46F48F5B79E4DE001985" level="section">200402. America’s Legacy Restoration Fund.</toc-entry> </toc> 
<section id="HA0469D8A88A44DF9AD86099D4756DAEF"><enum>200401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text> <paragraph id="H45AB703F014D49B684AE4E3EC15820B1"><enum>(1)</enum><header>Asset</header><text>The term <term>asset</term> means any real property, including any physical structure or grouping of structures, landscape, trail, or other tangible property, that—</text> 
<subparagraph id="H99BAC05F67E44205BDECF3A061774C85"><enum>(A)</enum><text>is tracked and managed as a distinct, identifiable entity by a covered agency; and</text></subparagraph> <subparagraph id="H12A6FB6B418549C2AFC895B3228B1CA7"><enum>(B)</enum><text>has a specific service or function.</text></subparagraph></paragraph> 
<paragraph id="H9927962BEC8B4A81AE643FFB9443307A"><enum>(2)</enum><header>Covered agency</header><text>The term <term>covered agency</term> means—</text> <subparagraph id="HBA53A63B2C384CCE9BBA2B4B0C6F4A03"><enum>(A)</enum><text>the Service;</text></subparagraph> 
<subparagraph id="HD5AA6ABBA49149B4BE0678E5F664CE88"><enum>(B)</enum><text>the United States Fish and Wildlife Service;</text></subparagraph> <subparagraph id="H766B5E56774042169F7125178F1E3D0E"><enum>(C)</enum><text>the Forest Service;</text></subparagraph> 
<subparagraph id="H88B1510171E442EA9E248D190E73F89D"><enum>(D)</enum><text>the Bureau of Land Management; and</text></subparagraph> <subparagraph id="HCAAC41BD826C42498E389828EF110B32"><enum>(E)</enum><text>the Bureau of Indian Education.</text></subparagraph></paragraph> 
<paragraph id="HA7141D180E4245A9A388B0CCAF0C47BE"><enum>(3)</enum><header>Deferred maintenance</header><text>The term <term>deferred maintenance</term> means maintenance—</text> <subparagraph id="HC4C7C219F1C44A79B6903DB30ED29032"><enum>(A)</enum><text>that was not carried out on an asset when it should have been; or</text></subparagraph> 
<subparagraph id="H44223A2D6DBB4B8F809F61C2781E18A3"><enum>(B)</enum><text>was scheduled to be carried out and was put off or delayed for a future period.</text></subparagraph></paragraph> <paragraph id="H03C8350C44A942C1AA4A775C48D64ADA"><enum>(4)</enum><header>Fund</header><text>The term <term>Fund</term> means the America’s Legacy Restoration Fund established by section 200402(a).</text></paragraph> 
<paragraph id="H64845EE7D48C477180E79622112AF49A"><enum>(5)</enum><header>Priority deferred maintenance project</header><text>The term <term>priority deferred maintenance project</term> means any activity to reduce or eliminate deferred maintenance of an asset, which may include—</text> <subparagraph id="H582B1526C39E48E59B973010AD902116"><enum>(A)</enum><text>resolving directly related infrastructure deficiencies of the asset that would not by itself be classified as deferred maintenance;</text></subparagraph> 
<subparagraph id="HFCEC99F02C5F4CA58D116262494F7776"><enum>(B)</enum><text>conducting cyclical maintenance on an asset if, with respect to the asset, a deferred maintenance classification would be imminent without intervention;</text></subparagraph> <subparagraph id="H2199E4CF859840D8837D7CAFEA904628"><enum>(C)</enum><text>modernizing the specific components or systems of the asset requiring repair to contemporary operational standards, in accordance with the laws and policies applicable to a covered agency; and</text></subparagraph> 
<subparagraph id="H8301A37C193147A9AFE7CB5BEBC6181C"><enum>(D)</enum><text>an activity that supports any combination of purposes described in subparagraphs (A) and (C).</text></subparagraph></paragraph> <paragraph id="H81D9B213DF3641ECA4CC9C3A0E43DD60"><enum>(6)</enum><header>Relevant Congressional Committees</header><text>The term <term>relevant Congressional Committees</term> means—</text> 
<subparagraph id="H4394DE17FC4A4C04AF5AE3A24D831F2F"><enum>(A)</enum><text>the Committees on Natural Resources, Agriculture, and Appropriations of the House of Representatives; and</text></subparagraph> <subparagraph id="HD08BC076484F4AE39770578305BF6D97"><enum>(B)</enum><text>the Committees on Energy and Natural Resources, Agriculture, Nutrition and Forestry, Indian Affairs, and Appropriations of the Senate.</text></subparagraph></paragraph> 
<paragraph id="HAD70EE57F01042C1B8002DD897FE85AC"><enum>(7)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means the Secretary and the Secretary of Agriculture.</text></paragraph></section> <section id="H7695CDD17B2D46F48F5B79E4DE001985"><enum>200402.</enum><header>America’s Legacy Restoration Fund</header> <subsection id="H7AD5438A7B7D4F708BC7B5F7B8E0C7DD"> <enum>(a)</enum> <header>Establishment</header> <text display-inline="yes-display-inline">The fund established in the Treasury of the United States known as the National Parks and Public Land Legacy Restoration Fund is hereby redesignated as the <quote>America’s Legacy Restoration Fund</quote>.</text>
                            </subsection> 
<subsection id="HC732092057DC4F5DB1E9E432C5FE51C6"><enum>(b)</enum><header>Deposits</header> 
<paragraph id="H4B744FF600244BA8B53D88A2116A5CDE"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), there shall be deposited in the Fund an amount equal to—</text> <subparagraph id="H1FEFF01AB757401B99D43FDBECD2174A"><enum>(A)</enum><text>100 percent of all revenue collected under section 3 of the Great American Outdoors Act 250;</text></subparagraph> 
<subparagraph id="H0A105993A705493E8510071924853C0A"><enum>(B)</enum><text>100 percent of all donations collected under the Great American Outdoors Act 250; and</text></subparagraph> <subparagraph id="H982006AD1CDE4BE49DBE842EBCEB2582"><enum>(C)</enum><text>50 percent of all energy development revenues due and payable to the United States from oil, gas, coal, or alternative or renewable energy development on Federal land credited, covered, or deposited as miscellaneous receipts under Federal law in the preceding fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H169B15759B204595BC0897973A3250D6"><enum>(2)</enum><header>Maximum amount</header><text>Any amounts deposited in the Fund for each of fiscal years 2026 through 2030 under subparagraphs (A) and (C) of paragraph (1) in excess of $1,900,000,000 in any fiscal year shall be transferred to the General Fund of the Treasury.</text></paragraph> <paragraph id="H76FEBD9DF62D459A9C8221E5F0D24919"><enum>(3)</enum><header>Effect on other revenues</header><text>Section 200402(b)(3) of title 54, United States Code, as in effect on the date immediately before the date of the enactment of the Great American Outdoors Act 250, shall apply to this chapter and any disposition of revenues made under this chapter.</text></paragraph></subsection> 
<subsection id="HAEAA751CD2D94A8FABD160E9CBEB4C79"><enum>(c)</enum><header>Availability of funds</header><text>Amounts deposited in the Fund for each of fiscal years 2021 through 2030 shall be available to the Secretaries, as provided in subsection (e), without further appropriation or fiscal year limitation.</text></subsection> <subsection id="H01148E06AE60488C9A5B258538A477BB"><enum>(d)</enum><header>Investment of amounts</header> <paragraph id="HCE427DDFF5FC416F8424A7C465FD1EFE"><enum>(1)</enum><header>In general</header><text>The Secretary may request the Secretary of the Treasury to invest any portion of the Fund that is not, as determined by the Secretary, in consultation with the Secretary of Agriculture, required to meet the current needs of the Fund.</text></paragraph> 
<paragraph id="H6500319958E84EE0ABD233E97C668974"><enum>(2)</enum><header>Requirement</header><text>An investment requested under paragraph (1) shall be made by the Secretary of the Treasury in a public debt security—</text> <subparagraph id="HD3EB7D5F31AF4FA8BABFAE69B658106D"><enum>(A)</enum><text>with a maturity suitable to the needs of the Fund, as determined by the Secretary; and</text></subparagraph> 
<subparagraph id="HB6A0FC6004B8497A9EB899F8C21D5FCC"><enum>(B)</enum><text>bearing interest at a rate determined by the Secretary of the Treasury, taking into consideration current market yields on outstanding marketable obligations of the United States of comparable maturity.</text></subparagraph></paragraph> <paragraph id="H6823E6ACB0944F19A515CE949C94EE22"><enum>(3)</enum><header>Credits to Fund</header><text>The income on investments of the Fund under this subsection shall be credited to, and form a part of, the Fund.</text></paragraph></subsection> 
<subsection id="HF7E97159D1FA4EE9882260F812494CDE"><enum>(e)</enum><header>Use of funds</header> 
<paragraph id="H14E54F47D7BE4E4FAF9A705B6BB6A6FE"><enum>(1)</enum><header>In general</header><text>Amounts deposited in the Fund for each fiscal year shall be used for priority deferred maintenance projects or to carry out the pilot program in subsection (k), as applicable, in the System, in the National Wildlife Refuge System, on public land administered by the Bureau of Land Management, for the Bureau of Indian Education schools, and in the National Forest System, as follows:</text> <subparagraph id="HFA719E57FAB34237BF2B6E94BBE9ED36"><enum>(A)</enum><text>70 percent of the amounts deposited in the Fund for each fiscal year shall be allocated to the Service.</text></subparagraph> 
<subparagraph id="HEC344A76B38244A7A3E4A00037C8FE71"><enum>(B)</enum><text>15 percent of the amounts deposited in the Fund for each fiscal year shall be allocated to the Forest Service.</text></subparagraph> <subparagraph id="H259A872F184E47C4A8D32D3FFD927C36"><enum>(C)</enum><text>5 percent of the amounts deposited in the Fund for each fiscal year shall be allocated to the United States Fish and Wildlife Service.</text></subparagraph> 
<subparagraph id="H08276C3D3B1F46968DC7B953E71FCF17"><enum>(D)</enum><text>5 percent of the amounts deposited in the Fund for each fiscal year shall be allocated to the Bureau of Land Management.</text></subparagraph> <subparagraph id="H7478A4E88F2749C1AC12E7748014C5B0"><enum>(E)</enum><text>5 percent of the amounts deposited in the Fund for each fiscal year shall be allocated to the Bureau of Indian Education.</text></subparagraph></paragraph> 
<paragraph id="HC8874A351464447DB9D77FA53C6B7E33"><enum>(2)</enum><header>Transportation and nontransportation projects</header> 
<subparagraph id="H705B179F0E3448DD9ECA7B1F2C149512"><enum>(A)</enum><header>Nontransportation projects</header><text>Over the term of the Fund—</text> <clause id="H0D142EE5FB8F4FBE9C2437AA4471CA19"><enum>(i)</enum><text>for the United States Fish and Wildlife Service, not less than 80 percent of amounts from the Fund shall be allocated for nontransportation projects per year;</text></clause> 
<clause id="H432AE93F05DE4593AFF1F7A19C6CC0B2"><enum>(ii)</enum><text>for the Service, not less than 70 percent of amounts from the Fund shall be allocated for nontransportation projects per year;</text></clause> <clause id="H17A69B72A6094682A16A97D750CDD9DB"><enum>(iii)</enum><text>for the Bureau of Land Management, not less than 65 percent of amounts from the Fund shall be allocated for nontransportation projects per year; and</text></clause> 
<clause id="H13C6C88C14AA47CD80DB9B01DAA369BA"><enum>(iv)</enum><text>for the Forest Service, not less than 55 percent of amounts from the Fund shall be allocated for nontransportation projects per year.</text></clause></subparagraph> <subparagraph id="H26E5ECE8AC384D9F89AC63951472C837"><enum>(B)</enum><header>Transportation projects</header><text>The amounts remaining in the Fund after the allocations required under subparagraph (A) may be allocated for transportation projects of the covered agencies, including paved and unpaved roads, bridges, tunnels, and paved parking areas.</text></subparagraph> 
<subparagraph id="H548FC67327F043948FC1203332BC5B74"><enum>(C)</enum><header>Plan</header><text>Any project funded under this section shall be consistent with an applicable transportation, deferred maintenance, or capital improvement plan developed by the applicable covered agency.</text></subparagraph> <subparagraph id="H0D3BD17904C94764A2189332FDEA5647"><enum>(D)</enum><header>Transfer of funds</header><text>Funds made available or allocated under this section to the covered agencies may be further allocated or reallocated to the Federal Highway Administration for transportation projects, in accordance with the allocations and limitations in this subsection and the prohibitions and limitations in subsection (f).</text></subparagraph></paragraph> 
<paragraph id="H356D84960C5543D3AB55F00CB4D3C3CA"><enum>(3)</enum><header>Special rule for certain funds</header><text>In accordance with the limitations set forth in paragraph (1), the Secretary shall allocate not less than 80 percent of the revenues collected under section 3(b) of the Great American Outdoors Act 250 and deposited into the America’s Legacy Restoration Fund toward priority deferred maintenance projects in the unit in which the revenues were collected.</text></paragraph></subsection> <subsection id="H3919F6952C124544B7C6DF1955B72689"><enum>(f)</enum><header>Prohibitions and limitations</header> <paragraph id="H028BF12A2F4A4C3F99950EE409295EB1"><enum>(1)</enum><header>Prohibitions</header><text>No amounts in the Fund shall be used—</text> 
<subparagraph id="H6353BF0491D641C7A2EB03ECC949D298"><enum>(A)</enum><text>for the acquisition of land or any interests in land;</text></subparagraph> <subparagraph id="HA15721D049854738ACBB6125C97001EE"><enum>(B)</enum><text>to supplant discretionary funding made available for annually recurring facility operations, maintenance, and construction needs;</text></subparagraph> 
<subparagraph id="H29D4368CB81848C6BABE5BD2340F21E3"><enum>(C)</enum><text>for bonuses for employees of the Federal Government; and</text></subparagraph> <subparagraph id="HDD088994AD82411C9F5E5EF781FE2458"><enum>(D)</enum><text>to decommission a road.</text></subparagraph></paragraph> 
<paragraph id="H8620313D12334ABD9EF52790F76732F3"><enum>(2)</enum><header>Limitations</header><text>Of the amounts made available under this section to a covered agency, not more than—</text> <subparagraph id="HD5B9140C651A49538E47B63098B325F7"><enum>(A)</enum><text>3 percent of the amounts deposited under subsection (b) and 0 percent of amounts made credited under subsection (d) may be used for administrative expenses;</text></subparagraph> 
<subparagraph id="H50D499AF14B34AA7AEF2D335A95AEEF3"><enum>(B)</enum><text>except as provided in paragraph (3), 15 percent may be used for a contingency fund; and</text></subparagraph> <subparagraph id="H0E023AD9DB2A4E1085DEBABAEC91B473"><enum>(C)</enum><text>8 percent may be used for priority deferred maintenance project planning and compliance.</text></subparagraph></paragraph> 
<paragraph id="H2619396A76B4477790D21BD4FB06E91E"><enum>(3)</enum><header>Contingency fund</header><text>The head of a covered agency shall provide written notification to the relevant Congressional Committees not less than 30 days before taking any action authorized by this section for a specific priority deferred maintenance project if the amount to be reallocated from the contingency fund for such priority deferred maintenance project is projected to be 10 percent or greater than the initial amount allocated to such priority deferred maintenance project.</text></paragraph></subsection> <subsection id="HF18A60EB5DC840C8A7E08ECEB70B3CE4"><enum>(g)</enum><header>Priority deferred maintenance project selection</header> <paragraph id="H378296A43BCF452AA4112FA86260E1AC"><enum>(1)</enum><header>In general</header><text>As part of the selection of priority deferred maintenance projects to be submitted under subsection (h), the Secretaries shall—</text> 
<subparagraph id="HE201502957654DE7BA2367600547C367"><enum>(A)</enum><text>ensure for each covered agency that funds are prioritized primarily for priority deferred maintenance projects that—</text> <clause id="HB45715682B884BDDB87D003502C4174B"><enum>(i)</enum><text>address mission critical assets that promote public access, enhance the visitor experience, or improve outdoor recreation opportunities;</text></clause> 
<clause id="HDAC18048AB1F4D7AA2A3AB16A5C23157"><enum>(ii)</enum><text>address deferred maintenance on assets for which failure would result in—</text> <subclause id="HA0C96EDBA2FD44BB9EF3479B043074D8"><enum>(I)</enum><text>an imminent threat to public health or safety; or</text></subclause> 
<subclause id="HC0436AF19DE847D1B273DE8C24069664"><enum>(II)</enum><text>the closure or material impairment of public access or core operational functions;</text></subclause></clause> <clause id="HA5EF75E29AB04F42962E39B5DEA7DCD8"><enum>(iii)</enum><text>are necessary to prevent the further deterioration of an asset that would result in a substantially higher future repair or replacement cost; or</text></clause> 
<clause id="HF0CE799A10884620AA0DDC58B080F2C4"><enum>(iv)</enum><text>address any combination of purposes described in clauses (i) through (iii);</text></clause></subparagraph> <subparagraph id="HBB79A1AE09154B888E604F88B266EE84"><enum>(B)</enum><text>publish, on a publicly available website maintained by the Secretaries, a clear set of criteria for priority deferred maintenance project selection that takes into account—</text> 
<clause id="HC797276FAC3E4A6BBFD95EBC3070B2CF"><enum>(i)</enum><text>the criteria listed in subparagraph (A);</text></clause> <clause id="H5F94E61143C54F67B75EDEE8EB509387"><enum>(ii)</enum><text>appropriate distribution of priority deferred maintenance projects geographically;</text></clause> 
<clause id="HA266C5D734BF4B409CADFB1E4064D205"><enum>(iii)</enum><text>appropriate distribution of priority deferred maintenance projects between large units and small units; and</text></clause> <clause id="H3FF94899B3174D9B96FC3D599363BE3F"><enum>(iv)</enum><text>whether a unit or State has not received funding in a previous priority deferred maintenance project list for a covered agency; and</text></clause></subparagraph> 
<subparagraph id="HEB2FF6749AB84E83BD89AA006FEFC75E"><enum>(C)</enum><text display-inline="yes-display-inline">annually solicit recommendations for priority deferred maintenance projects from each Governor of a State that contains lands managed by the Secretaries; and</text></subparagraph> <subparagraph id="H2AF742C441D14F07BD3E97E4002A70BB"><enum>(D)</enum><text display-inline="yes-display-inline">require that any transportation project to improve infrastructure account for a not less than 10 percent growth in visitation over existing levels for such infrastructure.</text></subparagraph></paragraph> 
<paragraph id="H3FA492D558474DC5B6116CE875622617"><enum>(2)</enum><header>Accessibility</header> 
<subparagraph id="H0996B08ED3B54E3482E4BFFFE98ED646"><enum>(A)</enum><header>Required consideration for accessibility</header><text>In expending amounts from the Fund, the Secretaries shall incorporate measures to improve the accessibility of assets and accommodate visitors and employees with disabilities in accordance with applicable law.</text></subparagraph> <subparagraph id="HDAD0CAB4590540EF854F1AF2DD4075F2"><enum>(B)</enum><header>Access America</header><text>In submitting a list of priority deferred maintenance projects under subsection (h), the Secretaries shall include not fewer than 2 priority deferred maintenance projects annually that are authorized under subtitle A of title II of the EXPLORE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8481">16 U.S.C. 8481–8487</external-xref>).</text></subparagraph></paragraph></subsection> 
<subsection id="H3FD0E995886349CA95BA74EBF0C4ADE7"><enum>(h)</enum><header>Submission of list of priority deferred maintenance projects to Congress</header> 
<paragraph id="H0145B4DC68F941DEAD49251BD1A3ECFE"><enum>(1)</enum><header>Initial submission</header><text>Not later than 90 days after the date of enactment of this section, the Secretaries shall each submit to the relevant Congressional Committees a list of proposed projects to be funded for fiscal year 2026 and the subsequent fiscal year that as of the date of the submission of the list, are ready to be implemented.</text></paragraph> <paragraph id="H656EDECF103E47458DD6DCB13627E415"><enum>(2)</enum><header>Submission of annual list of priority deferred maintenance projects to Congress</header><text>Until the date on which all of the amounts in the Fund are expended, the Secretaries shall annually submit to Congress, together with the annual budget of the United States, a list of priority deferred maintenance projects to be funded from the Fund for the applicable fiscal year and the subsequent fiscal year that includes a detailed description of each priority deferred maintenance project, including the estimated expenditures from the Fund for the priority deferred maintenance project.</text></paragraph> 
<paragraph id="H9498E3A18FBC4239BBBD2FB6F72ED765"><enum>(3)</enum><header>Submission of list for priority matching projects</header> 
<subparagraph id="H819223356E914670BA86BBD54C9FC54C"><enum>(A)</enum><header>Matching requirements</header><text>As part of the priority deferred maintenance project lists submitted under this paragraph, the Secretaries shall submit for each covered agency a list of priority deferred maintenance projects for which full funding may be accomplished through a combination of funding from the covered agency and private cash or in-kind donations (including through matched funding campaigns), including the—</text> <clause id="H701DFA8F2B154223BDAA67790F4A2414"><enum>(i)</enum><text>amount the covered agency has allocated to such priority deferred maintenance project; and</text></clause> 
<clause id="H30CC7038AEEC4067BA6F61BC846A0B85"><enum>(ii)</enum><text>remaining amount the covered agency is soliciting to fully fund the priority deferred maintenance project.</text></clause></subparagraph> <subparagraph id="H81CC3157396E4599A71DD1F21E5897A8"><enum>(B)</enum><header>Limitation</header><text>The contribution of each covered agency to priority deferred maintenance projects included on the list submitted under subparagraph (A) shall collectively total not less than 5 percent of the funding allocated to each covered agency.</text></subparagraph> 
<subparagraph id="HD31DAD868FF541EF8B2F65E9F5189EAF"><enum>(C)</enum><header>Timeline for completion</header><text>If a priority deferred maintenance project has not received sufficient matching private donations on the date which is 5 years after such priority deferred maintenance project was initially included on the list submitted by the Secretaries, the Secretaries shall, with respect to their respective departments, re-allocate any—</text> <clause id="HD995F2F25CB343D8B6C8EE5DDBB16004"><enum>(i)</enum><text>Federal funds initially allocated for such priority deferred maintenance project to a new priority deferred maintenance project for the same covered agency, to be submitted in accordance with subparagraph (A); and</text></clause> 
<clause id="H6EB7CED713DF4B7F9DB93BCC4B9116E8"><enum>(ii)</enum><text>non-Federal funds initially allocated for such priority deferred maintenance project to fulfill the matching requirements of any other priority deferred maintenance project submitted under subparagraph (A) for the same covered agency, prioritizing any other priority deferred maintenance projects proposed within the same unit at which the initial project was proposed.</text></clause></subparagraph></paragraph> <paragraph id="H87A32020909B4240804B957D037AC1B6"><enum>(4)</enum><header>Maintenance action teams</header><text>In carrying out this section, the Secretary shall provide a list of each individual priority deferred maintenance project carried out by a maintenance action team during the preceding fiscal year.</text></paragraph></subsection> 
<subsection id="H8DC70AA375D34226824DEE0B2B99DA3E"><enum>(i)</enum><header>Alternate allocation</header> 
<paragraph id="H85083C80DF8A4270B24DF55E4C6DE0DF"><enum>(1)</enum><header>In general</header><text>Appropriations Acts may provide for alternate allocation of amounts made available under this section, consistent with the allocations to covered agencies under subsection (e)(1).</text></paragraph> <paragraph id="H6017B0D5D4FC40728B73260DBE40F664"><enum>(2)</enum><header>Allocation by president</header> <subparagraph id="HC4F21B92189F461384DB67A491A31912"><enum>(A)</enum><header>No alternate allocations</header><text>If Congress has not enacted legislation establishing alternate allocations by the date on which the Act making full-year appropriations for the Department of the Interior, Environment, and Related Agencies for the applicable fiscal year is enacted into law, amounts made available under subsection (c) shall be allocated by the President.</text></subparagraph> 
<subparagraph id="H20C02ECAA9F7432D93724B2F5F9E11D6"><enum>(B)</enum><header>Insufficient alternate allocation</header><text>If Congress enacts legislation establishing alternate allocations for amounts made available under subsection (c) that are less than the full amount appropriated under that subsection, the difference between the amount appropriated and the alternate allocation shall be allocated by the President.</text></subparagraph> <subparagraph id="H1D4D11692AB94FA8BE2379048318F824"><enum>(C)</enum><header>No full-year appropriations enacted</header><text>If Congress has not enacted full-year appropriations for the Department of the Interior, Environment, and Related Agencies for the applicable fiscal year by the end of the previous fiscal year, amounts made available under subsection (c) shall be allocated by the President, if that allocation had previously been approved under paragraph (1) as an allocation for the subsequent fiscal year.</text></subparagraph></paragraph></subsection>

                <enum>(j)</enum>
                <header>Public-Private partnerships and philanthropic donations</header>
                <paragraph id="HFBC2F4735C444492AE8AC42E7D524970">
                  <enum>(1)</enum>
                  <header>In general</header>
 <text>In carrying out this section, the Secretaries may accept cash or in-kind donations that advance efforts of the Great American Outdoors Act 250, including encouraging relevant public-private partnerships.</text>
                </paragraph>
                <paragraph id="HEC9B3ED82A544C38B835EA7B367055F6">
                  <enum>(2)</enum>
                  <header>Solicitation of donations</header>
                  <subparagraph id="H95A152F142E34BB98EBC51C85FCB49B0">
                    <enum>(A)</enum>
                    <header>In general</header>
 <text>The Secretaries shall make publicly available information on ways the public can donate to support the efforts of the Great American Outdoors Act 250, including through—</text>
                    <clause id="HF032857C78A04D1EB3A8D97001ABD55B">
                      <enum>(i)</enum>
 <text>public awareness campaigns;</text> </clause> <clause id="HA346EE09C5B34B968B101D5794329927"> <enum>(ii)</enum> <text>physical or digital donation locations at specific project sites or within units managed by a covered agency;</text>
                    </clause>
                    <clause id="H33D943A1B2CB424BA48ACD0052B2D22E">
                      <enum>(iii)</enum>
 <text>the solicitation of donations during the checkout process for the purchase of a physical or digital pass to access a Federal recreational site or an interagency pass, such as the America the Beautiful—the National Parks and Federal Recreational Lands Pass; and</text>
                    </clause>
                    <clause id="HEB1368C43AFA49C7B3C5F25609C83288">
                      <enum>(iv)</enum>
 <text>partnerships with the National Park Foundation (<external-xref legal-doc="usc" parsable-cite="usc/54/101111">54 U.S.C. 101111</external-xref>), the National Forest Foundation (<external-xref legal-doc="usc" parsable-cite="usc/16/583j">16 U.S.C. 583j</external-xref>), the Foundation for America’s Public Lands (<external-xref legal-doc="usc" parsable-cite="usc/43/1748c">43 U.S.C. 1748c</external-xref>), and the National Fish and Wildlife Foundation (<external-xref legal-doc="usc" parsable-cite="usc/16/3701">16 U.S.C. 3701</external-xref>).</text>
                    </clause>
                  </subparagraph>
                  <subparagraph id="H8B9C68257AAC440C85B3FD641482E0F8">
                    <enum>(B)</enum>
                    <header>Credits to fund</header>
 <text>Any cash donations accepted under paragraph (1)—</text> <clause id="HA23A7AC644C84020B02EAE205E90A84D"> <enum>(i)</enum> <text>shall be—</text>
                      <subclause id="H5809AFE22BC1464BBA3C4CC61B09F4E6">
                        <enum>(I)</enum>
 <text>credited to, and form a part of, the Fund; and</text> </subclause> <subclause id="H94A269EEA2D94E46A90A2E2A18A11734"> <enum>(II)</enum> <text>immediately available for allocation to the covered agency for which the donation was made; and</text>
                      </subclause>
                    </clause>
                    <clause id="HAC32EB757A3D4B7C83A084610561690F">
                      <enum>(ii)</enum>
 <text>may be immediately allocated to specific priority deferred maintenance projects submitted under subsection (h)(1) or (h)(2) or to fulfill the match requirements under subsection (h)(3)(A)(ii).</text>
                    </clause>
                  </subparagraph>
                </paragraph>
                <paragraph id="H09A4762F83FC4CED991892CBB59CB380">
                  <enum>(3)</enum>
                  <header>Partnerships</header>
                  <subparagraph id="HB02968E5B423470CAF3277D937E03B10">
                    <enum>(A)</enum>
                    <header>Cooperative agreements</header>
 <text>In carrying out this section, a covered agency may transfer all or a portion of funds for a specific priority deferred maintenance project on Federal lands to carry out the planning, design, construction, maintenance, or any other activities to carry out such priority deferred maintenance project through a cooperative agreement with the following:</text>
                    <clause id="H5277A6E006304CB38D71AF31415C3C4E">
                      <enum>(i)</enum>
 <text>A congressionally chartered nonprofit organization.</text> </clause> <clause id="H9126FC1170A448BB8D3CA0F227B3731D"> <enum>(ii)</enum> <text>A nonprofit organization affiliated with a specific unit of a covered agency with experience carrying out priority deferred maintenance projects in such unit.</text>
                    </clause>
                  </subparagraph>
                  <subparagraph id="HF176FE19DF1F4C80BFF6559B825CC3CF">
                    <enum>(B)</enum>
                    <header>Regulations</header>
 <text>Any cooperative agreement entered into under this section shall be considered a financial assistance instrument and shall not be treated as a procurement contract.</text>
                  </subparagraph>
                  <subparagraph id="HDFE63BBA7C2A4191A319C8CF10512A5E">
                    <enum>(C)</enum>
                    <header>Reporting</header>
 <text>The Secretaries shall ensure that all cooperative agreements entered into under this section include appropriate reporting, financial management, and oversight requirements consistent with part 200 of title 2, Code of Federal Regulations, to ensure transparency and accountability of Federal funds.</text>
                  </subparagraph>
                  <subparagraph id="H0087D2B99575492CAF2C7A8700DB142B">
                    <enum>(D)</enum>
                    <header>Retention of NEPA responsibilities</header>
 <text>Any decision required to be made under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) with respect to any priority deferred maintenance project to be carried out under this paragraph on Federal lands shall not be delegated to any non-Federal entity listed under subparagraph (A).</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="H73D302C4A46441DC99B8AA82EFA175F7">
                  <enum>(4)</enum>
                  <header>Good neighbor authority</header>
 <text>To the maximum extent practicable, the Secretaries shall carry out priority deferred maintenance projects under this section using good neighbor agreements entered into under section 351 of the EXPLORE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8571">16 U.S.C. 8571</external-xref>).</text>
                </paragraph>
                <paragraph id="HD7DE482FA34A41EA9042D78AE839BA55">
                  <enum>(5)</enum>
                  <header>Cross-boundary partnerships</header>
 <text>To the maximum extent practicable, the Secretaries shall seek to enter into public-private partnerships with any governmental, nonprofit, or private entity to carry out joint priority deferred maintenance projects under this Act that improve access points between developed recreation sites on non-Federal lands adjacent to lands under the jurisdiction of the respective Secretary.</text>
                </paragraph>
                <paragraph id="H329DE6B5D3B9427581A239FDE23CA7F6">
                  <enum>(6)</enum>
                  <header>Centennial challenge amendments</header>
 <text>Section 103501(c)(3) of title 54, United States Code, is amended by striking <quote>including funds and fairly valued durable goods and materials</quote> and inserting <quote>including any combination of cash, fairly valued services, durable goods, and materials</quote>.</text>
                </paragraph>
              </subsection> 
<subsection id="H6772E3791D42491281BA9FC28753009B"><enum>(k)</enum><header>Outdoor recreation and sportsmen’s access pilot program</header> 
<paragraph id="H7A81AD7C308845DDB8491B12C7FF625F"><enum>(1)</enum><header>In general</header><text>In expending amounts from the Fund, not more than 15 percent of funds made available to the—</text> <subparagraph id="H9B4257EBE66A4C65A98A748BC051D88B"><enum>(A)</enum><text>Service shall be allocated to outdoor recreation projects;</text></subparagraph> 
<subparagraph id="HBCB9CE019DBE45379C14E3FEAE62847E"><enum>(B)</enum><text>Forest Service or Bureau of Land Management shall be allocated to outdoor recreation projects or sportsmen’s access projects; and</text></subparagraph> <subparagraph id="H08CE1AC23CF54D6091496A4DD9450249"><enum>(C)</enum><text>United States Fish and Wildlife Service shall be allocated to sportsmen’s access projects.</text></subparagraph></paragraph> 
<paragraph id="H4CDCD953CC6F42A1840F9E49C6EFD5ED"><enum>(2)</enum><header>Location</header><text>In carrying out this subsection, the Service, and Forest Service, Bureau of Land Management, and United States Fish and Wildlife Service shall each carry out not less than two outdoor recreation or sportsmen’s access projects, as applicable, per year in each region of each respective agency.</text></paragraph> <paragraph id="H84F48C3AE0DA4334AC9C0DC640DA1484"><enum>(3)</enum><header>Partnerships for sportsmen’s access projects</header><text>To the maximum extent practicable, the Directors of the United States Fish and Wildlife Service and Bureau of Land Management and the Chief of the Forest Service shall use the authorities provided under this section in combination with other authorities to carry out sportsmen’s access projects, including—</text> 
<subparagraph id="H59231F5CD06A45809D4660C894F3E89C"><enum>(A)</enum><text>good neighbor agreements entered into under section 8206 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>) or section 351 of the EXPLORE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8571">16 U.S.C. 8571</external-xref>);</text></subparagraph> <subparagraph id="H5804D765E33E4F74BBB57AD2A1490DF9"><enum>(B)</enum><text>stewardship contracting projects entered into under section 604 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c</external-xref>);</text></subparagraph> 
<subparagraph id="H7D96372A2943433D919A7836EA3C26BC"><enum>(C)</enum><text>self-determination contracts and self-governance compact agreements entered into under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>); and</text></subparagraph> <subparagraph id="HF3E4F3A77990499D9D4B958E47F02999"><enum>(D)</enum><text>agreements entered into under the Tribal Forest Protection Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/25/3115a">25 U.S.C. 3115a et seq.</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="HEDF623A126164198AE27B9660E556E16"><enum>(4)</enum><header>Receipts for sportsmen’s access projects</header> 
<subparagraph id="HDC1C378669BF4071BB29E703DA12D372"><enum>(A)</enum><header>Allocation</header><text>Except as provided in subparagraph (B), revenue received from a sportsmen’s access project under this section shall be retained by the Federal Government and distributed to non-Federal recipients in accordance with Federal law.</text></subparagraph> <subparagraph id="H2CAF04BC18CE4F0493FCD05D0E257034"><enum>(B)</enum><header>Retention by unit</header><text>The amounts described in subparagraph (A) retained by the Federal Government shall be retained by the unit at which such sportsmen’s access project occurred, and may be used without further appropriation to carry out—</text> 
<clause id="H7E370BECCDE04EB5A1168EF95BC7E428"><enum>(i)</enum><text>additional sportsmen’s access projects; and</text></clause> <clause id="H9E345F4F222F4F88BE8BFA2FF9431414"><enum>(ii)</enum><text>if there are amounts remaining after funding subparagraph (A), to address deferred maintenance.</text></clause></subparagraph></paragraph> 
<paragraph id="HC5A2AEAC35EC4880A8170BB83EC43889" commented="no"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H79991882C4994F9C90442133A7E873DC" commented="no"> <enum>(A)</enum> <header>Outdoor recreation project</header> <text>The term <term>outdoor recreation project</term> means any activities that improve outdoor recreation infrastructure, including recreation enhancement or improvement services (as such term is defined in section 351(a) of the EXPLORE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8571">16 U.S.C. 8571(a)</external-xref>)), that are carried out in accordance with the laws and policies applicable to a covered agency.</text>
                                    </subparagraph> 
<subparagraph id="HE5BF68C24E9840C59D8FF781E8B57F44" commented="no"><enum>(B)</enum><header>Sportsmen’s access project</header><text>The term <term>sportsmen’s access project</term> means any activities that improve recreational opportunities for sportsmen, including improving wildlife habitat for hunting and fishing.</text></subparagraph></paragraph></subsection> <subsection id="HA35B1A80E6344ECCBBC7F75300E1DAE6"><enum>(l)</enum><header>Transparency and accountability</header> <paragraph id="HF4C2D3C97D974DFBB72D4E8DD311D385"><enum>(1)</enum><header>Standardized methodology</header><text>Not later than 2 years after the date of enactment of the Great American Outdoors Act 250, the Secretaries shall establish clear, quantifiable, and standardized metrics across each covered agency for—</text> 
<subparagraph id="H2FF2457CC06A4669BD9FDB57ECE4F43F"><enum>(A)</enum><text>calculating and determining deferred maintenance, ensuring that such metrics—</text> <clause id="HFF336A6391FE4A29BD342C9DFCA45329"><enum>(i)</enum><text>adhere to established standards for both transportation and nontransportation assets; and</text></clause> 
<clause id="HE15087C53F8B4C9AA43B30D5CE65A204"><enum>(ii)</enum><text>rely on standardized condition assessments methodologies;</text></clause></subparagraph> <subparagraph id="HDEBDF827581140DF93BAE59D6B2A6B73"><enum>(B)</enum><text>delineate between cyclic maintenance and deferred maintenance; and</text></subparagraph> 
<subparagraph id="HBCACC39D804A487593B15640A2C5EB6A"><enum>(C)</enum><text>provide for the timely addition or removal of an asset from the deferred maintenance list.</text></subparagraph></paragraph> <paragraph id="H639D39F74E064F42A4799CFCA405D999"><enum>(2)</enum><header>Priority deferred maintenance project dashboard</header> <subparagraph id="H905DB46CD0A348949A03679A55CAB2FA"><enum>(A)</enum><header>Requirement to maintain</header><text>Not later than 1 year after the date enactment of the Great American Outdoors Act 250, the Secretaries shall each maintain a searchable geospatial database on a publicly available website to track, for each priority deferred maintenance project that receives money from the Fund, the—</text> 
<clause id="H3657E3C2648A4ABA8A255631F1E60A7B"><enum>(i)</enum><text>location of such priority deferred maintenance project;</text></clause> <clause id="H0D809B45294846B281350816B549BA48"><enum>(ii)</enum><text>purposes of such priority deferred maintenance project, as outlined by the criteria in subsection (g);</text></clause> 
<clause id="H4357DDADC471450DA73327F6E784884F"><enum>(iii)</enum><text>projected cost of such priority deferred maintenance project, and whether such priority deferred maintenance project is exceeding projected costs or below projected costs;</text></clause> <clause id="HEB5F0DA9EDBD496FA50B06021C7CCBE5"><enum>(iv)</enum><text>projected timeline for completing such priority deferred maintenance project, including whether such priority deferred maintenance project is ahead of schedule or behind schedule;</text></clause> 
<clause id="HE5E0CF81421E4F8EA867107F74D7235D"><enum>(v)</enum><text>status of Federal environmental reviews, permits, and authorizations for such priority deferred maintenance project, including—</text> <subclause id="HEAA76D0F346348F38961C9C7B80326CF"><enum>(I)</enum><text>a comprehensive permitting timetable;</text></subclause> 
<subclause id="H0647805CD5974E1F8B145A2524699F87"><enum>(II)</enum><text>the status of the compliance of each lead agency, cooperating agency, and participating agency with the permitting timetable with respect to such priority deferred maintenance projects; and</text></subclause> <subclause id="HBA5432D5B9A04346BF8D2D5D7DF7493B"><enum>(III)</enum><text>any modifications of the permitting timetable required under clause (I), including an explanation as to why the permitting timetable was modified;</text></subclause></clause> 
<clause id="HE7C98728F3D94206B826C6A4E8C06C67"><enum>(vi)</enum><text>information about whether such priority deferred maintenance project has received non-Federal funds and a link for members of the public to donate to such priority deferred maintenance project; and</text></clause> <clause id="H7337C3720FFB46978F40EF2411B22AA7"><enum>(vii)</enum><text>in the case of completed priority deferred maintenance projects, the effectiveness of such priority deferred maintenance project in reducing the deferred maintenance backlog.</text></clause></subparagraph> 
<subparagraph id="H771BA2FFCA1E4B6DBA36820290262CFF"><enum>(B)</enum><header>Explore America 250 report</header><text>As part of the dashboard established under subparagraph (A), the Secretaries shall include a list of not less than 250 projects funded under this Act that improve outdoor recreation or visitor experiences (including projects that support the implementation of the EXPLORE Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8401">16 U.S.C. 8401–8574</external-xref>)), as determined by the Secretaries.</text></subparagraph></paragraph> <paragraph id="HD921644D8B4E4FEA8B4873AC04F88738"><enum>(3)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of the Great American Outdoors Act 250, and annually thereafter, the Secretaries shall each submit to the relevant Congressional Committees a report that—</text> 
<subparagraph id="H3BF2E80ACD03423790DBA5B79AB425D3"><enum>(A)</enum><text>lists the current cyclic maintenance needs and the deferred maintenance backlog for each covered agency, including information for each State and unit of a covered agency;</text></subparagraph> <subparagraph id="H68A6A4D4447441C4B6520668074346DA"><enum>(B)</enum><text>describes how much deferred maintenance was reduced in the prior year for each covered agency and how much deferred maintenance each covered agency plans to address to reduce the backlog in the upcoming year;</text></subparagraph> 
<subparagraph id="H9EC21FF3C6864DA09262EDA0CADAF948"><enum>(C)</enum><text>describes actions taken by the covered agencies without using amounts from the Fund to reduce deferred maintenance;</text></subparagraph> <subparagraph id="HEEE9945226334EABB7F9C4E0803BC77E"><enum>(D)</enum><text>includes a plan from the covered agencies to increase preventative annual and cyclic maintenance activities by covered agencies to a level that properly maintains the assets of the covered agencies and prevents the addition of assets to a deferred maintenance list under subparagraph (A);</text></subparagraph> 
<subparagraph id="H376CC09024094D4CA373A5F5F5CFAFA5"><enum>(E)</enum><text>lists assets on the deferred maintenance list that each covered agency disposed of the prior year under subsection (o) of the Great American Outdoors Act 250 and assets on deferred maintenance list that each covered agency plans to dispose of under subsection (o) in the upcoming year;</text></subparagraph> <subparagraph id="HC5503695AEA5438C8E17DEF9120DAEB0"><enum>(F)</enum><text>outlines any full-time employees hired or maintained to enact the provisions of this section; and</text></subparagraph> 
<subparagraph id="H495F76437F21417EAD4ABCEDC550E520"><enum>(G)</enum><text>provides a clear explanation of the full status of all funds, including the average number of days for a priority deferred maintenance project to reach completion from the date of award and the date on which funds are obligated.</text></subparagraph></paragraph></subsection> <subsection id="H0B35982D5147465B9DB688A36B3E73FE"><enum>(m)</enum><header>Implementation</header> <paragraph id="HFC05439890914EBCA1391D7F5D60D1AD"><enum>(1)</enum><header>Streamlining</header> <subparagraph id="H2F2330A4F83441398F44E633C79C8B30"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Great American Outdoors Act 250</short-title>, the Secretaries shall develop a consolidated categorical exclusion (as defined in section 111 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336e">42 U.S.C. 4336e</external-xref>)) for projects using funds authorized by this Act to eliminate or reduce deferred maintenance on land under the jurisdiction of the Secretary or the Secretary of Agriculture.</text></subparagraph> 
<subparagraph id="H351A60B0A3254852B80D20C67C61FE4A"><enum>(B)</enum><header>Administration</header><text>In developing and administering the categorical exclusion under subparagraph (A)—</text> <clause id="HBF8DB414E956469EAFD0980723074485"><enum>(i)</enum><text>the Secretaries shall comply with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></clause> 
<clause id="H8580F716AF8642358C4D14C20271656C"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretaries shall apply the extraordinary circumstances procedures under section 46.215 of title 43, Code of Federal Regulations; and</text></clause> <clause id="H420A4B4965384104A804B548575FC0D0"><enum>(iii)</enum><text>such categorical exclusion shall have the force and effect of law.</text></clause></subparagraph> </paragraph> 
<paragraph id="H71A097EBA1FD4E32AEC846B7B84F0C47"><enum>(2)</enum><header>Timelines</header><text>The Secretaries shall award a construction contract for a priority deferred maintenance project not later than 180 days after the approval for the final design of such priority deferred maintenance project.</text></paragraph> <paragraph id="H02B88EB465B64B26B82F2BAD03B3A8FC" commented="no"><enum>(3)</enum><header>Micro-purchase threshold</header><text>For any priority deferred maintenance project funded under this section, the micro-purchase threshold for goods, services, and construction described in section 2.101 of title 48, Code of Federal Regulations, shall be $25,000.</text></paragraph> 
<paragraph id="H830C97F0A9194B988E6BA3B636FF092B"><enum>(4)</enum><header>Architect-engineer service fee allowances</header><text>Notwithstanding any other provision of law, fees for architects and engineers for priority deferred maintenance projects shall be capped at 8 percent.</text></paragraph> <paragraph id="H97122C059ADA4743B10994CC7C685ECA"><enum>(5)</enum><header>Acquisition flexibilities</header><text display-inline="yes-display-inline">Notwithstanding any requirement for a Presidential emergency or disaster declaration, the Secretaries are authorized to use the emergency acquisition flexibilities under part 18 of title 48, Code of Federal Regulations (and any successor regulations), including the increased micro-purchase thresholds, simplified acquisition thresholds, and other higher-level emergency flexibilities, in contracting for priority deferred maintenance projects.</text></paragraph></subsection> 
<subsection id="H34CA55928FF74C4F87227CD63221FD89"><enum>(n)</enum><header>Disposal of assets</header><text>The Secretaries shall provide for the disposal of constructed assets included on a deferred maintenance list submitted under subsection (m)(3) that no longer serve the public interest or advance the mission of the applicable unit to which the asset belongs.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HCD9491145F9C427E843E837B39E81078"><enum>(b)</enum><header>GAO study</header><text>Not later than 2 years after the date of enactment of this Act and annually thereafter, the Comptroller General of the United States shall—</text> 
<paragraph id="H4DF18454411E4788A423A7FBEC695335"><enum>(1)</enum><text>conduct a study on the implementation of this Act and the amendments made by this Act, including whether the implementation has effectively reduced the deferred maintenance backlog of the covered agencies (as that term is defined in section 200401 of title 54, United States Code); and</text></paragraph> <paragraph id="HC4C6227D39A9493CB49E00A43FE3EC34"><enum>(2)</enum><text>submit to Congress a report that describes the results of the study under paragraph (1).</text></paragraph></subsection> 
<subsection id="H6673F8C8CED84D308F7977535DADDC3C"><enum>(c)</enum><header>Rule of construction</header> 
<paragraph id="H74FE89C0A3854086ACEDEE401DF8256B"><enum>(1)</enum><header>In general</header><text>The amendments made by this Act shall not be construed to—</text> <subparagraph id="H966A44CBBD3E4D5F9C193E8F7A7606E5"><enum>(A)</enum><text>except with respect to the designated name of the fund, replace the National Parks and Public Land Legacy Restoration Fund as in effect on the date immediately before the date of the enactment of this Act;</text></subparagraph> 
<subparagraph id="H67D9D33881A947DCBB3FE729E470BD41"><enum>(B)</enum><text display-inline="yes-display-inline">affect or modify any amounts within the National Parks and Public Land Legacy Restoration Fund as in effect on the date immediately before the date of the enactment of this Act; or</text></subparagraph> <subparagraph id="H4EFACEEAF8214AC591161ED62E7180D2"><enum>(C)</enum><text>establish a new fund.</text></subparagraph></paragraph> 
<paragraph id="H5F3DBE3E5C7A4F63A6F5951470FC9928"><enum>(2)</enum><header>References</header><text display-inline="yes-display-inline">Any reference to the National Parks and Public Land Legacy Restoration Fund in any law, regulation, map, document, record, or other paper of the United States shall be deemed to be a reference to the America’s Legacy Restoration Fund.</text></paragraph> </subsection></section> <section id="H74960EAF1039444E81DF6011BB347EBA" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Codification of foreign visitor fees</header> <subsection id="HB81D68AA755740228651683C544AFD14"><enum>(a)</enum><header>Visitor nonimmigrant</header><text>Section 802 of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6801">16 U.S.C. 6801</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H8501235D6F9E45BA94E0111F879B1E0E"><enum>(17)</enum><header>Visitor nonimmigrant</header><text>The term <term>visitor nonimmigrant</term> means a nonimmigrant individual admitted into the United States under—</text> <subparagraph id="HFAF9A0AA5CC44906A2F32C84AF91F2DA"><enum>(A)</enum><text>section 101(a)(15)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(B)</external-xref>); or</text></subparagraph> 
<subparagraph id="HB99227AEAAFF470694332A68A986E17A"><enum>(B)</enum><text>section 217 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187</external-xref>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HEFF0D3B0A438479EAA6B7D98A666A916"><enum>(b)</enum><header>Entry fee for foreign visitors</header><text>Section 803(e) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(e)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H8183174AE4234B0DAF80C8095ECF2E00"><enum>(3)</enum><header>Foreign visitors</header><text>For all Federal recreational lands and waters for which an entrance fee or standard amenity recreation fee is charged, the entrance fee or standard amenity recreation fee for a visitor nonimmigrant shall be not less than $100 per visitor nonimmigrant, in addition to any other fee charged with respect to such Federal recreational lands and waters.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H064100ECFD034A4B9CCB26F3E960F45B"><enum>(c)</enum><header>Annual pass for foreign visitors</header><text>Section 805(a) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6804">16 U.S.C. 6804(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H890BB4460A13485FB095634FE8C6B198"><enum>(11)</enum><header>Rule for visitor nonimmigrants</header><text>The Secretaries shall make the National Parks and Federal Recreational Lands Pass available for sale to any visitor nonimmigrant for a fee of not less than $250.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H9CA9DB79924E4ED8AF6611D311439998"><enum>(d)</enum><header>Receipts</header><text>Any monies derived from this section and amendments made by this section shall be deposited in the America’s Legacy Restoration Fund.</text></subsection> 
<subsection id="HA531537448BB441D88D1647E04161E7A"><enum>(e)</enum><header>Definitions</header><text>In this Act:</text> <paragraph id="H3005FB9CE18D4611B1C58F01D0CD7341"><enum>(1)</enum><header>America’s Legacy Restoration Fund</header><text>The term <term>America’s Legacy Restoration Fund</term> means the America’s Legacy Restoration Fund established under section 200402 of title 54, United States Code, as amended by this Act.</text></paragraph> 
<paragraph id="HD46B255CD2BB4F78AEF7DD3F3F2050AC"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection></section> </legis-body></bill>
